right now at 5:00, high surf slams the bay area coast, leaving damage behind. meteorologist kari hall is also tracking another storm rolling in. donald trump removed from a second state ballot, and a big decision from california this morning. plus, today is expected to

be the final busiest travel day of the year. this as many head home or leave for new destinations to ring in the new year. a live report on the steps you can take to avoid the chaos. this is "today in the bay." good friday morning. finally, the end of the holiday week. i'm kira klapper. laura garcia is off. >> i'm marcus washington. certainly a lot to get to this morning. first, cleanup is still under way in capitola. here is a live look this morning. many homes there, as well as businesses, damaged after massive waves pounded the coast. people there had to protect their homes from waves. they used sandbags, storm boards, but ultimately with the high tides came evacuations. many lost power around midday yesterday. and while most have returned to their homes, more high surf is expected tomorrow. capitola village will remain closed until it's safe to

reopen. capitola wasn't the only place hit by extreme waves. in marin county, the surge was so big, some streets had to be evacuated. video from stinson beach, where people showed up to watch the waves, even though they were told to stay away. let's check in with meteorologist kari hall, tracking this high surf and another incoming storm. we can see the storm that is still off the coast, but some of the rain already starting to make it into parts of the bay area. mainly the north bay, starting out with some light showers this morning, and that's going to be the case at least into early this afternoon. but we can see the rain still coming down, up around clear lake and cloverdale, as well as ukiah, and it's going to continue to be mainly for the north bay until later today. we are seeing the surf going down just a bit, so it went from a high surf warning to a high surf advisory, which is just a step below. but we could still see pretty big swells, and that will be in effect until 6:00 today. rain will be heavy as we go into

later this evening, and the wind will be picking up as well. we could see gusts 20 to 45 miles per hour, and this weekend we'll have another rain chance into early next week as well. but looking at our hour-by-hour forecast, most of us not seeing a lot of rain until afternoon. here is 2:00, 3:00, 4:00, we start to see heavy waves of rain for the evening commute and that will come along with gusty winds. we'll talk about all of that in a few minutes. mike, you've got drops on the lens in richmond. >> this is not really rain, it's just droplets on the lens, maybe some mist in the air. do continue to watch, because it will get tougher to drive here. easy, light drive as far as the volume. let's get something more interesting. even more mist, the camera over here, we see that yellow mustard color. that means there's even more fog, mist and drizzle in the north bay. 101, all from santa rosa toward novato into san francisco, that will be a factor along the

coast. also, livermore, same spot as yesterday, spreading farther through the altamont pass. no problems, but do be careful for those conditions. back to you. >> thanks, mike. the roadways look pretty open, thanks to mike showing us there. but happening now, today is supposed to be the last day of chaotic holiday travel of 2023. long lines are expected at bay area airports today, as millions of travelers return home after the holidays, or head to their new year's eve destination. >> "today in the bay"'s thom jensen is live for us at oakland international airport. we've seen those long lines over the past week or so. this morning, looking behind you, it looks pretty clear. >> reporter: right? look at it. this is surprisingly clear. the faa says it's supposed to be one of the busiest travel days of the year. you remember how it was the day after christmas when we were here on tuesday, kira and marcus. the line at this end of the building in the southwest terminal came all the way out from the ticketing and gating area into the baggage area,

wrapping around the inside of the building and then looping around before going inside. that was at this hour of the morning. it is still early but we're not seeing that right now. the line, you can't even see it inside the building. so travelers finding good conditions right now. but it is expected to be busy. the faa says they expect 2.5 million travelers per year in american airports, u.s. airports over the next three days, friday, saturday, sunday, and maybe even monday, new year's day, one of the busiest travel days as well. that's up 6% over last year. a few people we talked to here at the airport at oakland international, at least, on tuesday and then yesterday, they were actually standing in line waiting to get on their flights when they got notice that their flights had already been boarded and they had to make new arrangements. >> we're going to miss our flight, but that's all right. we see another one at 7:00, so hopefully we'll make that one. >> is it just because of long

lines? >> yeah, we got here two hours early, but just not early enough. >> it's been crazy. i've lived here my whole life, i come every year for christmas and it's never been this bad. everybody in line is saying it's never been this bad. >> reporter: there were some cancellations and delays reported christmas eve through tuesday due to fog, a major southwest hub, chicago o'hare, hundreds nationwide and dozens at bay area airports over that time on southwest alone. we're not seeing those this morning. i just checked with flightaware and all of oakland international in the past 24 hours, just seven delays and one cancellation. so that's looking good. but if you're going to be traveling, coming to either here at oakland international, sfo, san jose, wherever you're flying out of, you might want to get there early because they are expecting it to be busy today through monday. we're live at oakland international, thom jensen, "today in the bay." >> if i was flying out today and i saw what's behind you, i would be a little excited.

like you said, go early. you don't know what later on is going to be. thanks, thom. we're going to turn to politics and a second state is barring donald trump from appearing on their presidential ballot, this time it's the state of maine. >> it joins colorado in deciding mr. trump, he can't qualify for president under the 14th amendment. now, a big decision from california as well was made overnight. scott mcgrew has been following this. scott, give us an update of what's happening here at home. >> california, really the easiest, california secretary of state, who is in charge of elections, says donald trump will appear on our ballot, both in the republican primary and in the general election. remember, this may be a national election, but states set their own rules. in maine, the rules say the secretary of state there must told a hearing if anyone challenges the qualifications of a candidate. this is the secretary of state there, shanna bellows. she says she's weighed the

evidence and decided trump did engage in insurrection against the united states. i am mindful, she said, that no secretary of state has ever deprived a presidential candidate of ballot access based on section three of the 14th amendment. i am also mindful, however, that a candidate has never before engaged in insurrection. the state of colorado, meantime, has barred trump through the courts. a lower court determined trump did engage in insurrection, but said it didn't disqualify him. the state supreme court disagreed, ruled he had disqualified himself. both the state supreme court and the state republican party in colorado have asked the u.s. supreme court to make a ruling. the most important question, who decides if a candidate has violated section three of the 14th amendment? the writers weren't clear about that at all. a look at a map where this question is in front of the courts, whether he qualifies for

the ballot, note, we hadn't colored in maine because that was strictly a secretary of state's decision. michigan earlier this week said he could be on the primary ballot, but left the door open for removing him from the general election. the constitution may be the highest law of the land and there are certain qualifications that are straightforward, like you've got to be 35. but others that are far less clear. marcus and kira, we've never seen anything like this before, and right now we're not sure, nobody is sure how all this works out. >> it was so surprising getting those alerts from our nbc bay area app saying what was going on in maine and then here in california. hey, the times we're in now. >> and important that she also mentioned this is unprecedented what i'm doing, but this is unprecedented what he did. >> correct, and that she's following the law. the maine law is very specific about what she's supposed to do and this is her decision. >> all right, scott, thanks so much. 5:09 this morning.

taking a live look out in san francisco, dark and early on this friday. last friday of the year. >> oh, my gosh! that's crazy to say. >> it is. and mother nature surely is showing her presence. meteorologist kari hall, of course, has been monitoring everything that's going on. we have another storm coming through, right? >> yes, and we are going to be tracking all of the rain that's going to be moving into the bay area. we can see the storm that's rolling in, and the rain that's starting to move into far northern california. also, looking at tahoe for the weekend, we are going to see our very warm weather continuing, but a little bit of snow on saturday. we've been watching that sierra snowpack because it's been so low, and if you're going skiing, this weekend there's only going to be about 1 to 4 inches of snow for much of the sierra, but we are looking ahead to next week when we are going to see a lot more snow coming in, if this verifies and if we can get those temperatures to come down, we do have some more storms on the way. i'll be tracking that and what

good friday morning to you. it is 5:14. as we take a look at our day planner for napa, we're going to start out cloudy. light rain this morning and cool temperatures, but we're only headed up to about 60 degrees, and that rain coming in right in time for lunch. we'll get a look at our afternoon rain and gusty winds in the microclimate forecast coming up. traffic is light, but what kari said regarding the weather.

we have the mist and low clouds kind of hovering around the city. so it looks beautiful but it's in uf to get the roads slick. the wipers will be working in many parts. we'll show you how the commute is building up. as you know from earlier this week, it's light right now. we are moving you forward and this is the time of year when we look ahead to new laws for our communities and the upcoming presidential election and the inevitable breaking news that will shape the new year. >> we can't predict what that will be, but we can remind whau that meant in 2023. here is nbc's kris sanchez with a look at some of the stories that shaped the year. >> reporter: the cleanup still under way in several bay area cities, weekend storm, damaged homes, flooded roads. >> 2023 roared in, driven by an atmospheric river, powering strong winds and record rainfall, toppling trees, knocking out power and triggering mudslides. president biden surveyed flood

damage in downtown capitola and the pier that was nearly wiped out, promising extradited federal resources. and while the atmospheric river was a virtual fire hose, it was a hose of a different kind that started a conversation about dignity and the unhoused. a san francisco art gallery owner was caught in a 14-second video spraying a woman on the sidewalk demanding she move. the debate continues about how to balance the needs of housed and unhoused residents. >> we're told that there were four people shot and killed here, two at one location and two at another. >> reporter: about a week later, another vulnerable community was brutalized by an armed gunman who told our janelle wang in a jailhouse interview he shot and killed seven coworkers because he felt bullied in the farmworker housing. his trial is pending. in late january, the oakland police chief, leronne armstrong, was placed on leave by mayor sheng thao and ultimately fired, creating a vacancy at the top of the opd, which remains open to

this day. in february, san francisco was rocked by a deadly explosion in the outer sunset at a home where police say the residents ran a hash oil laboratory. the man who awaits trial is charged with the death of his own wife. you don't see this every day. i mean, it is just dumping down. this is not tahoe. this is the santa cruz summit. >> reporter: by late winter and early spring, winter dominated the headlines, from a blanket of rare low-level snow that had people making snowmen, to the flooding of the farm community of pajaro, forcing hundreds of people from their homes. and the bomb cyclone that took out power to hundreds of thousands of pg&e customers in the south and east bay, and on the peninsula. some people remained without power for weeks. and a chill fell over silicon valley when federal regulators shut down silicon valley bank in what was the

second largest bank failure in u.s. history. a lot of us got a lesson on diversifying our investments and looking for that fdic guarantee. in late march, bay area radio listeners mourned the death of dj of wild 94.9. though jeffrey vandergrift was known for making so many people laugh, he had been open about his own mental health struggles. april began with the stabbing death of cash app founder bob lee and his accused killer currently awaits trial. in the maye, elizabeth holmes reported to a prison camp to begin her 11-year sentence for defrauding investors with blood testing technology that never worked. summer kicked off with the bay area's first national women's soccer league team, bay fc. the four u.s. olympic gold medalists turned founders say they will be ready for play in the 2024 season, which begins in

march. elon musk wasting no time in rebranding twitter. >> reporter: in july, twitter became x, which elon musk says represents the evolution of the social media platform into an everything app. but since then, musk has been accused of allowing hate speech to go unchecked on the platform, where a growing list of big companies stopped advertising. and before taylor swift was named "time" magazine's person of the year, she was named honorary mayor of santa clara, where she rocked levi's stadium for two nights in a row, drawing fans who couldn't get tickets to the parking lot to trade friendship bracelets. about a month later, the beehive swarmed as she came to town. and the bay area said good-bye to another iconic woman, center dianne feinstein, who served as a san francisco

supervisor and mayor before becoming the longest serving woman in the u.s. senate, known for work on gun safety, exposing cia torture, california water rights, and for blazing trails for other women. in october, hamas launched a surprise attack on israel, and israel defense forces responded with a siege on gaza. bay area people raised their voices. some to call for support for israel and an end to anti-semitism, and others to call for humanitarian aid for palestinians and a permanent cease-fire to end civilian death. by november, pro-palestinian protesters were orange need enough to shut down the bay bridge for hours as san francisco hosted apec, the largest gathering of world leaders in nearly 80 years, and a private meeting between president biden and chinese president xi jinping. the same day david depape seen in police body cam video was convicted of attacking

congresswoman nancy pelosi's husband paul with a hammer in their own home. on october 16th, mlb owners voted unanimously to allow the a's to move to las vegas, and while they look to build a stadium, the san francisco giants and san jose sharks are looking to build better teams. and mr. irrelevant, brock purdy, continues to give the bay area something to cheer for, as the last round draft pick keeps the 49ers in the playoff push. as 2024 begins, you can count on the nbc bay area team of journalists to continue moving you forward through the hard times, the good times, and the growth times. kris sanchez, "today in the bay." >> certainly a lot over the year. >> wow, it's hard to believe. something else to add to that, what we've got going on with this weather. >> i think the waves we had yesterday is going to go on that countdown as well. that was pretty wild. and we're starting to see the

waves calming down, but we have a new storm that's going to be coming in, and most likely more dangerous surf and waves coming in over the next couple of days as rain arrives. we're also going to be tracking the off and on rain, first starting in the north bay, but then continuing to move into the rest of the bay area as we go into the afternoon. so there will be some spotty light showers to start, but some of the heavier activity reserved for the evening commute. here we are at 2:00 to 3:00, and we're starting to see that heavier rain coming into the coastline, parts of the north bay and spreading into the east bay. and then it continues to intensify as it moves in with the potential of some thunderstorms later today. this is at 4:30, 5:00, you see a lot of really bright colors. once again, showing some intense rainfall, with gusty winds and the possibility of thunderstorms continues into tonight. it looks like things wind down tomorrow into sunday, but during this time we're looking at the possibility of another inch to possibly an inch and a quarter for parts of the bay area.

some of the higher amounts along the coastline. looking ahead to the new year, we're going to see a bit more active weather continuing, and possibly a lot more sierra snow. so we're going to have a lot more rain and cold temperatures to talk about into next week. but for now, we'll be watching this new storm coming in later today. and you were talking about the conditions for some drivers. >> we're watching this new storm as it approaches, kari. there's mist, drizzle. it's on the lens here. through this blur you can see there are very few sets of headlights coming from richmond toward san rafael, where there's more moisture in the air. that's the highlighting with the mustard color extending down into san francisco and along the coast, also into the tri-valley. the big deal is that changes in visibility, which are happening now as the clouds come down. nothing else major going on. back to you. >> looks good, thanks. 5:23. next here on "today in the bay," nbc bay area responds. >> perhaps we are your new

right now at 5:30, dangerous waves roar over the bay area coastlines, causing a lot of damage in the coastal flooding areas, triggering evacuations. the devastation left behind by high surf and new warnings as a new storm is rolling in. starting over yet again in the search for the next police chief of oakland. mayor sheng thao rejecting the list of candidates put on her desk. the new timeline for the police commission to deliver a brand new list. also, the countdown is on. we are just three days away from

ringing in 2024. the preparations under way in the big apple before the massive ball drop, and the extra security measures in place. this is "today in the bay." little cough there to start the morning. >> i had that on tuesday. i hope i didn't give it to you. >> good morning to you. i'm marcus washington. >> and i'm kira klapper in for laura garcia. thank you for joining us this morning. we want to begin with breaking news we are following just into our newsroom out of the east bay. here is our brand new video, there is a large police response under way right now in oakland. this is video of the active scene near ninth and embarcadero. it is unclear what type of investigation is unfolding, however streets in that area are shut down. police are asking people to avoid that area. our "today in the bay"'s thom jensen is heading to the scene. he will bring us a live report in just about 30 minutes. >> we'll follow that. the other big story we're talking about this morning is that weather. meteorologist kari hall is

tracking the new storm heading our way. >> we do have a lot of big waves along the coastline, but not so much in the way of rain. it's been kind of spotty for us and yesterday was beautiful for much of the bay area. but now we're tracking a new storm system that's going to be coming in as we go throughout today. and this one is also going to pack in some high winds and bring parts of the north bay some heavier rainfall. we're already starting to see some light rain as we track it on the radar this morning. we'll continue to see the light rain up in those areas, but the rest of the bay area not seeing much more of the heavier rain until later today. here we are at 5:00 during the evening commute, a lot of oranges and reds on there, indicating some heavy rainfall, possibly some thunderstorms, and the gusty winds that could reach 25 to 35 miles per hour as this heavy rain rolls in for this evening. we'll talk about this and what's ahead for the weekend coming up. mike, as of now, we have fog at the golden gate bridge. >> it's enough, as the sheen shows, and we'll show this to

you closer up, the roadways are damp and potentially slippery. so the typical note about lower visibility and increasing stopping range. you can leave plenty of space because there's plenty of room at the golden gate bridge. farther north we have a darker yellow. that is fog that is continuing to be tougher for visibility. watch novato, santa rosa. we showed you the mist on the lens in richmond. we led the show off this half hour with the police activity in oakland, so i want to warn you that is at the embarcadero exit, close to 880, embarcadero and ninth. we're following what the reason is for this police investigation. there may be lane restrictions just off the freeway. the nimitz itself does move smoothly, as do the rest of the bay area's freeways. just that fog. back to you. high surf advisory remains in effect this morning for the coastline in san francisco. the coastal north bay and parts of the peninsula. this comes after massive waves

caused flooding and minor damage yesterday. "today in the bay"'s ginger conejero saab is joining us live this morning from pacifica once again. >> ginger, how does this morning compare to what you were seeing yesterday? >> reporter: well, it is a bit different from how it was yesterday. first off, i know kari was just talking about the rain and the wind. we're seeing a bit of both here, while yesterday, at worst, it was maybe some mist that we were experiencing. but the waves yesterday were much bigger. now this morning, you can't see much, but the waves do seem a bit calmer and come less frequently, and we're talking about that high surf warning that's been downgraded to a high surf advisory for parts of san francisco, the coastal areas in the north bay, including point reyes national seashore, the peninsula coast, northern and southern monterey bay, and all the way down to the big sur coast. the high surf warning we were keeping an eye on yesterday

expired a couple hours ago, but not before a lot of action in parts of the coastal bay area and right here at pacifica pier. massive waves not only broke over the seawall, but made their way across the street, even creeping down the side streets and threatening people's driveways. this is video from yesterday afternoon. the must-see waves brought in crowds and some who dared to come too close got a salty water reminder of the power of the ocean. now, the pier remains closed, so the beach boulevard here in pacifica. >> be aware that waves, any time a wave could come up and cause harm, so i suggest you stay far away. >> reporter: and some people in marin county did not heed that warning, yesterday at stinson beach lots of people showed up to watch the waves, even though they were told to stay away from the coast. now, the surge was so big, some streets had to be evacuated for

several hours, but luckily, there wasn't much damage. the same could not be said for some residents down in capitola, where some homes along the beach were damaged and without power last night. families were evacuated yesterday afternoon. a family left through their front window when the water came inside and became too much of a threat. they were able to return to their home last night, although without power. businesses were also forced to close early during what is still a holiday week. now, all of that a difficult reminder of what capitola experienced not too long ago, difficult for residents there. this high surf advisory is in effect until 6:00 p.m., and as kari has been talking about all morning, we still might see big waves throughout the weekend. that's it for now. >> that video is shocking. ginger, thank you so much. stay safe out there. 5:37 right now. a san francisco city worker is

waking up in the hospital following a brazen hit and run in broad daylight. this morning police are still searching for that driver. it happened around 4:00 yesterday afternoon near eighth and mission streets in the city's soma neighborhood. sfpd officers say they noticed a car wanted in connection with a crime, but before they could pull it over and stop the driver, the driver sped off, hitting a city worker. if you have any information, you are asked to call sfpd. a follow-up to a child endangerment case involving a south bay daycare. you may remember back in october when two toddlers drowned at happy happy daycare in san jose. well, those owners were back in court yesterday and were arraigned. now they have a significantly higher bail. other conditions implemented by that judge include gps monitoring and both must surrender their passports. they also cannot care or be in custody of any children other than their own. later this afternoon, the judge will ensure bail has been posted

and gps monitors are in place. it has been nearly one year that the city of oakland has been without a police chief. now the police commission is scrapping its first list of its top three candidates for police chief. oakland mayor sheng thao rejected their first attempt at replacing former police chief leronne armstrong. last night the commissioners appeared at a special meeting to announce it will restart the entire search process. former oakland police chief and current new orleans police superintendent anne kirkpatrick says it is time for oakland's leaders to step up and take the lead. >> i am a proponent of civilian oversight, but i think the best option for them is let their elected officials, the mayor and the city council, that's the voice of the community, to make this decision. >> a new round of open recruitment will take place in january, with a finalist of

candidates to be sent to the mayor on march 1st. 5:39 right now. the countdown is on to new year's eve. this morning preparations are under way for major celebrations this weekend. >> but police, as always, are on high alert for large protests, lone wolf attacks, especially in major cities like new york, where close to 1 million people will watch the ball drop in times square. romney smith from our new york nbc nation joins us now with more. >> reporter: good morning, marcus and kira. the focus of the hundreds of thousands of people who come to times square to ring in the new year will be fun. but the focus for nypd will be making sure everyone is safe. the organizers of the ball drop in times square expect upwards of 1 million people to pack this area sunday night to bring in 2024 with the iconic ball drop. there are no known credible threats at this time, but police are ramping up safety and security efforts and they also expect demonstrators related to

to decide donald trump will not be on the 2024 ballot because he engaged in insurrection against the united states. there are some key points to remember as you are following the story. one, presidential elections are not national elections. each state sets its own rules on how the elections work. that's why we're seeing one decision made by the colorado supreme court, another made by the maine secretary of state. two, this is not just some random decision made by shanna bellows, who nobody has ever heard of before. she didn't come up with this out of the blue. she was following maine law specifically, which says if somebody challenges a candidate's qualifications, the secretary of state must hold a hearing to make a decision. take a listen. >> i am required by law, it's an authority delegated to me explicitly by the maine legislature, to hold what's called a section 336 challenge

hearing. both parties come, they present their evidence, they file briefs. i review only that evidence in the context of the laws, the facts presented, and the constitution, and then i must make a determination. i'm duty bound to both hold a hearing and make a ruling. >> the 14th amendment says someone who conducts insurrection against the united states may not be an officer of the united states. curiously, the constitution is vague as to whether that applies to the office of the president of the united states. it's a reasonable argument that it doesn't. to those who argue trump should get due process, that a court should decide whether he's an insurrectionist based on evidentiary hearings, they did that in colorado and found him culpable. california's secretary of state, meantime, has ruled trump will be on the primary ballot here, and assuming he wins that on the ballot, in the general.

nikki haley trying to keep donald trump off the general election ballot in her own way by beating him in the primary. she's walking back a gaffe she made on the campaign trail, where a voter asked her what the cause of the civil war was, and she didn't mention slavery. keep in mind, this happened in new hampshire, not alabama or mississippi or some former confederate state. new hampshire. 32,000 from new hampshire fought to end slavery, 4,000 of them died. haley would later clarify, of course, the civil war was about slavery. >> last night i was asked about the civil war, and what i think of the civil war, what was the cause of the civil war. of course the civil war was about slavery. we know that. that's unquestioned, always the case, we know the civil war was about slavery. but it was also more than that. >> haley would go on to talk about government and personal

battle of the midwest, you could say. looking forward to that. let's look at the forecast. meteorologist kari hall has it for us today. more rain? >> yes, we are going to start to see the rain coming in for the afternoon. for the north bay, it's a little earlier but does start out light. we're still tracking big waves along the coastline. we went from having a high surf warning to a high surf advisory. so it's basically a step down but still means that conditions will be dangerous until this evening. then we'll see that rain coming in for the afternoon, maybe heavy at times. and those wind gusts will start to pick up late morning and continue into the afternoon, along the coast and in the santa cruz mountains, we could see gusts 45 plus miles per hour, with the storm coming in. and then looking ahead, we'll see more rain chances early next week, but now we're focused on this storm that's coming in. we can see that low barreling closer to our coastline and pushing up a lot of the high winds and rain that we'll see as we go throughout today, off and

on showers as we go into this afternoon, picking up for this evening, and then gradually tapering off for tomorrow as that rain continues to move off toward the east. our rain outlook looks pretty good, with the possibility of another inch of rainfall, but with that we could see some areas for those creeks that we'll need to monitor closely, and moderate times today, so creeks, rivers, streams may reach the monitor stage. once again, watching some of those typical areas in the peninsula, in the north bay, that do flood. and then our outlook going into next week, once again, does show more rain coming in for next tuesday into wednesday, and our temperatures in the low 60s. and you're seeing the conditions, mike, maybe a factor for drivers. >> yeah, undoubtedly that will be the case in many views here, like the golden gate bridge. we see how slick conditions are. and i did get word -- i'm not going to blame any one thing on this crash. in the crash detail, coming
