east bay mother. a woman steals her car with her 2-year-old child inside. an all-new look at the moment it happened and the way police tracked down the suv and the toddler. this is "today in the bay." here we go, tuesday morning. 6:00 right now. thanks for starting your day with us. i'm laura garcia. >> i'm marcus washington. we're starting off this tuesday with a wet start to our morning. >> we are. >> not all day. >> not all day. >> it's a weak storm. the rain totals right now less than a tenth of an inch. so just as quickly as it treks in, the clearing will start out in the north bay initially, and then we'll get some clearing in the south bay later tonight. but right now we're in the 50s. if you look at the live cameras, we're seeing some areas that are starting to show more cloud cover versus rain. stormranger is still showing us spots with light to moderate areas south of the golden gate bridge, around the peninsula, and then, yes, stretching through central california.

fresno, monterey. that means impacts could be likely through the grapevine commute, the stretch through frazier park. we'll see it trek down to southern california. by 2:30 the majority of the rain clears out. we'll keep some of the cloud cover, but things are looking better, especially once we see 70s later this week. along with the rain, when it comes through, as you showed at the golden gate bridge, we have wet pavement, water kicking up behind the cars and slowing sensors that lasted for three or four minutes, southbound 101. no more problems, it cleared up nicely. you saw the volume, very manageable. predictable from the north bay into san francisco. from the east bay into san francisco, also, predicting the volume coming from the oakland toll plaza, it's a smooth flow of traffic as traffic flows down the eastshore freeway and out of the maze without any major issues. green highlighting all around. wet pavement. highway 4 holding steady over the last 20 minutes.

the rest of the bay shows a predictable build in the east bay, as well as san jose getting over the first burst, 101. new video shows damage done after a large tree fell overnight in lafayette. nearly 300 pg&e customers remain without power at this hour. it happened about 10:00 last night along spring hill road near pleasant hill road. a jeep was destroyed. crews are on the scene working to restore power as the tree took out a nearby utility pole. pg&e estimates power to be restored to that area by 6:00 this morning. no word on what caused the tree to fall. in contra costa, one woman is behind bars after she allegedly stole a car with a 2-year-old child inside. >> bob redell is joining us live this morning. bob, it was cell phone technology that led to her arrest? >> reporter: correct. a stolen cell phone. good morning to you, marcus and laura. surveillance video also captured the crime. this happened yesterday afternoon around 1:30 along

california avenue in san pablo. as you can see in the surveillance video i mentioned, the suspect is getting into the driver's seat of the car that she allegedly stole. it's not clear if she knew the 2-year-old child was also inside the vehicle. the car belongs to the mother of the child, who told us off camera she left the driver's door open and the car running so she could quickly drop off something at her mother's house. police did locate the stolen car within about 20 minutes in the city of richmond. >> it's incredibly unnerving, and we're extremely thankful that in this particular incident the child wasn't harmed. >> reporter: the child, as you heard, was not harmed, was reunited with her family. the suspect, 35-year-old joy taueetia, allegedly stole the victim's cell phone, which helped police locate her and the child. taueetia is now booked in jail in contra costa county facing vehicle theft and kidnapping charges. reporting live, bob redell, "today in the bay."

>> wow, thankfully that child is okay. thank you, bob. well, in just a few hours convicted killer scott peterson is due in court for a status hearing. this comes as the los angeles innocence project wants to make sure his civil rights were not violated. peterson was convicted of killing his pregnant life laci peterson. his lawyers are asking the nonprofit to look at the case with fresh eyes. they believe there's a possibility that there's evidence or even witnesses that weren't presented in the first trial. on top of that, there may be dna evidence that could be a factor now. kris sanchez will have a live report in our next half hour with more on the evidence and reaction from a legal analyst. an embattled school district picks up its search for a new superintendent. two members of the sunol glen school board are facing recall after voting last year to ban the flying of the pride flag on campus. barns was the only trustee to

vote against the ban and last month she announced she was retiring, citing stress tied to the controversy. recall supporters are planning to attend tonight's board meeting. turning to decision 2024, several states hold presidential primaries today. presumptive gop nominee former president trump making his case to voters. joe biden continues to hit battleground states in an effort to convince americans he is up for a second term in the white house. brie jackson is live in washington for us this morning. what's at stake today? >> reporter: good morning. so there's a lot at stake. today primaries are being held in several states, including washington, georgia and mississippi. and former president trump, he could secure never delegates today to officially clinch the gop nomination. president biden and former president trump on track to face off in november. the president wasting no time taking aim at his political

inflation. the consumer price index. prices up 3.2% from this time last year, way down from highs of 9% or worse. we'll talk more about that in a second. in the meantime, airbnb says no more security cameras in its rentals inside, and the price of bitcoin is now above 71,000. that gives the made-up money's total market cap, its value added altogether, a value higher than facebook, higher than berkshire hathaway. it is now the eighth most valuable financial asset in the world. in fact, if you took all the silver in the world, all the silver in the mines, around people's necks and wrists and grandma's teapot, added that altogether, the total value of bitcoin at $1.4 trillion would be higher than all the silver in the world. now, that's probably going to attract more investors into bitcoin, but there are differences. silver does things. you can make a teapot out of it.

bitcoin generally not used for anything. you could buy a coffee in a coffee shop that takes bitcoin, but you don't have your bitcoin anymore, which is why we care so much about the dollar of the -- value of the dollar. almost all of the inflation came with rent and gasoline expenses. grocery prices did not go up. southwest warning it may have scheduling problems if it can't get enough new boeing airplanes. boeing has run into all kinds of trouble, including a new faa report that says boeing failed 33 out of 89 quality control audits. southwest flies several types of 737s and nothing else. the house moving ahead with a vote on a ban on tiktok, if tiktok's parent company doesn't make major changes to server its relationship with china. president biden says he supports the bill.

former president donald trump waffled on the issue in an interview yesterday saying he worried about the security risk of tiktok, but that banning it would give facebook more users, which he opposes. trump also said he was willing to cut entitlement programs like social security and medicare, but then his campaign quickly reversed that. so two bits of news made that trump does and then does not support cutting entitlements, and trump does not, but somewhat does support a ban on tiktok. i'm not blaming trump. i'm blaming the format of the interviews. when he calls into a tv show and "morning joe" used to do this all the time, rarely do they fact check him. he either misunderstands the question or over the phone there can be misunderstandings, and you end up with this, what position does he have? i just don't think it's a good format for interviewing presidential candidates. >> it's not the first time. >> not his last time. >> thanks, scott.

new data shows teens and their parents are spending too much time on their phones. that's according to a study done by pugh research center. researchers surveyed 1,500 teens and nearly half of teens say they feel anxious when they don't have their phone. when they have it, they say it's easier to pursue hobbies and interests. they say it's also affecting parents' conversations with their kids. >> do you think your mom gets distracted in a conversation? >> i think she thinks it's less than it definitely is, because i think it's a good bit and i think she would say it would be lower than what it actually is. >> what do you say, mom? >> it's probably true. >> calling out mom there. ahead this morning on "today," a closer look at the new report, including how teens and parents are approaching screen time. it's all coming up on "today."

new at 6:00, a california developer taking its talents to the midwest in hopes of making history. so construction is expected to begin in september in oklahoma city on what is expected to be a tallest skyscraper in the u.s. its developer says that it's building the tower and three smaller ones near it and funding was just secured at $1.5 billion. in addition to the tallest in the u.s., the building would be the fifth tallest in the world at 1,900 feet. the salesforce here in san francisco, 1,070. >> i hope you're not afraid of heights. >> or tornadoes. 6:19 now, and attention to all disney fans out there. >> happiest place on earth could be getting a $2 billion upgrade. disney planning a ten-year project to expand its theme park in southern california. it's waiting for approval from the anaheim planning commission. the idea is to build a more

california. some heavier pockets right now through fresno. for us locally, a lot of that is light and it's going to remain light. i do want to bring your attention toward the sierra because if you have any sort of plans, notice here along 80, 50, we are dealing with gusty winds, along with a winter weather advisory. so you may want to take some time to let that storm system pass before heading up. this weekend, tahoe is going to be stunning. wind gusts are also going to be picking up in san francisco, 29 plus, oakland 27 plus. that's because as the cold front moves through you'll definitely notice the breeze kicking up at times for the south bay. and speaking of lake tahoe, this is a live look. it's about 34 degrees. you heard me mentioning the winter weather advisory, but i wanted to highlight not only the sierra stretch, in addition to that maybe you're road tripping further north, making your way to portland or oregon, you'll definitely be encountering conditions where we could see wintery mixes up there as well. so be mindful this is going to

remain in effect until 10:00 a.m. tomorrow. so let's take a look at how the sierra snowpack is doing. we had an impressive blizzard, dumped a ton of snow in a short period of time. right now everything from the north down to central is over 100%. south is at about 94. but statewide average is at 104%. for perspective, just last year we were at 199%, so, yes, we did see more snowfall last year during the rain year, but so far we're doing okay as far as the statewide average goes. now, what's ahead is going to be a series of stretches of daytime highs in the 70s. here is the high pressure rolling through. once the dry offshore wind picks up, we get a warmer thursday leading us into the weekend. look how clear the skies are expected to be this weekend, into saturday and sunday. right now, because of the rain that we got, we are also seeing very good numbers when it comes

to the water rain year. almost a surplus of 6 inches. and typically san jose gets rain shadowed by the santa cruz mountains. even in the south bay we're talking about 3 inches there, which means percentage-wise we're at 136% for santa rosa, 161% for san francisco, and 126% for san jose. so we're doing very well when it comes to that. remember, we're no longer in a drought for the state of california. but you'll definitely notice the warming saturday into sunday for san francisco. look at this to look forward to. man, 75 by friday, 76 by sunday. >> that looks good. this, it's okay. the bay bridge toll plaza, the backup is standard and the wet lens, that's what you'll encounter, slicker roadways. vianey is talking about scattered showers, so just use caution. traffic is moderating itself pretty well. you can go close to the speed limit in most spots, but go as

afternoon, we're starting out in the 50s, and notice in san jose, until about 8:00, 9:00 a.m., we'll keep a chance for scattered activity. and then it does look like we'll get a couple of cells that move through around noon. so it looks like by the time 1:00, 2:00 rolls around, the majority of the rain will be pushed further south and we should be in the clear as far as rain goes. we'll keep the cloud cover around in san francisco, getting some of that light rain pushing through. by 12:00, 1:00, we'll get peeks of sunshine. and then we've got a warm-up on the way. we'll talk more detail in just a minute. new developments in the high-profile case of scott peterson, which has been in the headlines for two decades. he's due back in court today as the los angeles innocence project has asked to take a look at the case. the legal nonprofit wants to make sure his civil rights were not violated. "today in the bay"'s kris sanchez joins us outside of the courthouse this morning. this doesn't necessarily mean that the innocence project

itself believes that he's innocent? >> reporter: no, based on what we've seen, the l.a. innocence project wants to make sure all of the evidence that could have been presented at the first trial was presented, and we expect that the judge today will set a timeline for when the l.a. innocence project will get to see what they are allowed to see. now, scott peterson's team did ask the l.a. innocence project to take a look at the case with fresh eyes, and what they saw based on what came from the defense, they believe that there's a possibility that there might have been evidence or maybe witnesses that weren't presented in the first trial which could have had an impact on the case. on top of that, we know that there is dna technology that has advanced and there could be evidence that wasn't a factor back then, but could be a factor now 20 years after scott peterson was convicted of killing his pregnant wife laci. the innocence project detailed filing shows photos of a

burned-out van found near the petersons' modesto home around the time laci disappeared. >> they've obviously looked at the scott peterson defense file and now they want to go back and look at the underlying law enforcement files and d.a. files to ensure that everything was provided to scott peterson's defense team, and they also want to start by re-interviewing some of those witnesses that weren't called at trial and they want to look at this forensic evidence that could lead them to believe that laci may still have been alive, and was she seen after scott peterson went fishing. >> reporter: and you might remember that was part of scott peterson's alibi. we will be inside the san mateo county superior courtroom while this is unfolding. scott peterson will not be. he is appearing via zoom. kris sanchez, "today in the bay." >> it will be interesting to see what happens.

thank you so much. well, today sonoma county supervisors will hold an unusual debate on whether to consider declaring racism a public health crisis. now, the county's health department proposed that resolution, suggesting black people's lives are ten years shorter on average than other racial and ethnic groups countywide. the department adds black and latino children are more than twice as likely to live in poverty. the resolution does not ask for additional money or to redirect existing funds. also today, san francisco supervisors will consider a resolution supporting the state proposal to track the presence of opioids in wastewater. this is part of an effort to understand the flow of narcotics into communities and reduce overdoses from drugs, including fentanyl. san francisco and marin are already experimenting with similar strategy. new this morning, a new insurance industry report is out grading the major carmakers' assisted driving systems, and let's say there's still a lot of

work to be done. >> ginger conejero saab is in the newsroom today. what should anyone with autopilot system know about this? >> reporter: listen, the institute for highway safety conducted this study and found when it comes to tesla's autopilot system, there is no evidence of it or any other assisted driving systems providing real world safety benefits. tesla is not commenting on the new findings, but in the past it said its autopilot system is about ten times safer than the u.s. average. in all, researchers tested 14 systems and only one earns an acceptable rating, two are rated marginal, and 11 are rated poor. iihs president says, quote, most of them don't include adequate measures to prevent misuse and keep drivers from losing focus on what's happening on the road. the iihs looked at key elements from partial automation systems, 14 systems, including those from bmw, ford, gm, genesis, lexus,

mercedes-benz, tesla and volvo and looked at driver monitor, attention reminders, emergency procedures and safety features. the shortcome, vary. here are what the marks look like for tesla's autopilot system for its 2021 model 3. they can receive good, acceptable, marginal or poor. you're seeing the report card. the overall rating is poor, so is driver monitoring, attention reminders, acc resume and other features. it received positive marks for emergency procedures and lane change. the goal is to encourage automakers to have more robust safeguards. the scores are from a battery of tests. some performance areas weighing more heavily than others and the results are worrying. the silver lining is that quick fixes can be made, and sometimes it's just as easy and quick as a

software upgrade. so there's hope. >> good to know. thank you so much, ginger. a new review by the federal transit administration reportedly increases the total cost of b.a.r.t. extending to san jose by another $600 million. in the bigger picture, that's really just a small chunk of change compared to the ballooning overall cost. last year the vta put a new price tag on the project of more than $12 billion, about triple the initial estimates when the project was first unveiled a decade ago. the federal review also pushed the opening out another seven months to 2037. when the first plans were unveiled, vta envisioned a 2026 opening. let's take a live look this morning at walnut creek. nice and calm out there this morning. weather-wise, is it going to stay that way? meteorologist vianey arana has been tracking what we can expect. is rain still coming down in that area? >> it is, but very light. and we are on our way to much

more stable weather. we've first got to get through this cold front. it's a weaker storm. if you look at our cameras, san jose at 53 degrees, wind speeds nice and light. as the cold front continues to move through, we are expecting to see wind speeds pick up, 20, 25 plus, especially around the coastline into this afternoon. we have high pressure that's going to start to move in on wednesday and set us up for a stretch of temperatures in the 70s. i wanted to give you the temperature outlook. this is extending into the next ten days. the key colors for the state of california, we're talking about not only above average temperatures expected, but well above average temperatures expected for the state of california, and a large portion of the east coast. so we've definitely got some 70s expected. i'll give you a look at your seven-day forecast in a bit. let's check in with mike. >> san jose, earlier we had wetter roads and a lot more traffic volume. it's just starting to rebuild,

we have the morning commute hitting and sticking. over here, 101 moves smoothly on the sensors. there's slowing that's starting to build toward oakland road and another batch of slowing toward the airport. 87 shows the slowing over the last few toward taylor. 237 shows more volume off of 880, so that's a typical pattern for the south bay. same for the east bay right now. this is looking toward the weekend, but i'm going to hit this hard because i think this time it's going to happen for real. this was scheduled twice before, this is southbound 680, the closure all weekend starting friday night until monday morning at 4:00 a.m., 680 south from 580 toward sunol. your reroute will have to be, if you're heading across, just east of the freeway you're going to take 84 or go over the dublin grade, a longer drive. it got waved off, but this weekend's weather looks like they can do it. >> you can do it. back on earth, a group of astronauts back home after months in space. we're going to show you the incredible moment they landed.

prosecuted. there are huge differences in the cases, biden and vice president pence appear to have kept a small number of documents by accident. trump's lawyers say trump told them to tell the courts his documents didn't exist, even as witnesses and videotape show the documents being moved from within the mar-a-lago facility. there are primary elections today in hawaii, washington, mississippi and georgia. once biden and trump win those delegates, they'll both have enough delegates to make sure they're the nominees. >> this year medicare is negotiating lower prices for some of the costly drugs on the market that treat everything from heart disease to arthritis. that's in the law we've already passed. now it's time to go further and give medicare the power to negotiate lower prices for more drugs over the next decade. >> president biden campaigning in new hampshire yesterday. he will meet with teamsters today. former president trump's lawyers have asked for a delay in the trial where he's accused of

faking business records. they say they should wait for the supreme court decision on presidential immunity, though trump wasn't president at the time of the alleged scheme. the trial starts later this month. trump doesn't deny the payments, he does deny there were sexual encounters. trump has twice more said he did not sexually assault writer e. jean carroll, though a court has found him liable of just that. he did it once at a rally in georgia, again yesterday morning on cnbc. carroll has twice sued him over this, twice won, and carroll's lawyer is not ruling out a third lawsuit. some republican donors are worried the republican party will have to pay trump's legal bills, donor money that goes to the courts can't be used to get republicans elected. his daughter-in-law is the co-chair. yesterday the rnc laid off dozens of party workers and leaders in a huge shake-up, about 60 out of 200, or roughly

bay, and then you can see if i zoom this in even closer, how some areas, including livermore, are getting light rain, seeing more light rain in san jose. san francisco is catching a bit of a break. a lot of this rain will clear out quickly. this is at around 3:00. we'll still get scattered activity far north and also through portions of the south bay, but by the time we get to 4:00 or 5:00, it completely clears out. what is left behind is a lot of cloud cover. we might get early morning fog for tomorrow. wednesday, thursday, look at this. clear conditions, as the high pressure rolls in. but i do want to mention that as the system continues to move through, we will notice some of those winds kicking up in santa rosa, gusting upwards of 30 plus. also stretching through oakland and san jose as well. so the winds will kick up, but the long-range outlook showcasing when that moves in and out, so notice by wednesday that high pressure nearby really begins to dominate in the

forecast for really the entire state of california. that's going to bring us such a pleasant warm-up. but i want to show you, in case you missed it earlier, how our reservoir levels are doing. i just want to show you that right now the four largest reservoirs in the state of california are at 82% of capacity, 100% or more of historical average for some of those locations, and that means we are doing fantastic when spring rolls around with warmer temperatures. for thursday, friday and sauer -- saturday, upper 60s, beautiful day to be out and about. maybe you're not heading to the city and you'll be in one of our wonderful inland locations, the tri-valley, stretching through the south bay, the weather, we're talking upper 70s on the map. i already have so many plans, i'm taking my dog on a hike and he's going to love it. >> a little bit of drizzle, wet

this comes as the los angeles innocence project wants to make sure his civil rights were not violated. peterson was convicted of killing his pregnant life, laci peterson. his lawyers are asking the nonprofit to look at the case with fresh eyes. they believe there's a possibility that there is evidence or witnesses that were not presented in the first trial. an east bay mother is safely back with her toddler after a terrifying 20 minutes yesterday. that's when authorities say that another woman stole her car with her 2-year-old child still inside. it happened yesterday afternoon in san pablo. police later released surveillance video they say shows the female suspect getting into the driver's seat. officers arrested that suspect and police credited the tracking system in the mother's cell phone, which was also stolen. the car was found nearby in richmond, the child was found safe. hundreds of people living in lafayette have their power restored after a large tree fell overhead that happened near

spring hill road. nearly 300 customers lost power during the peak of the outage. the tree also damaged at least one car. well, tesla and most of its rivals are receiving poor grades for their automated driving systems. in a new report released by the insurance institute on highway safety, just one of the 14 carmakers performed well enough for the overall acceptance rate. that is the lexus system on its ls line of cars. gm and nissan were rated marginal. 11 others rated poor. researchers looked at things including driver monitoring, reminders and emergency procedures. tesla has not yet commented on the rating. >> both hands on the wheel. a little slick this morning. just a tad bit. the good news is we're going to see some of that sunshine make its way in for this afternoon, helping us dry out just a bit. and we've got 70s on the map for
