for joining us for our midday newscast. i'm marcus washington and i'm laura garcia. we're going to get to the developments out of sonoma state in just a moment. but first, we are following breaking news. the dow jones industrial average crosses 40,000 points for the first time. we've been watching it this morning. dips a little bit below it right now. but it did this morning. it's been fluctuating fluctuating around that number live. look at the big board. now the move comes as expectations of interest rate cuts and enthusiasm around artificial intelligence aren't really helping to boost investor sentiment there. we'll keep our eyes on the markets. in the meantime, the president of sonoma state university is on leave following a controversial email detailing a pact made with pro-palestinian campus protesters. nbc bay area's ginger conejero saab she's live for us over at sonoma state and ginger, so the president says that he was actually trying to reach an agreement with his

students. but that's not how this is actually playing out. that is correct. marcus. laura, that is not how this is playing out. president mike lee says he was trying to find that agreement with student protesters who were camped out here at persons lawn on campus. those student protesters were here for weeks protesting the israel-hamas war. the encampments were cleared because president lee came to several agreements with the protesters. agreements that were detailed in this letter dated may 14th and sent to the school community there. lee said he joined discussions about students demands, and as a result of those discussions, he says the parties reached several points of agreement. those include establishing an advisory council of students for justice in palestine, an academic boycott of israeli institutions, disclosure and divestment of sonoma state university foundation investments, and calls for a cease fire. now many are expressing issues with the letter, including the director

of the college's center for the study of the holocaust and genocide, who tells the press democrat he was, quote, complete blindsided and finds the provisions made highly problematic. in a statement, csu chancellor mildred garcia said lee's statements were sent without appropriate approvals. she goes on to say in part, quote, i want to acknowledge how deeply concerned i am about the impact the statement has had on the sonoma state community and how challenging and painful it will be for many of our students and community members to see and read. now, in response, president lee said, quote, in my attempt to find agreement with one group of students, i marginalized other members of our student population and community. i realize lee said, y

right. thank you very much, ginger. well, uc's recent crackdowns on student protests have now led to an authorization for strike organized by academic workers. the uaw local post on social media says that the strike vote is in response to what union claims to be intimidation and retaliation tied to employees exercising free speech, protests and collective action rights. now, the union includes teaching assistants, student researchers and tutors. nearly 80% of those voting authorize a strike, depending on conditions which union leaders are now evaluating, with a possible announcement tomorrow. now, uc president's office says such a strike would set a dangerous precedent by introducing non-labour issues into labor agreements. in a statement, it goes on to say, quote, to be clear, the uc understands and embraces his role as a forum for free speech, lawful protest and public debate. however, giving that role, these non-labor related disputes cannot prevent it from fulfilling its academic

mission. major news out of washington just coming into our newsroom, the federal government is officially moving forward with easing restrictions on marijuana. president joe biden making the announcement official on x, saying he's asking the department of justice to switch cannabis from a schedule one drug down to a schedule three that doesn't completely decriminalize the drug, but it clears the way for medical research. biden says the move also works to right past wrongs. when people were punished more harshly for carrying marijuana, there are some steps to go before it's final. this could take anywhere from a few months to a year. donald trump's first criminal trial could wrap up fairly soon, depending on what the defense decides to do and scott mcgrew. it all depends on whether the former president decides to testify in his own defense. exactly right. good morning. it would seem like something he'd like to do. it's also probably not a good idea. his lawyers are likely advising him against it. remember, the jury should draw no conclusions from that. everybody has a right

to decline to testify. but one way or the other, it soon is going to be the defense's turn to take control of the courtroom, because the prosecution seems to have called its last witness with michael cohen, a man who, under cross-examination, the defense depicted as a criminal and a liar, out to exact revenge on his former boss. trump meantime, made his usual appearance before tv cameras this morning. this was a case that wasn't going to be done. and then when i announced i was running, they brought up. they could have done it seven years ago. this could have been brought seven years ago, but they wanted it right smack in the middle of the election. these are very dishonest people that we're dealing with now. that's not right. when the payments to stormy daniels were made in the fall of 2016, nobody knew about them. that is, after all, the whole point of hush money. nobody knew about them until 2018, when the wall street journal first revealed them in 2018, trump was president. and we don't charge sitting presidents with crimes, but they can be charged after. now, you

can make the argument the prosecutor is reaching with this allegation that it's a weak case, that there are legitimate legal arguments. it's not a felony. but no, the charges could not have been brought seven years ago. senator robert menendez walked into a court not far away in new york city, the federal court, to continue his bribery and corruption trial. prosecutors say the new jersey democrat and his wife accepted bribes and payments from, among others, the egyptian government. it is still very early days, but looking at what they're arguing, it looks like the senator's lawyers are going to try to pin some or all of this on his wife. and this isn't the first time senator menendez has been on trial for corruption. totally different case earlier. so that was back in 2017. a jury just could not agree. doj just ended up dropping the charges. but that's right. we'll see what happens. yeah. all right. thanks, scott. well teachers in contra costa school district plan to hold a rally today. group is threatening a strike over their salaries and intake procedures for students. the

rally is expected to start at 345 this afternoon in pleasant hill county. superintendent of schools lynn mackey released a statement saying in part, quote, teachers and other school employees deserve a raise commensurate with their education, skills and the critical role educators play in building our society. this agency has a track record of ensuring that our employees are some of the best compensated educators in the county, and will continue to do so well. if you have what they call a lead foot, you want to listen up to this because state lawmakers are expected to hit the gas on a new push to crack down on speeding. that bill would increase penalties for speeders. it would include two strikes on your driving record for anything over 25mph over the posted speed limit. anyone caught speeding more than once in a calendar year? well, they would have their license suspended. the senate appropriations committee is expected to take up that measure this afternoon. governor gavin newsom is in italy this

midday. he addressed the vatican climate summit while touting california's efforts to combat climate change. i come here today. day 3232 straight days over one month, where california's economy is literally being run with 100% clean energy, 100% 32 days straight, proving the paradigm that this can be done. in his speech, newsom touched on the state's decades long history of advocating for the environment among them former president ronald reagan's signature on a bill which curbed tailpipe emissions. while reagan was governor of california. newsom also went on to call out fossil fuel companies for fighting against efforts to combat climate change. newsom is expected to remain in italy through tomorrow. today is bike to work day and many people taking advantage while using an alternate form of travel energy

or stations set up at workplaces and along those trails all across the bay area, like this one you see right here. this is over at the stevens creek trail in mountain view. now, the goal here is to help in the environment by using a different form of transportation for the day. anything to get cars off the road and get people on their bikes to enjoy the outdoors, get a little exercise, de-stress versus sitting in traffic all day. energizer stations gave out water and some snacks to cyclists as well as maps to help them along the way, which is nice to see. we've got a lot of bike riders, i think, here in the bay area. yeah, absolutely. so if you bike to work, you still got a bike back home. so let me show you that forecast early. and for us, maybe it's just for running errands and getting out around town throughout the rest of the day. here's a look at our forecast for mountain view, where we are going to be at noon 72 degrees. just really nice out there. and our temperatures make it into the mid 70s for today with a mostly sunny sky, but we are seeing a wide range in

in denying a request from house republicans for audio of that interview between special counsel robert her and president biden. now, we've had the certified transcripts from that interview from for months now. biden's critics in congress, they actually wanted the audio, but doj said no. now, the white house is saying no. they're claiming that interview is property of the executive branch and not something the legislative branch can have. nbc news and other news organizations believe that audio is public record, given the transcript has already been released. and there's a new camp protest at uc berkeley. dozens of pro-palestinian protesters occupying a uc owned building near people's park. the occupiers brought signs about the war in gaza. a uc berkeley spokesperson says this group of mostly non-students is not connected with the protesters,

who left their encampment at sproul plaza after reaching an agreement with the university. one protester says the takeover is for nakba, a day palestinians remember hundreds of thousands of their people being displaced in 1948. university says it's not going to comment on what it may do. there are a number of police and security guards keeping a low profile near the occupied building. well, new at 11. uber is trying to make life a little easier for caregivers. the ride share service is launching uber caregiver this summer. it's a tool designed to simplify getting rides and medicine to those with health problems. now, once your insurance provider has added, caregivers can pay for rides to appointments, pharmacies and grocery stores. the driver, rideshare and caregiver can talk in a three way chat feature on that app. redwood city will host boat lovers all weekend long as a west point harbor welcomes back the pacific sail and powerboat show. nbc bay area's

george clooney should be on that boat. lake cuomo no question. the next one is was in the movie argyle. absolutely it is a 33 foot fairline express cruiser again v-8 power. it is a british built. it is very similar to what an aston martin style would be with the upholstery and the and the design. it's just a lovely boat and it's a debut of this west coast as well. what shocked me is that you can sleep four on that one, but the one that i really like is the one that sleeps ten. the sailboat, the 44 foot catamaran is fantastic. it is even keeled so you don't heel over like you might in a regular sailboat. and that's very enjoyable as well. but it it is comfort, comfort, comfort. world cruiser has all of the items electronics that you need to make a voyage across the ocean, and the next one is a really quiet ride because it's electric. it's a vita electric boat 26 foot. also a debut on the west coast, actually in the united states. there's two of them here, and we're going to be doing rides on those boats. if

sunday. doors open at noon every day. tickets for adults are $12. talk about a good time. you know there's nothing like a nice old county fair, you know? right? when's the last time you've been, though, i try to take my. i grew up in the central valley, though, so it's kind of a way of life out there. well, you know, fair seasons, just getting started. so, you know, maybe next weekend. this weekend they have pig races and stuff. my kind of party. it is nice. and we have some great weather too. for the contra costa county fair . it's going to be in the low 80s and it cools down quickly. so you want to make sure you have a jacket if you're going to be out there late. not only today but the next several days, warm afternoons, cool evenings, and a lot of sunshine throughout the day and looking at our temperatures around the bay area. we have low 70s in the forecast for the north bay. it may be a little bit warmer tomorrow as we take it into the afternoon. we're anywhere from 75 in napa to 77 in santa rosa,

and we're also going to see some hotter temperatures farther north, while we're also going to see much of the rest of the bay area in the 70s and cooling down quickly in time for first pitch for the giants game tomorrow evening. we're going to see those numbers coming down to the mid 50s as the wind picks up and the clouds will be rolling in. so you can also watch that from the comfort of your couch right here. and we have much warmer weather for the bay fc game tomorrow night. it's going to be in the upper 60s and then dropping down to the low 60s. so really nice there. there's also the 626 night market at the alameda county fairgrounds. we're going to see temperatures tomorrow evening going from mid 70s to as soon as the sun sets. will be in the upper 50s. so that's a significant cool down there. and then for the oakland greek festival, this begins tomorrow. continues throughout the weekend. and we're going to see those numbers in the mid 60s for the middle of the day. and then upper 50s later on in the evening. and when there's also the boogie music festival happening in downtown campbell.

now, we're going to see this festival on both saturday and sunday, and we're starting out in the morning with low 60s and making it into the low 70s with an all clear sky. and then we have bay to breakers on sunday to wrap up the weekend and get in some of those steps. we're going to see temperatures in the 50s to start. and good luck to all of the racers out there. maybe be watching it on tv. we're going to see those temperatures in the mid to upper 70s as we go throughout the weekend. for the inland areas and then for san francisco. expect some mid 60s in the forecast east through early next week. and now let's turn to our climate in crisis. california's coastline is constantly changing, but there is a group of scientists at scripps institution of oceanography. they're keeping an eye on those changes with some pretty advanced technology. they go out once a week and use a laser mapping system called lidar, which also stands for light and detection and ranging. and their goal is to understand how, when

and where coastal bluffs fail. they're able to compare even the smallest changes at the beach from the week before to even the year before. and researchers use this information to build better models to help predict how our coastline is going to evolve. predicting when and where a landslide is going to occur is extremely difficult. definitely, there are things that we can look for. you can tend to get repeated events in the same area over time. and so a landslide can be active over a period of weeks or days or months. the recent el nino may be a glimpse into those changes. ocean levels rise slightly during an el nino year, and combine that with heavy rain, king tides and a couple of days with huge waves this past winter, it was all a recipe for erosion. if you want to learn more about this technology, it's on our website, nbcbayarea.com. look for this story on our climate in crisis page. all right. thanks, gary. well happening now. the port of oakland is celebrating the arrival of a new commercial hydrogen refueling station. this

is to help fight climate change. the station sits near the east bay mud headquarters over in west oakland. it will be used to help power zero emission hydrogen fuel cell trucks with a range of up to 400 miles. that project will also initially include about 30 trucks as part of a zero emission funding grant. if distraction was his mission, one animal certainly scored a goal. next on nbc bay area, the raccoon catching a lot of attention for causing some stressful moments at a soccer field, trying to catch him in a garbage can
