general motors take the city to court over taxes. the reason the company says it was over charged, and the response from the city. the border crisis deepens. the u.s. is deeping for an influx of migrants. this is "today in the bay." good thursday morning to you. i am marcus washington. >> i am laura garcia. we have a lot to get to on this thursday morning. we begin with the team coverage on the high surf warning. ginger conejero saab is live at half moon bay, but first kari hall is tracking what we can expect. >> now we are still seeing the impacts as the storm continues to move in, and a high surf warning will be in effect from now until 3:00 a.m. on friday. we continued with scattered showers and breezy winds at times and there will be a new

storm moving in by tomorrow evening. we are watching the impact of all of this coming in, and the storms out over the pacific and churning up the waves and big breakers that are expected to reach 25 to 30 feet, and the high surf warning in effect until friday, once again, and at the same time we can see sneaker waves coming in that will make it dangerous, and that's coming at the same time we have the king tide season approaching. along the coastal areas and bayshore, we may see flooding happening by friday morning, and high water levels will continue. we will continue to see the impacts, at least over the next few days. i will be tracking this. we will talk about the next round of rain coming up in a few minutes. >> thank you, kari. if you are headed to the coast today, beware massive waves are expected to be

crashing up on the beach. >> yeah, ginger conejero saab is live. what are the conditions like? >> reporter: good morning, marcus and laura. we are here at half moon bay here at the pier. the waves will happen further out on the coast, and where we are we can get an important reminder here at this popular spot for surfers or beachgoers to gather before they head out, and there are important reminders we need to send them. pacifica is seeing this this morning, and i spoke with our photographer, jesse, the waves are high as the pier as they are rolling in, they are slamming

the seawall and sending water up and over the promenade and across the street where homes are. not too long ago his car got hit with a wave and it's getting wet out there. officials are saying waves could reach up to 30 feet, and the swell expected to bring rip currents and sneaker waves, as kari mentioned. this could take surfers and swimmers off guard, and so don't turn your backs to the water. watch out for the rocks and debris that can be kicked up with the waves also. >> don't stand on that side. always walk this way on the curve, because if there's a wet spot that means water gets there, so don't -- stay away from there.

cool, more fog registering up here in novato and throughout the north bay. livermore does look like it has a lot of fog but the camera over in dublin is able to see for quite some distance. no problem or slowing, just maybe mist on the roadways. we had highway 87, and southbound was slow heading down from downtown and highway 85. looks like a crew was there but none was in the grid. the north side had a grid but that crew cleared right on time. the southbound side clear just over the last few. >> thank you. developing right now, nearly 8,000-person caravan of immigrants are making their way towards the mexico and u.s.

border. >> just hours after top biden administrations met with the officials in mexico, another bus carrying migrants arrived, and now democratic mayors in several cities far from the southern border know the buses sent by republican states will keep coming. crossings at the southern border are down this week after last week saw record highs. more than 12,000 people coming into the u.s. a day. it has the leaders of border states and the cities where migrants often end up begging for help. >> we cannot do this alone. >> in a meeting with secretary of state, antony blinken, mexico

sister. placer county sheriff deputies are treating that case as a homicide. and then general motors is take san francisco to that court over taxes. it wants san francisco to refund $108 million in taxes for the past several years and pay an extra $13 million for fees. cruise generated very little money. gm contends it only sold 677,000 worth of goods in the city last year. the company doesn't comment on

legal matters. a person for the san francisco city attorney's office said we are reviewing the complaint and will respond in court. it's 5:09 on a thursday morning. it's clear right now in san josé, but, you know, in the midst of the storms kari has been tracking, it feels like winter. >> yeah, for most of us there will be spotty showers still lingering for today and the approach of the next storm will bring in heavier rain. as we get a closer look we have been tracking it all with storm ranger, our mobile doppler radar, and there's spotty showers in the north bay and along the coastline. most of us are waking up to dry conditions. later this morning there will be the potential of coastal flooding and low-lying areas due to the king tides. this will happen at about 11:26

this morning, the peak of it, and then we will go back to lower tides in the afternoon. we will have more on the spotty rain, and a look ahead to the last few days of the weekend coming up. gas, how are gas prices looking up? >> holding steady. santa clara, the lowest there is 3.95 at platinum gas on washington street. and then sunol super stop, this just came in a few hours ago, 3.97 at the exit right off 680. and then in the north bay, 4.15 at marin avenue. this is all on gasbuddy.com. looking at the yellow highlighting on the right, that means there could be dense fog on the roadway, and a live look

good thursday morning. here's a look at storm ranger still tracking spotty rain. there will be a chance today, but it's mainly dry to our morning. on the bay bridge, some cars may be kicking up water but not a lot falling from the sky. more on that coming up in a few minutes. we are looking at fremont, our camma off of the nimitz 880. a smooth flow of traffic, and maybe misty roads as kari was talking about. good morning. very happy thursday to you. apple got a reprieve on the ban on selling apple watches. the court said apple used

somebody else's technology without their permission. we usually see a rally this time of year, the time between christmas and new year's. in the last three days, the nasdaq has risen a full percentage point. and there were six record closes in december on the dow. the s&p 500 near all-time records, up 25% in 2023. all right. cummins makes engines for dodge ram and the government alleges it covered up higher than acceptable emissions from its engines, $1.6 billion, and that's the second largest violation of the clean air act since that act was created. it's the largest fine since the bp deep horizon oil spill. and then zulilly is shutting

a few hundreds of an inch of rain in alum rock. we are watching some of the higher rain totals there. there will be breaks today, and then we will get ready for the next systemrrg tomorrow afternoon into the evening. looks like it could impact your saturday plans as well. additional rainfall on top of the inch we saw for parts of the north bay, another inch of rainfall. the next round could be higher for areas south of the golden gate bridge. we will have a better soaking with the next storm coming in. it looks like for saturday evening into sunday, it will dry out for a little bit. that's the last day of the year. next we can going into the middle of the week, we could see another big storm system coming in, and the center of the storm staying off the coast.

we have been watching to see if we could get a good sierra snow there, and every single time it looks like it will come down more in the form of rain, and light snow for the upper elevations. it's not quite what we hoped for, but it's better than nothing. we are going to see off and on showers in the forecast with a little more break today, just staying mostly cloudy with spotty north bay rain. the bigger system arriving tomorrow. we start off the new year with sunshine and then the rain following not too far behind the start of the new year. stay away from the coast today. there could be fog and mist on the drive, too, mike? >> yeah, the clouds are coming down and turning into fog here. in san josé, a little sheen on the roadway. this is 101 northbound. there's mist and fog but not a

meteorologist, kari hall, is tracking another round of wet weather, plus -- >> you know, for the last 10 or 11 months not having a police chief says a lot about our leadership here in the city of oakland. >> back to square one. oakland mayor rejects all candidates for the police chief. what happens next in the city? this is "today in the bay." it's thursday morning. good morning to you. i am marcus washington. >> i am laura garcia. we are tracking incoming rain and a high surf wind advisory. we have live team coverage for you, but first let's check in with kari hall. >> after that first round of rain moved through yesterday, as well as the gusty winds, we still have big breakers along the coastline, and a high surf warning in effect from now until tomorrow morning. we will see scattered rain at times and mostly cloudy for today. a new storm will come in for

tomorrow evening. the big thing we have been tracking is the dangerous surf as the breakers reach 25 to possibly 30-plus feet due to the wind-driven storms moving out in the pacific and pushing up the big waves along the coastline up and down the coast. the waves are higher due to the astronomical tides, and that's the gravitational pull, the sun and moon together pulling that in, and the surf could get higher over the next couple of days. as of now we are seeing spotty showers, and that will continue mainly for the north bay as we go throughout today. we will talk more about the timeline of additional rainfall coming up in a few minutes. >> thank you, kari. the town of capitola also breaking for the next storm

after the powerful surf has proven to be quite destructive. >> tom jensen is live for us in capitola. as i understand, the ongoing work to repair the wharf is on hold? >> reporter: yeah, they are bracing for what happened here a year ago. they hope it doesn't happen again. the surf is too high to risk, you know, injury or loss of life to get out on the wharf and work now. it was just last january that the downtown area of capitola was flooding and the raging surf

tore the wharf in half. >> the pier was just being renovated and redone. it was a bad, bad, bad scene, so hopefully it doesn't destroy it again this year, but there's some worry, yeah. >> reporter: robert handa spoke about that last night, and they are hoping the waves don't stall the work and postpone the reopening. they will have to re-evaluate that after the storms pass through and see if any damage was done, if at all. thom jensen. back to you. >> that you. and then here's aftermath on iron springs road, and 97 people

are without power in that area and there are no estimates of when the road could open just yet. power expected to be restored about 9:00 this morning. mike, you have breaking news? >> yeah, we will start with the rails. we have word from bart there's a delay. there's some sort of police activity in this stretch, and that will lead to any delays for trains that have to travel through the area, so they declared a 20 or more delays for those from the east bay heading into pleasanton or sunol. meanwhile, on the roadways, there's a crash over near eastbound 580 coming over from san rafael. and on that same bridge, damp roadways, and fog may be a

factor. here's our view from dublin looking over towards livermore. those clouds are coming back down as they were overnight, and now there's probably fogging and low visibility. back to you. >> thanks, mike. happening today, the owners of a san josé daycare will be back in court. two toddlers at the happy, happy home daycare back in october died, and the owners need an interpreter. seven additional charges have been added to the original complaint. the pool was fenced off, and they say one of the owners left it propped open after watering the plants the night before, and nobody checked that before the children went into the backyard. and then on christmas around 8:30 at a home on clark avenue in mountain view.

several people were inside including a 6-year-old boy that was shot. an adult was also hurt, but it's unclear how he was injured. both are expected to be okay. neighbors who were home at the time say the incident is heartbreaking. >> i came out from the balcony to see what was happening, and i saw the family in distress and hear crying and i see the red and blue lights flashing everywhere, and it was very heartbreaking because it's a little kid. >> mountain view police are looking for whoever is responsible. they are asking anybody with information to call them. and then the oakland mayor rejected all three finalist presented to her by the police commission. they were armstrong, and kevin

hall, and a police chief that was placed on leave a few months ago. mayor thao said she would not hire armstrong again after she fired him. the president of oakland police officers association says he's frustrated with the latest setback of the search. >> this should be the first thing that gets done. 11 months later is completely unacceptable. >> the oakland police commission president says he respect the mayor's decision and is looking forward to working with her to find a suitable candidate. and then a scary crash south of san francisco happened yesterday afternoon near glenn canyon park. a driver hit a curve and that caused the car to flip and slide

down the hill. rescuers were able to pull the car up from the hill. the driver and the passenger had minor injuries. the roads were slick but we don't know if weather or speed played a role in the crash? this is just west of reno. it's quiet right now. there's snow up there. chp wants to remind people about highway safety. people should not park along the highway to play in the snow. it can be distracting for other drivers, and it can cause crashes. be careful if you are headed up to the sierra. my sister-in-law headed up yesterday and she said it was a mix of rain and snow depending on where you were. >> yeah. it has been so like, the snow is so sparse that i can see why people when they see a little patch of snow, they are like, let's go and play in it. but it's not safe. we are watching out for your forecast heading there for the

weekend. look at palisades this morning. it's nice, but you have to go to the upper elevations before you see some of the snow. there's going to be a mixture of rain and snow throughout the weekend, so still dangerous travel getting there. we are going to see at times rain changing over to snow as temperatures drop to the overnight lows down in the low 20s. closer to home? maybe you want to watch the warriors game. we are going to see temperatures tonight in san francisco in the upper 50s. we are also going to continue to see great weather in san josé, and tonight is going to be a great night for the sharks game. also temperatures about the same, so you just need a jacket. you will keep that jacket on for the glowfari lantern festival at the zoo. we are going to talk more about that, coming up. kari, light traffic continues around the bay.

that's good news as far as speed sensors go. that fog, that is an issue that is creeping around and getting tougher to see in many spots including the tri-valley, 580 and livermore and dublin. the rails is where we are following a major delay for bart. that includes that stretch here where police activity is going on on the tracks, and there's a bus bridge between south satisfy, colma and daly city. that will affect the red and the yellow lines. the blue and the green lines start at daly city so they are not affected. but keep that in mind if you are riding the system, that may impact your ride. and then we will check on more times coming up.

and what to expect for today. it will be mostly cloudy and the sun peeking out from behind the clouds, and our temperatures going from the low 50s to mid-60s for the afternoon. for the most part, staying dry but cloudy in the north bay. we're watching that and the next big storm coming up in a few minutes. bart, they are restoring the system, the service through daly city. we will talk about why they had to stop trains, coming up. 5:44 right now. u.s. governors and mayors are appealing to the white house to help manage the influx of migrants. scott mcgrew is here, and you would imagine it's getting tough with so many people coming to find the right resources? >> yeah, they need more. absolutely. we have not seen this kind of

influx new york, chicago, denver, that so many others are dealing with. it's a problem, and it's so much bigger than what a city can handle on its own. there are more coming. there's another caravan, thousands already on the u.s./mexico border. this is absolutely a crisis for us. remember, these people are doing what they think is in their best interest, to get into the united states before the rules change. every time we threaten to crackdown, the crowds get larger. the mayor of new york is trying to stem the nonstop flow of buses dropping people off in the middle of the night in wintertime, telling bus companies they have to tell the city where they are stopping several days ahead of time or face the seizure of their bosses. a attorney that advocates for migrants says the people are

the high surf warning along the coastline, very dangerous waves out there. that continues into tomorrow morning. scattered showers and breezy winds for us today. once again, that next storm coming in tomorrow evening. we have already had a decent amount of rain in parts of the north bay and along the coastline with nearly two inches of rainfall in mount tam. in the santa cruz mountains we had an inch and three quarters there as well. most of us in the valleys had rainfall totals like danville and even in san josé where we had a few hundreds of an inch of rain, and so most of us it has been light, and we are going to see more rain coming in. as we track it with storm ranger, the rain is spotty. the north bay will have the best chance of seeing that rain continuing for this morning into the afternoon, and a little more of a break today. tomorrow we will have a new

storm coming in. the rainfall totals look to, basically, match what we already had or maybe be a little more for areas further to the south with the potential of half inch of rain for the tri-valley. it could be over an inch for the coastline in spots like half moon bay. that storm moves in and continues into early saturday. sunday is looking dry for the afternoon as you make plans to ring in the new year. by next wednesday, we will track a new storm that looks to mainly stay off the coast, and as that changes we could see more in the way of heavy rainfall. our temperatures have been fairly mild. it will be kind of a warm day for this time of year. upper 60s for the south bay. for tonight we are back down into the upper 40s. tomorrow, mid-60s. rain moving in late in the evening and continuing into saturday, and sunday is looking mostly cloudy while we will see sunshine in monday's forecast,

looking good with the rain on tuesday and wednesday. and temperatures in san francisco warm with mid-60s, but we will need the umbrellas along with the jackets every now and then. mike, was there a bart delay? >> yeah, they are recovering. bart police had to pursue somebody, an unauthorized person on the tracks and that person is unauthorized, and now they are getting a ride not on bart but in a squad car. the bay bridge itself is slowing on the decline off the treasure island tunnel area. here on the east side like in oakland, just damp roadways. a new incident may be happening around berryessa. back to you. >> thank you, mike. the powerball is growing

welcome back. you're watching "today in the bay." now turning to our climate in crisis, 2023 was the hottest year on earth. it was a year of climate and weather extremes. earlier in the year, to refresh your memory, we were hit with a siege of atmospheric rivers, and had flash flooding that

destroyed buildings, and the sierra got buried in snow, and the historically dried up lake reappeared. in spring, when that arrived we had tornadoes rolling through the west, and a tornado tore through mississippi in late march. just days later a two-day tornado outbreak spawned 146 tornadoes, the third largest outbreak in u.s. history. in the summer, wildfire smoke choked the big apple, and chicago and new york had the distinction of the worst air quality in the world during that hazy week. climate change is making wildfire smoke outbreaks more frequent and in a lot of places in the country, blistering heat pounded cities. more than a dozen u.s. cities reported their hottest summer on record, and while there was
