right now at 5:00, honoring a fallen hero. a public memorial service in oakland today honoring the officer shot last month in the
5:01 am
line of duty. we're live this morning with how officer tuan le is being remembered. and the start of the next fiscal year here in california is still months away, but there's going to be a lot of discussion about cuts and the education world is bracing itself. tracking the return of rain. a live look outside. new storms making its arrival as king tides return to coastal areas. meteorologist kari hall is tracking conditions for us this morning in your neighborhood. this is "today in the bay." here we go, wednesday morning. 5:00. thanks for starting your day with us. i'm laura garcia. >> i'm marcus washington. we're going to get to the commute in just a bit with you, mike, but first let's talk about that forecast. we've been talking about the rain all week. >> it's dry now, but you want to grab the umbrella if you're getting ready to head out the door. it is looking nice and clear as we get a live look outside in san jose. and we're also feeling the chill in the air as well, another cold
5:02 am
morning. as we take a look at what to expect, once again, not a lot of rain coming down. it is still well to the north of us. as we go throughout the rest of the morning into the afternoon, we're going to see this rain coming in and affecting us for much of the day. that's round two of the rain. we had round one yesterday with some light showers. a bigger storm is on tap for the weekend. that's going to be moving in on saturday. looking at today's forecast, we'll start to see more coverage of the rain around 8:00 to 9:00, and then going into late morning, into the afternoon. it still will continue even for the evening commute and there may be pockets of heavy rain, but not a really big soaker here. we're going to start out tomorrow morning with some chilly temperatures, and also looking at more rain ahead. so i'll have more on that in the full microclimate forecast in a few minutes. mike, you have info on a closure in the tri-valley. >> overnight road work northbound, we've had that for the last couple of weeks,
5:03 am
sticking around past the 5:00 clearing time. they've got to finish up. the sensors just lit up on the map there, so they may indeed trigger the reopening. we'll double-check that. southbound, that will be closed. a big warning, all weekend, starting friday night through tuesday morning, likely, likely to open a few hours earlier than that, but that's the section for 680 that will be closed. 84 or 580 through castro valley are your alternates. i've got it on twitter, i guess x i have the maps for you to prepare. we're looking at a disabled vehicle, part of the caldecott tunnel. back to you. in a few hours, family friends and colleagues will pay their respects to fallen officer tuan le, killed in the line of duty while responding to a burglary at a cannabis dispensary. >> bob redell is live for us from outside of three crosses church in castro valley where services will be held this morning. bob, good morning.
5:04 am
>> reporter: good morning to you, marcus and laura. yes, at 10:00 this morning the public will gather at three crosses church behind me here in castro valley. this will be an opportunity for members of the oakland police department, other law enforcement agencies, dignitaries, including government and community leaders, along with the public, to pay their final respects for officer tuan le. he was shot and killed while responding in plainclothes to a burglary last month at a cannabis business in oakland. officer le was 36 years old, he was married. he had graduated from the police academy in 2020. he was working as a community resource officer the past two years, trying to build positive relationships between opd and oakland residents. those who knew officer le describe him as a dedicated officer and a familiar face in oakland's asian american community. le is, sadly, the 54th oakland police officer to die in the line of duty and the first killed in nearly 15 years.
5:05 am
marcus, laura. >> very sad. bob, do we know what the latest is on the investigation into the murder of officer le? >> reporter: we do. there have been a number of arrests, laura. law enforcement has arrested two men and charged them with the murder of officer le. both appeared in court last week, but they did not enter pleas. two other men are facing charges in connection with that burglary. back to you. >> bob, thank you for that. well, the funeral services are being held today. nbc bay area will stream those for you. we'll have that on our streaming platform. you can see there on roku, fire tv, as well as nbcbayarea.com. it's scheduled to get under way at 10:00 this morning. you can go to nbcbayarea.com for that information. after a heated and emotional debate, an agreement in san francisco over a revised middle east resolution. >> there are eight ayes and three nos. >> the resolution is adopted as
5:06 am
amended. >> supporters applauded last night when supervisors passed a measuring calling for a cease-fire in gaza. people on both sides of the debate says it falls short. it condemns hamas terrorists and israel and calls for the removal of leaders on both sides. it calls for the release of hostages. at times supervisors were heckled. in the end, advocates called the vote an important one. >> yesterday in committee, supervisor dorsey mentioned these attacks on women and members of the public shouted him down and called him a liar, which is really beyond frightening to me and obviously happening at this moment in time to me right now. >> san francisco took action that really sets a tone for us to build towards a peace agenda, to build towards recognizing the humanity of all people. >> san francisco joins the cities of richmond and oakland in passing resolutions against the middle east violence.
5:07 am
in each case, critics have pointed out the debate is sidelining more pressing local issues. today is the deadline for governor gavin newsom to lay out his budget proposal and it comes as the state is facing a very big deficit. now, they say that those cuts are inevitable and public school leaders are bracing for impact. >> "today in the bay"'s kris sanchez joins us from the newsroom with more on what kinds of cuts we may be looking at. >> reporter: california is staring down a $68 billion deficit, and after the governor lays out his plan, there will be months of back and forth. here is a live look at the state capitol, where we expect the budget unveiling to happen later today. today is the governor's deadline. now, the california school board association is trying to get ahead of talks in an effort to protect education. that group is advocating that the state dip into the $8 billion reserve dedicated to education, or take the cuts from programs that haven't yet been funded so that the impact feels
5:08 am
like less. republican senate chair says that preserving education should be a priority. >> i would hope that the impact on education would be the very minimum. we do have a $68 billion deficit, so it has to come from somewhere. >> reporter: so why are we in this position? it's because we began the budget year with a $26 billion shortfall from this year, which is not ordinary. according to the nonpartisan legislative analyst office, tax revenue was hard to tally up because we got so many extensions to file our taxes and to pay them after those severe winter storms. when governor newsom reveals his budget, we'll cover it here and online. >> thank you so much. powerful winter storms are impacting a large segment of the northeast this morning. many areas currently without power and at least four deaths tied to the systems.

now, this is video of flooding in maryland where those conditions intensified overnight. new jersey's governor has already declared a state of emergency, with winds topping out near 70 miles per hour. back down to washington, d.c., torrential rains knocking down trees, making those driving conditions difficult. the capital will remain under a flood watch until later this morning. we're bringing in meteorologist kari hall. it seems like those problems there, they're not over yet. >> they're not over yet, and we're still seeing more storms developing. they also had a big severe storm outbreak across the south. as we take a look at what to expect for us for this morning, we are seeing some clear conditions here, but then looking at all of the snow that's been moving across parts of the upper northeast, and we're also seeing it moving off the atlantic coast. but still the storm system is continuing to bring a lot of problems. once again, we are starting out
5:10 am
fairly clear here, but we are watching the approach of some light to moderate showers that will be here over the next several hours. and then looking at petaluma, what to expect this morning, temperatures in the low 40s right now. it is mostly cloudy and eventually we'll start to see that rain coming in. our temperatures today headed for the mid to upper 50s, but some of us will only be in the lower 50s. we'll talk more about that coming up. mike, how is the issue in the caldecott tunnel? >> it just cleared from the chp report. there was never any slowing westbound. one of the bores had a disabled vehicle in the tunnel. that cleared without further incident. 24 is fine in the commute direction out of orinda, toward the bay bridge. a smooth flow pretty much all avenues toward the bay bridge. over here, there was some slowing, it's still there, getting out of san francisco north 101, approaching the golden gate bridge. we take a look at it from our perch up here from sutro, and we're looking at a smooth drive with taillights heading into the north bay. there were some crews

5:22 am
for today, and tonight as temperatures drop, we'll have a frost advisory in effect, once again, for all of these areas shaded in the light blue color. we could see temperatures in the low to mid-30s, and we do have some more cold mornings ahead. our next round of rain comes in on saturday. it starts in the morning, continues through the afternoon. and then it tapers off early sunday morning. next week we also have some light rain in the forecast, but with the chilly air, we will have some lower snow levels, especially for the sierra. looking at our seven-day forecast, we have the rain coming in today, and sunshine coming back tomorrow. and just a few clouds, a few more clouds on friday. on saturday, it's going to be raining, but clearing out on sunday into early next week. and for san francisco, expect more of the same temperatures that we're seeing for some of the inland areas like concord and santa rosa. we're going to see that along the coastline as well. mike, do you still see

that intensive care, but did not notify the president right away about that, either. austin transferred responsibility to his deputy, but even she did not know why and she was on vacation outside the united states. now, austin is the fact's top civilian commander of the military. he outranks every general, every admiral. only one person outranks him, and that's joe biden. to have him out of commission or under anesthesia without telling the president is a problem. democratic senator richard blumenthal says austin owes congress and the american people additional facts to ensure that he can continue to serve. former president trump says he wants to speak in the federal appellate court in washington when it continues the hearing thursday, listening to arguments from trump's team that presidents are completely protected from all laws for

anything they do as president. there's no testimony in this kind of court case, but there are closing arguments, and trump apparently would like to deliver part of that closing argument. >> it's a very sad thing that's happened with this whole situation, when they talk about threat to democracy, that's your real threat to democracy, and i feel that as a president you have to have immunity, very simple. >> now, the judges on the three-judge panel heard the arguments yesterday, but they seemed unconvinced. one asking, how is it we ask a president to take an oath to uphold the law, but the president doesn't have to follow the same law himself? one judge asked if a president would be allowed to order somebody's murder and not have to face charges over that. trump's attorney said, if the hypothetical president wasn't impeached first, then, yes, he would not face any criminal liability for murder. now, that's a legal stretch, but it sticks to the legal theory that the attorney was giving the

friday. we're going to see that later this morning coming in. and we're starting out with very chilly temperatures. i want to show you what to expect as you're stepping out the door, with rain chances increasing today, as well as higher wind speeds. now, we'll also have king tides for today through friday. that could create some flooding in low-lying areas along the bay shore and the coastline. then we'll see more rain and wind likely in the forecast from friday night through saturday. now, looking at this next system coming in, we're seeing the rain still well to the north of us. only some spotty sprinkles along the coastline and parts of the north bay for now. but eventually by 7:00 to 8:00, we'll start to see some lighter rain coming in, and then it spreads into parts of the east bay, the south bay by noon, and it's going to be off and on. there will be some breaks of plenty opportunities to maybe even see some rainbows today between those showers, but we are going to see at least the chance of rain into this evening. and then as we take a look at how much rain we could expect, most of us are looking at light

that continues throughout much of the day, clearing out for sunday, with more rain ahead. our seven-day forecast shows temperatures in the mid to upper 50s, only up to 60 degrees on friday. but then our mornings will be very chilly, dropping down to the 30s. widespread rain and potentially heavy at times on saturday, but then early next week we are back to the sunshine. mike, you're seeing a buildup out of the east bay? >> right, which we expect. this is not due to any disabled vehicle. that cleared without a problem on the bay bridge. this is just the timing issue, 5:52, a mild build out of oakland, a mild build for highway 37. more slowing westbound 80, san pablo. there is a minor crash. should be on the shourl, but a distraction. and the build through contra costa county for highway 4. no problems for vasco, but a little slower. 101 shows the typical pattern. the other issue for the south bay, north 87 past downtown, approaching sky port, there is a disabled vehicle that might be blocking one lane. you do see a build.
