tv   Today in the Bay  NBC  December 26, 2023 6:00am-7:01am PST

6:00 am
for travelers across the country. we're live with the airline in the middle of the chaos, and today's outlook for anyone heading to bay area airports. elon musk likely heading to court, this time over allegedly failing to pay bonuses to twitter employees when he took over the company. how much the company could be forced to pay up. this is "today in the bay." good tuesday morning to you. i'm marcus washington. >> i'm kira klapper. laura garcia has the morning off. look who doesn't have the morning off. meteorologist kari hall. >> look who is back. >> she's doing weather, she's doing traffic. she does it all. take it away. >> it starts out cold, but we are having a very nice break from the rain. but we are going to have some much needed rain also coming in in the forecast. we're taking a look around the bay area, with our temperatures in the upper 40s this morning. so, yes, it is cool, but we
6:01 am
talked about this, the spare the air alert day, where wood burning is prohibited for today, as we are already seeing an unhealthy amount of particulate matter floating through the air. some of the worst is in santa clara valley. for people with breathing problems or a heart condition, you should limit time outside today as we see this continue, as our temperatures head for the upper 50s and low 60s. it's a cool day, we are going to see peeks of sunshine, and then tomorrow the rain will be coming in. i'll be watching out for all of that for you as well. we'll also get a look at what's happening on the roadways. we get a look at the san mateo bridge and we're starting out with a smooth flow of traffic all around the bay area. haven't seen any issues. that's a look at the golden gate bridge, where it is very well spaced out in between all the vehicles there. no major accidents as of yet. let's hopefully see that continue throughout the morning, watching out for what's going
6:02 am
on. 101 near the san mateo bridge off-ramp, i'll let you know if that's going to slow things down. i'll have a look at the weather and traffic in a few minutes. >> thank you so much. let's talk about that commute in the skies this morning. happening now, more problems for the holiday travel for southwest airlines, but fortunately this time around, it is not the level that passengers faced last year. still, more than 100 flights were canceled in the middle of the holiday rush. >> "today in the bay"'s thom jensen is live at oakland international, one of the airports hit hardest by delays and cancellations. thom, we saw you a little bit ago, there was a huge line behind you. it looks longer now. >> reporter: now we've moved outside. actually, it's a little bit shorter. we've moved outside because now the line no longer starts inside at the ticketing and comes outside, loops around, and then back into the baggage area. it starts outside now, goes into the baggage area, then loops around the back wall of the
6:03 am
baggage area, back to ticketing and the security gates. so still quite a long line that folks are facing as they arrive to the southwest ticketing gates here this morning. airlines did have issues yesterday, 11 cancellations here for southwest at oakland, and 36 delays. airlines hired thousands of new workers, everything from maintenance folks to flight attendants and pilots to avoid the issues they faced last year, especially southwest, which stranded more than 2 million passengers. like last year, southwest says weather was a major contributor to the issues on christmas, mainly at a major hub, chicago o'hare, which was socked in with dense fog. no flights taking off or landing. no major problems being reported here or at sfo this morning, after seven flights were delayed yesterday at sfo. the 11 we talked about here, along with 36 delays, 11
6:04 am
cancellations in oakland. southwest said they expect all flights to be back on schedule today as that fog lifts in the midwest, and passengers hope they're able to keep that promise. we did talk to passengers here in the line today, though. one family told us that they weren't expecting this at all and they had to make plans to get on a later flight and they were going to be delayed getting into ohio to see their family for the new year's. but most passengers said they expected to make their flights. this line has been moving, and like i said, they don't expect those issues that they had last year, where southwest, remember, just weeks ago, agreed to settle with the u.s. department of transportation for $140 million, including a $35 million fine, after those delays and cancellations last year, again, stranded more than 2 passengers. so hopefully not those issues today. they're expecting everything to move along smoothly. the problem is, if you don't get
6:05 am
to the airport, you might run into a line like this, and that could cause you some issues. but they expect all of the flights to at least take off and land as scheduled today, here in oakland and at the airports around the bay area. we're live in oakland, thom jensen, "today in the bay." >> it's good to know they won't be stuck, able to get home. >> exactly. >> get this early. thanks, thom. it is 6:04 right now. a federal judge is ruling that x, formerly known as twitter, must pay its employees millions of dollars that they were promised. a judge ruled on friday that the social media giant violated a contract between the company and its employees. the judge sided with a former executive of the company who sued twitter, claiming breach of contract. the company has been accused by employees of age discrimination and discrimination against employees with disabilities. employees also have claimed the company failed to give advance notice of mass layoffs.
6:06 am
the lawsuit against the social media giant claimed employees were promised half of their targeted bonuses, but payments to them were never made. x no longer has a media relations department and could not be reached for comment on the judge's ruling. developing overseas, the u.s. military carrying out new air strikes in iraq. the air strikes are a retaliation to an attack on a military air base. here is a map showing where that attack happened yesterday that left three u.s. troops injured, including one who is in critical condition. iranian-backed militants claimed credit for the attack. u.s. officials say they used a drone to target u.s. military personnel. israeli forces, they are bombarding gaza with air strikes in an apparent preparation to expand their ground offensive. here is a live look this morning at the white house in washington, where later today

one of israeli prime minister benjamin netanyahu's most senior advisers is scheduled to meet with state department officials. this comes after netanyahu made a visit to troops in northern gaza yesterday, and vowed to keep up that fight against hamas militants. the united nations humanitarian team leader said palestinian civilians in gaza who honor israeli evacuation orders cannot be guaranteed that they will be safe. now to a follow-up on a fire that gutted several buildings in los altos on christmas morning. the fire broke out early yesterday inside this building on el camino real. several businesses inside were destroyed, including a dance school, a college prep tutoring center, and others. firefighters say it took them 12 hours to get the situation fully under control. the building eventually will have to be demolished. the cause of that fire is still under investigation. 6:07. oakland is encouraging residents to adapt a drain to prevent the
6:08 am
inevitable flooding which could occur during upcoming winter storms. the city expects above average rainfall this winter and spring. residents are encouraged to clear their gutters and drain spouts, as well as clear sidewalk gutters of leaves and other debris. to officially adopt a drain, you just go online to oaklandca.gov. the city will lend out tools necessary to clean drains and volunteers will get rain updates on their cell phones. oakland is sending crews out to make advanced preparations. crews are cleaning storm drains, putting sandbags in areas that have seen previous mudslides or flooding. >> clearing that out of the way is so important. we are expecting more rain. we know if that's clogged up what happens. all it takes is a few leaves around the storm drain to cause the whole stream to have a problem. we are going to see rain coming in starting tomorrow. it's a cold start this morning and temperatures in the low to mid-40s across much of the bay

area as you get ready to go out. baby you stayed in bed yesterday and didn't have to deal with this, but it's time to get back to work and layer up, because we are going to start out chilly. we've been watching out for fog. as of now, things are looking good for your drive to work this morning. no issues with visibility. it is a spare the air alert day, as we see a lot of pollutants in the air and also more clouds moving in. rain will be returning in the forecast starting tomorrow, with some mild temperatures continuing, and the rain will be off and on as we go into the weekend, with a few breaks coming in on sunday. but our hour-by-hour outlook shows that we will start to see that rain coming in by 8:00 to 9:00 for the north bay tomorrow, and spreading across much of the rest of the bay area as we go throughout the day. i'll talk more about how much you can expect, at least with this first round of rain and what's ahead in the next storms that will be coming in, that's coming up in a few minutes. >> thanks, kari. 6:09 right now. potentially dangerous

good tuesday morning. we take a live look outside in dublin, as you get ready to head out. that's a look at 580, where it's flowing pretty well. it starts out chilly with temperatures in the low 40s this morning. i think the morning time is when we'll see the most sunshine. more clouds moving in as our highs hit the upper 50s here. it's going to be cool, and eventually we'll get rain. as we get on the roads this morning, there is not a single accident anywhere across the bay area. let's keep it that way. the sensors are all green. i'll have another update on weather and traffic coming up in a few minutes. wall street is set to open higher on this holiday shortened week. the markets are coming off eight straight winning weeks. the positive momentum rolling on, as investors believe the federal reserve will cut interest rates several times next year.

in focus this week, data on home prices, pending home sales and jobless claims. general motors is halting sales of the electric version of the chevy blazer, just weeks after it hit showrooms. this is following reports of software problems. edmunds got confirmation that gm is halting the deliveries and has previously reported two dozen issues during testing of the suv. they include the infotainment system, repeatedly crashing. other reports say drivers were left stranded after the car broke down while charging. gm and chevrolet say they're aware a limited number of blazer ev owners have experienced software issues, leading to the temporary halt in sales. apple's new year will begin with a launch of the vision pro headset, and end with new macs. the company will begin shipping the vision pro in the first week of january, that means it will

likely hit the stores in late january or early february. apple has repeatedly said they will release this early 2024 with no actual date, and the list is also expecting the new mac event in the fourth quarter of the year after the iphone 16 debut. the season of gifting drawing to a close, but trips to the mall, the post office, not so much, depending on the gifts you received. so last year shoppers rurnld $171 billion worth of goods. the rush this year could be even bigger. "today's" brian cheung explains, if you didn't get the gift receipt, there are steps you can take. >> if you don't have the receipt, one way to get around that is by going to the store and asking anyway. walmart can look up your order using just your credit card number. have your personal information on hand. have an i.d., because especially with return theft, they usually want to check your i.d. worst case scenario, you don't
6:16 am
have the receipt, ask for store credit. >> best buy is extending deadlines for returns until january 13th for phones and tablets. apple is allowing returns until january 15th. now, for more tips, including some fees you might face when you return those items, be sure to tune into "today" at 7:00, right after us here on "today in the bay." >> will you be returning anything? >> i have to return some lights. >> like light bulbs? >> yeah, for a tree i never got. i did order it. a whole story, we'll talk about it another day. yeah, i'm returning the lights. keeping the ornaments. >> then you'll get the tree in february? >> right. i'll get prelit. that might be better for me. >> it's nice to know your own limitations. >> know yourself. 6:16th morning. trending, a great accomplishment for an animal shelter in
6:17 am
pennsylvania. >> for the first time in 47 years, their kennels were all empty at christmastime. two weeks ago they had full kennels with dogs, and all of them were adopted. this year the shelter adopted out 600 animals and reunited 125 strays with their owners. the spca says they plan to pull animals from other shelters in the next week in hopes of relieving some of their stress. that's incredible. >> that is. the season of giving, give a home to a pet. i'm not responsible enough, when i say responsible enough, i'm not home enough to necessarily get a pet. know thyself, we've been talking about it all morning. >> can't keep a tree alive. >> it's okay, it's okay. i have children who want a dog desperately. i tell them they need to be a little older so they can help. i know they're not going to help. i know that's not happening. i just need them to be more
6:18 am
dependent before i can take care of one. >> i know a lot of folks want help walking dogs in the rain. >> the dog don't even want to go outside. i'm going back in. i think a lot of us feel the same way. we're going to see rain coming in tomorrow morning. we do have one more day to get things done, including returning some of those gifts. here is a look at what's happening on the bigger scale. i've zoomed way out so we can see where the storm is off the coast and continuing to bring clouds our way, and eventually that rain will be here. with all of the storms we've had out in the ocean, they are churning up big waves and those will get even bigger as we approach thursday. that's when we will have the high surf advisory, and we already have a coastal flood advisory in effect. that's for all of these areas in green. these are the low-lying areas along the bayshore and some of the areas that typically flood with king tides as we get closer to that. we're going to see water levels coming up late morning. and for the waves along the
6:19 am
coastline, you want to be very careful because we do have a lot of people in town, we have people who want to head out to the coastline, check out the beach, and it's going to be very dangerous to be anywhere close to the water because we could see big waves, rip currents, as well as sneaker waves. you want to be careful and keep an eye on everyone. we'll start to see our weather turning very wet over the next couple of days, and then a couple more storm systems coming in between thursday and friday. we're dry for much of the weekend, and next week we get ready for more rain as we go into the new year. so as far as the initial line of rain that we'll see between tomorrow and early thursday, it's mostly going to be about a half inch of rain or less for most of us south of the golden gate bridge. the farther nrgt you go, parts of the north bay may see anywhere from a half an inch of rain to closer to three-quarters of an inch of rain. going into the weekend into next week, much more rain coming our way, and there could be a little
6:20 am
more that could make up the rainfall deficit we've been having so far this fall season. and then going into the next couple of weeks for the sierra, it looks like we could finally get a decent amount of snow here, possibly up to 2 feet for those upper elevations. i was just there a couple of days ago, and they are just praying for snow. so it looks like that's in next week's forecast. we're going to see the rain off and on starting tomorrow, continuing through saturday. sunday is looking dry, and we also have a dry start to our new year. for san francisco, it's much more of the same, temperatures near 60 degrees. our mornings start out in the low 50s and we'll need the umbrellas from wednesday through saturday. getting on the roads this morning, let's get a look at the bay bridge. not even turning on the metering lights. there is such a light flow of traffic. it looks like a holiday. we do also see a few more people on the san mateo bridge, but it is flowing pretty well. it looks pretty good. we haven't seen any major
6:21 am
accidents this morning. really great news. not even seeing anything other than green sensors for much of our main roadways all around the bay area. the south bay looking good. starting to slow down just a little bit as you go from 82 to the 680 interchange. as far as the east bay drive times, it is all green. that means that everyone is flowing at least at the speed limit. but you do want to watch the speeds out there. i know how it can get when there's not as many people on the roadways. back to you. >> thanks. yeah, the caltrans sign over the freeway said something like it's a highway, not a speedway, slow down. so that goes with kari's message this morning. >> go to vegas for that. it is 6:21 this morning. next here on "today in the bay," nbc bay area responds. >> ribbon, wrapping paper, cardboard boxes on bows. what do you do with all of those holiday remnants? i'm

welcome back. the death toll from a powerful earthquake that hit china last week has risen to nearly 150 victims. the 6.2 magnitude quake struck a remote mountainous area. it destroyed more than 14,000 homes and triggered heavy mudslides. officials say 149 people have

died as a result. nearly 1,000 others were injured. this morning, rescuers are still searching for two missing people. in the meantime, beijing breaking its record for hours of sub-zero temperatures in december. this is a feat that was set back in 1951. the cold waves swept through the country, bringing blizzards and sending temperatures toward historic lows. since december 11th, a weather observatory in beijing has recorded more than 300 hours of below freezing temperatures. the capital has endured nine consecutive days of temperatures below minus 10 celsius, or 14 degrees fahrenheit. >> 11, 10, same thing. >> cold is cold. >> exactly. let's talk about our holiday leftovers, not the food, but all of the stuff all over our floors right now. >> what do i do with all these piles of ribbon that you have miles and miles of, and the mountain on top of mountain of
6:26 am
wrapping paper? we did ask consumer investigator chris chmura how to deal with the holiday waste. >> we're going to use guidance from the city of san jose. let's start with bows and ribbons. san jose says all bows and ribbons cannot be recycled. they can be thrown in the trash, or you can save them and reuse them next year. wrapping paper is easy to reuse, too. well, some of it is. we understand, not everyone's unwrapping technique today is exactly conducive for reuse next year. it's okay. san jose says aggressive unwrappers can recycle most wrapping paper. don't worry about the tape. the city says it's fine in the recycle bin. one rule, the shiny stuff. san jose says wrapping paper that is shiny or contains foil or metallic pieces cannot be recycled. reuse or trash that stuff. same for tissue paper. the city says tissue paper contains the wrong fibers for recycling. they're too short to recycle.
6:27 am
you have three choices, reuse it, trash it or compost it. cardboard boxes are generally recyclable. the city recommends you flatten them down. that saves time at the recycling center. gift bags, most are recyclable. the city says the shiny ones are a problem, they're partly plastic and not recyclable. you'll have to reuse or trash those. >> chris chmura always with the great advice. thanks, chris. we have a lot more ahead at 6:30, including the wrapper formerly known as kanye west apologizing this morning after being cut by multiple brands over anti-semitic outbursts. his message to the jewish community. plus, x must go to court. that is what a federal judge has ruled, after allegations the company withheld bonuses from its employees. we'll have more dailset

right now at 6:00, violating contracts. elon musk's x is facing a lawsuit, after employees say they were not given their rightful bonuses. we're live with the details and a key ruling allowing the suit to move forward. plus, watching out for unhealthy air. meteorologist kari hall is tracking a spare the air alert for the bay area and incoming rain. this is "today in the bay."
6:31 am
good morning. thank you so much for joining us on this first day of kwanzaa, the day after christmas. i'm kira klapper in for laura garcia this morning. >> and i'm marcus washington. let's get a look at that forecast this morning. meteorologist kari hall is tracking those cold temperatures as we start out the day. >> it is a cold start, and for a lot of people this may be the first day this week you're getting out of bed and going back to work, so make sure you layer up. take a look at these temperatures and where we're starting right now in the upper 40s across much of the bay area. it's also clear, would we're watching for fog. we have high clouds overhead that's keeping that from developing. at the surface, we have moderate air quality and it may be worse as we go throughout the day. it is a spare the air alert. you might want to check ahead, catch public transit to help out our air quality, and absolutely no wood burning today because that's going to make it even more unhealthy. in gilroy it starts out hazy, we'll see more clouds coming in.
6:32 am
temperatures go from low 40s to low 60s this afternoon, and we're also going to see our temperatures looking a little milder over the next couple of days. we've got several storm systems coming in, as well as what to expect as we go through the next several days into the weekend, the last few days of 2023. i'll have more on that coming up in just a few minutes. also, we'll have a look at the commute this morning. that's been so light. i haven't seen any issues out there on the roadways. this is a look at the bay bridge toll plaza and that approach. they haven't had to turn on the metering lights today. we're also going to continue to see, hopefully, no accidents out there on the roadways. it is all green sensors as we take a look at our traffic map. kira and marcus? >> that is great news. thank you so much. the company x, formerly known as twitter, must go to court, after elon musk's company allegedly withheld bonuses from its employees. >> "today in the bay"'s ginger conejero saab is live in san
6:33 am
francisco. hi, ginger, good morning. x motioned for this case to be thrown out, but obviously didn't succeed. >> reporter: good morning to you, kira and marcus. you are correct, they did motion for this case to be thrown out, did not succeed. the judge saying that the plaintiff here, mark schobinger, has a plausible case, allowing his complaint to move forward in federal court, here in california and not in texas, which is something that twitter attempted to make. that meaning the decision for this case will be on the hands of the california federal court and not one in texas. schobinger was a senior director for x until may. now, these allegations, allegations that schobinger made, are the key arguments here, which stem from oral promises that were made to twitter employees who stayed with the company through musk's acquisition of twitter back in october of 2022. the judge ruled that the plaintiff has a plausible breach
6:34 am
of contract case under california law. schobinger alleges that twitter orally promised to pay each employee a portion of the bonuses in twitter's bonus plan so long as the employee was covered by that plan and that the employee stayed within the first quarter of 2023. now, the plaintiff claims he was covered as a senior director at the company, he says he did what twitter asked, but he never received his bonus. the judge ruled by allegedly refusing to pay schobinger his promised bonus that twitter violated that contract. his lawyer says this is a very important decision relevant to claims we have filed on behalf of nearly 2,000 twitter employees. one of the key parts to this case is that question, can oral promises be binding, a very interesting question. so far, the federal judge says yes, there's enough to go to court. twitter or x, i should say, no longer has a media relations team, so they have not yet commented on the judge's ruling. back to you guys.
6:35 am
>> a story we will continue to follow. ginger conejero saab for us this morning in san francisco. thank you, ginger. at 6:34 right now, the desperation in the middle east is growing amid the brutal fighting and loss of life, which is now really defining the israel/hamas conflict. one of prime minister benjamin netanyahu's most senior advisers is scheduled to meet with white house and state department officials today in washington, d.c. this comes after netanyahu visited israeli soldiers in gaza, you can see it right here, hours after devastating air strikes. the hamas-run palestinian health ministry says 250 people were killed in those air strikes, including at least 70 in a strike on central gaza at a refugee camp. one man says his wife and four children were among them. >> translator: the world watches us as we die and are slaughtered, he says.
6:36 am
>> israeli families are in mourning. 17 troops have been killed in battle since friday. there are also more than 100 hostages still believed to be held in gaza. well, new at 6:00, ye apologizing for a series of anti-semitic remarks he made back in 2022. he posted a statement in hebrew on his instagram account, saying in part, quote, it was not my intention to hurt or demean, and i deeply regret any pain i may have caused. i'm committed to starting with myself and learning from this experience to ensure greater sensitivity and understanding in the future, end quote. back in 2022, he made comments on x saying jewish people blackballed him and he also made comments about hitler. many companies like adidas and gap ended their partnerships with the rapper. back here locally, a man in the east bay is under arrest after he was caught on b.a.r.t.

6:38 am
happening now, travelers are hoping to avoid problems. we have a live look at oakland airport, this coming after weather in the midwest caused flight delays and cancellations yesterday on christmas day. fortunately, not as bad as last year. remember that? but still hundreds of flights were canceled yesterday, including 11 at oakland international airport, where you're looking right now. so far this morning, there are no canceled flights. you can see long lines. let's head over to meteorologist kari hall now for a check of the forecast. lots of people up and at it already, headed back to work, to the airport. >> back home. so we are going to have a spare the air alert day. our air quality is a little more unhealthy than we like to see. there will be more clouds coming in and the rain returning tomorrow, with mild temperatures. by the end of the week into the weekend, we'll see off and on rain, with some breaks coming this weekend, if you're looking for opportunities to get outside. but, also, those storms off the coast will make our waves even
6:39 am
more dangerous. we're already seeing rip currents and sneaker waves that come up a lot higher than some of the other waves. right now those waves are anywhere from 8 to 14 feet. that's really important because a lot more people during the holidays head to the coastline and you want to make sure you're never turning your back to the water. as far as temperatures, it's going to be in the low to mid-60s for parts of the peninsula, down to the south bay, while much of the east bay to the north bay will see temperatures in the upper 50s. so a little cool out there. tomorrow the rain will be coming back, so i'll talk more about that timeline and what you can expect coming up in a few minutes. >> we'll see you soon. thanks. 6:39 right now. and today, of course, the day after christmas, many already thinking, what do i do with that tree? ahead on "today in the bay," we are breaking down how you can properly recycle it, compost it, without hurting our climate in crisis. plus, the 49ers blown out by the ravens.

this afternoon. we'll talk about rain coming in in our forecast in just a few minutes. turning to our climate in crisis, with christmas behind us, it will soon be time to get rid of your tree. before you throw your christmas tree in the waste, there are some rules you need to know. in san francisco, it is important to not leave anything on the tree. and don't feed it to the bison at the park and golden gate park. they are given unsold trees donated from local lots. and don't feed it to the goats. the goat herd in the bay view used to collect trees, but they've stopped because of all of the leftovers that gave the goats indigestion. lastly, don't throw the tree on the sidewalk. the city has an event this morning at the civic center plaza to discuss its annual christmas tree recycling that starts on january 2nd. and in san jose, the city collects the trees the same day
6:44 am
as garbage, recycling and green waste. remember to move all the tinsel, the decorations and tree stand and cut the tree into five-foot pieces. place it on the street one foot from the curb. all of these rules. that's why i don't mess with real trees. you can set it out by 6:00 a.m. on your collection day. for more stories like this, visit us online at nbcbayarea.com and click on the climate in crisis tab if you need to look at that once again. >> always good to know. thanks, kari. well, the 49ers six-game winning streak has come to an end. the team last night losing to the ravens at home on christmas day. but that didn't stop those fans from having a lot of fun.
