rest of the bay area before we clear out the day. we are seeing rain over santa rosa, marin county and extending off towards the north. once again, that is the only spot where we are seeing the rain for now. temperature wise we are headed for the upper 50s and low 60s, and we will have more cold mornings ahead. cinthia, you have news for bart riders? >> yeah, it will run from hayward to daly city. those much you running from berryessa, you will have to get on the richmond bound train and transfer from that. the rest of the commute clear as we go into the thursday, and we will watch the build and be back with another report. back to you. police officers met with dozens of protesters. >> this is in an effort for the

preparation of the con strupbtion for student housing. a live look now at video overnight showing crews clearing belongings from the park. many of the items were placed into boxes and hauled away, and trees are being removed. this unfolded just after midnight as police and chp officers barricaded every street within two blocks of people's park. there have been clashes with police officers. >> we hope they leave peacefully. >> several streets surrounding the park will continue to be closed to traffic for the next three to four days while crews build a parameter comprised of

double stacked shipping containers. an appeals court blocked the plan to build a complex for its students at the park, and governor gavin newsom is in support of the university's plan. the university cannot begin construction until after the issues are resolved. ahead in our next half hour, thom jensen will have a live report from that scene which is growingly chaotic post the midnight hour. we are expected to hear from the men accused of killing tuan le on friday.

three suspects are facing charges for that death. mark sanders on your screen set to be arraigned today. we also expect allen brown to appear in court as well. the investigation, police say, is far from over. >> speaking at the elected district attorney of alameda county, i will leverage the full weight of my office against these people who we believe ruthlessly murdered an officer of the law. >> the case is still ongoing, and more arrests could come soon. and a police chief is urging changes that would allow them to disclose additional information normally redacted in complaints made public. back in november a former police officer mcnamara was released after racist text messages were

discovered, and the publicly released texts required redaction, and the exchange was with an officer employed in another state. to their knowledge that person is no longer employed at that law enforcement agency. there's an ongoing investigation into a current employee that received messages from mcnamara, and he said that investigation is subject to legal rules of limited release. the naacp says this is a step in the right direction. >> we want to make sure justice was given out equally between all the officers involved, and often what we see he's not able to release that one officer, but

there were two other officers involved, and if we know everybody then we know what is going on. >> the chief previously announced he was working to strip mcnamara of his certification. and then this comes as a record-setting 300,000 migrants crossed the border last month, and house republicans promise impeachment for alejandro mayorkas for not dealing with the crisis, and then they have a border funding plan they have yet to take action on. >> our administration under president biden's leadership has fought for the long-needed fix since day one, when president biden on the first day of his

administration submitted a comprehensive immigration reform bill to congress. >> senate majority leader, chuck schumer, says the group is close to a border deal and passing a budget that avoids a government shutdown. they have until january 17th. a man is behind bars after threatening remittive swalwell. michael shapiro left threatening voice mails threatening the lives of his children as well as swalwell. in a statement he noted that quote, there's no place in america for threats of political violence, adding it's important to, quote, resolve our differences at the ballot box. shapiro was previously charged in a 2019 threats case. by the way, let's take you live outside to san josé. looks like a clear night.

and the s&p 500 was off almost 1%. big-name tech stocks such as apple are struggling to start the year as valuations may be over stretched, and there's uncertainty when the federal reserve may start to cut interest rates. apple lost more than 4% this week. we have hiring in the private sector. and reuters reports apple is drafting terms of a settlement in a case alleging the company routinely and knowingly kept a 30% commission for itself letting the scammers have the other 70%. the lawsuit covers anybody that fell for the scam between 2015 and 2020, and callers would sound urgent and fool people into buying itune cards.

also, coming along with chilly temperatures that will continue into next week with frosty mornings ahead as those temperatures continue to drop. right now we are seeing another cold front coming through out ahead of that, and we are seeing the clouds and a little bit of spotty rain, and a quick look at storm ranger shows it's move into parts of marin county and santa rosa and making its way closer to napa within the next hour. we will be watching out for that, once again, very light rain. then we are headed for temperatures near 60 degrees all around the bay area. we will continue to see weather like that into the weekend as well as tomorrow. not much of a change temperature wise. we are also going to see at times off and on light rain, and another round possible early tomorrow morning, most likely before many people are up and out the door. as we go into the rest of the weekend we will see another system once again coming in on saturday then clearing out for sunday. early next week the atmospheric

river will be to the north and dipping to the south eventually, but it will be weakening and will keep rain chances in the forecast for the middle of next week. chances of rain between now and sunday, looks like 0.1 of an inch of rainfall, and it will be a better deal for the sierra that has been lacking a lot of snow. we could see six to eight inches of snow this weekend in the sierra, and then taking it into next week the storms are expected to give about two feet of snowfall. great news looking ahead. look at our temperatures. it's going to be so chilly. we talked about the frosty mornings, and that's because temperatures will be just above freezing for a lot of the inland valleys, and i wouldn't be surprised if spots in the north bay valleys were below freezing. the next several days san francisco will stay in the 50s.

and temperatures going from mid-40s at 8:00 to 56 at noon and then upper 50s throughout the rest of the day. that's what we will see across much of the bay area, a cool afternoon, breezy winds and sunshine. eventually that rain will be coming back, and i will have more on that in a few minutes. cinthia, seems like traffic is so far so good. >> yeah, green on the radar and sensors, and everything looking smooth around the bay area. let's look at the toll plaza. san mateo bridge, moving smooth. the drive times, richmond bridge under a ten-minute commute as you cross into the bay bridge into san francisco. >> cinthia, thank you. this morning we continue to follow breaking news in the ongoing battle to control people's park at uc berkeley.

overnight the university closed off the area. >> and arrested a number of people, the berkeley police did, and thom jensen is live. do you have new information about the those arrests? >> reporter: yeah, scott and kris, good morning. we learned the police did arrest seven people all charged with trespassing, and two also charged with the failure to disperse all misdemeanor charges. they have successfully cleared the park of everybody and cut down the trees they need to cut down for the housing project. a lot 6 work still going on here. take a look at the video we got that came in overnight that showed crews moving in and tearing down unoccupied penitentiaries, and belongings placed into boxes and carried away. chp officers barricaded two streets in every direction from

the park, and many opposed with the building of the complex here have been showing up at times and clashing with officers. >> we have an urgent need for student housing at uc berkeley. the university is donating a good portion of the land to a nonprofit developer to create new housing for low-income people, and two-thirds of the park will be kept for its own space. it's an important project for the university. >> reporter: the spokesperson for the university also told us the people knew they were trespassing and knew they had to leave and refused to leave and that's why they were arrested. several streets surrounding the park will be closed to traffic for the next three to four days while crews continue to build a parameter of double stacked shipping containers, and they are going to want to stack

containers where we are standing right now. last year the state appeal's court blocked the university from the project that is approaching $400 million to build a 17-story complex for students at the park, and housing about 1,100 students. after its ruling the supreme court decided whether or not the college could continue to build the housing here, and governor gavin newsom is in support. the university cannot begin construction until all the issues are resolved. you can see that these are being double stacked here, these containers, and they will be, again, taking three to four days to complete this work. the kwraoupt will have to wait until all the legal disputes are settled before they can actually begin the construction on that housing project.

meanwhile, opponents say that this project should not take place, and they should find another location, because this has been a save haven for unhoused folks and also for demonstrations here related to the university and the city for many, many decades. live in berkeley, thom jensen for "today in the bay." >> thank you very much. one of the suspects accused in the murder of an oakland police set to appear before a judge later this morning. >> today in the bay's bob redell joins us from the news room. there could be more arrests even still? >> correct. oakland police say this investigation has not ended and it's still ongoing. as you mentioned, there could be more suspects taken into custody. right now three men have been charged in connection with the murder of oakland police officer tuan le who was working outside

a cannabis dispensary. two of the three suspects are facing murder charges, including this man, 27-year-old mark sanders of tracy who is accused of shooting and killing officer le. a third man is being charged with burglary. the district attorney, pamela price, says sanders is being charged with the special circumstances and special allegations. interim oakland police chief confirmed one of the suspects was arrested with officer le's handcuffs and that's reports of sanders' violent past is true. >> he has the history of the killing of another and associated violent crimes. >> speaking as the elected district attorney of alameda county, i will leverage the full weight of my office against these people that we believe

ruthlessly and wantedly murdered an officer of the law. >> he could serve life without the possibility of parole. sanders and brown have their first court appearance later this morning at 9:00 in oakland. >> meantime, bob, we have a new development in the killing of kevin na sheeta. the move by the d.a.'s office mean the two do not any longer face the possibility of life in prison if convicted. the charges are being dismissed because they could not be proven beyond a reasonable doubt, but

the men face other charges. the defendants' attorney argue a third suspect, gilbert, killed the officer and has not been found. two boys were killed in antioch. we are hearing from the father that was the driver of the car the boys were riding in. last night a group of about 50 family and friends gathered at the waterfront park in bay view and sent balloons in the car for the 13-year-old, a basketball player raised in hunter's point. on december 22nd, the father, took he and his brother to the store and back and their car was t boned by an suv. the people in the suv ran from the crash and the father said the other driver flew through

the intersection. >> it took about ten seconds to really come to and to get over the initial shock, to look to the right and see the whole right side of the car crush my babies, and that's tragic. >> i can't imagine what he's going through. we did reach out to antioch police for an update on the investigation and have not heard back. we will update you when we do. there's an outbreak of the avian flu that is ravaging chicken farms in sonoma county. experts are predicting it will spread across the bay area. more than a million birds have been euthanized in sonoma county alone since thanksgiving. it resulted in tremendous hardship for farms and grocery

stores have been completely out of eggs. the director of the farm bureau says consumers will have to share the pain. >> there will be a shortage of eggs, and probably an increase in the price of eggs, and sonoma county that has been hit, so we will see the outfall of this horrible pandemic without the industry. >> all right. let's open up our curtains and look over san francisco this morning where it's super clear. kari, we know sometimes super clear means super cold. i had to sleep with socks on last night. >> yeah, chilly temperatures. you want to bundle up if you are going out to the warriors game tonight. it will be in the mid-50s in san francisco. we are also going into the night

with winds gusting up. it will be beautiful weather for the 49ers game on sunday. 60 degrees and breezy throughout the day. this is a look at the forecast for big sur. we will see temperatures on friday a little milder compared to the rest of the weekend. once that rain comes in on saturday it will only reach up to about 54 degrees on sunday. if tahoe is in your weekend plans, make sure you are also aware that there will be some snow showers coming down on sunday, but clearing out in time for you to head back to the bay area. cinthia, are you watching out for drivers in the east bay? >> yes, this is the alert for next weekend. we have seen it in the past. it causes a lot of trouble. it's southbound 680. we are going from the 580 connector all the way down to sunol where it connects with 84.

this will be next friday night until tuesday morning, so martin luther king, jr. will be closed. you can come down 580 and down 84 into parts of the east bay and south bay, or 238 goes down into fremont or 880. those are your alternates. as far as events going on around the bay area, you will have to look out for local traffic. there's a game at chase center so we could see a backup on 280 and people will make their way home on the bay bridge. and then there's a sharks game tonight. if you are looking in the mirror and complaining about your breakout, you should know there's a vaccine that could clear acne. we're moving you forward with

figures, some of who had previously been reported. laura jarrett explains. >> this is the first time deposition transcripts and other confidential material previously under wraps are coming out, and they are stemming from an old civil lawsuit brought against elaine maxwell. >> ahead on the "today" show, the people named in the first release of documents and how they are responding, coming up to 7:00 right after "today in the bay." former president trump asking the supreme court to overturn colorado's ruling that removed him from the ballot. the state supreme court ruled last month that trump is disqualified from the ballot because of his actions leading up to the january 6th attack. the colorado panel based its

rainfall deficits where now santa rosa has caught up to normal. we are still running a rainfall deficit in oakland. we need another 3.5 plus inches to catch up for where we should be this time of year. it's not so bad for san francisco, lacking an inch and a half, and concord needing about 2.5 inches of rainfall to catch up. it's mostly a dry start for many of us heading out the door and temperatures are chilly in the low to mid-40s. we will have more cold mornings ahead. there's another cold front coming in right now, and we could see clouds and spotty rain for parts of the north bay and along the coastline. we are seeing some of the light rain moving through parts much sonoma county, and we will be moving over towards napa county and it's already starting to fall apart. the rest of the day is sunny as our temperatures head up to close to 60 degrees. we will see about the same thing

tomorrow, not a major change temperature wise, but then looking at our hour by hour forecast, it does show that late tonight for parts of the north bay we could see light rain, and most of it clearing out before sunrise tomorrow and then the rest of tomorrow afternoon is albright and sunny. now, on saturday, once again we are watching out for more rain coming during the afternoon, but it looks like it's clearing out fairly quickly. sunday is dry, and monday will continue to watch out for rain chances throughout next week. once again, we are expecting some saturday showers, and this is a look at how much we may see. less than 0.1 of an inch for most of us, and so once again it will be very light. if you have not yet picked up the holiday decorations in the yard, i think you will be able to get it done. we are going to see some of the showers moving in. sunday we are dry, and other rain chances for the middle of next week, and look at how cold it will be, low to mid-30s and other chilly temperatures in san

storms into rain makers. the storm that just brought the rain into the bay area on tuesday will meet up with the storm that is lifting out of the gulf of mexico, and will possibly bring an end to the snow drought for the northeast this upcoming weekend. for new york, philly and baltimore, this is the longest stretch they have had without a day with one inch of snowfall. it has been 705 days since significant snowfall for many of the cities. snow coverage today is much less than it was last year at this point. in 2023, 36% of the country had snow on the ground, and now it's at about 20%. looking ahead to year 2078, models look like the snow drought may increase to 7% to 42%, so you can see how climate
