todd johnson for nbc bay area. there was a crash on in mill valley last night near da silva island drive. it happened in the unincorporated area of mill valley. a car swerved into the oncoming lane but fortunately nobody was hurt. law enforcement is out in force this holiday weekend. the chp maximum enforcement period began last night and goes through late monday. all available officers will be on the road watching for drunk and impaired drivers. chp arrested 150 drivers for dui this time last year. there is a developing situation in san francisco. a protest taking over union square. take a closer look at the middle of the screen.

look at the christmas tree specifically. there is one protester in the tree, climbing about 20-30 feet up. police say several arrests have been made for assault and vandalism. they are asking people to avoid that area. protesters are outside the police station in the tenderloin district and they are calling for the release of those arrested. we will bring you updates throughout the evening. this is one of several demonstrations across the bay area that is part of actions as the war between israel and hamas rages on. protesters gathered near powell and market streets today. the cold for a shutdown of holiday celebrations to honor palestinians. organizers want to a cease-fire and they want the money being spent by the biden administration to be spent here at home. >> instead of spending money to

about $1000. bittersweet news for san francisco. a candy shop is closing before christmas. see's is closing down tomorrow and that is it. they did not say why this store is going out of business. they are not leaving the city completely. there are four other stores in the city. more trouble for x. they are being accused of shortchanging workers. a new lawsuit from both former senior staffer accuses twitter of failing to pay millions of dollars in bonuses promised to employees. x tried to have the case dismissed but a judge denied the request. the company is accused of discriminating against women and older employees as well as failing to give proper layoff

notice. we are learning more about a deadly shooting in antioch. shots were fired last night on sunset drive. a 26-year-old man was shot and he died at the same. police say they detained a suspect a short time later. it is not clear if that person will face charges. a somber vigil in the south bay. hundreds came out to honor children killed in gaza. 6000 children have been killed. sump with the count is high is 10,000. there are pictures of some of those killed. many of the organizers has something to share. >> these children need us. they are our voice and regardless of her they come

from, they are our family. at the end of the day, palestinian, israeli, whatever your races, we need to protect the children. >> reporter: and many more children have been displaced or lost a parent in the war. this comes as israel appears to be intensifying the military campaign with reports of strikes overnight. bombs fell on gaza city. refugee camps included. this is after evacuation orders were issued yesterday. the un approved and heavily negotiated resolution to send desperately needed aid to gaza. today, hamas restated its position and will not negotiate the release of hostages. coming up, we could see some of them in paris.

parkour began in paris france in the 90s. they would scale walls, jump from ledges, two benches. the first ever festival in the bay, philippine groups held a town holiday event. it features live music, dancing, and traditional foods. they sold traditional bags and clothing. we were there to help celebrate what people call burma. it is the month between september and december. >> during the bird a month, one thing that filipinos led to do is to have a good time and to celebrate. >> christmas came early for the kids there. they all got toys donated by

54 degrees in livermore. and 58 in walnut creek. the average highs this time of year are in the upper 50s. getting close to 6:00, 55 degrees in san francisco. we are going to cool off quickly with less wind tomorrow morning. inland valleys around the bay. you may wake up with patchy frost and fog. by noon tomorrow, temperatures climbing into the mid and upper 50s. near 60 in san jose and a bit cooler because we are likely to see fog hung up around the north bay valleys. eventually clearing out to some hazy sunshine inland and partly cloudy skies closer to san jose. the forecast goes back up. mid 60s around san jose. upper 50s and low 60s from the north bay to the tri-valley. 60 in san francisco.

increasing clouds and by wednesday, cooling temperatures and rain coming back into the picture as we had to the middle part of the week. this is the first of what looks to be two storms arriving. no big surprise here. sonoma county, they could see again, two inches of rain. they would drop into the tri- valley, they are likely to see less. the timing of the rain looks to be during the commute starting in the north bay. not as much in the santa clara valley and then by wednesday night, a few showers and we should catch a break between wednesday rain chances and the next one coming in. it looks like midday friday and into saturday. we had to the next holiday weekend. maybe if you showers early next saturday. as we head into new year's eve, skies clear out. new year's eve,

freezer. what we know about the family who found it. would you trust a driverless car to give you a ride? what waymo says proves their own fleet is safe. thank you for it joining us. i am terry mcsweeney. >> and i am candice nguyen. tonight antioch police are investigating a deadly crash that left two brothers dead. >> police are trying to figure out who was driving the car that the boys were killed in. the two were in this blue car heading east on west sixth street. this was at about 11:30 pm last night. the driver of a black escalade slammed right into their car. the boys, ages 12 and 13, died in the crash and the people in the suv ran from the scene. than the father of the boy

showed up. it is not clear who was driving the car. neighbors say drivers often speak through that stop sign at that intersection. >> it is very bad out here. it is dangerous. there is speeding out here all the time. >> this doesn't surprise me at all. >> the impact sent the car into the fencing of a church parking lot and the suv slammed into a fire hydrant. the boys have not been identified yet. we now know the name of a man stabbed to death in a domestic violence attack. his name is ezra raymond. jason gillenwater stabbed him. later, he shot and killed himself during a police confrontation. a woman had been in a relationship with him but was trying to separate with him.

a very disturbing discovery in southern california. police are investigating after the body of a woman was found inside of the freezer. family members found the body yesterday morning. the woman has not been identified. at this point there are no signs of trauma or an ace pacific -- specific physical characteristics. police are trained to identify her. the biden administration is acknowledging violence against public transit workers. >> this comes one week after the nbc bay area's investigative unit discovered a spike in attacks nationwide. they are calling it a national lover has level hazard. there is a proposed general directive that if it is finalized, public transit systems across the country will be required to conduct assessments on worker safety, identify plans and strategies

to ensure safety and look at how this is being accomplished. i spoke with the international transit union about what this all means. >> it is huge. it is finally complying with the law that was put in the infrastructure bill. it is a big thing for us but they're going to hold authorities accountable and they will actually report instances happening. i applaud the administration for taking this step but we still have a ways to go. >> last week we reported on bay area bus drivers being hit, shot at, and even kidnapped by violent passengers. we told you about transit worker assaults increasing 121% nationally in recent years. out of all major transit

systems nationwide we found transit in the east bay is on track to have the highest rate of assaults of transit workers, far outpacing new york and chicago. the agency declined to interview with us but they said one act of violence is too many. tina gonzales shared her experience of being attacked this summer. >> i got hit across my face seven or eight times. i blacked out and was punched. i woke up from it. it is getting worse. we are seeing it more and more. i never missed a day of work. now, it is scary to go to work. >> when the federal directive is worked out, transit agencies will have 60 days to submit their data. they hope there will be new safety rules the spring. are you willing to get a ride from a driverless car?

waymo hopes he will. it they are sharing their safety record. they are trying to distinguish itself from its main competitor, which remains of her two under two separate investigations. driverless cars may not require your hands on the wheel it they do need your trust in the technology. some are skeptical and even injured. >> there are people that have different emotions about it and are judging us from the sideline. >> reporter: currently waymo is operating driverless cars in multiple cities. they have logged more than 7 million miles on public roadways. they are releasing new research about their safety record.

after analyzing their own data, they found driverless cars were three times less likely to be involved in any kind of crash reported to police. and nine times less likely to be involved in a crash with an injury. that means if humans had been at the wheel, san francisco would have had nine more crashes involving injuries. >> we are trying to be transparent. >> reporter: waymo will not say how many driverless cars are on the road. waymo has expanded beyond 250 cars. meanwhile, waymo says trying to accurately compare driverless cars to humans is difficult . they don't operate in all of the same places that humans do. waymo don't drive on highways or in severe weather like thick fog or rain. humans don't always report

crashes so, waymo has to factor that too. they recently submitted data to a scientific journal for review in the hopes of having independent researchers look at the data. >> at the end of the day do you believe these cars are safer than human drivers? >> yes. they are safer. that is exactly what we are showing. >> reporter: it is a bold announcement but not one that a traffic safety expert is ready to make. >> i am not prepared to say definitively yes to that. >> reporter: remember, the waymo driverless cars have logged 7 million miles so far but human drivers log 3 trillion miles. >> it requires just a lot more --. >> reporter: flanagan is a research professor at the university of michigan transportation research division.

>> i think i can sign on to this is the best evidence of --. >> so you think this shows a lot of promise that we are not at the point where we can make broad claims that driverless cars are in fact safer. >> i think that is a fair characterization. >> as waymo hopes to win over more drivers, -- remains off road. there have been two separate government probes involving safety issues. they say they are focused on rebuilding trust and operating with the highest standards when it comes to integrity and accountability. >> we want to be judged on our own. we want people to see the work that we are putting in. it is, like anyone, for any sports team, there is a big difference between sports teams.

we waited forever and then she finally came. she was supposed to be born on december 9 but she came in the 20th. >> the parents say they think their daughter look so comfortable in the stocking. she is everyone's favorite christmas present. >> that is a great idea and they look so cute. >> it is just perfect. >> you think the mom's love it, of course they do. so, meteorologist rob mayeda, let's take a look the christmas weather. >> it's pretty nice tonight. comfortable temperatures. no wind and no rain. monday maybe trending a bit warmer than the high temperatures we saw. the christmas forecast right now, let's show you where today topped out. technically, above average. it we are zeroing in on the coldest time of year. average highs in the mid and upper 50s today. about 65 degrees in san jose.

59 in san francisco. 51 in -- and we are watching for patchy fog setting up around contra costa county. it is 51 in livermore and christmas in the park in san jose is looking nice as well. cooling down to about 40 degrees by 7:00 a.m. 30s in the east bay and the valleys. the clear skies will likely allow temperatures to get pretty chilly. patchy fog too around the inland. keep those temperatures somewhat cool. hartley cloudy skies in san jose. mid and upper 50s from san francisco to oakland and northbay temperatures in the 50s.

here is a look at the fog. up and down the central valley. partly cloudy skies and no rain in the forecast. as we approach christmas day, mid and upper 60s from san jose down to morgan hill. close to 60 around the tri- valley and of course, monday evening, levi's stadium, the ravens against the 49ers. perfect gametime temperatures. no wind or rain. now tuesday, we begin to see changes, increasing clouds leading up to the chance of rain, returning by wednesday morning. we could see totals getting close to one inch of rain. the rain does get started as early as 7:00 or 8:00 in the morning. showers taking us into wednesday night for another round of rain. this is going to show up friday. it looks for right now like it
