decide whether the former president remains eligible to return to the white house. nbc's ryan nobles join us with all the very latest on this. ryan, good morning to you. >> reporter: good morning. and the secretary of state in maine said her ruling will be set on pause until the court weighs in. that means, just like in colorado, the former president will still appear on the primary ballot for now. for the second time in less than a month, a state has ruled that former president donald trump was in violation of section 3 of the 14th amendment because of his actions on january 6th and, therefore, ineligible to run for president of the united states. maine's secretary of state, a democrat, ruling that trump should be removed from the state's ballot. in her decision, she writes, the weight of the evidence makes clear that mr. trump was aware of the tinder laid by his multi-month effort to delegitimize the election and then chose to light a match. the ruling is similar to the decision made by colorado's supreme court that also declared

trump ineligible. while both rulings are unprecedented, former trump's name will remain on the ballot more now while the court process plays out and appeals are made. but trump's culpability related to january 6th is something the u.s. supreme court will still have to deal with. trump called the ruling a partisan attack. we are witnessing in realtime the attempted theft of an election and the disenfranchisement of the american voter said trump campaign spokesperson. >> my obligations to the constitution and rule of law come before any other consideration. no other factors could weigh on that decision. >> challenges like these have popped up across the country and most have been denied, including in arizona, minnesota and most recently michigan. hours after the main decision, the secretary of state in california announced that the former president would remain on the ballot in that state after facing calls to remove him.

meanwhile, trump's gop opponents rushing to his defense. >> the idea that one bureaucrat in an executive position can simply unilaterally disqualify someone from office, that turns on its head every moment of constitutional due process this country has always abided by for over 200 years. >> and it is being held on super tuesday, which is march 5th. that may not leave enough time for ballots to be appealed in time for ballots to run its course. >> thank you so much. peter, we do have to acknowledge how strange this is. that's never happened before, right? at the same time, the state laws allow for it and there's never been an insurrection, an attempted coup before. they would say this is unusual. >> this is about who gets to make the termination, whether the 14th amendment should be

brought to gaza. it is the same fate as her 73-year-old husband. his death confirmed last week. president biden saying the death cuts deep and vowing to bring remaining hostages home. presumed captured including don alexander who is i presumed captive in gaza including edan alexander in new jersey he turns 20 today in captivity. >> i decided that this year i'm not going to make edan's birthday cake. it's making me too sad >> reporter: meanwhile, a former hostage is speaking out, detailing the grueling conditions she went through while in captivity for 54 days comparing her experience to the holocaust or calling when a surgeon operated on her hand without anesthesia telling her you're not coming home alive it comes as israel in a rare move is admitting serious mistakes in the war, saying the

today israel and hezbollah both say they have been exchanging fire all morning as fears of a regional war continue to climb. >> just awful scenes on all sides. thank you. turning now to another war, the war in ukraine russia unleashing one of its biggest aerial attacks of the year russia launched over 120 missiles overnight, as well as sending several dozen bomb dropping drones into the capital and other cities there president volodymyr zelenskyy said that most of the incoming missiles and drones were shot down, but an unknown number of people are buried under the rubble. meantime, there is some positive news this morning for potential home buyers. mortgage rates dropped for the ninth week in a row now. they sit at their lowest level since may. here to break it down is nbc's business correspondent brian cheung brian, it is nice to see you this morning a lot of people have been eyeing the housing market this morning hoping rates fall. what do lower means for those

folks? >> maybe bring in the buyers from the sidelines into the market it's been a tough 2023 when we consider how high mortgage rates went as this last week. the average mortgage rate is 6.61%. that's down from almost 6.7% this week and down substantially from the 7.8% just two months ago. if you put this into dollar amounts, if you are talking about a $400,000 home, 20%, this is a savings of $255 a month this is really good news for people that have been looking on the sidelines and saying that mortgage rate is a little too high, good news for them when we look to 2024, what the federal reserve has been doing is talking about the potential for interest rate cuts that could mean mortgage rates might go down further from here. you could see 30-year fixed mortgage rates tied to what the federal reserve is doing perhaps going down to the low 6s

this year. that could be better news. although, home prices are still broadly high across the board. >> but more people to put their house on the market if they know the rates are lower. >> possible good news for sellers as well. >> brian cheung, thank you very much appreciate it. all right. we have a lot more to get to, including the countdown to new year's eve people all across the country are making their final preparations for the big night and everyone is watching the weather. we have it all covered, including dylan's forecast but first stephanie gosk joins us live from time square this morning. how are authorities getting ready? >> reporter: hey, laura. good morning there will be the security that people see here on new year's eve, things like counter terrorism units, barricades, sanitation trucks blocking

streets and then there will be the security people do not see, plain clothed officers, surveillance cameras there was a big meeting here where people said there was no credible threat. but they do have concerns that the war in gaza could make an event like new year's eve a big target for lone wolf actors and they have been struggling with protests, pro-palestinian protests it is the kind of thing law enforcement is concerned about in other large cities like boston and chicago in las vegas, they're expecting up to a half a million people on the strip there as well. and you will see similar levels of vigilance in all of those cities, laura. >> so that's the security. but what about the fun, stef what can crowds look forward to? >> reporter: oh, yesterday was one of my favorite days in times square it was good riddance day that's where anything that happened in 2023 you say good-bye to and get rid of 2024. today there is another annual event.

of the year. they are expecting more than 2.5 million passengers to go through tsa checkpoints. here's the problem, peter. earlier this week, they said we're not expected to be as busy bigger picture now if you compare that to a year ago, more than a half million passengers per day more, which is an astounding increase. that is more than what we saw before the pandemic in 2019. the sheer number of volume is obviously elevated in terms of what airports are seeing here, where the hardest hits have been, miami international is actually the worst yesterday. more than 300 delays it was one in three flights there. fort lauderdale as well followed by chicago o'hare and denver international. nationally, peter, you are looking at 400 flights that are delayed. but the so-called misery map shows it is really only a couple dozen or so, the most at this point for jfk, boston and bwi. there are some considerations right now for visibility

problems in the northeast. also you mentioned those rogue waves out west some rainfall from san francisco all the way down to san diego that could cause delays. by and large right now, things are good i do not want to jinx anyone we're keeping a close eye on what's to come. >> we like to keep the misery map as green as possible. >> let's check in with dylan with a check of the forecast. >> it looks okay for people traveling into the weekend here are our trouble spots light snow stretching into the northwest. here is that storm system approaching the west coast we did see that rough surf, and we have a lot of rain and wind across coastal california. for the east coast, if you do run into any delays today, it would mostly be this morning because of the dense fog we have dense fog advisory we're only reporting visibility of 1.3 miles right now down in richmond, it is less than half a mile that could create isolated delays for the most part, i think we're okay for today

home where four university of idaho students were murdered crews using heavy equipment to tear the walls and flatten the structure. that home where ( the it was inside that home where xana kernodle, ethan chapin, kaon. kaylee goncalves and madison mogen were found stabbed to death in november, 2022. for some in this small community, the removal is a relief. >> i'm glad that it's gone. >> definitely a new start for sure. >> reporter: others expressing their doubts. >> i don't think tearing the house down will help this move on for the father of kaylee goncalves, the emotions are mixed. >> you are happy it is gone. you have negative feelings and emotions with that place but then you see how much joy and love was in that place >> reporter: the family says they're placing their trust in lead investigators yet, caution about the possible impact the demolition would have over the trial.

>> i hope they're totally wrong. they never leave it. they never go back but that's a luxury that we would have and we don't have now. >> reporter: despite the objections from some of the victims' families, the university defending their decision to move forward. >> our understanding from a legal standpoint everyone was finished the house for our community, it was time for the house to go down >> reporter: the school saying it cost them $700 a day to hire security to keep people out. the prosecution, fbi and bryan evidence. in may, a judge entered kohberger's defense teams have visited the house and collected evidence in may, a judge entered a not guilty plea for the defendant. the university saying the fbi plans to use documentation to construct visual and audio exhibits and a physical model of the home for the trial >> they will be able to create that house in every form or manner possible that should be able to answer the jury's questions. >> reporter: the goncalves

will be put on pause until the court weighs in. the former president will still appear on the primary ballot at least for now. she wrote, quote, the weight of the evidence makes clear that mr. trump was aware of the tinder laid by his multi month effort to delegitimize a democratic election and then it is called a partisan attack and has vowed to appeal right chose to light a match the trump campaign has called a partisan attack and has vowed to appeal right away. she made it clear that trump will stay on the primary ballot while the appeals process plays out. the primary is scheduled for march 5th. that may not be enough time to hear the appeal. but at some point, the united states supreme court will still be forced to confront these questions about trump's role on january 6th and if it is in violation of the 14th amendment. that means these challenges could actually have a bigger impact on the general election in november. other states like arizona, minnesota and michigan and now

california have denied those challenges this, of course, all comes against the backdrop of the federal indictment that trump is facing on this very issue. that trial right now scheduled to start on march 4th. laura? >> all right, ryan thank you. meantime, people all across the country are getting ready for the long holiday weekend on new year's eve and police are ramping up security to keep those celebrations safe. stephanie gosk is where one of the biggest parties will take place. you guessed it, times square stef, what is the latest out there? >> reporter: nypd says there is no specific credible threat. in other words, they don't have a place and a time, that kind of threat but they did meet at police headquarters on friday to talk about their security strategy. they do have concerns that the war in gaza makes this event on new year's eve more of a target. specifically, they're concerned about lone wolf actors or protesters, demonstrators that may try to disrupt the event people that come here will see the security presence they're used to seeing in times square the visible presence, counter

terrorism units, as well as those things people don't see, including plainclothes officers, cameras and other types of surveillance there will be similar security in other large cities around the country, including boston and chicago. also in las vegas where they're expecting up to a half a million people on the strip for new year's eve jacob? >> stef, a lot of people are traveling to new year's destinations today what's happening on that front >> reporter: yeah. busy, busy, busy you know, the tsa is warning people just to be prepared 2.5 million people will be using the airports in the next couple of days. we have seen lots of delays this week although, so far we haven't quite hit 500 delays around the country. there are some weather concerns in the northeast you have some heavy fog that may slow things down but at the moment, things are moving more or less smoothly and there is some good news on
