as we speak in state's republican primary, here's a look at polling locations across the state right now, former ambassador to the united nations nikki haley trying for a last-ditch upset over former president donald trump. every other republican candidate has bowed out at this point. to watch tonight are independents, called undeclared. >> there are a lot of them, undeclared voters make up 39% of all voters in new hampshire and they're allowed to vote in today's republican primary. leading us off this hour is garrett haake. and mike memoli. garrett the news this afternoon is that nikki haley will not drop out even if she doesn't win new hampshire. what's the state of the race right now. >> reporter: you don't want to set the expectations that you're out if you don't win. haley is on to south carolina,

her home state, then on to super tuesday after that, the trump campaign is making it pretty clear they want to make haley's life miserable not only here in new hampshire but every other state she competes, they think they can knock her out. what happens if donald trump is presumptive nominee in the next couple of months? >> how do you bring them back into the fold. >> they'll all vote for me again. everybody. i'm not sure we need too many. i think that biden is the worst president in the history of this country. but we'll all come back. they're all coming back. >> reporter: a little of projection there, not a lot planned. the former president, joe biden and his record could be motivator to get these softer

republicans and undeclared voters back on the trump train at some later date. >> garrett, mike, there's rye mary today too for the democrats, it's a little confusing, because president biden is not on the ballot, can you explain? >> reporter: yeah, kate, you may remember what happened here in new hampshire fourts year aes, joe biden stumbled his way to a fifth-place finish. he left before the polls closed to go to south carolina. once he was in the white house he directed the democratic committee to move south carolina ahead of new hampshire. but biden then chose not to file to get on the ballot, that's left his supporters here with a few options and they chose to organize a write-in effort. this is risky proposition,

because we've seen in the past, an incumbent who doesn't do well in new hampshire's primary having to struggle to get re-elected, that's the real risk here for president biden. the turnout has been slow but steady, the interesting thing here has those undeclared voters are overwhelming choosing the republican ballot, good news for nikki haley. >> garrett, let's do back to you, you mentioned the high number of independent voters in new hampshire, how they might make tonight's results look different? >> reporter: they're the x factor in this state the whole electorate looks different in new hampshire than it does in iowa, it's a greater population of folks both republicans and undeclared who vote here, who have college degrees, that's been a determining factor in these races and smaller percentage of evangelical

voters, another determining factor, who primarily vote for donald trump in iowa less likely to see that kind of big break toward him in new hampshire. these undeclared voters absolutely critical for nikki haley and very difficult to poll by the way, we have to admit what we don't know, any time you see a poll in new hampshire trying to figure out how these voters are going to vote in which primary is a difficult question. >> a really important point to end on. our decision 2024 coverage continues later this hour, ahead we'll be joined by chief political analyst chuck todd, what he's watching as the ballots are counted tonight. the excitement tonight begins in just a few hours, join kristen welker, tom llamas and hallie jackson for special coverage of the new hampshire primary starting at 5:00 p.m.

eastern on nbc news now. millions of people on the west coast are cleaning up from some of the worst flooding they've seen in decades. >> one of the hardest hits spots was san diego, nearly 3 inches of rain fell in just 3 hours, more than a month's worth of rain the city typically sees in one day. >> people had to. be rescued from flooded homes and streets. cars were literally swept away in the weather. meteorologist michelle gross hahn has been tracking this system for us, those pictures are stunning. we understand there's a break maybe in the rain today, is there more coming. >> there's a more coming. a break on the west coast, that's good news. most of that rain is moving to the southwest, the heavy rain is the southcentral states into the mississippi valley, the tennessee valley, ohio valley and then into the northeast, a lot of rain here over the next several days, could see 10 to 12 inches of rain in some spots.

darker colors, reds, oranges along the gulf coast that's where we're expecting the most amount of rain. there's that reprieve on the west coast, that's good news, rain falling in the southwest and even some thunderstorms along the mexican border there, we're looking at higher elevation snow, southcentral states. some storms, we could see strong to severe storms as we go throughout the overnight hours, there's that west wallop, we're seeing that break today but tomorrow we're seeing heavy snow pushing into four corners today by tomorrow that next storm moving onshore, lot of rain again over the next several days. intense rainfall rates may cause flooding. here's that higher elevation snow, purples and pinks, the highest elevation in the mountains. back to you both. >> michelle grossman for us,

thank you. one of top issues for voters this election is the economy and there's good news to tell you on that front. >> have you noticed your 401(k) may be creeping up lately or increasing pretty well the stock market has been a real hot streak. the dow closed above 38,000 points for the first time ever. the s&p 500 soared to new heights. today, the markets are more mixed. >> what does it mean for your bottom line. let's bring in christine romans. positive vibes on wall street. >> positive vibes on main industry, too, that's rare, too and this time we see these consumer sentiment polls are showing rapid improvement for how people think. a couple of reasons why -- look at that. michigan consumer sentiment index up over 20% over last two months. that hasn't happened since 1991. something has changed for people.

i've been looking at a lot of different categories, eggs for example, egg prices are down compared to last year, those egg prices are down. gas prices are below $3 a gallon in more than 20 states. over there in new hampshire, gas prices are $3.03 a gallon. new hampshire has the fifth unemployment rate. after a whole year last year, of everyone worried about a potential recession that never happened, all that negativity is starting to fade. >> so, talk about the housing market, because that's not all good news, right. >> yeah, the housing market is where you can still see the impact of the federal reserve campaign to cool mortgage rates. now, maybe they'll improve later this year, that's the consensus and that could make some, i don't know, some thawing in this very cold housing market. last year home sales, the lowest since 1995. but home prices are still high because there's not a lot of

inventory, so -- this is sort of a good math on the back of the napkin maybe, if you look at a typical median home price, if you had mortgage rates go down another point and a quarter, that would save money on a new mortgage, that starts to encourage people to either refinance or maybe buy a house. that's not happening yet. maybe that's down the line. >> christine, thanks. today's money minute. fcc is cracking down on a major tax software company. pippa stevens joins us now. the federal trade commission has banned turbo tax from advertising their tax services as free the agency said intuit, may run services that people may

the supreme court has weighed in on the heated battle between texas and biden administration on the u.s./mexico border. the supreme court voted if favor of the white house 5-4. on monday justices ruled in favor of the white house allowing federal agents to cut or remove razor wire installed by texas governor abbott to deter illegal crossings in his state. guad joins us now. good to see you. what more can you tell us about this ruling? >> reporter: part of ongoing battle between the state of texas and the federal government. governor abboth has used state resources to patrol the border, to enforce immigration laws and this is just another one of those battles, it's not going the change things dramatically today here, you can see so much the wire that has been installed

by texas state authorities, one of the areas where the wire was cut when we had that surge here in eagle pass, texas national guard came in and put in more wire. what's interesting, kate, as we discussed this and after we report that the supreme court has ruled that border patrol can cut this wire if they need to, just down from where i'm standing we can see texas state authorities it looks like men and women in uniform ix, texas national guard, installing more razor wire in an area where there's container in between the two bridges, as we discussed this ruling they're still putting up more razor wire in this area that has been taken over by texas authorities. a statement from dhs informing that in order for them to patrol this area and to enforce immigration laws they need to have access, having the ability

to take this wire away if they need to do so, and of course governor abbott and the state attorney here also releasing statements against the supreme court ruling and we can expect this to be an ongoing battle between texas and the biden administration. >> what are we hearing from administration officials? >> reporter: well, as of now, as i mentioned because this is just one part of this ongoing legal battle, for now they still have to wait for other rulings, we are the barrier in the water down the stream from here where the federal government sued texas for installing that barrier and the fact that texas took over this part, the federal government asking texas state authorities to turn over control of the park among other battles that continue to be fought in the kurt for now, kate. >> guad, thank you. the historic trial of the mother of a convicted high school shooter is under go in

michigan. jennifer and james crumbley are charged with involuntary manslaughter. their son was sentenced to life without parole last month for killing four people at oxford high school. james crumbley will be tried separately in march. adrienne, can you remind our viewers about the case against jennifer crumbley, the mom. >> reporter: let's start with the first question, and remind folks about this case, it takes our viewers back to the year 2021. that's when ethan crumbley, two was then 15, walked into his high school x oxford high school here in michigan, he shot and killed four of his classmates, he injured several others, ethan crumbley was sentenced last month, he's serving life without the possibility of parole right now, he's now 17, he was 15 at

the judge granted his defense request to continue his arraignment until next month. his next scheduled court appearance is february 29th. he remains in custody on a no bail status. steps away from the courtroom where he made his appearance this morning, the impact of the mass shooting last year still deeply felt by county leaders and law enforcement officials. in the morning meeting, the border of supervisors commemorated the lives lost a year ago today with a moment of silence. the victims' names were read aloud. the sheriff's office was recognized for their work a year ago along with other first responders. the sheriff says a year later, the county is still healing. even she is still processing the images and sounds from that fateful day. >> the memories of being on site and seeing the devastation, nothing ever prepares you for that. regardless of the training that you have received.

it's really hard to see. then just the families learning of their family members that were murdered was really hard. the cries, you never forget them. >> reporter: what she hopes to see moving forward is more collaboration and trust with her office and the farm worker community. today marks one year since that mass shooting that left seven dead and one injured. ginger conejero saab, nbc bay area news. >> thank you. in the east bay, an end to a tense standoff overnight in brentwood. you can see the heavy police presence in this video, including the s.w.a.t. team. the standoff started yesterday afternoon and it ended during the overnight hours. deputies are not revealing if arrests were made or if anyone was hurt. the sheriff's office so far is not commenting.

registered republicans, this is i think the real problem. john mccain was competitive with republicans and dominated independents. if she dominates independents she lose republicans by 40 points, what i'm looking for tonight, is it going to be high turnout? the fascinating thing, you covered a lot of campaigns, kate, when you hear these, oh, a high turnout, anecdotes that support theories of high turnout. it doesn't have the same feel. the last days of the new hampshire primary are filled with multiple debates. nikki haley got out of those debates, these voters wait until the very last moment to decide, i think she just let her foot off the gas here in a way that i think looking back they'll regret some things they could have done. >> nikki haley has said,

regardless of how tonight pans out -- >> what else are you going to say before the voting. >> let's listen to what she's been saying. >> we're going to south carolina. we have put in the ad buy there, this has always been a marathon, it's never been a sprint. we want to be stronger in new hampshire and we'll be stronger than that in south carolina. >> she's trying to appeal to voters, if she gets blown out tonight, what do you think happens? >> a double-digit loss -- look, it really is -- it depends on what she wants, if she still wants to work in a rap party that donald trump runs, then the prudent thing for her to do is to get out, but if she's decided, look, i have no future there, my future is rebuilding the republican party beyond

trump, then there's incentive to stay in this race, so i think some of this -- like, we can say, okay, we can make the political calculations, it comes down what is her ambition and if she wants a future in trump's republican party she might have to get out tonight. >> you were speaking with voters about the possibility of a biden/trump rematch. >> i'm open to a third party candidate. >> you want to kick the tires on a third candidate. >> if biden and trump are my choices, yes. >> i can't pull the leffler for someone i don't believe in. >> you'd like new people. >> new people, fresh minds, fresh ideas. >> the best we got? come on now. >> you're hearing some frustration there. >> what was great there, we went to this bowling alley, there weren't candidates. in a good way, you got the

under question. steven romo reports. >> reporter: in the wake a of one of the deadliest wildfires in american history last summer, big names made big pledges to help people recover in lahaina and the island of maui. among them, amazon ceo and multibillionaire jeff bezos and his fiancee lauren sanchez. they pledged a whopping $100 million for recovery efforts. but months later, the question, where exactly, if anywhere, did that money go? in their initial post, the couple promising not a one-time lump sum but multiple donations over, quote, the coming years as the continuing needs reveal themselves. a spokesman for bezos telling nbc news the couple donated $15.5 million to the bezos maui fund which provided funds to at least four local organizations. nbc news independently verifying

the maui food bank did receive a donation, but the lack of transparency with the community on how exactly the money will be used is leaving a bad taste in the mouth of hawaii state senator angus mckelvey. >> what hurts us is when you hear, $100 million, why are you looking to raise taxes for lahaina, you got $100 million. >> reporter: bezos, has announced several large donation pledges in recent months as part of his earth fund. >> do you plan to give away a majority of your wealth in your life. >> yeah, i do. >> it's not a question of bezos not being truthful or not making good on his promise, it's about the way in which the money is actually transparentally dispersed. >> reporter: these pledges getting a lot of positive press
