12:00 pm
hi, everyone. i'm zinhle essamuah, and kate snow is off today. "nbc news daily" starts right now. today is thursday, february 22nd, 2024.
12:01 pm
laying out the case. the opening statements begin in the first trial tied to the deadly "rust" movie set shooting and the implications of actor alec baldwin. and tens of thousands with no calls, no texts, no nothing and the emergency work around you need to know about. the biden administration is considering new actions to allow immigration at the border and how capitol hill is reacting right now. and sobering thought, young americans are drinking less than they used to, and why you ask? we will explain. no shortage of stories to get to, and so we will start this hour with the trial of that armorer in that shooting of the movie set. hannah gutierrez reid is charged with the deadly shooting of when
12:02 pm
alec baldwin fired that deadly shot, and hid trial date has not been set yet. dana griffin is outside of the courthouse in santa fe and angela is with us as well. what did we learn from both sides today? >> well, zinhle, the prosecution is painting the defense hannah gutierrez reid as unprofessional and sloppy armorer who contributed to the death of helena hutchinson and bringing live rounds on the movie set where they should not have been. and others are saying that hannah gutierrez reid is the scapegoat, and point the finger at alec baldwin saying that you should never point a gun at a crew member. this is what we heard so far. >> these witnesses will describe the defendant's conduct as unprofessional and sloppy.
12:03 pm
the idea of a live round ending up on a movie set is incomprehensible. >> being in that church or firing that weapon, that was alec baldwin. >> reporter: and right now the first witnesses on the stand is the officer who responded to the scene, and you can see him in the running into the church where they were on the scene and she is on the ground, and he called for a helicopter to send her to the hospital, and that is where they discovered she had been shot in the stomach. >> and now, first of all, angela, what is standing out with these opening statements? >> legally, quite a lot. you see the strategies and with the prosecution, they are hell-bent to bring in that she was a cocaine user.
12:04 pm
in a manslaughter case, that evidence may not have been admissible, because it is not relevant, but they added the charge of evidence tampering to say that she passed on this baggy and painting her as a drug user, and tampering with evidence and a drug user. >> and what do you make of that? >> well, she is painted reckless and also that it is not this event or the negligence or the drug use that resulted in the death, but it was alec baldwin. >> thank you for the legal analysis. president biden is sharpening the rhetoric against russian president vladimir putin, and he had a fund-raiser tuesday, and president biden called putin a crazy sob. he talked about his threats against the west, and also, we learn that alexei navalny was
12:05 pm
able to see his body at the prison. josh lederman, what have we heard firstoff from the mother of alexei navalny? >> well, there is no doubt, zinhle, that the russian government did not want to see a massive public support for alexei navalny which seems to be confirmed by his mother who says she was able to see his body, but she was actually blackmailed to having a private funeral for him, and no chance for his supporters to attend, and she is trying to resist what she is calling the threats from the russian government saying that they told her that unless she acquiesced to their demand for an unannounced private funeral, they would do something to the body. so she was very upset, and said
12:06 pm
that they presented her with paperwork, and said that the authorities have said that the cause of death is natural, and something that allies and supporters say that it is not true. >> and talking about the pointed words from president biden directed at president putin, and we are learning that the president spoke with his daughter and widow in california, and what might the ramifications of the meeting be? >> the kremlin has responded to the choice words of president biden and president putin saying that he believes that biden made the comments, because he was upset over what putin said several days ago about preferring president trump over biden as the next leader of the united states, and as far as that meeting, president biden did sit down with alexei navalny's wife and daughter dasha, and the white house releasing photographs of the meeting, and saying that the president expressed the admiration for navalny's
12:07 pm
extraordinary courage and fighting against corruption and for a free and democratic russia. while this meeting in and of itself is unlikely to change anything, it is a clear sign of how the white house is trying to very publicly show support for navalny's family and supporters, and make it clear they will stand up for what he fought for even in his death. >> yes, absolutely, the legacy is remembering on for the people who remember him, and taking to the streets. josh lederman, thank you. and now, at&t is saying that the service is being restored for tens of thousands of customers after a outage this morning. customers may have woke up to a sos on the screen. that means they could not make a call or receive texts unless they were on wi-fi. and so verizon customers were trying to contact at&t customers, and here the break it
12:08 pm
down is our technology expert brian cheung, and where this stands right now? >> well, it is 3/4 functional, but it is not entirely out of the woods here. i have been hearing anecdotally that people are not seeing the sos on the phone, and back to full service, but the big question is, why, zinhle? what led to the outage? a hack? weather-related? we don't know. at&t has not responded to the nbc for the explanation of the outages this morning, but the government is taking note. it is widespread across the country, and john kirby of the national security council said that the fbi and others are working with the tech administrators to find out what is happening, and this is escalating, and so we don't know if it is a hack, and it does not sound like they saw from the national security experts from
12:09 pm
the government, and mycolleague kevin collier if it was a hack. we just don't know. >> and so, now, there is a work around with the sos feature, and can you break it down? >> yes, for the iphone users, maybe you saw it in the corner of the phone, but you have to set up the settings to enhance it. sos, you can hold the power button for a few seconds and you is that screen, and the sos button the slide it to the right, would make a emergency call to 911, and alert them to where you are. after that, there would be an impromptu text emergency contact, but you have to have that set up. you can do it in settings, and go to health, and under health, you go the medical i.d., and then you add a loved one, and significant other, and family member as that contact, and then
12:10 pm
as you swipe that sos, you are going to be notified in that situation, and here is where you r and this is something that is a lot of people wonder if you were in this situation this morning that like many americans were, and there were long out outaj s for you. >> and is this limited to at&t? >> we saw on downdetector that at&t was reported outages and that is because of the inbound and outbound calls from the at&t customers that they were trying to make or receive a call. and so the government officials are trying to find out what happened here, and we don't know what the trigger was, and not just people, but it was business owners as well experiencing the outages this morning. >> very frustrating. thank you, brian cheung. time for the money minute.
12:11 pm
toyota is issuing a recall and they are taking steps to recall artificial intelligence. with more, kate rogers. >> toyota has recalled 280,000 vehicles because of engine issues that can cause the vehicle to go out of neutral on a flat road. they are recalling the sequoias and tundras. and the irs is going to start a new round of audits focused on private jets to determine if executives are using the business aircraft for personal use and writing it off as a tax deduction in an effort to reverse what the irs is calling the historically low audit rates of large companies and high earners. and the justice department released the first a.i. officer. they would show how the
12:12 pm
integrate the technology into criminal prosecutions and investigations as the department is facing a transformative a.i. on the force. >> we talk about a.i. every single day on this program, and it is very important for the government to take a look at it. thank you, kate rogers. okay. coming up, grin and bear it. china is going to send a pair of giant pandas to the united states. we will tell you where. and how one dance class is helping seniors to put a pep in you'll find them in cities, towns and suburbs all across america. millions of americans who have medicare and medicaid but may be missing benefits they could really use. extra benefits they may be eligible to receive at no extra cost. and if you have medicare and medicaid, you may be able to get extra benefits, too, through a humana medicare advantage dual-eligible special needs plan. call now to see if there's a plan in your area and to see if

>> we are following breaking news out of texas. a judge has ruled that a houston area's punishment of a brak student over his hairstyle is legal. the controversy erupts last august when darrell george was punished for the natural dreadlocks style. they said it violated the school dress policy. and now, morgan chesky in dallas, and what more can you tell us about this ruling? >> yeah, zinhle, we know that both sides had a chance to speak to a judge for several hours today, and he came back siding with barers hill school district by saying that this specific policy that kept 18-year-old george out of classes for months now, and it does not violate the crown act enacted as recently as
12:16 pm
2023 in an effort to hopefully stop race-based hair discrimination, and the school said for their part, because the crown act does not stipulate link, their own policy of the district that has kept george out of classes, and the judge agreeing with them, and we know that, zinhle, the family has planned to appeal here. the family is so emotional, they could not immediately address the cameras afterwards, but supporters of the family say that this is only going to elevate this issue to more people, and hopefully that the right decision can eventually be made here. i should point out, zinhle, that right now george wears his hair up, and the district says despite that, if he lets it down, it would violate the policy, and that why he is not allowed to go to class. >> important details there.
12:17 pm
and what are the broader details there, and given that the crown act cannot specifically protect individuals with natural hairstyles. >> i know that you have done an extensive amount of reporting on this, and it is to create a open, and free world with hair, and more than 20 states have followed suit. what the decision today from the judge does is to show that there is some latitude for at least right now, zinhle, on how specific agencies or districts can interpret that. as for whether or not the specific wording of the crown act remains here in texas is yet to be seen, zinhle. >> thank you, morgan ches key. the biden administration is considering a strict new order to deal with the migrant crisis. the new plan is going to make it harder for people who are crossing illegally to qualify for asylum, and speed up the deportation process.
12:18 pm
nbc correspondent ali rafa is following this, and how would it work and how is this sitting with those on capitol hill? >> well, they are saying this is a result of the work of lawmakers over the last month, and as they work together with republicans to have that work stalled in congress, and with that border deal stuck in limbo, and now officials are telling my colleagues julia sircan that it can take unilaterally without congress' approval to curb the migration across the border. one thing they are considering is to make it harder for migrants to pass the initial screenings for raising standards for asylum, and fair interviews with migrants, and considering fast-tracking the deportation
12:19 pm
and having a last one in, first one out type of policy. this could take a significant amount of time to enforce, and the biden administration though, even as they are considering optionts still pushing for congress to pass that border deal. we heard from the department of homeland security yesterday saying that it is going to take more funding to help the front line personnel to deal with the border to help. twp resource shortages, and officials say it could be weeks before there is a decision made, but whatever is decided upon, and whenever it does happen, it is going to garner more attention, zinhle, because this is a top issue in the 2024 election, and an issue that the republicans have been seizing on to attack the biden administration, and so, this is
12:20 pm
a delicate chance for the white house, because they are trying to counter the attacks while not angering the progressives and advocates on the other side who don't want to see any action to make it harder for the immigrants. zinhle? >> yes, it is also going to have implications into the elections. thank you, allie. and now, the hot pursuit, literally. how a chase to a stolen big rig comes to a fiery end. you will want to see this as "nbc news daily" continues. ultomiris is for adults with generalized myasthenia gravis who are anti-acetylcholine receptor antibody positive. it is lasting control over your gmg symptoms. and, ultomiris is the only long-acting gmg treatment with 8 weeks of freedom between infusions. ultomiris can lower your immune system's ability to fight infections, increasing your chance of serious, life-threatening meningococcal and other types of infections.

12:47 pm
is there an age too young to be traveling with kids? >> i do not think. so i think that you can fly with a child when you as a parent are ready to do that. we were discussing, i have a 10--month-old, and she was on a flight at 6 weeks. >> 6 weeks? >> yes. it is really easy when they are little, and the added benefit under the age of 2, they fly for free and they are unwieldly when they are a little older, but there are ways to cope. >> and getting used to traveling, too. and how do you calm your kid, because i remember my mom would hand us candy. >> yes, you can throw the treats at the problem, and make it go away. the first piece is the aspect of parenting is that the parent should stay calm, and the child is rising and geting aggravated,
12:48 pm
then pack treats and comfort items and don't deploy them all at once, and give them the treats and calm them down, and the things that you know that is going to satisfy them is the pacifier that you know you are trying to wean it from them, and don't give them on the runway, or something that is elevated. >> and a long flight as we saw there. >> and other travel hacks that parents can employ to help to minimize the stress at the airport? >> yes, i am a big believer to being well prepare and getting to the airport early, and not only a better seat or if you are traveling with a small baby with a basinette that you cannot
12:49 pm
check in advance. and pro tip, the airport is a great place for a 2 or 3-year-old, because they can run around and get nice and tired and once they get on to board, they will have a little less energy to exert, but before that happens, the days leading up to the flight, get them excited for the flight, and tell them they are going on the plane, and an adventure, and read a book, and watch tv and tell them they are having an exciting adventure in the sky. >> and let them know that you do all of these things and the tantrum happens. so what can you do for the parent and the fliers around. >> and you can be prepared and it is 100% not always in your control. and one thing that i would say is that the parent's obligation is first and foremost to themselves, and their child, and if you know they are aggravated, it is to know that, and calming down your child. and you know, that something that i am smart, and i like to
12:50 pm
call the preventive courtesy, and i know that when i get on the plane, i know i cannot control the attitude of my 3-year-old for hours. i will tell the passengers around me, i am so sorry, and i will do my best and let me know if it is out of control for you, and they appreciate it, and you are all allies together. >> and you are not just an expert traveler, but a mom. i trust your opinion so much on this. thank you. >> thank you. and don't go anywhere, there and don't go anywhere, there is still much me news ahead. or my dry eye's made me a burning, stinging, 5-times-a-day,... ...makeup smearing drops user. i want another option that's not another drop. tyrvaya. it's not another drop. it's the first and only nasal spray for dry eye. tyrvaya treats the signs and symptoms of dry eye disease fast by helping your body produce its own real tears. common side effects include sneezing, cough, and throat and nose irritation. relying only on drops? not me.
