the impact it could have on the community. good afternoon i am janelle wang, will come to nbc bay area news at 4:30. a lot of stories we are tracking including a major blow to homeowners in california. speak up state farm stop selling new policies for home insurance but today it announced it is dropping thousands of loyal customers. we are going to explain. this could be huge for everyone with a smart phone. apple is being sued by the federal government over claims that it is blocking other smart phone makers from advancing their technology. scott budman will join us with the breakdown. spring is here, giants opening day is around the corner. we will have a report coming up with a sneak peek of what is in store for fans at oracle park this season. we will begin in a self- pay. san jose leaders are pushing for a new law to help low- income renters in their home.

there's the grand opening of a new senior apartment building in san jose today. the housing complex has nearly 150 units, all for low income elderly. the mayor is using this program to talk about a proposed program that would force developers to designate 20% of their properties for affordable housing. >> this policy, once approved will go into immediate effect keep some of our most vulnerable families in housing, not just to keep them off the streets but to keep them in their neighborhoods with their community. >> the city council is expected to vote on that ordinance next tuesday, robert handa has been looking at these developers for a while now. robert, setting aside housing for low income renters, it sounds like a win, is there a catch? >> reporter: not really, this is a good development for a

lot of lower income families. first of all, the complex you're talking about is one of many being built in san jose. the units are already designated for lower income people, people who make less than the median area income, but what it would do is force them to set aside 20% for people who live in the immediate area, the immediate neighborhood, the people who have already been taking the impact of these kind of developments, more taxes, more congestion, more traffic. they don't always benefit. this means 20% of the tenants will be people who come from that neighborhood, who grew up in that neighborhood, and additionally, another 15% of lower income families that will come from the city council district. this is for low income or affordable housing complexes. quite a big change because a lot of the times these projects get built, the neighborhoods feel the impact that they don't always feel the benefits. >> that is so true robert. we've done stories similar to this before and usually property owners and developers oppose it.

are you hearing pushback about this proposal? >> reporter: actually i talked to mayor matt meehan about that and he said the affordable housing has been very supportive. you have to understand these units are restricted, no one loses money in this, brent are already set so nobody really loses anything in this kind of process so it's really just a matter of trying to give priority to people. in terms of how landlords and other people will be impacted by this, there shouldn't be too much of a change. it will be just like any other affordable housing complex, it is who gets to live there. >> the city council will vote on this on tuesday, how likely is it to pass? >> reporter: i think kind of an informal survey of the city council members, again unofficial, but it seems to me it has pretty broad support. i would not be surprised if it passes almost unanimously on

tuesday because i think the principle involved is one that a lot of people not only can get behind but also each council district will have people benefit from it because it will affect the lower income families in each council district for each of the housing development that get built. i would say it has a pretty good chance of passing, and if it does, the city would set up an online portal for people to find out if they qualify, and how they would apply. >> good details, we will see how the vote goes on tuesday. robert handa live in san jose, thank you so much. let's go to the east bay going digital. the city of oakland is getting information to residents and visitors. digital kiosks will be installed in some of the 80's busiest areas including jackson square and east oakland. the two-sided touchscreens will provide information on dining and shopping, local events, shopping, and social services the kiosks also act as a hotspot and include an

emergency 911 button to contact police. the city said the goal is to provide better access to resources while also promoting businesses throughout the town. >> we want to make sure it's across the city because we know it is in some of our most marginalized part of the cities that it is our black and brown businesses located that they should have wayfinding as well. this is a great jumpstart in terms of how we continue to bring more businesses online in the city of oakland. >> one more big bonus? the kiosks don't cost the city a dime. the installation, and maintenance services are all paid by ike, the company that created these kiosks, they have cameras installed and ike says they will pay to repair any kiosk that gets damaged. three kiosks have been installed and all 50 are expected to be running by the end of this year. in san francisco the memorial for the family killed

in the city at a bus stop continues to grow. people have been bringing flowers and candles to the site all week. the family was hit by an suv while waiting for a bus in west portal on saturday. a brazilian national who worked at apple, his wife matilda pinto and their one-year-old son joaquin died. their three-month-old who was in critical condition died yesterday. the driver of the suv 76 rosemary lau has been arrested and is out of the hospital but has not been charged by investigators because the investigation into the crash is still ongoing and we are still waiting on word from the district attorney's office whether they intend to charge her with a crime. in marin county a person is dead after a late-night house fire in san anselmo. the fire was coming out of the second floor of the building when they arrived. crews extinguished the fire and or later, the cause under investigation and the victim has not yet been identified.

thousands of california homeowners will be left without home insurance after state farm announced plans today to not renew policies. they already stopped writing new homeland policies, now plans to cut around 30,000 property insurance policies and 42,000 commercial apartment policies. tate farms says the move will help it to ensure long-term sustainability in california and the changes are only happening in this state. the impact to customer, they will start being informed in july. at least 7 of california's largest property insurers have limited or completely paused new home insurance applications, citing the many buildings and homes being destroyed every year by climate catastrophes like floods and wildfires. our consumer investigator chris kamara has been interviewing those who have been dropped by their insurance companies and also about the exodus of

insurance companies in california. he will have a life report on this development about state farm coming up in our 6:00 newscast. a bombshell announcement for apple today, the department adjustment has fired a civil antitrust lawsuit against the company. it claims apple has a monopoly over the smart phone market which harms consumers, developers, and rival companies. the lawsuit filed by the doj along with the attorney general in federal court says in part that, quote, each step in apple's course of conduct built and reinforced the moat around its smart phone monopoly. the justice department said in a release that to keep consumers buying iphones, apple moved to block cross-platform messaging apps, limited third- party wallet and smart wash compatibilities, and disrupted non-app store programs and cloud streaming services. our business tech reporter scott budman has been following the story all day and i watched wall street, investors

certainly shaken, stock is down 4 present at the end of the day, let's talk about the lawsuit, do they think he has a monopoly? >> generally a monopoly means you don't have a choice in that that for a consumer but we all know people who say i don't want an iphone, i will go for the android model. there are certainly other choices and other companies like samsung and google that sell these things so i don't know how monopolistic this is. you mentioned the moat, i also heard it described as a wall, and i get what the doj is saying here. apple tries to keep people in the ecosystem of the iphone and that makes it easier to use services and apps and watches and things like that, but doesn't make it exclusive? the easy answer is no. people who have android phones and use apple products and by the vice versa but it's not as easy. if i were to text you from my android to your apple phone, our bubbles might look a little

different. is that enough for a lawsuit? i just don't know. it will be interesting to see where this goes because everybody knows there are choices beyond whatever apple offers and gets at the same time, but they also know that if you are in that walled garden or moat or whatever there also choices you can make. >> once you use an apple smart phone, you don't want to do another one because you know it's compatible and then you have to get the laptop so i am just not tech savvy enough. >> apple does make it easier if you are within that ecosystem and therefore it's a bit harder if you are not within the ecosystem but antitrust usually means consumers don't have another option and we all know there are many options to apple products out there. >> what happens if the government wins this lawsuit? what can they do? >> they say what they want is

for apple to open things up and they could make apple openings up. they could say hey, make the watch compatible just as much with an android phone as it is with an apple phone or make the apple app store open to android devices as well. that would make it one of those cross-platform things and we've seen that in the past even with tech competitors, but they hint at, although it would be a bit of a surprise is it's a bit of a company breakup, although many politicians threaten it and they are saying there could be, quote, structural changes. that government code for we might remove part of the company or make apple spit it off. i think that is what investors really fear today, but i doubt that happens. i imagine going forward apple will have to give a little bit but maybe not as much as what the doj is going to want. >> it has to wind its way through legally so apple could settle. >> apple could certainly settle without going through what would be an extensive and fairly collocated court case. >> okay, scott budman, thank you so much.

the ballpark this season. misty smith got the plush assignment of the day and she takes us out to the ball game. hi kristi. >> reporter: hi. before fans even cheer on the team, they have a number of new food options to consider to take back here at oracle park. we are talking about chicken, noodles, onion rings just to name a few but it is not just the food that is getting a spring refresh here. the team says they have taken a number of steps to help boost the fan experience this season. first, let's talk more about the food. the giant announced that oracle park has a new concessions for sports and entertainment, trying to build on the traditional fan favorites like the famed garlic fries, that includes a spicy chicken concept created by chef david chang. they are throwing out a sunday circular souvenir helmet, onion rings, and something called

birkin bag. they are tasked with choosing customers who are deemed worthy of purchasing the bag. hermes has not yet commented on this lawsuit. i will post links to the other stories you voted for on my instagram stories. we are less than three weeks away from the total solar eclipse and a new york woman is helping make sure this rare phenomenon is accessible to people who are visually impaired. kiki smith started losing her vision in second grade and she plans to use sonar technology to hear the eclipse in real time on april 8th. she's been teaching herself about this for several months and plans to share this expense with others. here's what it will sound like. >> as it gets darker incrementally by the minute those tones increase.
