the morning commute, which is starting to kick in. i'll show you the bay bridge coming up. today is super tuesday, voters in california and 15 other states and one territory headed to the polls. >> scott mcgrew has certainly been following this. a lot of people assume the incoming president will certainly win, but the big question is dealing with the race, nikki haley, how will she perform? >> this is how this is going to work. democrats vote today on who they want to nominate for president, joe biden facing no serious competition there. republicans will do the same. as marcus mentioned, their top two choices so far have been donald trump and nikki haley. trump has 273 delegates after his past wins, haley 43. whoever wins, you need about 1,200 to win, and faces presumably biden in the general election in november. haley says if that's trump,

he'll lose again to joe biden. she says pick her instead. >> don't take my word for it. look at the polls. in any one of the polls that are out there, he squeaks by. in all of those same polls, i defeat joe biden by up to 18 points. do you know what that means? it's bigger than the presidency. that's house, that's senate, that's governorships, school boards, really getting our country back on track. some video coming into our newsroom from virginia as those polls open ahead of ours. this is not the most glamorous thing you're going to see today, but this is democracy in action. each and every person's vote counts. donald trump's name will be on the ballot in colorado and maine today, after the u.s. supreme court ruled in trump's favor, said those states do not have the power to remove his name

under the 14th amendment, which bars insurrectionists from office. the high court had no opinion on whether trump incited an insurrection. it only said congress can apply the rule. trump looking ahead to the next case where he's asking the supreme court to rule presidents are above the law. >> if a president doesn't have full immunity, you really don't have a president. because nobody that is serving in that office will have the courage to make, in many cases, what would be the right decision. >> but the implication is not a legal decision. arguments in the case will be made next month. the supreme court has danced around this one before with nixon and clinton, could you prosecute a sitting president. but this is a wider argument, that someone who was president cannot be prosecuted afterwards for crimes committed while in office, which does seem counter to the idea that every citizen is equal under the eyes of the law.
