right now on nbc bay area news, a stormy start to the workweek. we have live team coverage as we track rain, thunder and wind on the radar. a north bay family demanding accountability after their daughter was killed when her car was hit by a fire rig. tonight for the first time ever we hear from the firefighter behind the wheel. and stealing from santa. thousands of dollars worth of equipment taken from a photo booth in contra costa county. but families say they are not letting the grinch ruin their holiday plans. thanks for joining us on this special edition of nbc bay area news. i'm gia vang. >> i'm janelle wang.

we are tracking more wet weather. the latest system set to bring rain, thunder and wind to the bay area tonight. >> you can see san jose and emeryville. san mateo bridge as well. no rain falling in these areas but that is set to change in a matter of hours. earlier today we did hear thunder and saw downpours on the peninsula. the rain is expected to be widespread and people across the bay area are getting ready. >> crews in san francisco put up flood barriers. the city says it's not expecting severe flooding, but low-lying areas are prone to flooding. so crews are clearing storm drains and monitoring those areas. the city is also offering sandbags. meteorologist rob mayeda is tracking this rain as it moves in, and you have an updated timeline? >> opening act, the storm system will be moving in tomorrow. we have scattered showers around

the santa cruz mountains, a little more west of san francisco. but the main event with this storm still offshore. and we switch over to the satellite view. pretty interesting. you can see how some of these storms are puffing up offshore. lightning west of monterey, moving south to north. but a little farther to the west is where the real action is with this storm. there you see the center of rotation offshore. thunderstorms, a lot of moisture coming up from the south and increasingly unstable environment overnight, which is good for thunderstorms and the potential for high rain rates at times. if you look at rain totals between now and 9:00 a.m., this is a reason why the morning commute will likely be impacted. the areas in yellow half inch, and the hills could be looking at more than an inch of rain causing ponding on the road and

localized flooding in the middle of the commute. the wind will be increasing up to 30 miles per hour with the ongoing chance of thunderstorms and a second storm dropping in as we head into tuesday and wednesday. closer look at these two storms hour by hour and how much rain we're expecting over the next few days in our forecast in a few minutes. >> the upcoming rain is arriving less than a year after winter storms led to flooding and damage. san francisco's one of the cities impacted. homes, businesses and roads were all flooded. >> alyssa goard joins us live from the city which is bracing for more weather. what is the city doing to prepare? >> reporter: well, janelle and gia, the san francisco department of public works will be offering free sandbags for residents. at this spot, we are at marin street and kansas streets. they already have the sandbags up and ready. for resident who want to protect themselves against this weather. many people in san francisco are

preparing. >> because i know that the storm's coming. >> reporter: pam dalukeo is cleaning out. water came through her door this past winter. but ahead of this storm, she's optimistic. >> people started adopting the drains. if that continues into the season that's really going to help. >> reporter: nearby on fulsome and 17th streets, the san francisco public utilities commission set up temporary flood barriers to curb the impact. >> the water kind of piles up in this kind of junction. >> reporter: people who live nearby are still keeping an eye out. and, again, if you're looking to pick up some of those stand bags, they will be available from 8:00 a.m. to 2:00 p.m. starting monday to saturday here at the public works yard in san

francisco. live in san francisco, alyssa goard, nbc bay area news. over to capitola where many residents spent the weekend bracing for the wet weather. it was hit hard in january. the damage so bad governor newsom and president biden ended up touring the destruction. restaurants and shops along the water fared the worst, wracking up millions in repair bills. the owners of this tuscan cuisine restaurant are taking steps. >> we have sandbags that are hidden in front of our business, our windows are plastic covered on the inside. no water can come in. just the only thing, my main concern is my main door, because it is the main door, so i don't, last time when storms hit, water came in through the side of it. >> businesses up and down

richmond-san rafael bridge. westbound lanes are shut down there because of a crash near the middle of the span. no word on when those lanes will reopen. that's heading from san rafael to richmond. an investigation is under way after a crash in contra costa county left a child dead. the chp says the driver in a suv was going west on say the route 4 near martinez when they lost control and hit a tree. a 5-year-old girl in the car died and a 11-year-old was seriously hurt. paramedics took the children to the hospital. the driver was arrested on suspicion of dui. a fight ends in a deadly shooting. police say it happened yesterday afternoon on first street. the fight broke out between two men. shots were fired. a 29-year-old man died at the

scene and a suspect took off. police arrested him in present brentwood. around noon, someone called about a surfer stranded. they suffered minor injuries from scraping and bumping against the rocks of the surfer was okay. the grinch made an appearance in walnut creek. >> police are looking for the people who stole from santa's photo shop. >> reporter: families are back in the queue outside broadway plaza's santa photo stand in walnut creek, waiting for the annual opportunity to get pictures of the kids with santa. some parents just now learning

what happened at the stand sometime early saturday morning. a burglary and theft that nearly shut down the photo stand on its opening weekend. >> that's terrible. terrible. >> reporter: a worker found that the stand had been broken into. all the money from the cash register was gone, along with the camera for the santa photos. we reached out to the management office which was closed but were able to talk to an employee flex door at the security office. can mall security confirm what happened at the santa stand? >> reporter: he directed us to the corporate office, but police were at the plaza today, and this afternoon, walnut creek pd told us a security officer discovered the break-in just after 5:00 in the morning and reported it to police. he said the thieves got away with two cameras worth $500 each and about two grand in crash. parents say they're determined to get the santa pictures and aren't concerned the thieves will return while they're

shopping. a crime of opportunity, they say, that won't steal the spirit they get from this tradition. >> you find out that someone is taking advantage of what is supposed to be a joyous occasion. >> i think it's despicable, you know, in the spirit of the holidays, you know, it's even more hurtful. >> reporter: workers found a replacement camera and reopened santa's photo shop on schedule saturday afternoon. but the search for the grinch-like thieves continues. thom jensen, nbc bay area news. side show reported in at least three bay area cities overnight. this is video from a large sideshow in vallejo at the corner of lewis brown. you can see the crowd watched and filmed as cars spun out of control. sometimes people hanging out the

windows. at one point a christmas tree was doused with lighter fluid and set on fire. police also responded to several sideshows in oakland around 1:30 a.m. a sideshow was reported at 55th and bancroft avenue. gunfire also erupted, but they didn't find any victims. after officers broke up that sideshow they moved to foothill. once they broke up that sideshow they moved again to west graham. police didn't find any one hit by gunfire. a firefighter in napa who hit and killed a student while rushing to a fire won't face any charges. prosecutors had their final attempts thrown out. >> the vacaville woman's family says the big rig was going too fast to avoid the wreck. and for the first time, the firefighter is talking about what happened. jaxon van derbeken has the story. >> she's the life of my heart. and i'm going to continue doing

this. forever. >> reporter: for the last three years, elsa espinoza has visited her daughter's grave site in napa, not far from where the 22-year-old vanessa was fatally injured one morning in june of 2020. she was on her way from vacaville to meet up with her boyfriend from napa valley college where she was an honor student starting in communication. >> everywhere she goes, she was de/* a delight. >> reporter: it was on this stretch where vanessa espinoza was waiting to make a left turn at that light. she got the green arrow and started to turn when a cal fire rig ran the red light and broadsided her. according to the findings of the chp investigation. >> right before that telephone pole is where they came to a rest from this spot. that's how fast he was going. he pushed her vehicle about another 50, 50 feet down the

road. >> reporter: pete martinez, vanessa's stepfather says what's so heartbreaking is investigators found shy would she would have survived if they had followed policy to slow to five miles per hour while running the light. >> they are human. and they make mistakes. and they have to be accountable for this mistake. this mistake takes somebody's life. my daughter. he needs to be accountable for that. >> probably the worst day of my life. still to this day. >> reporter: captain jake white is a two-decade cal fire veteran who was driving the rig. >> responding like i would to any other call. code three, lights and sirens, responding in a timely fashion to the emergency. >> reporter: as he approached the intersection, white told chp investigators he made eye contact with espinoza from about 100 yards away.

he told us he couldn't actually see her eyes but saw her look up at his rig seconds before impact and then look down. >> i assumed that i was more than visible in the fire engine, displaying lights and sirens. >> reporter: gps data later showed the rig was going 45 to 56 miles per hour at impact. and napa prosecutors filed felony vehicular manslaughter charges against white. they say white was driving recklessly, without due regard for safety, especially since he was heading it a fire some 40 minutes away and violated poll policy to slow down at red lights. she says the courts have long granted wide leeway to first responder the and the law requires other drivers to yield to lights and sirens.

a second judge looked at the same evidence and threw out the case. elsa espinoza says prosecutors have given up on an appeal. but through all the setbacks, she finds sanctuary at her daughter's grave site. >> nobody has ever said sorry for your loss. >> day one, first thing i wanted to do was apologize. >> reporter: but white says attorneys told him not to speak with the grieving family, even as he sat near them in court, where they're suing cal fire for wrongful death. >> i'm sitting feet away from this mother, and god, i would love more than anything to give letter a hug and let her know how sad and sorry and empathy for her position. of course. but in the legal world, i'm told to halt the emotion. and go status quo and let legal system proceed. it's uncomfortable. i don't like that.

>> reporter: last year, white said he broke down and sought treatment. >> you know, i didn't want to be alive. to be completely honest. and i struggle with that to this day. it's, it's hard. >> reporter: he says cal fire has never punished him for the crash. >> i was never given any discipline. >> reporter: he's waiting for promotion to battalion chief. >> i'm doing just that. >> reporter: although he's no longer facing criminal charges, elsa espinoza says promoting white sends the wrong message. >> what are you teaching employees? that it's okay to mess up? take somebody else's life? and you're going to be, nothing, not even slap on the hand? nothing. >> reporter: cal fire had no comment on the crash or white's promotion, but espinoza says she's not giving up on holding someone accountable. >> you polite not see tears right now, you know.

coming, but right now it looks beautiful. >> right now we have dry conditions with roaming showers around the bay area. this is a slow-moving storm. friday it was right off the coast. slowly wobbling closer to the coast. as the center gets closer, that's going to help to increase lift in the atmosphere. good combination for seeing big rain totals tomorrow. today the opening act, less than a quarter inch of rain. san jose and hayward did pretty good. almost a quarter inch of rain. most of that fell early this morning. as we transition to city camera views, dry for the moment after the rain moved through earlier this afternoon, and it is mild outside tonight. livermore right now, 50, 52 in walnut creek. to san francisco, still in the mid 50s. so here's some good news. air quality tomorrow, back in the green. you needed wind, and you needed some rain to kind of help rinse out that smoke pollution. here comes the wind during the day tomorrow.

gusts will be close to 30 miles per hour. probably increasing for the afternoon and into monday evening. right now the view on our radar shows you a few scattered showers around the santa cruz mountains and a few more towards marin county, but it's offshore where we're beginning to see thunderstorms here as the center of low pressure approaches the coast. that is what's going to increase the rain after midnight tonight. look how things should be around 3:00 a.m. tomorrow. this is why it will likely be high impact on your morning commute, from 3:00 a.m., to 6:00 a.m. to 9:00 a.m. anda and 8:00 a.m. a chance of thunderstorms into the afternoon. we see many areas by 9:00 a.m. tomorrow, the areas in yellow and orange, about a half inch of rain or more. that's usually the threshold for runoff issues, especially around ramps and freeways. we may see localized flood advisories for the morning.

a few areas could be close to an inch of rain by midmorning. by the afternoon, adding to those totals. top totals about one to two inches for the north bay. morning temperatures start off in the 50s. as we move forward in into the afternoon, the chance of ongoing thunderstorms will be at play. high temperatures tomorrow in the upper 50s to mid-60s. by monday night into tuesday, we will see a second storm system that we think as we head into tuesday night and wednesday will increase rain back across the bay area again. so the second round of rain, if you go from monday 11:00 to wednesday, another two inches of rain coming down for the middle part of the week. once we get past that, thursday afternoon into friday is trending drier. few more sierra snowshowers. but it should stay dry as we approach christmas day. the story of our seven-day

and online as we learn more vehicles. tonight we investigate bay area bus drivers under attack. it's happening everywhere, but we found one bay area bus system is on track to be the most dangerous transit agency to work for in the country. candace nguyen has the exclusive report. >> reporter: we're talking about the transit. investigators looked into violence five years ago. after the pandemic, we started riding the bus again and found the problem is worse. >> [ bleep ], [ bleep ]. >> [ bleep ], [ bleep ]. >> reporter: we reviewed dozens of surveillance videos from the past two years showing bay area bus drivers being hit.

>> [ bleep ], [ bleep ]. >> reporter: pepper sprayed. shot at. and even kidnapped by a passenger with a machete. >> turn around, bro. >> i really can't make this turn. >> reporter: from 2008 to 2021, the federal transit administration or fta says assaults on transit workers increased 121%. bay area bus drivers tell us recently the atax have been more frequent. and more violent. >> no, no, no. >> reporter: nbc bay area first looked at surveillance videos and reported on these attacks in 2018. prompting calls for national safety measures. >> i'm going to call the cops. >> reporter: tina gonzalez was one of the drivers assaulted in those videos. >> oh, no!

>> reporter: we're sitting down with her now, because she was attacked again this year and suffered an acute head injury. >> in 11 years, i've been assaulted four times. >> reporter: have you ever feared for your life? >> when a kid pulled a gun on my. my supervisor told me one time, just remember, you're the only one on that bus that probably doesn't have a gun. it scares the hell out of me. >> reporter: we reached out to these bay area transit systems, requesting information on bus driver assaults. vta and muni say attacks increased this year. sam trans says it tripled. ac transit did not provide data after multiple requests over more than a month. so we went directly to the fta database. it looks all all transit systems. it far outpaces chicago's and

new york's rates. when we contacted ac transit, a spokesperson declined an interview saying 2023 data is still being collected. and they're adding better protective barriers around drivers. >> it's going to take either one of us dying for them to take it seriously. >> reporter: what are real solutions you want as an operator? >> a better shield. not the fake shields the ac transit made. something that, like new york has. they have those boxed-in. >> reporter: this is what most ac transit buses that we've been seeing have right now. these partial plastic barriers. as for new york city, they're checking out those fully-enclosed areas. >> our priority is to redesign the bus.

>> reporter: john costa is the president of the amalgamated transit union, representing operators across the u.s. >> there's more stabbings going on. i have grown adults come in my office and cry. >> reporter: costa is working with the fta on new safety measures authorized under president biden's 2021 infrastructure law. but regulations are still being written. one reason is due to disagreement over the proposal that transit system safety committees should have equal numbers of transit workers and management representatives. the american transportation association says an impasse could tie up all funding and management must be the final decision. gonzalez says bus drivers must be the driving voice. she still loves her job. >> i love my older passengers.

driving at that car or what led up to that crash. continued calls for a cease-fire from the bay area. a small group of protesters rallied outside nancy pelosi's san francisco home, organized by the peace organization code pink. speaker's called for an immediate cease-fire. they say the u.s. aid to israel should be conditional. this is the second protest held outside her home. police on the peninsula are asking for help finding a carjacking suspect near this marshall street complex. the victim was hit on the back of the head and the carjacker then drove off. about an hour later the car was found. the suspect is described as a heavyset man about six feet tall wearing a mask and orange construction jacket or vest. a new fire station on the

peninsula. the high tech upgrades unveiled today. and coming up tomorrow morning on today in the bay. fighting the holiday blues. the project borne out of the east bay. watch that on today in the bay starting at an al.

welcome back. a new fire station is ready to serve the peninsula. a ribbon cutting was held at fire station 4 in menlo park today. the fire captain says the old station was built in 1947 and was in need of an update. >> it was a fire engine-only, three-person apparatus. what this station allows us to do is provide not only engine company service but truck company service. the truck being the four-person company. now you have more than double your service provided to the west end of the district as well as to other areas of the fire

district that need it. >> the new two-storey fire station is filled with high-tech upgrades, partially powered by solar panels and has ev charging stations, and it also has decontamination systems to help protect firefighters from cancer-causing chemicals. a bay area nonprofit is looking for help to make tamales for workers. you don't need to know how to make tamales to help out. the group will hold a class. the party is happening tomorrow at st. john vma community center starting at 9:00 in the morning and expected to last until 6:00 p.m. the celebrated san francisco drag show is getting a new start. they are going out for the holidays. sunday's a drag. it ran for 15 years in union

tomorrow morning. another thing increasing, winds out of the south during the day from 15 to 30 miles per hour. and another storm dropping down the coast as we get into tuesday night and wednesday. right now, 54 degrees in san francisco, around the east bae. 52 in walnut creek. we've got this moisture coming out of the south. 56 in san jose. average high is 59 degrees. that tells you a little something about the air outside right now. san mateo approaching the san mateo bridge and the dunbarton bridge. a few spotty areas of rain. area of low pressure approaching the coast. as it gets closer, it's going to add lift to the available moisture out there and likely fire up some thunderstorms right on top of the morning commute. by 4:00 a.m. to 7:00 a.m. tomorrow, you can see these isolated do you know pours.

chance of thunderstorms that will impact high rain rates at times, probably through about 8:00 or 9:00 in the morning. another band passes through the north bay as we head to about mid bay. and then we move to scattered showers. look at the rain totals, the yellow, orange and red would indicate about a half inch to inch of rain coming down. as you know on bay area roadways, you get that much rain coming down in a short period of time, likely going to see issues for the morning commute. not too chilly at all. increasing wind during the afternoon with ongoing chances of rain at times and isolated thunderstorms still in the mix. so, for tuesday, ongoing showers, and then we'll probably see things after that tuesday morning commute taper off for a time. you can see it right there by 5:00. then by tuesday night and wednesday comes the next round of rain, dropping through the bay area.
