5:30. it starts right now. i am janelle wang. >> and i am jessica. two years after a security guard was shot and killed protecting a news crew in oakland, the district attorney's office is filing new charges and that includes the person with the actual murder. that change in charges comes as news to the widow who has been pushing for harsher penalties. >> reporter: the three men accused of killing kevin during the attempted robbery of a tv news crew two years ago were back in a double and courtroom facing new charges including gang and gun enhancement, which would increase their prison time if convicted. >> i am very happy that all of that has been added but again it can be changed and that is what i am right about. is she going to stand by the word of that paper or will she change it again? i don't know. >> reporter: virginia is kevin's window.

d.a. pamela price has been vocal on not overusing enhancements. that is why virginia spoke to the governor and state attorney general to's depth in and add gun enhancements. that is when she learned this. >> all three men will face gang and gun enhancements for the first time since 2021. we have an obligation to get it right. >> i was not aware of it. nobody that i asked in the courtroom that is leading this case do anything about it as well or her announcements this afternoon. >> reporter: and pointing to a different gunman , saying the man responsible is laurent gilbert, not mitchell. >> the previous prosecutors who charged the case under my predecessor made certain mistakes about who is usable for the murder of kevin and failed to include some charges that we deemed appropriate. >> reporter: attorneys objected

to the adding of gang enhancements. they added there is not enough evidence. in a statement, they said, quote, no one should trust the police work in this case. then the lead detective cannot commit some of who did the shooting. all three men face 78 years to life in prison. >> i want life in prison without parole. kevin does not get parole. he does not get to come home. >> nbc bay area news. according to sources, part of this restructuring plan will include laying off thousands of employees. it is unclear of the exact number. the announcement could come as early as next week. the san jose company has grappled with a supply-chain issue and post-pandemic supply and demand.

>> > inflation was lower than first reported. the consumer price index rope .2% in december instead of the .3% reported last month. that is according to updated numbers from the bureau of labor statistics. those changes help confirm that inflation went down at the end of last year, which signaled that the federal reserve could start cutting interest rates later this year. now, those numbers caused stocks to rise. that s&p 500 ended above 500 for the first time ever. but the dow jones industrial average fell 54 points at 38,000. well, hundreds of female prison guards have been fighting a lengthy legal battle against the california prison system or cdcr.

>> reporter: they claim miscarriages and lost wages because of a policy that changed in 2015 without explanation. their lengthy legal fight might soon come to an end. >> so i have had punches thrown about my face. i have been hit. i have been kicked. stuff thrown at me. >> reporter: as a correctional officer at the california medical facility , a medium security man prison, lia expected those incidents but not after she became pregnant. >> i knew i would have to continue to work. i had never seen anyone pregnant working there or if they did they were in upstairs in payroll. >> reporter: that was 2016. just a year prior, the employers in rehabilitation had quietly replaced a policy that required them to provide

light duty accommodations to pregnant officers. for reasons it asked to refuse to explain. >> you would have to basically find out a way to go hide yourself. >> reporter: how did that make you feel? >> awful. absolutely terrible. >> reporter: but she continued working . 16 hour shifts while carrying a 15 pound workload around your waist. >> i would tell inmates what are you doing? why are you still working on the outline. >> reporter: this was her second pregnancy but her first under the new policy. she said she and her husband wanted a large family and in 2018 she was pregnant again when she took part in a emergency cell entry where she had to remove a heavy locker. >> instantly i felt pain in my back and i thought i just could not. i ended up miscarrying.

>> reporter: mcallen is merely one of 300 female correctional officers suing the state department for discrimination, retaliation, and aniylah pregnancy disability rights. >> it is a lawsuit about the quality of women in the workplace. >> reporter: he said that cdcr violated california law and most law enforcement agencies provide accommodations for pregnant officers. >> we are asking for the same treatment that any other woman in the state of california would be entitled to. >> reporter: according to data since 2017, between 15 to 60% of the correctional officers have been women. cdc website shows that the first female correctional officers were hired in the 1970s, and they claim to currently hire women at a higher rate than the national average. >> so i worked in the mental

health side of it and have my entire career there. >> reporter: she is also a plaintiff in the lawsuit. she says she was 24 weeks pregnant when she was asked to do a emergency cell entry. >> i refused. and i emailed my doctor. as soon as i got out to the parking lot and let him know what had happened, he took me off of work and put me on disability that same day. >> reporter: she said she only received 50% of her pay while she was on disability but considers herself one of the lucky ones because multiple plaintiffs said they suffered miscarriages. >> it is just sad. i mean, i got to bring my babies home but not everybody did. >> reporter: the state civil rights department responsible for enforcing discrimination laws also filed its own lawsuit seeking a return to the pre-

2015 pregnancy policy. facing lawsuits in a bill to address the issue in 2020. the cdcr reverted to its to 15 policy but not before mcallen severed another incident while pregnant for the fourth time. >> a inmate fought and he -- he fought us. he broke the threshold. he punched and kicked and did everything he could. >> reporter: her baby survived but she hurt her back and cannot work for three years. the california department of corrections and rehabilitation refused to talk with us but said a settlement is in the works. and the proposed settlement will provide significant benefits to members of the settlement class and acknowledges that the underlying dispute the policies have ended. >> they all understand they signed up to what could be a very dangerous job. they are adults and appreciate that.

in chinatown. 12:30 to 2:00. as we hit sunday first super bowl watch party back in the day, i do see some high cloud cover moving across. partly sunny to even some mostly cloudy skies at the coastline but that would not stop anything from happening. looking dry. low 60s on sunday. beyond this, we are looking at a storm system as we head into next weekend. okay? so by february 17th we are getting indications we could have a atmospheric reverie turning. the total is 1 to 2 inches. maybe even higher per our early estimates. and look at this. we may even get another one lining up after that. february 18th, 19th, and 20th we could go back into more of this wet weather pattern. look at this seven-day forecast. the weekend is coming in strong. dry weather monday, tuesday, and wednesday. we get into those rain chances beginning on friday.

ago. all four astronauts reported feeling good after the landing. a win for prince harry and his fight against the british media. the prince had settled a phone hacking lawsuit with a tabloid publisher. he first sued in 2019 and accused them of invading his privacy by hacking into his cell phone. two months ago the judge ruled that the prince's phone was in fact hacked. he was awarded thousands of dollars. now, harry has settled the lawsuit and will get $500,000 from them. harry is also involved in other cases against tabloid newspapers. what is coming up next? >> right now at 6:00 a emergency landing turns into a arrest. questions tonight about airport security. why can planes take off so easily? and there it is. a live look at allegiant stadium.
