and we are talking sports. we are talking las vegas, we are talking the a's, not the niners. we'll tell you about a lawsuit filed by nevada educators. also, an iconic restaurant, theatre and cabaret now set to shut down. we're live in san francisco with the recent economic struggles leading to the latest surprising closure. this is "today in the bay." here we are, tuesday morning, 5:00. thanks for starting your day with us. i'm laura garcia. >> i'm marcus washington. we'll get to mike in a moment with the commute. first, let's talk about that forecast. still some rain lingering around the bay area. >> yes, it's still a wet commute for a lot of us, even if it's not still raining, the cars in front of you are kicking up water from the roadways. we are still dealing with a system where the heaviest rain continues for southern california, while we're getting

spotty light showers to start out our day. a look at stormranger, our mobile doppler radar, it's not a lot of rain, and where we are seeing it, it has been very light. so we are dealing with that as you're driving to work this morning, but it is a cool start. temperatures in the mid-40s in san francisco. it is 46 in oakland, walnut creek about the same, and 51 in san jose. a look at our high temperatures for this afternoon, we're staying in the 50s across the bay area, with a high of about 57 in san jose. and there's actually a cold front that's headed our way for tomorrow that will bring not only more rain, but also more chilly temperatures. so we'll talk more about that in a few minutes. mike, you're already tracking a number of crashes in san jose. >> i come in just a bit after you by a few minutes, so we're looking at the rain that did fall on 101 while i was traveling through the santa clara county area. we're looking at slick conditions and one crash here on the shoulder, traveling north 101, just before alum rock. that caused some slowing has it

got pushed to the shoulder. another crash just north of there, i saw the impact of that. i saw the effect of it on traffic as it slowed and getting over to the shoulder as well. a few other smaller crashes, including 280 at meridian that may have activity. and the green highlighting through that one stretch, it continues toward the fremont area. we've had scattered light mist and drizzle and slick roadways. be careful. there is traditional slowing on 280 with whatever goes on with those sensors. a smooth drive through contra costa county as well. back to you. >> thank you very much. breaking this morning, country music superstar toby keith has lost his battle with cancer. ♪♪ ♪ i should have been a cowboy ♪ ♪ riding my pony on a cattle drive ♪ >> toby keith's family posting a

statement overnight saying he died surrounded by his family late in the evening. keith emerged on the country scene in 1993. some of his biggest hits include "should have been a cowboy" and "red solo cup". about a year and a half ago he first announced he was living with stomach cancer. toby keith was 62 years old. again this morning, thousands of people across the bay area are waking up without power after that powerful storm swept through. here is a look at the outage map from pg&e. last check, more than 19,000 people are without power in santa clara county. now, in san mateo county, we're seeing more than 14,000 people in the dark. another 19,000 people without power in sonoma county. there is more than 5,000 in marin county. so in solano county we're seeing about 3,500 people without power. a new obstacle for the

oakland a's and their quest to build a new ballpark in las vegas. nevada teachers are taking a new legal step in trying to shut down funding. >> "today in the bay"'s kris sanchez is here with a closer look at what this means. >> just as las vegas is rolling out the welcome mat for the 49ers, the nevada teachers are trying to roll up the welcome mat for the oakland a's. nevada lawmakers agreed to a $380 million package in public funding toward a baseball stadium on the las vegas strip, that you probably know. the teachers union said this is money that really should be going toward education and other public needs. the a's are not named in this lawsuit, which was just filed, which alleges that the bill to help fund the stadium wasn't passed on constitutional grounds, and that the state is taking on debt that should be not with the state but the county. at the same time, the teachers are trying to put the stadium

funding bill to a public vote and let voters decide rather than allow lawmakers to negotiate the deal. that effort is still under way. they are still gathering signatures for that. it is unclear whether or not that's going to pan out. this could impact the a's timeline. they, of course, want that stadium built by the start of the 2028 season. so anything that comes up between now and then really delays the process. >> thank you, kris. now to a live look at our nation's capitol. later today a full house vote is set to impeach the nation's top immigration official. department of homeland security secretary alejandro mayorkas. the house rules committee advanced the resolution yesterday and now it moves to the floor. if the article passes, it will then be up to speaker mike johnson to decide how soon to send it to the senate. mayorkas would be only the second cabinet secretary in u.s. history to be impeached. republicans argue that impeachment hearings are needed

due to a record high illegal border crossings. happening today, gop presidential contender nikki haley is scheduled to make two appearances here in the bay area. haley is expected to attend the first fundraiser, a luncheon, in san francisco, and then a dinner in atherton. atherton capitalist tim draper is hosting the events along with his wife. the exact locations of each event are not being disclosed and haley is not scheduled to make any public appearances while here in the bay area. another closure hitting home in san francisco, this one involves a one of a kind restaurant, nightclub and cabaret with a remarkable history. ginger conejero saab joins us live in san francisco this morning. this announcement is hitting one community especially hard. >> reporter: that's right, laura. asia sf is a long-running nightclub, as you mentioned, in the city's soma district and it's been around for 26 years. like many of the businesses in

the city that have closed recently, its loss will be felt. it's what it means for the transgender community that may not be so easily replaced. asia sf has been a platform for transgender performers of color who have historically been excluded from other venues of performing arts. you're seeing what it looks like inside the venue, minus the show, of course. performers sing on stage or along the bar area, as people enjoy their dinner. asia sf has welcomed trans performers of color for decades and provided a venue for their live performances. its founder says they have not been able to rebound from the pandemic, so he and his partners have decided to close and enjoy retirement. >> we would love the community to rally around asia sf and come in and see the magic that we create here and fill up all of our reservations in between now and the end of march. >> reporter: the last day is

sunday, march 31st, which coincides with international transgender visibility day, even though the business at 9th and howard is closing, the founder says don't be surprised if asia sf pop-ups will pop up in the future. so we'll still get that feel of what asia sf and the message it's been driving for decades. for now, we'll have to bid farewell. >> i bet there's going to be a big surge of people going. maybe that will help boost them. we'll see. thank you, ginger. happening now in parts of southern california, they're still under a winter storm warning this morning. the rain over the weekend triggering mudslides yesterday and causing major damage to l.a. homes. one homeowner experienced a similar storm over a decade ago putting up retainer walls. the walls worked this time but need some adjustments. >> we put the retaining walls

in, so the retaining walls seem to have worked, but they needed to be extended. they needed to go wider. this went around the retaining walls. >> parts of ventura, san bernardino and riverside county are still under that winter storm warning until tonight. >> the ground is so saturated. let's bring in meteorologist kari hall right now. she's got a look at how it's looking weather-wise. >> some parts of southern california has had 12 inches of rainfall in 24 hours. and we know that's coming on the heels of some already very heavy rain, and the storm is just parked there right now. so that's the same system we had over the weekend, and you can see the rain that's just streaming in to southern california, and then the change in colors show that we are getting some snow for those upper elevations. so still a lot going on there. we'll continue to monitor that as it moves throughout the day. we'll continue to watch our weather as the rain starts to wind down here. but there's a little bit more on

the way, so i'll have more in a few minutes. mike has been tracking lower gas prices. >> successful, in concord, for example, concord dominates the list for the east bay with their top ten all in the area underneath this one we're talking about, the $3.85. good bargains throughout much of concord, but we're going to shout out san leandro with $3.85 at gas mart just off the freeway. that's much closer to the similar price in los gatos, $3.84 at mobil on north santa cruz avenue. let's round out the report to show you that a lot of places are still above 4 bucks. $4.29 at national petroleum on cesar chavez street reported through gasbuddy.com. on the roadways, a smooth flow of traffic. slicker roads. the tri-valley not really seeing much of a commute outside of the altamont pass. no delays down vasco road or coming out of contra costa county. back to you. >> thanks, mike.

good tuesday morning. the time is 5:14. we take a live look outside in san francisco. still some wet roads and puddles out there after getting some rain over the past 24 hours, but we will continue to watch out for a chance of more showers in the forecast for today. but overall we will have a brief break in the activity before we get more rain coming in tomorrow. more on that and a look ahead to the weekend coming up in a few minutes. over here you see the little sheen off of the road, still damp pavement in many parts of the bay. we're looking at calmer

conditions and a nice start. 880, past the coliseum, some activity. and an update for b.a.r.t. and 101 in san jose. i'm looking at a crash right now. good morning. very happy tuesday to you. snap down in southern california, the latest tech company to cut workers. snap has never made a profit. down arrows really across the board as wall street pulls back from all-time records. that's to be expected. remember, sunday evening, head of the fed jay powell was on 60 minutes talking about being prudent about rate cuts. the economy may be too strong to cut in march, do rate cuts in march, he hinted. the flip side to lower equities is an increase in the mortgage rate, up above 7% again for the first time in the average 30-year fixed. this is to be expected. money came out of stocks, yields on bonds go up, mortgage rates goes up. it's a good reminder, you may

make or lose money but the money itself is not lost. it just moves around from stocks into bonds or back. and the stock market is not the economy and the economy is not the stock market. a travel company did a survey of travel professionals and they predict air travel disruptions will condition for years to come. airlines say they continue to be short-staffed and don't expect to find enough workers any time soon. we lost the expertise, the people who knew exactly what to do because they've seen that scenario before, one travel executive told bloomberg. meantime, the head of the faa will testify before congress this morning. most of the questions will be about boeing and the faa's oversight of the airplane builder. faa chair mike whitaker is expected to promise more inspectors at boeing factories. the company that makes those robotic coolers on wheels, says it got $90 million more in funding. the company is based in san

francisco and estonia, mostly delivers on college campuses. that money, the $90 million comes from venture capital and sand hill road is where we find venture capital. any time we talk about it, we're usually talking about funds in the millions and billions. but the people who work there sometimes come from very little, case in point frederick gross, who grew up as a kid moving hotel to hotel as his parents struggled to find housing. in college he was able to help them out. >> you bought your parents a house while you were still in college? what, 19, 20? >> yeah, i was 20. >> you bought your parents a house? >> that's right. >> how did that happen? you can find out how that happened on our podcast, sand hill road, this week with frederick gross of wellington management. grew up from very, very little and turned his entire life around, and now works very hard funding particularly minority firms.

>> i can tell i like this guy already. >> let me give you one statistic. black firms get 0.13% of venture funding. not 13%, 0.13%, so we talk about how to fix that. >> a lot of times you see people who are very giving and business-minded, they know how to work their way up. >> good to see. check it out. it is 5:18 right now. new this morning, a record 68 million americans are expected to bet on the super bowl, up 35% from last year. a new report says with the expansion of legal sports betting, super bowl wagers are expected to pass casual bets such as betting with friends or in an office pool for a second straight year. nearly 29 million adults plan to place online bets using a legal u.s. sportsbook. currently 38 states and washington, d.c. have legalized sports betting. in total, more than $23 billion

is expected to be spent on bets. >> wow. trending this morning, one reporter simply stealing the show on super bowl opening night. >> so raj mathai is out there and he's been showing us a lot of the hype from last night. but one little guy seems to have all of his facts straight. i want you to check him out with george kittle. >> your quarterback is now a young, hungry and underestimated player titled mr. irrelevant in the 2022 draft. >> yeah. >> what impresses you about -- what about brock purdy impresses you the most, and how did the locker room respect him in such a short period of time? >> i am more impressed by how good you are at interviewing. that was pretty talented, man. >> he knows his stuff. that's 11-year-old las vegas native jeremiah fennel. you might say he's setting social media on fire. jeremiah says he got into sports journalism at an early age. it's not like he's over the hill now. >> he was much younger.

>> he says he started because medical issues kept him from playing and he wanted to be around sports all the time. it looks like he's there to stay for a while, too. >> definitely. >> he knows the sport. >> and he's serious, too. no, answer the question. >> thank you. i'm cute, thank you, but please answer the question. >> mr. kittle. that's cute. nice to see. sunny skies, at least, for super bowl, right? >> yes, it does look good. for us with our parties and everything going on, it's going to be nice. we just have to make it through the next, say, 36 hours, because we're still looking at spotty rain here and there. it is a soggy morning commute for us. some rain off and on on the drive in, and you can see the sheen on the roadways as we take a live look outside in oakland this morning as you get ready to head out. so we're still dealing with this storm system. the storm that has really shifted to the south with the heaviest rain, but we're still getting light showers and all of this moisture in the air.

at times it does bring us some passing showers, but stormranger is showing it is definitely much dryer right now compared to yesterday at this time. but it is a chilly start, and we are right now in the low 40s in sonoma. it is 45 in palo alto and 51 in san jose, compared to the 48 that we're seeing in dublin. then we're headed for the upper 50s today, so there's not much of a warm-up for our afternoon. and tomorrow it's even cooler, that's because a cold front will be coming through. when it passes, we will see spotty showers, another chance of rain. it most likely will hit us late tomorrow morning from the north bay, pushing to the south, and then going into the afternoon with still a couple of lingering showers into the evening. then we'll dry out on friday, but we're looking at an additional quarter inch of rainfall for many spots. it may be up to a half inch of rain for some of our coastal areas and in the santa cruz mountains. so still pretty busy here and

there may be one more slight chance of rain, with the weakening storm system that will be dropping in on friday. it looks like a lot of the rain will be in the north bay and then weakening as it moves into the rest of the bay area. but once again, that's friday. we are all clear for the weekend. it will be chilly. look at our overnight lows in the upper 30s and highs in the low 60s. all we want is the sunshine at this point and a chance to dry out. we'll get it after our rain chances for tomorrow. mike, you've been watching a situation in san jose. >> yeah, there it is, flashing lights. so this vehicle, we saw that on the shoulder. one of the crashes for 101. it's the last one that remains on the northbound side. i believe it may be in the mud and there may be complications pulling it from the scene. slowing now a distraction as this goes on on the shoulder northbound 101, which does slow down right there at the scene. this is about the time we start to see the build in volume. the green highlighting shows the damp, wetter roadways throughout

5:26 this morning. in hawaii, the maui police department is working to improve its response to future tragedies. this is following the deadly wildfires which ripped through the town of lahaina. those changes are among 32 recommendations listed in a primary after-action report after the chaotic incidents of august 2023 when wildfires ripped through killing at least 100 people. changes include obtaining better equipment and stationing a high-ranking officer in the island's communication center during emergencies. 5:26 right now. coming up next, the top stories we're following, including counting down to the super bowl. here is a live look at allegiant stadium where in just days the biggest game of the year will be playing. excitement building in sin city this morning.

across the region and the heavy rain has now moved into southern california, with some light rain here moving into the bay area. not a lot on stormranger this morning, but the roads are wet. as we take a look at martinez, temperatures in the mid-40s with some peeks of sunshine for this afternoon. it's going to be a cool day, with our highs in the upper 50s, and we do have more very chilly weather ahead. we're going to get a few more days of winter feel in the air. mike, you're starting with an early backup in san jose. >> the flashing lights, chp has arrived on scene. you're seeing more traffic, more distraction on the shoulder, but more importantly it's the volume that's building. north 101 slows from story and it continues through oakland road. again, extra distraction on the right shoulder. also wet roadways continue there and around the bay, despite the fact it's not highlighted in

green in some parts, you'll see slicker pavement. so do be careful. we're seeing more traffic build throughout contra costa county and the bay bridge. i'll talk with the north bay and some issues continuing up there coming up. >> we'll check back with you. developing right now, the all-out push to restore power following sunday's powerful storm. within the last few minutes pg&e giving us a new update. about 65,000 customers are now without power, down from about 95,000 last night. >> people are so frustrated. "today in the bay"'s bob redell joins us live at cal state east bay. the campus will stay closed for a second straight day? >> reporter: correct. good morning to you, laura and marcus. you can see why, or you can't see why. there's a big digital screen behind me and normally those pixels are lit up. it's dark here on the east bay campus. campus will be shut down for the second day in a row because they don't have power. they want people to know that they're remote learning, so the

online learning is still going on and their campuses are not impacted. the outage map, we see that thousands of customers are still without power all over the bay area, especially in the south bay, up the peninsula, through sf and into napa and sonoma. if your estimated time says 11:00 tonight, pg&e says there's a possibility it could come on before then. utilities in santa clara county received reports of damage to their equipment at 700 different locations because of the big storm on sunday. yesterday workers removed trees and branches, began fixing downed power poles and lines. in willow glen, residents without power since 4:00 on sunday, they were using their cars as charging stations for their devices. one man tells us he borrowed a generator from one neighbor, while another neighbor let him

and his family use their shower. >> my wife is, like, can we please take a warm shower, and they said, heck, yeah. >> we don't have an estimated time as to when everybody will have their power back. >> it's going to be different for every commute. right now we're prioritizing critical infrastructure and critical customers. >> reporter: in san jose, the east side union high school district, oak grove and yerba buena high schools closed today because of power outages. in the north bay, sonoma county, there's a number of school closures due to power outages or other storm-related issues. you can see the dunham school district is shut down, fort ross elementary closed, harmony union school district and kashia. twin hills school district has closed apple blossom, orchard school and twin hills. we're at cal state east in

hayward, campus is shut down for a second day in a row. reporting live, bob redell, "today in the bay." >> a lot of people frustrated. let's hope they turn it around. thank you. happening today, a judge is scheduled to hear from both sides in a civil suit tied to the death of a teenager stabbed at a north bay high school. the 16-year-old died 11 months ago when he was stabbed in a classroom at santa rosa's montgomery high school. the 15-year-old defendant was later found not guilty of manslaughter. the victim's parents filed a wrongful death suit against the school district. the district has since filed a cross-complaint against the defendant's parents and several others. attorneys will appear in court today for a case management conference. it is 5:36. new answers from san francisco leaders fighting back against organized retail theft. last night district attorney brooke jenkins joined top-ranking police department members for a town hall that

focused on crime rings tied to what they believe is the majority of thefts in cities across the bay area. the problem in san francisco is leading some retailers to close shop, but jenkins says police and prosecutors are now specifically targeting the largest crime groups and it's making a big difference. >> disrupting those who are doing this over and over again has allowed us to bring the percentage of these types of crimes down, and we have to continue to do that. >> jenkins says she and other city leaders are trying to be creative in using the resources they have to tackle crime. that's in part due to the hiring challenges for san francisco police and other agencies. 5:36 for you this morning. the hype is now officially ramping up in las vegas. this is ahead of super bowl lviii, giving you a live look this morning at allegiant stadium, this is where last night we saw the first real super bowl event kick off. >> nbc bay area's raj mathai is in vegas all week. he has an up-close look at

opening night of the super bowl and some of the niners signature moments. >> reporter: good morning from las vegas. this is voting day in nevada, the democratic primary is today. but we're not talking politics, we're talking football. the 49ers will practice later today. this is their first real workout since arriving in vegas a couple nights ago. but last night they had a little fun, along with the fans. they called it opening night of the super bowl. take a look. >> san francisco 49ers! >> when you hear that, you know you're in vegas. that's mma announcer bruce buffer. this is the super bowl opening night party. tickets were about 50 bucks, so this was an affordable way to see the players up close and personal. this is the one and only time all week until the game that the niners and chiefs will meet face to face, even exchanging a few hugs. it's a made for tv event, not

and niners insiders all heading to vegas for the big game and you can check out our full coverage at nbcbayarea.com. >> heading to vegas, they are there. it's lively. the weather should cooperate for super bowl sunday here and there? >> here and there. if you're packing up your suitcase and heading to vegas, put in a little more than just your 49ers jersey, because it's going to be very cold there over the weekend. and as we take a look at that forecast, at least it will be clear, but we're only talking about highs in the mid-50s there, and overnight lows in the 30s. don't try to be too cute heading to vegas over the weekend. here is a look at our forecast as well. we're starting out with mid-40s and we are having a cool morning with more cold days ahead. and our highs today will stay in the mid to upper 50s, and it will be even cooler tomorrow as a cold front drops in. look at livermore, only 53 degrees, about the same in morgan hill.

these are high temperatures, so we know it's going to be cold early in the morning. we'll talk more about that and the incoming rain in our forecast. mike, you were saying the bay bridge metering lights are on. >> they were activated about eight minutes ago and quickly forming the backup in some lanes. also damp pavement and there will be slicker roadways. be careful out there. the backup a pretty standard pattern for a tuesday. we typically are back to the tuesday pattern, seeing a heavier volume. highway 4, a little build toward concord, pittsburg and bay point showing more traffic. highway 37, typical slowing. i was going to warn you about traffic control, but i just got the update. still, highway 128 does have traffic control because of flooding over the last few storms as well. we're looking over here toward maintenance, so the lower manzanita park and ride was closed because of king tides and high tides, but now they've

incidents north 101 as you approach alum rock. >> thanks, kari and mike. the house may vote to impeach president biden's secretary of homeland security as soon as today. >> what they're not going to do today, scott mcgrew, is vote that new plan to protect the border. >> yeah, not today, marcus, maybe not ever. though that bill written, in part, by republicans, solves many of the problems they're accusing homeland security secretary alejandro mayorkas of. the house rules committee yesterday voted to forward the mayorkas impeachment. the full house will vote today. if a majority vote yes, then mayorkas is, indeed, impeached, only the second cabinet secretary in u.s. history to be impeached. a reminder, that doesn't mean he's out of office. he won't get kicked out of office because he has to go to trial in the senate first and the senate is run by democrats. members of the congress and house homeland security

committee never did charge him with high crimes and misdemeanors called for in the constitution. mayorkas never did testify before the committee during its investigation. the committee members say they're worried mayorkas is letting too many immigrants into the united states under current asylum laws. as we've discussed in the past, there is a bill to limit the number of immigrants, a bill that would give the president the power to shut down the border regularly, likely daily, but speaker mike johnson won't allow the house to take a vote on it. >> the product itself is not worth the house's consideration here and that's why it's dead on arrival. >> many pundits say they think johnson won't allow a vote because if he did, members of his own party would vote yes. we have talked in the past about how powerful this bill actually is. critics say not powerful enough, but it's the biggest and best deal on the border that

republicans have gotten in a decade. candidate for president nikki haley is asking for secret service protection early, generally speaking candidates only get that kind of protection once they become officially nominated by their party. haley and her family have been the victim of threats and swatting. senator barack obama needed protection early in his campaign as well. haley is going to be in san francisco today for a luncheon, then atherton this evening to raise money for her campaign. billionaire tim draper is hosting her. i talked to draper about his support and how long it would last. >> she's behind in the polls, they did not win iowa, they did not win new hampshire and she's behind in south carolina. but she could stick around so long as she had the funding and people like you are able to find that funding for her. would you stick with her even if she continued to lose because she operates as this thorn in donald trump's side?

it's fairly chilly out there. you might still need the umbrella, and tomorrow more of the same, with a quick wave of showers passing by. we're not completely done with the rain, but we are now looking at how we're doing with our water year after all of that rainfall. and here is where we stand. santa rosa has had over 24 inches of rainfall, and that is 4 inches above what we typically see for this date. now, we're still at a slight deficit for oakland and concord, but we've made some huge progress there, and we're still lacking about -- we have a surplus of 3 inches of rainfall for san francisco and in san jose. so it really just depends on where you are. we're still seeing the heavy rain across southern california, another day of dealing with rainfall totals that we've had over a foot in parts of southern california. so really extreme rainfall totals. we're getting some lingering light showers here. not a lot of activity on stormranger, but we are seeing the mist and drizzle, wet roads

out there, and a chance of lingering showers today. but a better chance tomorrow, starting late morning as a cold front moves through. we'll see showers pushing from north to south. it still continues with a slight chance of rain into tomorrow evening, before we dry out heading into the weekend. so additional rainfall we're expecting for most of us, about a quarter inch of rainfall and there may be up to a half inch of rain. keep in mind the ground is saturated. so what we get will most likely leave puddles on the roads as well. there will be another slight chance of rain on friday, but mainly in the north bay. heading into the weekend into early next week, no major storms coming our way. we are going to see additional light snow in the sierra, 3 to 9 inches of snow. the weekend is looking great if you're headed there. we are still watching out for avalanche danger in the sierra. here at home things are quieting

down, but it will be chilly. it will feel a lot more like winter over the next several days. mike, you were checking on the drive across highway 92. >> yeah, i saw a lot of brake tapping over the last 15 minutes or so but now things are kind of calming town. right on pace with the volume building there. you see 880 also showing more traffic, which will feed in. and also down past the dumbarton bridge and toward fremont. we're still moving smoothly into the south bay, but 237 shows more volume coming off of 880. 101, typical slowing, no surprises. we are looking toward oakland. the volume builds again. maybe some damp roadways, but we're looking at a smooth drive. watch those speeds because you might come across puddles. the sun is not up yet. we're looking at the bay bridge toll plaza. the backup not so bad for a tuesday, but it is there and the metering lights are on. >> thanks, mike. happening now, university of california optometrists are
