tracking the next system moving in. and today is expected to be the final busiest travel day of the year, delays some already saw at local airports, and how you can avoid any of those headaches. this is "today in the bay." good friday morning to you. the last friday of the year. i'm marcus washington. >> and i'm kira klapper. we're going to get right to that breaking news out of oakland, where a large police investigation is unfolding near ninth and embarcadero. >> "today in the bay"'s thom jensen is there, just arriving to the scene. talk to us about what you've learned. >> reporter: well, we're still trying to get more information. this is breaking right now. initially we had heard that there were shots fired in this area, that possibly an officer was down. we have not gotten confirmation that an officer was injured. i want to be cautious about saying that.

but we did hear that initially. we do know that sometime in the 4:00 hour -- we're basically fifth and embarcadero, somewhere ninth and embarcadero this occurred. we got video from the scene a short time ago that was closer to where this happened. there was a white toyota pickup truck that had bullet holes and windows shattered. it looked like police evidence markings placed around in the street, around what appear to be shell casings. like i said, we initially heard an officer was down, but have not heard confirmation on that. chp has closed a lot of streets in the area. it keeps pushing the perimeter back here. we've got several different agencies here on the scene. chp, alameda county sheriff's department, oakland police, a lot of different agencies are coming and trying to help out with the scene here. a lot of officers have moved back to where our location is

right now and they're trying to keep cars from coming in as people begin to start their workday. we have to warn folks who are going to be heading off to work, right now, anyway, 880 both northbound and southbound, the exits onto embarcadero are blocked. if you usually take those exits, you'll have to find another one. we're trying to get more information and we will be back in the next half hour, hopefully with updates on exactly what happened here. for now, we're live in oakland, thom jensen, "today in the bay." >> thanks for getting us an update of what you've got so far. thanks so much. 6:03 right now. turning to the weather and capitola cleaning up, yet again, after massive waves pounded the coast yesterday. here is a live look this morning. many homes and businesses damaged, people tried to protect their buildings from the waves with sandbags, storm boards, but ultimately the high tides caused

evacuations. many lost power. while most have returned to their homes, more high surf the expected. capitola village will remain closed until it is deemed safe to reopen. that wasn't the only place hit by extreme waves. in marin county the surge was so big, some streets had to be evacuated. this video from stinson beach, where people showed up to watch the waves even though they were told to stay away. let's check in with meteorologist kari hall, who has been telling us this is coming, and we need to be careful. how is it looking, kari? i understand some warnings got extended, is that right? >> yeah, so we have still the high surf warning, the coastal flood advisory, all of this because of storms that are developing and pushing a lot of high winds and waves across some of the pacific, across the pacific into some of our coastline. and we will already start to see that rain coming in this morning, but the heavier rain is still off the coast, set to arrive this afternoon. we can see light rain coming down in the north bay.

our hour-by-hour outlook shows it picking up around 3:00 to 4:00 for this afternoon, and continuing into the evening with winds that may reach 45 miles per hour along the coast and in some of our hills. and then as we go into this evening it's going to be raining off and on, at times heavy downpours, but tapering off tomorrow. you can download our free nbc bay area app. you'll be able to get access to our exclusive mobile doppler radar and track how long the wet weather will be in your neighborhood. mike, you've been watching the commute and that weather is a little bit of an impact there as well. >> yeah, it's been on the lens as far as the water goes. the light water here and mist, drizzle, maybe light rain, richmond-san rafael bridge. it is impacting the roadways, making them wet, visibility tougher. our emeryville camera shows you clouds coming down that will make more mist and slick conditions around the bay. so do be careful. we're seeing dense fog in the

north bay. oakland, this is what thom jensen was talking about. the embarcadero on and off-ramps will be impacted by this continued investigation. the nimitz freeway itself moves smoothly. the embarcadero ramps are specifically impacted. the rest of the bay calm despite the fog. >> thanks. a second state is now barring donald trump from appearing on the presidential ballot, this time the state of maine. >> it joins colorado in deciding mr. trump cannot qualify to be president under the 14th amendment and a big decision from california as well made overnight. scott mcgrew has the updates for us. what's going on in california? >> well, that's the easiest. good morning to you. california secretary of state in charge of elections here, says donald trump will appear on the ballot, both in the republican primary and in the general election. remember, this may be a national election, but states set their own rules. in maine, the rules say the

secretary of state must hold a hearing if anyone challenges the qualifications of a candidate. this is the secretary of state there, shanna bellows, she says she's weighed the evidence and decided trump did engage in insurrection against the united states. i am mindful, she says, that no secretary of state has ever deprived a presidential candidate of ballot access based on section three of the 14th amendment. i am also mindful, however, that no presidential candidate has ever before engaged in insurrection. the state of colorado, meantime, barring trump through the courts. a lower court determined trump engaged in insurrection, but said that didn't disqualify him. the supreme court in the state disagreed and ruled trump had disqualified himself. both the state supreme court and the state republican party in colorado have asked a u.s. supreme court, the u.s. supreme court, to make a ruling on that.

the most important question, who decides if a candidate has violated section three of the 14th? the writers not clear about that at all. a look at a map where this question whether trump qualifies for the ballot is under some sort of consideration in the courts. notice, we had not colored in maine because that was strictly a secretary of state decision. michigan earlier this week said he could be on the primary ballot, but left the door open to remove him from the general election. the constitution is the highest law of the land, of course, and there are certain qualifications for president that are straightforward, like you need to be 35. but there are others that are far less clear. we've never seen anything like this before, and as of right now, marcus, we're not sure how any of this works out. >> i know you will be following, scott. thanks. well, happening now for you, today is supposed to be the last day of the chaotic holiday travel of 2023.

long lines expected at bay area airports today, as millions of travelers return home after the holidays or head to their new year's eve destinations. this is what oakland international airport has faced over the past few days, lines of people waiting, specifically here at southwest, to board their flight. the faa says they expect 2.5 million airline passengers daily, that's a 6% increase above last year. a few people we spoke with got noticed that their flights boarded while they were in line, so they had to rearrange their flights. >> we're going to miss our flight, but that's all right. we see another one at 7:00, so hopefully we'll make that one. >> is it because of long lines? >> we got here two hours early, like they said. just not early enough. >> it's been crazy. i come down every year for christmas and it's never been this bad. everybody in line is saying it's never been this bad. >> now, there were some cancellations and delays reported christmas eve through

tuesday, this is due to fog in a major southwest hub, chicago o'hare. hundreds nationwide and dozens in the bay area airports on southwest alone. but there have been just a handful of delays over the past 24 hours according to flightaware, and one cancellation. >> those poor people on that one canceled flight. a lot of people will be heading to tahoe to ring in the new year but the drive may be disappointing. despite recent storms, snow in the greater tahoe region is actually below normal for this time of year. this is interstate 50 in south lake. you can see there's nothing, i mean, i don't see any snow, unless that thing on the left is a light or snow. >> that's when we bring in the meteorologist. well, it's also a dark camera shot. >> let's just say there's nothing there, and farther up in the mountains there is snow.

ski resorts are open, but they aren't ideal conditions. however, resorts say they are doing their part to produce as much manmade snow as needed. >> should they get more fresh snow? >> they're going to get fresh snow. it's above 7,000 feet. so i was just there last week and there were people skiing, but you have to go to the top of heavenly and then you see a little snow. >> were you up there? >> i was not up there. i watched people go up the gondola. and i was, like, bye, y'all. last year i was there and it was amazing with all the snow coming down. maybe after the new year. we see more storms coming in. we've been tracking the activity with storms coming in that have been so warm compared to what we typically see for this time of year. so we are getting some rain, and it starts out for us for this afternoon. in the tahoe area we'll see that rain as well, and then mostly

sunny skies until later tonight. and then tomorrow that rain changes over to snow as those temperatures drop, but once again, it's a very light snow and we're back to the 50s on sunday. so about 1 to 5 inches for this weekend, and then next week it is looking really good. if we can get cold air to come in, we could see about 2 feet of snow in upper elevations. . mike, how are the gas prices? >> contra costa county finishing strong with a low of $3.77 in concord at the 76 station at cowell road. that's exceptionally low. in the north bay, vallejo, $3.89 at central gas on springs road and san jose dominates for santa clara, $3.95 here at the quick stop on pearl avenue right near capitol expressway. the roadways, not major

welcome back. we're moving you forward into 2024, and this is that time of year when we look ahead to new laws for our bay area communities, the upcoming presidential election, and breaking news that will surely shape the new year. >> we can't predict what that will be, but we can remind you of what it meant in 2023. here is nbc bay area's kris sanchez with a look at some of the stories that shaped the year. >> the cleanup still under way in several bay area cities, weekend storm damaged homes, flooded roads and closed down many businesses. >> 2023 roared in, driven by an atmospheric river, powering strong winds and record rainfall, toppling trees, knocking out power and triggering mudslides. president biden surveyed flood damage in downtown capitola and the pier that was nearly wiped out, promising expedited federal resources. and while the atmospheric river was a virtual fire hose, it was a hose of a different kind that started a conversation about dignity and the unhoused.

a san francisco art gallery owner was caught in a 14-second video spraying a woman on the sidewalk demanding she move. the debate continues about how to balance the needs of housed and unhoused residents. >> we're told that there were four people shot and killed here, two at one location and two at another. >> reporter: about a week later, another vulnerable community was brutalized by an armed gunman who told our janelle wang in a jailhouse interview he shot and killed seven coworkers because he felt bullied in the farmworker housing where they lived in squaller. his trial is pending. in late january, the oakland police chief, leronne armstrong, was placed on leave by mayor sheng thao and ultimately fired, creating a vacancy at the top of the opd, which remains open to this day. in february, san francisco was rocked by a deadly explosion in the outer sunset at a home where police say the residents ran a hash oil laboratory.

the man who awaits trial is charged with the death of his own wife. you don't see this every day. i mean, it is just dumping down. this is not tahoe. this is the santa cruz summit. >> reporter: by late winter and early spring, winter dominated the headlines, from a blanket of rare low-level snow that had people making snowmen, to the flooding of the farm community of pajaro, forcing hundreds of people from their homes. and the bomb cyclone that took out power to hundreds of thousands of pg&e customers in the south and east bay, and on the peninsula. some people remained without power for weeks. and a chill fell over silicon valley when federal regulators shut down silicon valley bank in what was the second largest bank failure in u.s. history. a lot of us got a lesson on diversifying our investments and looking for that fdic guarantee. in late march, bay area radio listeners mourned the

death of dj of wild 94.9. though jeffrey vandergrift was known for making so many people laugh, he had been open about his own mental health struggles. april began with the stabbing death of cash app founder bob lee and his accused killer, nima momeni, currently awaits trial. in may, disgraced theranos founder elizabeth holmes reported to a prison camp to begin her 11-year sentence for defrauding investors with blood testing technology that never worked. summer kicked off with the bay area's first national women's soccer league team, bay fc. the four u.s. olympic gold medalists turned founders say they will be ready for play in the 2024 season, which begins in march. elon musk wasting no time in rebranding twitter. >> reporter: in july, twitter became x, which elon musk says represents the evolution of the social media platform into an everything app. but since then, musk has been

accused of allowing hate speech to go unchecked on the platform, where a growing list of big companies stopped advertising. and before taylor swift was named "time" magazine's person of the year, she was named honorary mayor of santa clara, where she rocked levi's stadium for two nights in a row, drawing fans who couldn't get tickets to the parking lot to trade friendship bracelets. about a month later, the beehive swarmed levi's stadium as bee beyonce brought renaissance to town. and the bay area said good-bye to another iconic woman, senator dianne feinstein, who served as a san francisco supervisor and mayor before becoming the longest serving woman in the u.s. senate, known for work on gun safety, exposing cia torture, california water rights, and for blazing trails for other women.

in october, hamas launched a surprise attack on israel, and israel defense forces responded with a siege on gaza. bay area people raised their voices. some to call for support for israel and an end to anti-semitism, and others to call for humanitarian aid for palestinians and a permanent cease-fire to end civilian death. by november, pro-palestinian protesters were organized enough to shut down the bay bridge for hours as san francisco hosted apec, the largest gathering of world leaders in nearly 80 years, and a private meeting between president biden and chinese president xi jinping. the same day david depape seen in police body cam video was convicted of attacking congresswoman nancy pelosi's husband paul with a hammer in their own home. depape awaits sentencing and additional local charges. on october 16th, mlb owners voted unanimously to allow the a's to move to las vegas, and while they look to build a

stadium, the san francisco giants and san jose sharks are looking to build better teams. and mr. irrelevant, brock purdy, continues to give the bay area something to cheer for, as the last round draft pick keeps the 49ers in the playoff push. as 2024 begins, you can count on the nbc bay area team of journalists to continue moving you forward through the hard times, the good times, and the growth times. kris sanchez, "today in the bay." >> wow. >> a lot going on. >> i like how she says the growth times. challenges are opportunities to grow. we're doing a lot of growing with mother nature. >> finally seeing some grass growing around here. it's been so brown. we've had a dry start to our season. nice to see some green on the radar. here is a look at what to expect, with a high surf warning that will be in effect, and, also, the big waves that continue along the coastline.

at times we'll see some heavy rain for the afternoon, and gusty winds that will start to pick up late morning. but then peak as we go into the day. some of those gusts near the coasts and in the hills could reach 45 miles per hour. we'll see more rain chances ahead going into the first week of 2024, but of course we're focused on this storm that's been pushing up those big breakers, and also creating some coastal flooding as we also deal with our astronomical tides at the same time. and then looking at the rain that's going to be coming in starting in the north bay, with some spotty light showers to start. we'll see that through about 9:00 to 10:00. a bit of a break around the lunch hour, but then the north bay is seeing the rain picking up once again for about 2:00 to 3:00 for today, into the evening, maybe even some rumbles of thunder in some of these more intense downpours that will be coming in and the gusty winds into tonight. and then gradually it does taper off as we go through the day tomorrow. additional rainfall totals could

reach about an inch and that could briefly cause some localized flooding on creeks and streams, so watch out for that. then we'll see dryer weather, at least for the first day of 2024. mike, you're saying the drivers need to take their time. >> traffic is very light and they should take their time because of slicker conditions, mist, drizzle, fog, lower visibility. those are the big factors. the easy factor is the volume of traffic, very light despite smaller incidents. back to you. >> mike, thanks. the lights on the bay bridge could be coming back sooner than anticipated. up next on

welcome back. 6:26. and the lights on the bay bridge could come back to the city very soon. >> the nonprofit organization illuminate installed the lights on the bay bridge more than ten years ago, and you know just this year the lights turned off because of damage. the nonprofit didn't have the fund to fix it. it started crowdfunding to fix and install new lights. looking to donations as well. the san francisco standard says the group is at almost 90% of its funding goal. it needs roughly $1.5 million to restore the lights on the bridge. if funding is complete, the lights could be back on in another eight to ten months. we've got a lot more ahead at 6:30, including breaking news we've been following out of

roaring over bay area coastlines, causing coastal flooding and triggering evacuations. devastation left behind by the high surf, and now a weekend warning as a new storm rolls in. this is "today in the bay." good friday morning. thank you so much for joining us. i'm kira klapper. >> i'm marcus washington. we want to welcome you to the last friday of 2023. can you believe that? >> no, i like to say i haven't started my new year's resolutions from 11 months ago. we want to start with breaking news this morning. we have been following this out of oakland. a large police investigation unfolding near 9th and embarcadero. >> our "today in the bay"'s thom jensen is live on the scene. thom, what are you learning this morning? >> reporter: good morning to both of you. we don't have a lot more details right now. we've got a few more. we know this happened sometime

around 4:30 this morning. that's when our assignment desk started hearing on the scanner traffic about a shooting down here on the embarcadero. it's about five blocks from where we are right now, where the main scene is, at about 5th and embarcadero. that's where one of our photographers got video earlier this morning of a white toyota tacoma pickup truck riddled with bullets. the windows are shattered. then the video also shows that there are police evidence markings all over the street that appear to be marking shell casings of some sort, police or a suspect, we don't know what it is right now. but we have reached out to oakland pd, we got a call early on, information that possibly an officer was injured, that there was an officer down. we have not gotten confirmation of that. we reached out to opd and to the

police officers association and have not heard back. but we did follow an ambulance to highland hospital here in oakland, and there is a strong presence of police officers outside the emergency room there and several, at least four or five, police cars, at least a few of them appear to be from oakland police department. again, we have reached out to the oakland police department and the police officers association for more information to see if they can confirm that this was an officer-involved shooting, if somebody was injured. we hope to have more details in the next half hour. for now, police are moving us back from where we are right now, giving us a new location, where they're setting up a command post. we will talk to you from that location in the next half hour. for now, we're live in oakland, thom jensen, "today in the bay." >> hopefully whoever is in the hospital is okay. thom, thanks for that. it is 6:33 right now. meteorologist kari hall has been monitoring what we can expect

today, and you're letting us know rain is in our forecast. >> yes, today it looks very sloppy for this afternoon. and it's been really active with all of these waves along the coastline, while a lot of us in the inland areas haven't seen much in the way of any really crazy weather yet. so we do still have those big surf advisories. the rain will be picking up and the wind will increase later this morning into the day at about 20 to 45 miles per hour. looking ahead, we'll see more rain chances coming in, but this is the first storm that's going to be arriving, and we're already starting to see some light rain coming in along the north bay, the coastline, and the peninsula. then we'll see it taper off for a couple of hours before the heavier rain comes in around 2:00 to 3:00 today. and then looking at later on this afternoon into the evening, widespread heavy rain, gusty winds, and possibly even a few thunderstorms. so we'll be watching all of that

and, also, the impacts we'll see into the weekend. >> piggy backing off of that, the high surf advisory remaining in effect this morning for the coastline in san francisco, coastal north bay and other parts of the peninsula. this is coming after massive waves caused damage and flooding there yesterday. "today in the bay"'s ginger conejero saab joins us from pacifica, once again this morning. i was just fixated on that video. ginger, how does the weather you're seeing right now compare to what we just saw from yesterday? >> reporter: i turned my back, because you can hear the waves crashing against the seawall and you're kind of anticipating, is it going to be a massive wave like the ones we saw yesterday. we definitely don't want to get splashed by one of those. but, yes, those were pretty big this morning. we're not seeing them as big and

we're not seeing them as frequently. what we're seeing and experiencing is light rain that kari was just talking about and the winds are starting to pick up. the high surf advisory is still in effect for the north bay, coastal areas, san francisco, and other parts of the san francisco peninsula coast. i want to take a look back at that video from yesterday where those massive waves were happening during the high surf warning that we were keeping an eye on. that expired a couple hours ago, but not before a lot of action here at the pacifica pier. now, those big waves, they made their way across the street and even crept down the side streets. the waves brought in crowds and some who came too close got a reminder of the power of the ocean. the pier does remain closed and so the beach boulevard at the pier. >> be aware that waves maybe seem fine, but at any time a big wave can come up and cause harm. i suggest you stay far away.

>> reporter: well, some people in marin county did not take that heed of warning. yesterday at stinson beach, lots of people showed up to watch the waves, even though they were told to stay away from the coast. the surge was so big, some streets had to be evacuated for several hours, but luckily there wasn't much damage. the same could not be said for some residents down in capitola, where some homes along the beach were damaged, and were without power last night. families were evacuated yesterday afternoon. one family left through their front window when the water came inside and became too much of a threat. they were able to return to their homes, although without power. businesses were forced to close early during what, for many, is still a holiday week. we're taking a live look now at capitola, in capitola, that's capitola and san jose streets right there in downtown. we're told that the crews have

far as volume. but the conditions are why you need to slow down and allow extra time. here is our look at the bay bridge from emeryville, you see the mist, drizzle, fog, low clouds all mixing and making for wet pavement. as we are looking at the rest of the commute, the speed sensors are looking great. highway 37, very little slowing. even tougher to see in the north bay. i want to zoom over, look at the slowing that's shown up here in oakland. 880 north and southbound, the center of that slowing right around embarcadero. remember, thom jensen just talked about the police investigation that continues to expand in the area around embarcadero and 9th. 880 is open, but you can see flashing lights from the freeway as it passes over city streets and there will be distraction and slowing. the rest of the bay shows an easy, light drive. the fog, the mist, drizzle and incoming rain, do use cautious. >> thanks, mike. now to a live look at airports across the country.

we have san francisco, orlando, oakland, philadelphia. long lines are expected. at bay area airports, millions of travelers are expected to return home after the holidays or head to their new year's eve destinations. the tsa expects to screen more than 2.5 million passengers each day. that's a 6% rise from last year. >> a lot of folks heading out because the countdown is on. 2024 is almost upon us. preparations are under way for major celebrations this weekend. >> but police are on high alert for large protests, lone wolf attacks, especially in major cities like new york, where close to 1 million people will gather to watch the ball drop in times square. our romney smith from our new york nbc station joins us now with more. hey, romney. >> reporter: good morning, marcus and kira. you know, the focus of the hundreds of thousands of people who come to times square to ring in the new year will be fun.

the focus for nypd will be that everyone is safe. they expect upwards of 1 million people to pack this area sunday night to ring in 2024 with the iconic ball drop. there are no known credible threats at this time, but police are ramping up safety and security efforts and they also expect demonstrators related to the war in the middle east. now, thousands of officers will saturate new york city to make sure the celebrations are all as safe as possible, but they're still asking for the public's help to call police if they see anything suspicious. bringing it back to times square, the confetti test will happen at 11:00 eastern time and the goal is to make sure the 3,000 pounds of confetti will fly through the air perfectly at midnight on sunday night. i have to tell you, if you have never seen a new year's eve in times square, i highly recommend you put it on your bucket list. the energy is absolutely unmatched. reporting in times square, romney smith. back to you. >> thanks, romney. or you can stay here in the bay

and watch. >> exactly, there's a lot to do in the bay area, including that famous fireworks show along the embarcadero. meteorologist kari hall is timing out our forecast for people headed out. i will be at home. >> me, too. if you are one of those people packing a bag or trying to find a last-minute flight to times square, i want to show you what to expect, what a pack in that bag. we are going to see mild temperatures, rain is moving out, so you are pretty much all clear for the rest of the weekend. and temperatures around too bad, either. sometimes it can be really cold to ring in the new year. we're seeing temperatures there in the upper 30s, which is a little warmer than normal. around here, around the bay area, we have a lot of events going on, including christmas in the park continuing. we'll see rain coming in for the afternoon. it's not going to be the best evening to go there. but tomorrow looks much better. also great for the warriors game in san francisco, where we're going to see temperatures in the mid-50s, but it will be all clear and breezy for tomorrow

evening at the time that we start that game. and then looking across the country, we know we have a lot of people traveling, either coming into the bay area or you're heading out. here is a look at temperatures to expect, at least for today. once again, the rain starting to clear the east coast and we have a new storm that's coming into our area. so that's going to affect you if you're going into napa this weekend. off and on rain for today into early tomorrow. by sunday, we are looking at dryer conditions, so we're going to have some nice weather to start out the new year as well. and looking at santa cruz, we'll see the off and on rain just, once again, a heads-up about the big waves. you want to stay well away from the coastline. so we'll have a look at what to expect as far as the weather, the storms that are coming in, more on that coming up in a few minutes. mike, it's a good deal that's free. what's going on? >> well, you have all those

activities, i don't want to be left out of new year's eve and new year's day. let's walk you through great reasons why you should try transit. it's a good deal, it's free. so that's good. vta is going to continue their tradition of providing free bus service on new year's eve for bus route 500, as well as for light rail service, for the blue, green and orange lines, they'll all be free from 8:00 p.m. on sunday new year's eve through monday, new year's day at 5:00 a.m. same goes for transit, ac transit. the tempo line is included, as well as transbay. muni buses and trains, many lines will be extending service, with muni metro turnstiles, i'm told they're just going to be open so you don't have to worry about getting through. caltrain and samtrans will suffer free transit rides starting at 8:00 p.m. for both. samtrans, free service includes para transit that goes through 3:00 a.m. and caltrain will offer special

good friday morning. right now at 6:47, we're taking a look at the day planner for livermore, starting out cloudy, temperatures in the low 50s. we will see that rain coming in right at about 4:00 this afternoon. it will be much earlier for the north bay, so i'll time it out for all of our microclimates coming up. if your drive includes the golden gate bridge, it's kind of slippery here. the mist, the drizzle, the rain, that's coming in. so it will be wetter in many parts of the bay. others, a different story. we'll talk about that coming up. president biden is on vacation with his family in the virgin islands. >> meanwhile, you may have heard there was an unprecedented decision out of maine over the 2024 election. scott mcgrew, donald trump is off the ballot there as well. >> that's right, if the secretary of state, the local secretary of state, her decision

stands. maine becomes the second state to decide donald trump will not be on the 2024 ballot because he engaged in insurrection against the united states. now, there are some key points to remember as you are following this story. one, presidential elections are not national elections, each state sets its own rules on how the election works. that's why we're seeing one decision made by the colorado supreme court, another made by the maine secretary of state. two, this is not just some random decision made by shanna bellows, who, let's face it, nobody had ever heard of before outside of maine. she did not come up with this out of the blue. she was following maine law specifically, which says if somebody challenges a candidate's qualifications, the secretary of state must hold a hearing and make a decision. take a listen. >> i am required by law, it's an

authority delegated to me explicitly by the maine legislature to hold a section 336 challenge hearings. both parties come, they present their evidence. they file briefs. i review only that evidence in the context of the laws, the facts presented, and the constitution, and then i must make a determination. i'm duty bound to both hold a hearing and make a ruling. >> to those who argue trump should get more due process, that a court should decide whether he's an insurrectionist based on an evidentiary hearing, they did that in colorado and found him culpable. california's secretary of state, meantime, has ruled trump will be on the primary ballot here. nikki haley walking back a gaffe on the campaign trail when a voter asked her what the cause of the civil war was and she didn't mention slavery. keep in mind, this happened in new hampshire, the live free or

things are taken a turn for the worst. meteorologist kari hall warned us about this. and you say today will get extra sloppy. >> yes, and the wind is going to continue to pick up. we're seeing it along the coastline, but as the storm continues to spread across the bay area, rain and wind expected. some of the heavier activity not until later today. what we're seeing now is light and will taper off after, i would say, the next three or four hours, and then give us a brief break before the very heavy rainfall starts to move in at 2:00 to 3:00. it's approaching santa rosa and may include some thunderstorms. that's going to be rolling across the bay area into 4:00 to 5:00, really having a high impact on the evening commute. we're looking at winds at the same time that all of this heavy rain is coming down, our winds could gust 20 to 45 miles per hour, maybe even higher along the coastline. and then going into this evening, it's going to eventually start to wind down. we'll wake up tomorrow with spotty showers and then start to see the activity continuing to

clear out. looking at how much additional rainfall we have, possibly anywhere from a half of an inch of rain for parts of the east bay into the south bay, up to over an inch and a half for much of the north bay. and with all of this heavy rain, we're watching very closely, our rivers, creeks and streams, they may reach the monitor stage. that includes parts of sonoma county, as well as the peninsula, and the santa cruz county, some of those creeks and rivers. it will be a soggy start to the weekend, but clearing out by sunday, into the start of the new year. mike, you're tracking some delays in oakland. >> yeah, this is not weather related. this is a police investigation, our breaking news related to this. the embarcadero and 9th scene, as a bigger perimeter. this also impacts the embarcadero off-ramp and on-ramp. that's why there's slowing on the nimitz. i believe oak will take you back to 7th, which takes you to city streets.

you can also exit at park, which is before the backup really gets intense. that is a factor, traveling northbound on the nimitz. everything else is pretty much weather related, just words of caution, there's rain that's coming through richmond, berkeley, heavy mist and drizzle, and that makes the conditions tougher on the roadway. on your windshield you'll see the presence of water. in the south bay, it's looking beautiful in san jose. back to you. >> mike, thanks. 6:53 right now. happening now, investigators are back to square one in the case of a disappearance of a north bay girl from more than 30 years ago. amanda nicky campbell vanished back in 1991 while going to her friend's home in fairfield. authorities believe she had been abducted, and recently thought a man convicted of kidnapping and murdering a young girl in philadelphia back in the '70s might be connected. he had worked in fairfield around the time campbell

6:57. welcome back. we are moving you forward with a look at our top stories. >> first, we are staying on top of breaking news out of oakland where a large investigation is under way near 9th and embarcadero. that's where we find "today in the bay"'s thom jensen with what we know. >> reporter: good morning. we are still trying to get more information from the scene here from oakland police, and also from the police officers association. what we do know at this point is some time around 4:30 about four or five blocks from where we are right now, about 5th and the embarcadero, there was an incident involving a shooting, possibly involving police and a suspect. video from the immediate scene shows a white toyota tacoma pickup riddled with bullet holes and windows shattered. there's police evidence markings scattered across the street that seem to be marking shell

casings. again, we got information early on that this was an officer-involved shooting and an officer was possibly down. we did not get a confirmation from opd or the police officers association yet. but we did track an ambulance going from the scene to highland hospital, and there is a strong presence of officers, mostly it looks like from oakland pd, outside the emergency room right now, about four or five patrol cars and several officers out there. we hope to have more information from you on the officer's condition, if an officer was injured, information about the suspect, and exactly what happened here later on this morning. for now, we're in oakland, thom jensen, "today in the bay." >> thom, thank you. we're going to turn to a live look at capitola and pacifica, where there are high surf advisories until 6:00 tonight. and things have really taken a turn. kari joins us with the latest. >> i know yesterday it was clear and the temperatures were warm, so people did go to the
