who was shot as investigators prepare to deliver an update. good morning and thanks so much for joining us. i'm laura garcia and i'm marcus washington. that investigation into the shooting involving san jose police and a suspect continues. now, police say that that suspect was firing a gun in a densely populated neighborhood. well san jose police also telling us that they'll provide an update in about four hours. nbc bay area's kris sanchez has been at the scene all morning long. chris, what do we know? i can tell you that there is still a bit of a disruption here in the neighborhood. you see the crime scene tape here behind me, and officers are still actively investigating here on the scene. this is a parking lot that is blocked off. it abuts the alleyway where it appears at that officer involved shooting ultimately happened. it was in that alleyway where we got video just about an hour or two ago of both a patrol car and a gray van being covered up and put onto

flatbed trucks and then towed away. that was the same vehicle that we saw in investigators honing in on yesterday as they were investigating shortly after that suspect was shot. now, this is the area of coleman drive and or rather coleman drive and story road. and this all started about 4:00 yesterday afternoon when people started calling 911 to report a man firing shots. we did talk with someone in the area who said that with this many people walking around this neighborhood, it really is concerning. our homicide unit is investigating the incident as they do with any officer involved shooting. that's also being a going to be audited by the independent police auditor, the independent or the office of internal affairs, as well as the city attorney's office. and the district attorney's office is also here investigating. the officer involved shooting. we talked with neighbors who say they did not know that man at that point. perhaps now, a day later, something will come to them. we will say that in addition to the san jose police

department's internal affairs unit investigating, we will all we are also seeing investigators from the city attorney's office, as well as the santa clara county district attorney's office. all of this is protocol. when an officer is involved in a shooting, the suspect is fighting for his life, has life threatening injuries in the hospital. at last check, none of the officers were injured in san jose. kris sanchez, nbc, bay area news. all right. thank you for the latest there. funeral services are now scheduled as the iranian state media says the country's president and foreign minister are both dead following a helicopter crash, reports say their chopper made some sort of crash or hard landing in northern iran. as nbc's keir simmons reports, rescuers were slowed by bad weather and heavy fog. reporter well, governments across the middle east, including here in the gulf, are watching and worrying about events in iran. this morning with that news that president raisi did die in that helicopter

crash, an iranian official describing it as a hard landing last night before the news of the fatalities emerged and saying it was due to fog and bad weather. and certainly the images of the frantic hours long rescue operation in iran on the border with azerbaijan do show thick, thick fog and mountainous terrain. now iran is in mourning . the first vice president has taken over. he is as almost as much a hardliner as president raisi was. he went to russia to do a deal over weapons. back in october, president raisi presided over a government that sent missiles towards israel and historic move just last month over a government that crushed protests over women's rights after the death of a 22 year old woman. so there will be many

around the world who will not mourn him. many others, though sending their condolences, including president putin of russia and president xi of china. where this goes now in a region so marked by instability, is a question many people in many capitals will be asking today. nbc bay area caught up with iranians here in the bay area. one man with the iranian-american community of northern california says many iranians he has spoken with are hopeful this crash could weaken the country's current regime and may make way for change driven by its people. this is all because the iranian regime is afraid of the next nationwide uprising, which is in no doubt is going to happen sooner or later. we are also continuing to follow the developments out of iran as they come in for the latest 24/7, visit our website

nbcbayarea.com. a live look in san francisco this midday. we are moments away from federal, state and local leaders celebrating a big step to ambitiously connect san francisco to other parts of the bay area and eventually parts of the state. speaker emerita nancy pelosi and mayor london breed are among those highlighting billions of dollars in federal funding now dedicated to help caltrain expand its footprint. now for more on this vision and how it's moving forward, we want to turn to nbc bay area's ginger conejero saab. reporter what is being celebrated this morning is a major step towards moving a project forward. that project is a transit project called the portal, and it will extend the caltrain rail line, which currently ends at fourth and king streets in the city, to the salesforce transit center. that's more in the heart of downtown san francisco. the transit center has been up and running for years now. below the street level are. the bus concourse is another massive

structure that was built to accommodate trains. trains that cannot yet get there. that's where this project, led by the transbay joint powers authority, steps in. it recently got an over $3 billion boost from the federal government, and the head of that agency recently shared the portal is now in the engineering phase of the capital investment grant, meaning nearly half of the $8 billion price tag would be funded. here's animation from the transbay joint powers authority. you can see how the trains will go underground, then turn under second street and then eventually arrive at the transit center under natoma and min streets. it's not a long stretch that would be connected, but the price has ballooned over the years. unfortunately that number will continue to climb the longer it takes to get the project started. the agency is still short 2 to $3 billion today. however a federal state regional leaders are celebrating moving this project forward and anticipated end date to this,

which would connect possibly northern and southern california with the high speed rail project, is set for 2032, in san francisco, ginger conejero. nbc bay area news. oakland police are investigating a deadly shooting. we do have this video here. this is from the scene this morning with the victim's car after it crashed into a construction site. it happened around 215 this morning about one block from broadway and 14th street. police telling us that that man was shot and killed. so far, no motive is being released and no arrests have been made. new overnight fremont police investigating a deadly motorcycle crash. it happened a little before midnight on niles canyon road and for a time, both directions were closed. no other vehicles were involved. the victim has not been identified. the road is back open. the international criminal court is seeking arrest warrants. this is for israeli prime minister benjamin netanyahu and the leader of hamas on charges of war crimes. the icc are also seeking warrants for israeli defense minister, as well as two

other top hamas leaders. the warrants against the israeli politicians marked the first time the icc has targeted the top leader of a close ally of the united states. well, antioch's mayor is in china this midday. this is new video of lamar hernandez thorpe as he participates in meetings with the government and business executives there. now he's taking part in the 2024 silicon valley mayor's china trip. his office says. during the talks today, he actually spoke to world leaders about antioch's economic advantages and housing opportunities. he also gave a lot of high fives. there all right. back here in the bay area, we're tracking your monday forecast with a live look outside in the east bay overlooking walnut creek. really keeping tabs of the forecast. as our own meteorologist kari hall it looks great out there and i just can't wait to get some more sunshine. high five. might as well everybody. high fives all around. we're going to continue to see this great weather as we

go through the week. just a little bit warmer. let's take a look at what we're going to see as we go into the rest of the morning. into the afternoon. right now at 68 in dublin and it's 62 in martinez, a lot of these spots in the 60s, but we're still in the low 60s in the south county. and when you take a look at what we're feeling now versus yesterday at this time it is about five degrees warmer in santa rosa. so in the north bay, it's warming up a little bit more quickly. and we're going to see highs in the north bay into the upper 70s. we're up to 80 in concord. and a lot of these numbers are just slightly above what we typically see for this date. and it gets even warmer tomorrow. so we'll take a look at that and the rest of the week's forecast coming up in a few minutes. laura marcus, thanks so much, gary. well, a legal victory for wikileaks founder julian assange is ahead of nbc bay area we're going to have for you during our midday newscast the impact it could have as his flight extradition to the us, plus the way san francisco is playing a part in an international push to

to avoid extradition to the united states on espionage charges. nbc news meagan fitzgerald reports from london on the legal victory for the wikileaks founder. a big day here at the london high court, where judges ruled in favor of julian assange and against the united states government, giving assange the right to appeal extradition to the united states. now we know that these judges made this decision on two grounds. one, that should he be extradited and stand trial, that the trial would be prejudiced against him because of his nationality. he's from australia, and also because he was wanting assurances from the

samantha. and this was in back in 2013, in the movie, her now, in a social media post on x, the company says that it is working to pause the use of sky while it addressed this questions about how the voice was selected, openai previously stated that it didn't mean to make sky's voice sound like johansen. now to a live look in a san francisco, which will soon serve as a new hub for the united kingdom in its effort to reduce risks from artificial intelligence. british leaders this morning are announcing a new branch of its ai safety institute to test advanced artificial intelligence systems. the move will increase the uk's cooperation with the us and allow britain to tap into bay area talent. britain established its first ai safety institute last fall. in the meantime, us regulators are reportedly giving elon musk the green light, allowing his company neuralink to conduct a second brain chip implant. neural link chips can give people the power to control computers with their thoughts,

the wall street journal reports. this new approval comes despite recent setbacks for person with a first implant, which the company is now working to fix, scientists are creating a stronger thread which connects the chip to the brain. well, new at 11, the top pediatricians group in the us is making a sharp policy change about breastfeeding for those with hiv. the american academy of pediatrics now saying that mothers can breastfeed as long as they are taking medications which suppress the virus, which causes aids. it is a reversal in that longstanding policy the group has had in place. this is since the start of the height h i v epidemic in the 1980s. experts say drugs used to treat hiv can actually reduce the risk of passing the virus to infants to less than 1, well target is cutting the cost on food and other items. the number of goods impacted exceeds 5000 and includes grocery staples like paper towels and milk items also

receiving a cut. pricing include meat, bread, fruits and vegetables. many of those other goods will come from targets to fans good and gather as well as ever. spring south lake tahoe residents will vote on a proposed vacancy tax come november. if given the green light, it would require residents to report that they are indeed living in their homes . once a year. they would be subjected to a tax if they live there less than half the year, it would cost $3,000. for the first year, the house sits empty and $6,000 for each year after that. some say this is just another tax for property owners, but the proposed proposal supporters say it's a way to help boost their economy. if folks are only using their houses a couple times a year, they're not in those local businesses supporting local businesses, paying the sales tax that funds our city services. and so there needs to be an economic offset, say, if you're not going to be here full time, here's a way you can contribute

to our economy. according to the 2022 census, 44% of homes in south lake tahoe sit vacant the majority of the year. the measure is receiving some pushback on social media. if it passes, the tax revenue could only be used for specified purposes, including housing, roads and transit. well, many students graduating high school in the coming weeks might be asking themselves, now what? well, luna duran of san francisco found herself asking that same question several years ago when she was going to college. and it wasn't necessarily the most financial option for her. she actually works for bright horizon. this is a preschool and early child care center in south san francisco. they actually paid fully paid, that is, for her associate's degree in early childhood education. luna has actually been able to move up the ranks from teacher to instructional coach, who oversees a team of educators, is starting a job in early childhood education. you're constantly caring for children and constantly caring for others, and i think with this

degree program was a good opportunity to give something back to myself. bright horizons tells us that they actually ask those graduates to stay on with the company for at least two years afterwards, but that there is no written agreement requiring them to do so. giraffes at the oakland zoo are getting some special treatment. it's in the form of a new feeding system you can see there. it's all attached to a pulley, so the feeder can now be raised up a tree, allowing the giraffes to eat their treats and meals at their natural height. the zoo says several donors paid for the feeder, which costs $10,000. a kitten in san mateo county is now on the road to recovery. yesterday, firefighters were alerted to a kitten stuck in a storm drain in millbrae. they used little cat food to try to draw the kitten out of the drain. thankfully it worked. now the kitten is waiting at the peninsula humane society for a forever home. cute little fella. yeah, yeah, we were leaning in like, i want to see the kitten. i know, right? it's small, but it's good. good

to see the rescue. yes all right, well, we're enjoying sunshine. it's a beautiful day and we have really nice weather in the forecast all throughout the week. and we're going to talk about something we don't usually see this time of year. but as we take a look at this live view in san jose, nice and sunny temperatures will be warming up slightly over the next couple of days. some of our valleys in the mid to upper 80s for tuesday, but then cooling back down in time for memorial day as well as some gusty winds. now those gusty winds are also pushing a lot of what's now olive tree pollen through the air, as well as grass pollen. we've seen a lot of that lately. weeds and mold. pollen is fairly low, but if you've been sneezing, maybe that's what you're allergic to. we're going to see temperatures in the upper 70s for highs today in the north bay. novato up to 77 degrees in san francisco. we're in the upper 60s today, upper 60s for san mateo and then for dublin, hayward and fremont. we're looking at a high of 75 degrees

now. those temperatures come up once again for tomorrow, just slightly with the tri-valley in the low 80s, mid 80s for concord and in fairfield we'll see a high of 87 degrees, low 80s for much of the north bay. and then san francisco up to 71 degrees. and then it starts to come down a couple of degrees for wednesday. and if you've been looking at that 7-day forecast at the bottom of the screen, temperatures continue to come down. we're still going to have some dry weather, but there will be some rain farther to the north of here. and then with the active storm pattern across the pacific northwest, we're just getting the cool air pushing down into the bay area so this is what we don't typically see for this time of year, the end of may. and inland spots like walnut creek only seeing highs in the mid 60s. that's what we're going to see on saturday. sunday only slightly warmer. and then for memorial day, 74 degrees. so we're not looking at a significant warm up here

except for tomorrow. there's going to be a quick spike in temperatures and then cooling down for the weekend into next week. so as we take a look at our 7-day forecast, upper 70s today, low 80s for our warmer spots tomorrow like livermore and santa rosa, and then upper 70s on wednesday. and then as we go toward the end of the week into the weekend once again, we'll be cooling down. no chances of rain in here, and we're going to continue with a mostly sunny sky for the afternoons, but we will see the return of the low clouds and fog in san francisco. and we're going from a high of 70 on tuesday to only 59 on saturday. so that's a significant cooldown. it's going to be a chilly weekend in the city or also for the coastline, going to the beach for the holiday weekend. it is going to be chilly out there. marcus and laura headed out. she's very quick on and off getting these skills. accomplishe and no

problem, no problem at all. olympic greatness on full display in hartford, connecticut . that's where gymnast simone biles thrilled fans saturday in one of the first key events in the build up to the summer olympics, the core hydration classic. biles won the overall title. another gold medalist didn't fare as well. gabby douglas pulled out after struggling in her first rotation. the olympic trials take place in late june. i think the women's team for the olympics, they're in good hands, i saw that. all right, well, happening now, a building fire in san jose is under investigation. this all started a little after midnight on north fifth street. this is near jackson in downtown or the japantown area. this is a building that was undergoing renovation. firefighters actually had to cut a hole in the roof of that building in order to fight the flames. the captain there says that the owner of that building is telling them that they've actually had experiences with unhoused people entering that building in the past. ahead, the
