>> david griffin is outside the courthouse and dana mitchell is here as well. >> reporter: we've heard from two fbi forensic examiners, one who conducted a test to see if the gun could be misfired. he found it could when the hammer is fully cocked and when the chamber is fully loaded. here's why that's important. the owner's manual for this revolver advises that you not fully load the chamber. we learned last week that hannah gutierrez reed loaded that gun fully, putting in that sixth round before she handed the weapon to dave halls who handed the gun to alec baldwin. the forensic examiner said there was no way it could have been fired.

listen. >> in order for you to make the gunfire without pulling the trigger when it was in the full cocked position, you had to break it? >> this was the result in my laboratory. it would not fire without pulling the trigger in the full cocked setting without being broken. >> reporter: now the defense challenged that examiner asking if he opened up the gun to make sure there was no internal damage. he said he did not because that weapon arrived at the fbi fully functional. >> thank you. let me go to danny and bring him in. this is one of the strongest arguments from the prosecution so far. >> it's a very different case than the case against baldwin and the strongest case i believe is the evidence of the three different kinds of rounds onset. you have the blanks which just make a noise. you have the dummy rounds which look like a bullet, but they have no primer, no explosive force. then, of course, a live round.

they already showed in the opening, these look different. they have different features. a dummy round looks like a real round, but you shake it and it makes a noise to tell you it's hollow. even if we never brought live rounds onset, the prosecution will argue hannah gutierrez reed should have known what she was loading into a firearm could be a live round. she shakes it and sounds like a bb, she's probably okay. why didn't she do that? >> danny, we learned alec baldwin's trial is set to begin in july. we talked about the fact that this case against the armorer may give baldwin's team a leg up. how will they get an unbiased jury given how profile alec is and how many eyes are on this case? >> they won't. it's impossible.

the key is whether, in spite of what they've heard, can they render a fair and impartial verdict. as far as prosecution goes, the state's entire case is alec baldwin's entire case. they'll take all the evidence the state is introducing against the armorer and make it their defense. it was the armorer's fault this gun came to the set with a loaded round. >> danny and dana, thank you. we're following breaking news. the white house announcing that president biden will make a rare visit to the southern border on thursday traveling to brownsville, texas, to meet with border patrol and local law enforcement. that's the same day that former president trump is expected at the texas border as he delivers remarks in eagle pass before taping an interview with fox news. the visits underscore how much a political liability the border is for president biden. in an nbc poll former president

trump held a 35-point lead over president biden when it came to the question of who would better handle immigration. >> staying on the border, a cross the country big cities are buckling as they struggle to accommodate a growing number of migrants. >> in san diego hundreds of people were dropped at a bus stop because the county ran out of local aid money. ellwyn lopez is following that story for us. what does it mean that the migrant center is closed? >> reporter: migrants would typically go to a staging area, rest for a bit, use the bathroom. none of that happened. they ran out of money and closed their doors. now we're seeing scenes like this one in san diego. on friday volunteers were told to expect 350 street releases.

nonprofits jumped in to help folks get water and transportation. these migrants came from as far as china and as close as mexico. some of them fleeing political chaos and violence. take a listen. silo. will other cities have these situations? >> reporter: cities like new york and chicago are already struggling with this. there doesn't appear to be a solution. the border patrol said in part, this is, quote, the latest example of the pressing need for congress to provide additional resources and take legislative action to fix our immigration laws. there was a bipartisan senate bill on the table. that was shot down by republicans earlier this month who are not willing to free up funds without sweeping changes to immigration policies. the bottom line is that the pressure is high and we don't have a solution on the table. images like we saw over the weekend in san diego are likely to continue. guys? >> thank you. now to the race for president. the only person still challenging former president trump for the republican nomination, of course, former u.n. ambassador nikki haley. she's promising to stay in the race. >> this despite a double digit

loss to trump in south carolina. haley and trump face another test tomorrow in michigan. ali vitali has the latest. >> reporter: nikki haley stretching into her second day of campaigning in michigan, trying to take the state by storm just before voters go to the polls on actual primary day. in terms of the way this will shake out from a delegate perspective. delegates will be notched after tuesday's primary results. we're only talking 16 of them. that's not the full haul here. instead republicans will have a convention or conventions due to the confusion of who's running the republican party in michigan right now. either way the conventions will yield more delegate hauls for the candidates. the problem for nikki haley is that her campaign says this is a state that could help her with the coalition she's building of would be democrats, independents and republicans.

at the same time the delegate battle is difficult for them. we'll see how many she's able to notch here. haley remaining resilient and defiant in her posture here, telling republicans and americans alike she sees red flags in trump's candidacy that will extend all the way to the general election and continuing to make the argument that he cannot win against biden or a younger democrat if something were to happen to biden. that's an eventuallity that haley teases the possibility of. it becoming the hallmark of her pitch as she makes her way through michigan and also through a whole set of states on super tuesday. it's also a likely inflection point for the haley campaign who, while they're defiant are staying in. haley saying her campaign hasn't

gun violence is rocking the city of chicago. on sunday two incidents left four people dead. one shooting at a park in northeast chicago killed a 19-year-old girl. in a separate incident a young child and two adults were killed on the south side. 24 people were shot in the city just this weekend. adrienne broaddus joins me now. what more do we know about all

this violence over the weekend? >> reporter: we know investigators are searching for two people in one of those shootings. that's the shooting that happened in a home in a neighborhood. a 14-year-old was killed and others were injured. not only was there a shooting at that home, but there was a shooting earlier in the day that left a 19-year-old woman dead according to police. four people were standing in this park when someone walked up and started shooting. the ask now is if anyone has any information to contact members of authority. kate? >> a year and a half ago i spent a saturday in chicago following pastor donovan price. he helps families of people who die. he visited the site of both shootings and wrote on x he's tired and heart broken. what is being done to try to stop this from continuing? >> reporter: so many feel the way this pastor does. people are tired and heart

broken. aside from people in the community stepping up, we've seen the biden/harris administration do their part. i'm talking about the federal government investing in community violence intervention, specifically here in chicago. there was a training that lasted about six months. it contained 31 adults learning how to use data and other resources to prevent some of these violent acts from happening. i spoke with a gentleman who's a former gang member. he works with an anti-gun violence group where they go into the streets trying to meet with offenders before things escalate. >> efforts being made. adrienne broaddus, thank you for being with us. we know the identity of the man who died after setting himself on fire in washington, d.c. over the weekend. police say he's 25-year-old aaron bushnell. he was seen on video sunday.

>> aaron gilchrist joins us now. we understand he was part of the u.s. military. what else do we know about bushnell? >> reporter: the secretary of defense lloyd austin has been made aware of the situation. we learned that through the pentagon. he sent his condolences to the member of the air force's family. this man was an active duty service member in the united states air force. aaron bushnell from texas who walked up to the israeli embassy in washington yesterday afternoon. apparently he was live streaming. put his phone down. doused himself in fluid and set himself on fire yelling the words, free palestine. we understand it was a protest of the israel/hamas war in gaza and the biden administration's support of israel in its

this is the fast forward. people in a san pablo neighborhood are sheltering in place right now because of an armed suspect barricaded there. bob joining us now with more. >> reporter: a person who law enforcement says is armed we believe with a gun is barricaded inside the neighborhood behind me here in san pablo. we believe the suspect has a gun because a woman tells us she heard this person firing off a gun overnight. you can see the police have blocked the intersection. the contra costa county sheriff's office ordered this neighborhood to go into lockdown overnight. residents are allowed to leave, but they cannot go back home, which has been a problem for this man. >> they didn't tell me i

one of the most dangerous roads in san jose is set for major safety improvements. police are investigating a conflict, but first, governor the -- outlining the reasons behind this recall effort. some of the reasons, the governor's healthcare policies when it comes to immigration, school covid policies as well as high taxes in california. the governor came out victor crouse in a recall election in 2021. a deadly shooting occurred sunday afternoon near foothills boulevard. officers found one man in his 30s shot and killed outside the complex. police found two more men with gun shot wounds in a nearby armt. all three men with part of the same family. there's no threat to the public. the victims have not been

identified yet. san jose is placing in u safety measures for king road. it stretches six miles to east capital expressway. in the past five years, eight people have died. 21 have been injured on that road. now the city plans to add wider sidewalks, more bike lanes and bus stops as well as green spaces for the community. it looks like rain for parts of the bay area today. here's kari hall with the details. >> we have a cold front dipping in from the north and ahead of that, we are seeing the scattered showers and our rain chances will be increasing as we approach noon into the 11:00 to 12:00 hours. as we go into the afternoon, it's going to be very hit or miss throughout the day and also colder temperatures filing in behind this slight rain chance that we'll see today after hitting highs in the 70s over the weekend, we'll see low to mid-60s for today. not really cool just yet but it will be cold tonight as our overnight lows drop down to the upper 30s and we'll repeat some of the cold mornings and mild

stranging josiah kilman. investigators are trying to determine a motive. police say a group of nine masked teens from the chicago area broke into a luxury car dealership in wisconsin sunday. the group allegedly stole nine cars worth over $500,000. one 17-year-old suspect is under arrest. six of the nine cars have been recovered. duke basketball star kyle filipowski is dealing with a sprained ankle after colliding with a fan that stormed the court. fans rushed on to the court after wake forest beat duke on saturday. the injury to kyle filipowski is fueling an ongoing debate over the safety of court storming. caitlin clark got the wind knocked out of her by a fan who also ran on to the court. the war in ukraine is now in

that information is that he entered the united states in 2022 illegally. he crossed into the united states, turned himself in to custom and border protection. according to the information i.c.e., this is what he did. he was charged in acting in a manner to injury a child and also a motor vehicle license violation in new york and he was released before a detainer could be issued for him. sometimes when individuals are in the country under asylum are charged in any specific city, the police department will receive a detainer from federal immigration agencies, which will then process that individual either to a detention center or whatever it is that is next with that process. the information we have says the

detainer wasn't issued and then he went to georgia where he's now being charged with the murder of this student. >> guad venegas, thank you. there's a so-called silver tsunami coming this year. >> a record number of baby boomers are turning 65, 4.1 million. they're facing a tougher financial future. christine romans joins us now. >> christine, for those turning 65, what should they be thinking about? >> they should be thinking about whether they want to keep working. these aren't our parents and grandparents' generation who were ushered out of the workforce. 19% of people this age or older are still working. that's a new reality here. in terms of where they should have their money, they should be saving for retirement. the stock market has been a wonderful place over the past 20 years. it doesn't feel like it, but

it's 10.5% annually over the past 20 years. hopefully a lot of those folks have a nest egg. >> you want some of it still invested? >> yes. >> 65 is not what it used to be. what age does social security consider to be full retirement age? is it still 65? >> it's 67 now. the last 20 years it's been creeping higher. 67 for folks who were born in 1960 or later. you can take benefits at 62, but it's not advised. you get the most benefits if you wait the longest. 70 you'll get the biggest check. it's stark what you can see there. i tell people, you want to save early. claim social media later and you want to keep working if it makes you happy. >> what should people who are not near retirement age consider when it comes to setting their retirement goals?

>> you heard me say this a million times. time is your super power. if you're in your 20s or 30s, this is when you can socking money away before kids and before a mortgage. fidelity has a rule of thumb. if you're 30 years old, you should have one year's salary saved into your retirement plan. age 67 ten times. people look at me and pull their hair out. most people don't do that. we're undersaved as a nation. >> for the people who didn't do that and are facing retirement, is it possible to catch up? >> yes. if you're 50 or older, you can put away another $7,300 a year and that is on top of your 401(k). the catch-all here the catch 22, a lot of people who turn 50 have kids going to college.

new allegations are surfacing about the once popular chain yoga to the people. former students and staff claim they were subjected to emotional abuse and suffering. >> now some are speaking out for the very first time. >> reporter: yoga to the people was a multi-million dollar yoga chain. their philosophy everyone should have cheap access to yoga. in 2022 the fbi arrested three owners, including the founder. the leaders facing tax charges, pleading not guilty to defrauding the irs. now former students have come forward. nbc news spoke to over a dozen people, some on record for the first time recounting what they

call emotional and physical suffering. >> i was in pain. we were all in pain. >> reporter: founded in 2006 yoga to the people's donation based pay what you can model drew hundreds of people every day. jackie good founded it in 2007 as an nyu student. >> i had been practicing every day for two months. greg approached me and asked if i wanted to teach. they seemed to be very cool to me to my 21-year-old self. >> reporter: it turned to discomfort. >> there were crazy exercises that i just gave them my trust and i did, and now as an adult, i realize those things were pretty irresponsible. >> reporter: to certify as a yoga teacher there's a standard 200-hour course which nationally

registered yoga instructors. former teachers tell us the studio's version of the training was harmful. >> we did the arm raising. >> arm raising, your arms gradually were raised until they were over your head and then you held them over your held until it was physically painful. >> painful? >> yes. >> reporter: nbc acquired a copy of the training script from a former teacher. a few of the women we spoke to agreed to show us the pose used in the exercise. >> what kind of effect could that have on someone's body? >> if somebody doesn't have the strength to manage that, then that's when they could end up with smaller injuries that could progress to something a little more substantial. >> reporter: they say arm raising and truth circles were standard practice at yoga to the people's training. >> they gave you a microphone and said, look every person in the eye and tell them you never

told anyone. there was no after care. before you left, they said don't tell your family about this. they won't understand. >> reporter: former teacher nicky palmer said she was most troubled by the lack of mental health support. today yoga to the people has shuttered, but the owner and his attorney didn't respond to the allegations about the lack of support offered after a student's suicide. jackie good says she has life-long injuries. >> in january of 2011 i broke my hip after a class. i was being pushed into these extreme poses and eventually i had a hip replacement. >> do you believe that would have happened if you hadn't been at yoga to the people? >> no. >> reporter: medical records don't identify a specific cause of the injury. in 2020 more students and former teachers shared their experiences at yoga to the

nbc bay area responds to a peninsula teenager whose road to a driver's license was bumpy. she turned to chris' team for directions. >> suzy didn't want to go on scam, but her parents were okay telling her story. they paid for her to take an online driver's ed course. suzy passed and her course was supposed to culminate with a certificate she'd take to the dmv so she could take her learner's permit test. well, weeks later, no certificate. so her family called us. we contacted the folks who run it. two days later, they sent the certificate. the company said it's had shipping delays and advises students to avoid scheduling appointments until they received their certificate. we learned something new. california licenses driver's ed
