a total disaster. the search and rescue mission
5:01 am
under way in baltimore after a major bridge collapse. this comes after a container ship crashed into the bridge overnight. all the new details coming into our newsroom at this moment, as that investigation is now being launched. plus -- >> this could mean that mifepristone essentially becomes inaccessible to anyone in the united states. >> nearly two years after overturning roe v. wade, the supreme court is diving into another battle over abortion access. a live report from washington with more on the ripple effect this could have for the entire country. and a looming water rate hike. the new proposal one north bay county is considering, and the key vote set to happen. this is "today in the bay." good morning. thanks for starting your morning with us. i'm marcus washington. >> and i'm laura garcia. we'll get to that breaking news in just a moment. first, we're going to start with a look at the forecast on this
5:02 am
tuesday morning. kari hall is tracking what we can expect. >> a lot of people driving this morning, hitting some mist and drizzle, even some downpours in a few spots. we are going to have that for the next few hours, but it will be clearing out over the next few hours. i would give it until about 8:00 or 9:00. it's also quite breezy in some spots. oakland, the wind coming in from the west at 14 miles per hour, san francisco, a westerly wind at 17 miles per hour, and it's going to be another mild day, slightly warmer than yesterday, as our high temperatures in the south bay head for the mid-60s. we'll see a few upper 60s in the east bay with antioch and concord reaching a high of 68 degrees. we'll talk more about what's ahead and when we'll get some more steady rain in the forecast. mike, you had to use the windshield wipers. >> i did for a surprisingly short period of time, but i had to put them on steady for a few seconds. in fremont, you see one of the effects as well. blur on the windshield, if you don't have good wipers.
5:03 am
we're looking at a smooth flow. fremont, we saw mist on the lens. there's a disabled vehicle and a minor crash on the nimitz. not a major issue. we know there's continued road work with traffic control through niles, and just a typical start out of the altamont pass. chp, like yesterday, said it might be gusty there and also across the dumbarton bridge. a smooth flow of traffic, we see a lot of slowing on highway 4. i think it's just a few slower moving vehicles. back to you. well, we are following some breaking news this morning out of baltimore, maryland, where rescue operations are under way, after a critical bridge collapsed overnight. this is after being struck by a cargo ship. now, those images simply startling. take a look at this. here is a live look from above of what's left of the francis scott key bridge. now, a major segment of this mile and a half structure now submerged in the water, as you can see. very preliminary reports right now from authorities putting the number of missing at seven. at least two people have been
5:04 am
rescued, and are injured. a third person is in serious condition at a nearby hospital. the cargo ship also appears to be at the scene. here is a live look from the ground. the camera from across the patapsco river was rolling at the time of the mishap. you can see the ship slowly moving toward one of the bases of the bridge around 1:30 a.m. eastern time. now, suddenly, after the base was struck, most of that bridge quickly collapsing. the fbi already investigating, and so far this is not believed to be something intentional. a short time ago authorities at the scene held a first news conference. baltimore county's fire chief says that the all-out search is ongoing. >> we are still very much in an active search and rescue posture at this point, and we will continue to be for some time. we have a large area that we
5:05 am
have to search. this includes on the surface of the water, subsurface, as well as on the deck of the ship itself. >> now, there are said to be at least two crew members onboard the cargo ship who have not yet been rescued. as for how this all happened, authorities have not even started to try to reach any answers there. happening today, the supreme court will hear arguments on the availability of the abortion pill mifepristone. "today in the bay"'s alice barr is live in washington, d.c. with more on the big decision that is expected. >> reporter: good morning, laura. so these arguments today are going to focus specifically on whether the food and drug administration was right to expand access to mifepristone back in 2016, that is one of two drugs used in medication abortions, and that is now the most common way to have an abortion in the united states, used in up to two-thirds of abortions in the u.s.
5:06 am
the fda says the drug is safe to use to end early pregnancies, and in 2016 the agency expanded access to it, including by mail order and at major drug stores. it could also be prescribed without an in-person doctor visit in states that still allow that. some have outlawed that. the medication is also used when a woman miscarries. challengers say the fda disregarded important safety issues when it expanded access to mifepristone. not only could the supreme court decision mean a lot for reproductive rights, experts in the pharmaceutical industry warn it could open up other medicines to new litigation. >> potentially what is at stake is the future of the existence of the fda and the ability of people with the capacity for pregnancy to regulate their pregnancies at all. what is at stake is the legality of contraception, what is at stake is the legality of
5:07 am
abortion. even if you live in a state where abortion is legal. >> reporter: the biden administration is siding with the fda and promising to continue to fight to restore reproductive rights. we are expecting the supreme court justices to issue a ruling likely by the end of june. back to you. >> one to continue to follow. alice, thank you. well, now to decision 2024, and in just a few hours robert kennedy jr. plans to announce his vice presidential pick in oakland. a few names have been floating around, including nfl quarterback aaron rogers, former governor jessie ventura and nicole shanahan, the ex-wife of google founder. the announcement is at 11:00 this morning at the henry j. kaiser center. family members are responding for the first time after two brothers were attacked over the weekend by a mountain lion east of sacramento, one of
5:08 am
whom died. the family of taylen and wyatt brooks released this photo. taylen did not survive. el dorado authorities say the two were searching for deer antler sheds when a mountain lion approached. rangers say both raised their hands and yelled and even threw a backpack at the cat but it still charged. wyatt needed reconstructive surgery for his face and neck. he's now recovering at home. experts say the two did exactly as you're supposed to do. >> they stood tall, they shouted aggressively, they threw something at the attacking animal, and we always advise, if attacked, fight back. unfortunately, that was not enough. >> the family released a statement saying, we would like to express our sincere thanks for the outpouring of support and prayers from family, friends and the community. we are all devastated by the tragic loss of taylen, yet thankful wyatt is still with us, and are well aware the outcome
5:09 am
could have been even worse. they say both brothers enjoyed hunting and fishing together and lived a full, energetic life. the mountain lion has been euthanized. this was california's first deadly big cat attack in 20 years. 5:08 right now. happening today, santa rosa leaders will consider a possible water rate hike. sonoma water, the county utility, is proposing raising wholesale water rates by nearly 10%. according to the city's agenda, that's the source of about 90% of santa rosa's water. today the city's utility board will make a recommendation to city council members based on their review of the budget. the actual water rate hike is in the hands of sonoma water directs. let's take a live look outside, city by the bay, san francisco. waiting for the sun's arrival this morning. kari, you mentioned some rain in the forecast. >> we're going to see some off and on light showers, some drizzle as you get ready to head to work, and we are taking a break from any major storms for now.
5:10 am
but we can see the next one that is organizing out there in the pacific and will be heading closer to the bay area starting tomorrow afternoon into the evening. so today for the most part, leave the umbrellas at home. you may encounter light showers on your way to work. as it clears out, it's going to be nice with our temperatures in livermore going from upper 40s to low 60s for this afternoon. there will be some spots in the mid to upper 60s. we'll see that in the inland valleys, spots like concord and fairfield, and in the north bay we'll be in the mid-60s. tomorrow we'll see temperatures coming down in the north bay first as some rain moves in. i'll have more on that in a few minutes. mike, you've been trying to find some lower gas prices. >> i have to look higher and higher for the lows. we'll talk about contra costa county right now. the lowest in that county listed $4.39, concord's best for world monument boulevard. that's a familiar spot, higher price than we would like. santa clara's low is $4.55 at
5:11 am
platinum gas on washington street. and in marin county, mill valley has your low, $4.59. this is at the arco on redwood highway. thank you for sharing prices on gasbuddy.com. on the roadways, we are talking about a smooth flow of traffic. there's mist and drizzle in some spots. we're looking at no major delays for contra costa county coming across the carquinez, benicia bridge is moving smoothly, and there's a little bit of a dirty lens at the golden gate bridge. everything is okay, but that might be what happens as you get that mist this morning. make sure those wipers are in good shape. a billion dollars on the line. ahead, the mega millions jackpot for tonight's drawing and your odds of winning. you know who else has billions more is donald trump, but he can't spend it. we'll explain why coming up. let's talk about the excitement building as we approach next month's total solar eclipse. ahead, the cits casiehi

5:14 am
right now at 5:13, we're taking a look at our day planner in morgan hill, temperatures in the upper 40s and a few clouds. it will be clearing out and we have a really nice afternoon ahead. we're going to enjoy sun for one more day, and then rain comes in. we'll talk about scattered showers and our forecast for the rest of the week coming up.
5:15 am
san mateo bridge, westbound, nice, smooth flow. over to the peninsula, no delays and good volume. chp does warn about maybe some gusty winds overnight at the dumbarton bridge to the south. both bridges are at speed. good morning. very happy tuesday to you. take a look at my board and san francisco's reddit. it was up 30% from monday's open. why? no idea. this stock is less than a week old, it's very volatile. donald trump's truth social will start trading on the nasdaq today under the symbol djt, his initials. it's not an ipo, it's a market debut from a spac, which is a special purpose acquisition company, a publicly traded company with the sole purpose of buying another privately held company. let me give you an example. chick-fil-a is privately held. you can't buy stock in it. but if we created a company, traded on the stock market that
5:16 am
had no purpose other than to collect enough money from investors that we could buy the chick-fil-a company and fold it into our company, that's a spac. now, this is an example. donald trump did not buy chick-fil-a. truth social was purchased by the digital world spac, and now truth social is publicly traded. it makes donald trump's investment in the company worth billions. he needs the money. as you know, he needs to post a big bond in his business fraud case. unfortunately for him, he cannot sell the shares in the new truth social company. they're locked up for six months. he could use them as collateral to get loans or a bond, but the bank or insurance company may be cautious about accepting the value of the stock in a company that, as far as we can tell, makes no money. spacs don't always hold their value. charge-point, the south bay company that makes electric car
5:17 am
chargers went public through a spac. the open price was $10 and it's now lost 80% of its value. cpi showed that prices were going down at the grocery store. they're still higher than they've been, but the price of a single banana is going up at trader joe's. they sell their bananas by the banana and not by the bound. the price had been 19 cents for years and it's going up to 23 cents. part of that is inflation, possibly, but it's also the banana supply. and we've talked about this before, the food supply being affected by the climate. and we see it as higher prices, but there's a little bit of panic there, too. if our food supply is affected by the climate, who knows what happens. >> scary. it's bananas. making light of it all. >> quite literally. that's what i feel like this morning. hey, trending this morning, if you are fling lucky, it
5:18 am
might be time to buy a powerball ticket. there was no big winner last night so the jackpot has grown to an estimated $865 million. the next drawing is tomorrow. but mega millions drawing is tonight, and that pot is up to $1.1 billion. yeah, with a b. the odds of winning are 1 in over 300 million. when someone says you're 1 in a million, you want to be 1 in 300 million. the total solar eclipse is in a few weeks. >> the city of dallas is throwing a three-day festival to watch the eclipse. it is called totality dallas and it will span from april 6th to the 8th. the festival is happening at samuel park, in the direct path of the eclipse. activities are going to include fishing, kayaking, camping and a drone show for families who are going to attend. organizers say 2,400 people have
5:19 am
bought tickets and they expect a lot more. >> we're expecting 3,000 day passes to be sold. you can see where everyone is coming from that have purchased tickets so far, and this heat map is on fire. it's represented through all 50 states. >> so the good thing, everyone at that festival in texas will be able to see the eclipse on the 8th for about four minutes. those tickets are still available online. so if you want to book a flight, head that way -- >> and they do have the flight that is actually going to be in the air. >> oh, yeah. >> there's one that you can be in the air and see it. >> on the "today" show, dylan was saying you should sit on the left, otherwise you might not get as good of a show. >> move back. >> i did see on the heat map there's a lot of people from the bay area going there. we won't be able to see it. really interesting. so we're going to be following that, we're also keeping an eye on the weather here, as we're starting out this morning with some milder temperatures for many of us that
5:20 am
are seeing some cloud cover. over the south bay, we're in the low 50s right now, but in the low 40s in napa and definitely a lot cooler in santa rosa as you're heading out the door, 41 there, compared to 51 in oakland and san mateo. after a cool morning start, we are going to see some clearing for today, with walnut creek in the upper 40s now, a little bit of a wind blowing from here and there, but we are going to also see it calming down today as our temperatures will go from upper 40s to upper 50s at noon, and eventually reaching into the mid-60s. we'll see a high of 65 in los gatos today and east san jose 67 degrees. you can see cooler temperatures in the forecast on the seven-day at the bottom of the screen, with concord today looking at a high of 68. 65 in fremont and 63 in redwood city. we'll be in the low 60s in san francisco, and north bay into the mid to upper 60s this afternoon. rain holds off for today for the
5:21 am
most part, but we are going to see some scattered showers moving in, first in the north bay for tomorrow morning. it starts out light, but then we're expecting it to begin to pick up late tomorrow evening with some heavier rain moving through late tomorrow night into early thursday morning. and then we could just see some hit-or-miss showers in the forecast with another system dropping in on friday. that's also going to give us a very soggy start to our weekend. the active storm pattern continues with some waves of rain into at least sunday, and, yes, that's easter sunday we're talking about, with a possibility of some showers. looking at how much we could see with this initial round, well, we could possibly see over an inch of rainfall between wednesday and then again on friday into saturday, about an inch to an inch and a half of rainfall. so we are going to get a pretty good soaking, and even a chance of thunderstorms on saturday. slight chance of rain on sunday, but it does look light. then it starts to warm up, but
5:22 am
we do have a very cool week ahead, only upper 50s and low 60s temperature-wise, and at times we will need umbrellas. it seems like so far it's a smooth start to the commute. >> it's a clear view. a quick note, when i said about dylan said about your viewing of the eclipse, i don't have the exact information. you better double-check because i don't focus on this stuff like kari. i'm on the ground. and it's looking great on the roadways. a sparkly drive, good stuff to and from the city. no major issues on the bay bridge span. we see little blips here on the incline approaching the richmond bridge toll plaza. good stuff off of highway 37 and no build in contra costa county for highway 4. that's typically where we would see some of the first slowing. there may be mist and drizzle for some of the roadways. we're looking at your drive out of contra costa county. we're already at 20 minutes, which is unusual. we're typically at 17 or 18 minutes from marsh creek down to 580. i'll scan the maps and make sure
5:23 am
there's nothing unusual going on. maybe some brake taps, mist and drizzle. went reported out of the altamont pass, but no problems. the rest of the bay, all green. back to you. >> we like that. thanks, mike. coming up next on "today in the bay," nbc bay area responds. >> when a company offers 50% off, that's a good deal, unless it's 50% off the money they owe you. that's the predicament one viewer faces. i' consumer min

5:25 this morning. nbc bay area responds to a fremont woman who cut a deal with a big company. >> that she says later tried to cut her deal in half, so she asked consumer investigator chris chmura's team to step in. >> good morning. an at&t rep came to her home and upgraded her internet service. at&t offered a bonus, a $100 gift card. well, six weeks later, no gift card. so she called at&t. a rep offered her a $50 gift card instead. she said no, she expected the $100 bucks at&t promised. so aliyne contacted us, we reached out and a few days later they offered the full $100 credit. at&t said there was a miss communication but we have issued a courtesy credit to the customer to make things right. we appreciate that. if i could go back in time and

stand at her front door, i would kindly, but firmly ask the at&t guy to offer that 100 bucks in writing. that's good advice any time a salesperson offers a deal. put it on paper to make sure they follow through. if you have a consumer complaint, here is the deal, we respond. scan the qr code to fill out our consumer complaint form online. >> thanks, chris. coming up, top stories we're following today, including that breaking news in baltimore, where a major bridge suddenly collapsed overnight after being struck by a cargo ship. you'll have to see the video of the moment of impact. it is almost hard to believe. and, also, walking off the job. peninsula health care workers, they continue their two-day strike. a look at whether the conflict is moving the

do if you're affected. this is "today in the bay." good morning to you. i'm marcus washington. >> and i'm laura garcia. let's start with a look at our forecast for this tuesday morning. meteorologist kari hall is tracking what we can expect. >> we're starting out with mild temperatures, but also some mist and drizzle in spots as you're driving to work, and some low clouds. but we're also going to have some sunshine for today and big changes over the next several days, after a morning start with clouds it will be a dry and mild day, rain coming back in the forecast tomorrow. then a stronger storm system expected to roll in on friday with a chance of isolated thunderstorms, especially on saturday, and there will be heavy sierra snow into the weekend. so just a heads-up, if you had planned to go there. we're starting out in san ramon, temperatures in the upper 40s throughout the day, a mostly sunny day and highs in the low 60s, which is about normal or maybe slightly cooler than normal. we'll talk more about this
5:32 am
coming up. mike, you have some rain on the lens in san jose. >> you told me it wasn't going to stick around and it didn't on the lens. it's looking great on the roadways. you can see cars moving and no spray coming up behind them. so that's good news. a smooth flow in the northbound direction on 101 right in san jose, a smooth flow of traffic the other routes coming into and through the south bay. as we zoom north of there, we're looking at a little bit of slowing for concord, highway 4 finally kicks off slowing, same for 37, just the initial start. richmond bridge shows a little more congestion than we typically see. right now there's the bay bridge and it's moving very smoothly. we'll check on the slowing out of richmond. back to you. >> thank you. it is 5:31. back to that breaking news and the ongoing search and rescue operation in baltimore following the collapse of a key bridge. video captured the exact moment it happened at about 1:30 this morning. you can see the singapore flag

ship struck one of the support structures. it caused it all to just topple down like dominos. >> "today in the bay"'s ginger conejero saab is live for us in our newsroom this morning. ginger, baltimore mayor brandon scott calling this an unthinkable tragedy. what will be the main point at this point because there's a lot to think about here. >> reporter: a lot of unanswered questions, a lot to think about, correct. right now it's an active search and rescue. about two hours ago baltimore county's fire chief led a news conference updating what authorities know to this moment. it started, of course, with that stunning collapse of the key bridge seen on video, and the second leading up to it. the chief says 911 calls started coming in at 1:40 a.m. local time, and as crews made it on site they quickly realized just how massive an undertaking this is. at least seven people are not accounted for, but that number
5:34 am
may easily change given how dynamic the operations are at this point. two people have been rescued, one is uninjured, the other is in the hospital with serious injuries. now, you can see the bridge mostly under water and the ship, well, that has been seen tilting at the site. the ship's crew is still believed to be onboard, that may or may not be confirmed at this point. search and rescue operations are in place by air, land, and underwater, and the chief says sonar has located the presence of vehicles in the water but it is not clear how many. there are reports construction workers were on the pan doing work at that time. dive teams are on site at the moment. time is of the essence as they battle the temperature of the water, possible trauma, and exposure to frigid conditions for an extended period of time. >> well, this is a tragedy that
5:35 am
you can never imagine, and i was awake when chief wallace called me. but never what you think that you would see, physically see the key bridge tumble down like that. it looked like something out of an action movie. you just think about, most importantly, what we all should be thinking about right now, nothing but those families and people. >> reporter: the key bridge stretches for about a mile and a half long, and it is a major artery in baltimore connecting people to points east, including philadelphia. the port of baltimore is also one of the nation's major ports, so really the impact of this will be consequential. the white house is closely monitoring events, it is in touch with the governor and the mayor to offer any federal assistance needed. the white house has also said at this point there is no indication of any nefarious intent. guys, back to you. >> that video is just hard to believe. thank you. of course we'll continue to cover this breaking news on air and online.

be sure to download our free nbc bay area app for up to the minute updates. you can find it in your app store. in just a few hours the state of california will take steps to try to stabilize the market for home insurance. >> "today in the bay"'s bob redell joins us live from thes . this new action comes after a major carrier announced it's going to stop insuring thousands of homeowners. >> reporter: correct. good morning to you, laura and marcus. we're talking about state farm. you might recall late last week the insurance company announced it would be dropping around 30,000 property insurance policies and 42,000 commercial apartment policies this summer. this is because of rising costs and the risks of catastrophes like wildfires here in the state of california. later today the state's department of insurance will hold a public meeting to discuss new regulations designed to make it easier, more enticing for companies like state farm to
5:37 am
insure homeowners in the state of california. one proposal is to streamline rate reviews for insurance companies. these companies have complained it takes too long for the state to approve or deny a hike in insurance premiums. the state is trying to fix that. california insure commissioner said in a statement, quote, by updating submission procedures and clarifying requirements for insurance companies, we aim to eliminate confusion, reduce delays and enhance public participation in the rate-making process. this will help our department's experts make sure no policy holder is paying more than is required. at least seven of california's largest property insurers have eliminated or completely paused new applications, state farm stopped writing new homeowners policies last year and raised its rates. in a statement to chris chmura, state farm says it's dropping policies because they continue to be impacted by inflation, catastrophe exposure, reinsurance costs and the
5:38 am
limitations of working within decades-old insurance regulations, their words. recently state farm reported a net worth of $134 billion. that's up $3 billion from the year before. the state insurance commissioner says that raises serious questions about their financial situation and questions that the company must answer to regulators. state farm recently suggested we talk to janet ruiz, who speaks for an industry group called the insurance information institute. she says the money we pay for property insurance does not cover our claims. >> over the last ten years, for every dollar of insurance in california, the premium that was taken in, $1.08 was spent on claims and expenses. >> reporter: if you get a, quote, nonrenewal notice from your insurance company like state farm, you want to take action immediately. state law requires state farm to

give you 60 days notice, but you might need those two months to shop around and find a new policy. you might need to contact an insurance broker who can help you shop around for coverage from companies you might not know about. reporting live here in livermore, bob redell, "today in the bay." >> thank you, bob. now, our consumer investigator chris chmura is looking into the latest chapter in california's insurance crisis, including what you should do if you should suddenly be dropped from your policy. you can watch the full report on our website. just go to nbcbayarea.com. for a second day in a row, peninsula health care workers are walking off the job, demanding better health care coverage. nurses, therapists and house keepers are set to picket again outside daly city's seton medical center. more than 400 workers are expected to strike amid an ongoing contract dispute as workers say the hospital changed their health benefits at the start of the year. the hospital remains open and administrators say they have a plan to fill the holes left by

the courts in a portion of craneway pavilion and it hasn't sat well with neighbors who want the pavilion to be open public space. some protested over the weekend. a proposal for the construction is under review by the city and state land's commission. you can weigh in on the proposal in richmond city council meeting today. let's take a peek outside, shall we? oh, this is at kirkwood ski resort in tahoe. it is the latest resort to extend their ski season. new instagram post from the resort says it's extended until april 28th. other resorts have already pushed out their seasons. palisades tahoe is now slated to close after memorial day weekend. meteorologist kari hall is here, and any way you look at it, a whole lot of snow up there. >> yes, and it's been pretty good. we are right at normal for the central center sierra. the northern center is at 115%, so slightly above.
5:42 am
they may be able to extend the seasons a little longer. we do have more additional snow on the way this weekend, it may be very difficult to get there because we're going to see at 17 to 32 inches of snow, and it may be higher. i guess, depending on how much snow we get in the month of april, they may be able to extend it a little more. we are still in a very active storm pattern and we are going to see a couple more waves of rain for the bay area. the next one coming in on friday. it looks to bring us some heavier rainfall that may linger into the weekend. parts of your weekend plans may need to be adjusted. we'll talk about that and easter sunday and what we're expecting in a few minutes. mike, you were looking at slowing in richmond. >> we saw slowing around the toll plaza and i checked the live camera. i haven't seen a problem, just a little bump in volume. we have the slowing cleared from the sensor. it was just a couple of slower moving vehicles. the bay bridge, the metering lights have been activated and we're seeing the backup at the

good tuesday morning. right now at 5:46, we are taking a look at how the day shapes up in berkeley. as you're heading to work, it's in the upper 40s and low 50s with a few clouds. we will see a lot of sunshine today and a nice warm-up as our highs head for the low 60s. we're getting ready for rain for the middle of the week into the weekend, so i'll have more on that timeline coming up. one more event to talk about, in san jose we have a sharks game. that will mean more traffic, 280 and 87, perhaps. here 280 and 17, a smooth, easy drive as the volume picks up coming toward us, again, that's 280 north. we are following breaking news this morning. a london court ruling wikileaks founder julian assange is
5:48 am
aallowed challenge his extradition to the u.s. the court said that he can appeal unless the u.s. can confirm three things, that a sang will be afforded first amendment rights, he will not be prejudiced against for his nationality, and he will not be subject to the death penalty. now, he has been fighting extradition charges for more than a decade. the u.s. has three weeks to confirm it can follow those guidelines. today the u.s. supreme court will once again tackle the issue of abortion. >> this time they're considering an abortion pill. scott mcgrew, this seems like the last issue the court wants to be talking about right now. >> they don't want to talk about this. good morning to you. we may think of the supreme court as being wise, but they were incredibly nye we've when they thought they had put abortion behind them in the dobbs decision. justice alito said at the time, abortion is now an issue for the states, but it's back in front
5:49 am
of the high court this morning. the issue is an abortion medication called mifepristone. it is very commonly used all over the united states for decades, and doctors and medical studies say it's safe. so, too, does the food and drug administration. but there's a conservative group that has challenged the fda's authority to approve the drug and its authority to change the rules, for instance, allowing it to be used for up to ten weeks into a pregnancy or be prescribed via telemedicine and not in person, for it to be mailed within the united states. all things the fda decides. it's been making these decisions for the last few years that have loosened the rules to make it more accessible. so the central question today, does the food and drug administration have the last say on how drugs are prescribed and what drugs are allowed, or do the courts have some kind of authority as well?
5:50 am
antiabortion groups say the court should have a say, that the fda should not have the last word. but drug companies say if the courts got into the pharmaceutical business, that would allow all kind of things, for instance, what if the fda denied approval for some new cancer drug because it was ineffective. could that drug company get the denial overturned by going to the courts? >> it could have the effect of really undermining the fda and essentially saying anybody who has an idealogical concern about a certain medication could try to go to court after the fda's experts have reviewed the evidence and determined that it's safe and effective enough to be approved. >> if the supreme court were to uphold the lower court's restrictions on mifepristone, it would affect the whole united states, including california, where abortion is legal. and thinking about politics, it would affect key states in the presidential election. new restrictions on abortion,
5:51 am
remember, drove abortion rights supporters to the polls, and most americans do support access to abortion. a "washington post" poll shows two-thirds of americans support universal access to mifepristone. abortion through medication, the most common way of ending a pregnancy if that's what you choose to do. the case today is going to have a huge effect over the u.s. in general. >> very much so. we'll continue to follow. thank you. all right, this morning uncle sam will keep providing for children in need in california. meals will be given in the summertime when school lunches are no longer available. earlier this year the usda announced its summer program will become permanent and feed almost 21 million children nationwide, but only in california and 35 other states. 14 states, all of which are led by republican governors, have opted out. we spoke with the robert wood johnson foundation, a nonprofit dedicated to promoting health
5:52 am
equity. they're urging states to opt into the summer meal program to help fight child hunger and poverty. >> no one, no family, no child should ever go hungry, and that is a decision that we are making. so we have it in our tools to do what's right and actually to ensure that no child, no family ever goes hungry. in this country we need to be seeing food as a right to food, just as we need to be seeing health as a right to health and not a privilege that only a few are benefiting from. >> here is the list of 14 states not participating in the summer meal program. iowa and oklahoma say they already have existing programs to feed children. texas says it didn't have enough time to start the new program. in the meantime, oklahoma's governor says the federal program will cause more bureaucracy for families to wade through. 5:52. trending this morning, "the

tonight show's" jimmy fallon announces his popular book club. >> last night he selected 16 books for an elimination bracket and he's actually calling this the sweet 16. this is a nod, of course, to the ncaa tournament going on right now. fans will be able to vote on their favorite book round by round. this is until one book is left standing. the winning book will be "the tonight show"'s book club section. fallon says there is a wide variety of genres or viewers to pick from. >> until we're left with one winner, the fallon book club spring read. this is the bracket right there with 16 books. we have all different genres, mystery, young adult novels, new york times best selling authors. go to fallonbookclub.com. >> there you have it. it debuted back in 2018. this time around it comes during national reading month. >> which is perfect. everybody has got a book club these days. >> they do.
5:54 am
and i'll bet you everybody has some way to wager on that as well. >> that is true. >> how do you vote? do you have to read all of them and then rank them in order? >> which one you want to read. >> or try to read them all. >> it's a lot. especially on our shift. >> put down those phones and read. >> i just skipped book club last night because i had only gotten two chapters in. it's hard to find the time. >> i'm not prepared tonight. >> i can read you the news. [ laughter ] well, take the book outside today. it's going to be a nice one. then we're going to see some off and on rain. so i guess that's also good reading weather. we're going to also start out with some upper 40s and low 50s as you're heading out, and even though it's been cloudy, we are even getting some spots with some light rain this morning. the heavier rain, the more organized storm will be reserving for tomorrow evening into thursday. it's still well off the coast. we're starting out this morning with some 50s, but headed for
5:55 am
the upper 60s today. we're going to see a high of 68 in martinez, as well as concord and fairfield, and we can expect it to be back to where we were yesterday in much of the north bay with mid-60s. low 60s in san francisco. 66 today in fremont. san jose as well as much of the south county. it's going to be about the same tomorrow, but cooler in the north bay with clouds arriving early and the possibility of rain. the rest of the bay area is seeing the rain during late tomorrow afternoon, and then on thursday with some clearing skies, we are going to see our temperatures remaining steady. looking at our hour-by-hour forecast, it shows the arrival of some light showers by 10:30 tomorrow morning, and then at times we will see that rain mainly in the north bay, but really starting to ramp up for the rest of the bay area during the afternoon into the evening, and then some heavier rain late tomorrow night into early thursday morning. but it looks like for the most part on thursday the rain will give us a bit of a break before another storm system comes in on
5:56 am
friday. so initially we're looking at about a quarter to half inch of rainfall, some of the higher rainfall totals farther to the north and along the coastline, and then, once again, more rain ahead for the weekend. on good friday, a chance of scattered showers, and then some thunderstorms possible on saturday, but it does look like we may have a stray shower or two on sunday. but things will have a chance to dry out and then warm up after that. but we do have a cool and very unsettled week ahead, with san francisco's temperatures in the upper 50s. mike, you're seeing some changes now at the bay bridge. >> we had a backup form and then it completely cleared and now we're back to what we expect, filling in steadily from the middle to the outer lanes and the metering lights are active. that causes more slowing, but keeps the bridge moving smoothly. a little more slowing through richmond coming toward berkeley where things are nicely moving. same for the upper eastshore freeway. 37 had a little jam-up at mare island, typical slowing.
5:57 am
contra costa county, typical build. no drama for vasco, although we saw early slowing. 580 out of the altamont, maybe gusty winds, but i think things are calm now. over here there's a build into san leandro, and then south of here things are easing in san jose. back to you. >> thanks, mike. happening now, berkeley leaders are officially repealing a ban on national gas appliances in new buildings. this follows a settlement agreement with the california restaurant association, which sued the city after a ban passed back in 2019 as a way to reduce greenhouse gas emissions. berkeley was the first city to pass this type of law, leading to other cities like san francisco and l.a. to pass similar measures. the lawsuit, the cra argued it violated energy laws. judges agreed and blocked the ban. we continue to follow breaking news, crews rushing to find survivors after a bridge in
