loud music brewing in the north bay. people living in a nearby encampment say one business is targeting them. the new action being taken by attorneys. also, courtroom drama as donald trump's defense team has its turn calling witnesses in the hush money trial. we're live this morning with what to expect today. this is today in the bay good morning to you. on this tuesday, i'm marcus washington and i'm laura garcia. we're going to check in with mike for that morning commute in just a bit. but first let's get a look at the forecast. meteorologist kari hall is tracking what we can expect. yes. today, the warmest day of the week. this is what we are going to see as we get started this morning. as we take a live look at oakland, our temperatures go from mid 50s at 8:00 and a few clouds to all clear the rest of the day, and warming temperatures. now here in oakland we're going to see temperatures in the 70s up to 78

degrees 80 in fremont and 82 in san jose. so even though this is the warmest day of the week, the temperatures really aren't all that extreme. we are going to see mostly upper 70s and low 80s for the valleys. we're up to 82. in novato today, and we'll talk about a cool down for the rest of the week in the forecast. that's coming up in a few minutes. and mike, now you have a the start with the drive out of the north bay or into the north bay. yes, right here, the tunnel here, the robin williams tunnel, folks feeding out of the tunnel in the southbound direction, steady flow sometimes at this time of day, we'll see a traffic break because of crews clearing. not just yet. some low clouds, but visibility is just fine. it looks really cool. iconic view, i guess of the bridge right there across the bay. we're looking at the north bay. no slowing for highway 37. remember there was the overnight closure of the westbound direction and we've heard of no delays. so we'll talk about that. what's coming up in a few minutes. meanwhile we do have a new crash near the walnut creek interchange, so we'll track that. but no slowing shows up there or on pretty much any

other freeway except the altamont pass. that's for the freeways. back over to you. thanks mike. well, we do begin with some breaking news for you this morning. this is coming out of fremont. that's where police are investigating this fiery crash. now, it happened a little after midnight on fremont boulevard near thornton avenue. what we know now is that that car struck a tree before bursting into flames. police so far not confirming if anyone was trapped in the car, despite witnesses accounting that they suggest otherwise. now, we do know that someone was pulled from the car alive. it's not clear how that person is doing this morning. this morning, some unhoused people in the north bay are turning to a judge for protection from what they call harassment. they're accusing a nearby business of trying to drive them away by playing music . today in the bay kris sanchez joining us now with the tactic hitting a sour note here. chris. so this is an encampment, marcus and laura, of unhoused people behind an east bay tire shop that's been in san rafael for

years. things mostly have been harmonious until four days ago, when the music started. now, one of the people who lives in that encampment near lincoln avenue and second street says the music started about five days ago. it's a loop of music that blares all night long. the folks at east bay tire did not want to talk with us about the overnight music, but the president of the marin homeless union says the escalation is about forcing the unhoused people to pack up and leave. i think right now the property owner is trying to facilitate is being emboldened by the city of san rafael's antagonism towards camp integrity and trying to help facilitate the city's mission of forcing everybody out. while the city of san rafael did not respond to our request for comment about that claim that it is trying to dissolve the preliminary injunction protecting that encampment. but

we know that many local communities have been awaiting a supreme court decision in an oregon case that would clarify whether people can be fined or jailed for camping in public if communities don't have somewhere else for them to go. now, this morning, the attorneys for the people of that encampment will appear in marin county superior court. they are seeking a restraining order to force east bay tire to turn the music off. laura one, we'll continue to follow. thank you very much, chris. it is 504 right now and new overnight france and belgium announcing their support for a controversial ruling by the international criminal court tied to the war in gaza. the court yesterday called for arrest warrants for israeli prime minister benjamin netanyahu and the leader of hamas, along with israel's defense minister and two other top hamas leaders. the court is accusing both sides of war crimes and crimes against humanity. the u.s. and israel are among those harshly condemning the decision, calling

it a farce and saying there's no comparison between each side's motives. well, new overnight, many in iran mourning after the country's president and foreign minister were killed in a helicopter crash. this is new video of the funeral procession for ibrahim raisi and members of his entourage. a white truck carried the coffins for him and his foreign minister, along with seven other people who died in that crash. tomorrow marks a public holiday as a funeral for the former iranian president will be held in the country's capital of tehran. 505 for you this morning, former president donald trump, back in court today, the criminal hush money trial proceedings monday ended abruptly. this is after the jury heard more testimony from his former lawyer, michael cohen. now the prosecution rested its case. the defense called its first witness, who drew ire from the judge overseeing proceedings today in the base. brie jackson live for us in washington this morning and brie possibly another dramatic day in courtroom today. that's right.

good morning. marcus. so, judge juan marchand cleared the courtroom yesterday to scold one of former president trump's witnesses, robert costello. now, costello was an attorney for rudy giuliani. now, among other things, marchand saying, if you don't like my ruling, you don't give me side eye or roll your eyes. chaos breaking out in the courtroom during the criminal hush money trial, a former president trump, nobody's ever seen anything like this. this is a witch hunt. this is a witch hunt. judge juan merchan clashing with defense witness robert costello, a former federal prosecutor, after he advised former trump fixer michael cohen before the two had a falling out. costello testifying that cohen said numerous times that president trump knew nothing about the $130,000 hush money payments, stating cohen did this on his own. cohen's attorney coming to

his defense, i think michael has been nothing but, forthright with this prosecution team. while on the stand, cohen admitted that he stole money from the trump organization because he did not receive a large enough bonus. trump allies speaking out. there's a lot of crime in this city, and the manhattan d.a. should be focused on real crime, not on a president of the united states. a protest outside the courtroom continue. those against trump chanting no one is above the law . no one is above the law. his supporters, echoing claims that this case is a witch hunt. we did nothing wrong, and i want to get back to campaigning. i'm representing millions and millions, hundreds of billions of people. judge marchand says both sides should expect to deliver closing arguments after memorial day in manhattan, district attorney alvin bragg's office presented its case with testimony from 20 witnesses over

15 days. marcus and it continues today. all right. brie jackson this morning in washington, brie. thank you. happening today, san francisco leaders will formally condemn a still unsolved racist incident that left many people rattled in the alamo square neighborhood twice in the last month. terri williams says he received packages on his doorstep containing a doll in a noose and a message with racial slurs telling him to leave. since then, neighbors have rallied around him. today, supervisor will adopt a resolution condemning the intimidation and threats made towards his family. it also urges police to prioritize the investigation. san jose leaders say they will hold a final vote today, clearing the way for 150 foot buffers between schools and rv parking or homeless encampments. now that ordinance will ban rvs, tents and other dwellings anywhere within 150ft of preschools, elementary and secondary schools, as well as daycare centers. the new role

will start as a pilot program near three schools in east san jose, and if it works, the council may extend it citywide. let's take a live look outside this morning. and here is san francisco getting started with the day. not so clear, but certainly not that bad. meteorologist kari hall, of course, been monitoring what we can expect weather wise throughout the day. and you said earlier, cory, hottest day of the week. yeah. and the temperatures are coming up a few more degrees compared to yesterday. it's already clear as we take a live look outside in san jose, and the sunshine continues throughout the day. we're going from low 50s to low 70s at 11:00 to then seeing temperatures briefly making it into the low 80s. but what we are going to see today is going to be a little bit above what's normal for this date in san jose. we're used to seeing temperatures in the mid 70s, but we'll see a high of 82 and 86 today in concord. mike, how about those gas prices. are they going down. you know overall we're seeing that downward

right. thanks, guys. you bet. use those pipes right now. well, speaking of it, the king. yes, elvis presley, the music icon's famed graceland estate over in memphis is set to be sold during a foreclosure sale this week. that sale date has now been set for thursday. this is all according to legal notice. however, presley's family fighting back to stop that foreclosure sale. presley purchased graceland mansion back in 1957, and lisa marie inherited the property after his death. however, lisa marie died in january of 2023 and her daughter is now the heir of the estate and trustee of the promenade trust. presley's granddaughter has countered that lawsuit, saying that the claims to that estate are fraudulent. according to the document. the music stars heir says lisa marie presley never borrowed money or even gave a deed or trust to nason. nason investments, which is the company behind that upcoming sale. an injunction hearing is now set for wednesday . trending for you this morning. you have just two more days to

50 in san francisco. and then as we zoom in to the south bay, this is a look at our high temperatures for today, los gatos up to 83 degrees 82 in milpitas and san jose. and it's going to be in the upper 70s for oakland and hayward with some mid 80s in danville today, upper 80s for antioch and livermore, 83 and 73, in san mateo, san francisco, 70 degrees in the mission district in the outer sunset in the upper 60s mill valley 78. while santa rosa will see a high of 84. and speaking of santa rosa, we'll see those temperatures going from the mid 80s to today upper 70s on thursday. look at saturday's forecast. only 67 degrees that is going to be so chilly, especially with the lack of rainfall and really not expecting a lot of clouds. but it will be breezy and then we are still going to have some cooler than normal temperatures extending into much of next week. so our memorial day is

going to be cool for most of us. after seeing the peak of the temperatures for today. mike, you're looking at that drive through san rafael. yeah, we're looking at a smooth drive. heading south is the commute direction. some low clouds, but no problem. no fog. visibility is great. you see, the speed sensors show green, but just churning right here. highway 37, typical westbound had the overnight closure, but right now it's open. typical commute here getting through walnut creek and two walnut creek. no problem. but that crash is south 680 approaching the walnut creek interchange. everything else moves very smoothly. the only slowing right there out of the altamont pass to be expected. we got moreews, traffic and nwe

initiative is aiming to help our kids struggling in middle and high school. the schulze family foundation, along with pinterest and americorps, they have teamed up with 11 states, including california, to create the new youth mental health corps. now it will help kids connect with mental health support, which is lacking in many parts of the country. now we know that locally there is a shortage of mental health providers who can actually afford the bay area and insurance coverage is usually not long enough to get better. now, last year, a mental health american study found that almost 60% of young americans with major depression do not receive any mental health treatment, and

it's badly needed. the cdc study found that the suicide rate among young americans increased over 60% between 2007 and 2021. a new youth mental health corps will deploy specially specifically trained 18 to 24 year old men and women to help their peers navigate and find help in the mental health system. they have somebody they can talk to who can say, look, these are the best resources in our area. let me help get you there, more quickly, around the country, we have young people that are just, waiting for weeks and weeks, in some cases months and months, to access services. in some cases, it's because they just don't know where to go, where there are, let's say, shorter wait times, where there are resources that are more commensurate to their needs. the youth mental health corps launches in some states this

far. yeah. so you might want to move on past today and get closer to temperatures. yeah. we are going to have the valleys warming up today. also starting out with a breezy wind. it's all clear and our temperatures in the low 80s. for those high temperatures in the south bay. looking at the tri-valley in livermore 83, while martinez will see a high of 84 and up to 84 in napa and in santa rosa. we'll bring it down a few degrees for tomorrow with highs in the upper 70s and low 80s for some of our warmer spots. san francisco will be in the upper 60s, and on thursday, also looking a touch cooler with san jose hitting a high of 77 degrees. so the rest of the week looks really nice. we'll talk more about the weekend coming up. and mike, you're starting out with an important closure for fremont. yeah, we continue to follow the investigation in fremont from this fiery crash. and bob redell. our crew should be on scene shortly, but over by the yellow sign. that's where american high school is down 84 or thornton. that's thornton middle school. and so there may

be more congestion over the next hour heading in toward the area. and fremont boulevard is currently closed between thornton and peralta. locals to the area will know where that is. that's near centerville. that's just off of i-80 as well. now the freeways move smoothly through the area, and in fact, most of the freeways are moving very nicely with a gradual slowdown that starts over in typical spots like 37 and highway four over in the east bay. no major issues at the bay bridge. things are very calm right there and in the south bay. we haven't yet saw the slowdown. maybe it's just starting to form another ten minutes. and where the arrow is will be some slower sensors. back to you. thanks mike. well, happening today, the state supreme court weighs the future of california's gig economy. it comes in the form of a voter approved measure some workers now call unconstitutional today in the bay. ginger conejero saab live for us in san francisco this morning. and ginger, this really all boils down to whether delivery people or rideshare workers should be considered independent contractors, right? that is correct. marcus. laura,

good morning to you. and both sides really have quite a bit at stake here. and that is why we are expecting a turnout of gig workers later, as this case or this will be heard by the state supreme court in san francisco later today. let's take it back a bit and talk about what is at the center of these arguments. proposition 22 was a voter approved ballot measure in the 2020 elections. it was sponsored by big gig firms like rideshare companies uber and lyft. there's also doordash and instacart, and it allows those big companies to treat their drivers and delivery workers as independent contractors. now, it was a response to a california law that codified a supreme court decision requiring companies to classify gig workers as employees. proposition 22 passed with 59% approval from voters, but drivers and delivery workers have continued to challenge its constitutionality. today, the state supreme court will hear arguments on both sides and where that decision falls eventually impacts the gig

economy tremendously. later today, hundreds of workers are expected to rally outside the courthouse to show their opposition to how proposition 22 works in practice. a rideshare driver that has been driving for eight years now that we spoke with, says he has seen things change. he says what is offered in the proposition is not enough to protect contract workers like drivers, and he believes it's simply unconstitutional. if there was a $10 fair uber and lyft before they started with, you know, $2 for what they do, which is the background stuff, the, you know, the leadership and the software and $8 to go to a driver. now, if that's a $10 fair, uber and lyft now take 7 to $8 and driver gets two. now we heard from uber from this just about 30 minutes ago. uber has responded with quote forced employment would be devastating for the thousands of drivers and

couriers who turn to uber for flexible work, and the millions of californians who would see major service reductions and cost increases or lose ride sharing and food delivery entirely. this is something that we can see far reaching effects from laura, and as far as today's events are concerned, we are expecting about hundreds of workers to rally outside the courthouse and also watch those oral arguments on a large screen. that all begins at 1230 this afternoon, so we'll be watching out for and updating you both on air and online. laura, certainly they want their voices heard. interesting. thank you. ginger 535 for you right now to build or not to build that is the question. and tonight people in walnut creek can let the city know what they think of a proposed chick fil a today in the bay's bob redell is at the shopping plaza. this is where the popular fast food restaurant will be built. chick fil a is a very popular fast food restaurant that can have a long line of cars outside its

location, with people using the drive thru. however, this proposed location at the citrus marketplace behind me here in walnut creek will not have a drive thru and residents are worried there could actually be more traffic because of that. because more customers would be using food delivery services instead. in march, the city's planning commission approved a conditional use permit for this location inside the citrus marketplace shopping center, which is on oak grove road. people who live nearby quickly did file an appeal because they are concerned about the impact on traffic, especially since this is so close to the major intersection with ignacio valley road. and again, because this proposed location would not include a drive thru, the appeal claims that they'll make the shopping center even busier again due to food delivery services. however, a traffic study by the city of walnut creek disputes both claims, saying the restaurant would not substantially impact traffic. i

think it would be fine. probably there's not a lot in that plaza, so as long as there's parking, then i think the traffic wouldn't be too bad. it's going to create a traffic nightmare. you got northgate high school right up the street. you got ignacia valley down the street, and certain times during the day it's going to be pretty chaotic. it is a wonderful restaurant. a lot of people love it, but definitely it could be an issue. a walnut creek city spokesperson tells us no decisions have been made and both sides will be heard at tonight's city council meeting. also adding that the project made its way through the planning process because it met all the necessary requirements here in walnut creek. bob redell today in the bay. thank you bob. 5.37 right now, drivers accustomed to traffic lights at a busy oakland intersection are seeing something else there. instead leaders say theft is to blame. stop signs have replaced traffic signals where east 12th street meets sixth near international boulevard near coast guard island. city leaders say people from a large

encampment nearby are stealing the copper wiring from the box powering the lights. as a result, the lights often stop working. people in the encampment are also believed to be pirating electricity from nearby customers. right now, the changes are indefinite, at least until the encampment is cleared. well, medical staffers in san francisco are sounding the alarm over staffing shortages, and later today, city leaders are promising to unveil a new ballot measure. this is aimed at easing that crunch. supervisor asha safai is organizing a news conference for later this morning outside of zuckerberg general hospital. he says that new fall ballot measure will address the city's shortage of first responders and emergency call center operators. the measure also seeks to boost retention and recruitment. it will be unveiled this morning at ten. contra costa county leaders later today. they are expected to address the shortage in ambulances. the county fire chief says that the problem isn't the result of triple

whammy, including an increase in 911 calls, a shortage of paramedics and not enough space at local hospitals. the county's standard time for offloading patients is 20 minutes, but many are waiting up to 90 minutes before being taken to an e.r, and emts cannot respond to other calls while waiting. he says that part of the problem includes too many people calling 911 when they should see their personal doctors or visit urgent care. from the moment that somebody calls 911, there is a constraint on the supply of ambulances. there is also a constraint on the supply of hospital beds and emergency department beds. now, at one point over two days last week, the county reached level zero for several hours, meaning zero ambulances were available. it's 540 on your tuesday morning. taking a peek outside, the beautiful golden gate bridge. we'll check that commute in just a little bit. but first let's check the forecast. okay, so

kerry, you're saying this is going to be the warmest day of the week, but not too hot. not too hot. i mean, in our standards of may and how hot it could be. well, it's not too bad. and we're starting out all clear across the bay area one of those indicators that we don't have, the marine layer that fog that helps keep our temperatures cooler right now in the low 50s, there is a light wind. and in gilroy, we're going to start out with some mid 40s in the next hour. but then seeing our temperatures heating up quickly, going from 59 degrees at 10:00 to 71 degrees at noon, and then eventually into the low 80s with a mostly sunny skies. so our temperatures are above. what's normal for this date with san francisco? up to a high of 69 degrees, oakland will see a high of 78, which our average high temperature is 68 degrees. so in some spots we're ten degrees above what we usually see. mike, you're tracking a crash. what's going on? you know, we're looking over here checking the live camera because it is northbound 880 north of the

coliseum, where everything moves very smoothly. again, these tail lights heading up toward 29th. it's the bottom of the screen right here. i do see some slowing in the southbound direction. so there may have been an incorrect report where this car got a flat tire. sounds like the tire popped and they lost control for a second. no major injuries reported a pretty predictable pattern as far as the build for the commute. the metering lights are on at the bay bridge. we'll talk about what's coming up, though tonight. you do have a game over here, so i call that out of the coliseum. the note is a 640 game tonight. tomorrow and then a midday game the following day. but this is the bigger issue is overnight. we have again the closure for westbound 37, just like we did last night. they're continuing to finish up those projects. the major weekend closures are done. but tonight you'll have that closure from 9 p.m. to 4 a.m. everything went on schedule last night. westbound. eastbound will be the next couple of nights. and i'll warn you about that again. but your typical bill shows up here on highway 37 and the bay bridge just a few minutes with the metering lights on, and the backups are already forming. it is tuesday, though. back to you

spoke shortly thereafter at a ceremony to recognize jewish american heritage at the white house. here's the president's first reaction to the accusations against israel. well, let me be clear. we reject the icc's application for arrest warrants against israeli leader. whatever these warrants may imply, there is no equivalence between israel and hamas. and it's clear there isn't much to do. all it can to ensure civilian protection. but let me be clear. contrary to allegations against israel made by the international court of justice, what's happening is not genocide. we reject that and will always stand with israel and the threats against its security. now, neither the united states nor israel are members of the international criminal court. so the arrest warrants, if issued, will not affect the accused directly. it could limit their travel, though the icc also has a warrant for

vladimir putin's arrest as well. in north america, both canada and mexico are members of the icc, as are most countries in europe, including france and germany. here's a spokesman with the state department. there should be no equivalence between israel and hamas. none hamas is a brutal terrorist organization that carried out the worst massacre of jews since the holocaust and is still holding dozens of innocent people hostage, including americans. furthermore, the united states has been clear since well before the current conflict that the icc has no jurisdiction over this matter. other news the top democrat in the senate says he'll bring back that tough new immigration bill written in part by republicans who had allowed the president to among other things, cut off the applications for asylum and bring more funding to border patrol. it was rejected by republicans at the behest of donald trump, who said publicly he wanted the border to remain an issue. we, the american people, do not have the luxury of playing games with border security. the issue is

deciding if it's the right move for your home or business. and it can get expensive when you already have solar. but aren't seeing the results and the returns that you want to. meteorologist kari hall is shining a light on that topic. california leads the nation in solar generation in 2023. what's known as small scale solar or homes or community centers was enough to power around 6 million homes, solar power is also coming to light in states like texas, florida and north carolina. as the world looks to turn off the switch on fossil fuels, solar panels can lower greenhouse gas emissions, create green and healthy neighborhoods, and possibly increase your property value by up to $15,000, according to the department of energy. as attractive as rooftop solar panels may be, it can get complicated and frustrating, with frequent and confusing changes in how property owners get reimbursed and what's known as the net metering program. last april, we changed the policy for new systems, but not

for old systems. old systems still get that. net metering deal. the new systems now have, have you still get to save the retail price if you use the power right in your house? but if you inject it into the grid, you get a much lower compensation. we're now in the third version of this program with recent reductions in buyback rates, due in part because california has expensive electricity rates. some residents have started to question whether solar panels are right for them, and that makes solar companies nervous. now, initially, it can be overwhelming trying to figure out the tax credits, the installation, the net energy metering and trying to estimate how much that that's going to cost. but just remember that the end goal is to try to switch to renewable energy, to meet our climate goals that we have, try to do what you can. yeah, we have more stories like these on our website, nbcbayarea.com and click on the climate in crisis tab. good information there.

that's a reality show waiting to happen. 30 minutes in. gary. i can't do it. yeah, yeah, we're in sacramento. how far we got? long road to woodstock. okay, we'll stay right here, then. yes, and enjoy the nice weather. we have some great weather. a little warm for some areas today, but not unbearable. we know that when we start out with a clear sky and no fog over san francisco, it's going to be a warmer day. we're at 50 right now. it's 43. in sonoma we have our usual cool start to the morning. it is 56, in los gatos, san jose, 52 degrees, low 50s for much of the east bay. but this is a look at our high temperature for the afternoon in san jose. we're looking at a high of 82. also 82, in morgan hill and gilroy. if you're looking at the 7-day forecast already up at the bottom of the screen, you'll see that the temperatures come down from here. we're up to 85. in walnut creek, danville, 84 and oakland will see a high of 78 degrees

there. also 78 in redwood city. in san francisco, we're in the upper 60s, even up to 70 in the mission district. and for the north bay, napa, sonoma, santa rosa, 84 for your high temperature. but we're also seeing quite a few storm systems moving into the pacific northwest. a lot of rain up there, none of it making it to the bay area, but it will provide some cooling as we see a shift in our wind direction and high pressure kind of shifting over toward the desert southwest. so looking at our ten day temperature trend, this is something we don't often see for our memorial day weekend. going from mid 80s to only a high of 65 in concord on saturday, sunday. also very nice. and if you're enjoying the day off and you're also going to some of the memorial day ceremonies, we can expect temperatures in the mid 70s. so really comfortable weather will continue throughout the rest of the forecast. so not seeing anything too extreme here, even though today will be above normal in some spots up to

ten degrees above normal. and then we cool down for the weekend, where we go from above normal temperatures to cooler than normal temperatures. san francisco will only reach a high of 58 degrees. like you're seeing things holding steady at the bay bridge. yeah, they're holding pretty steady. it looks like maybe the last few minutes has seen another burst of traffic, so we don't have the spacing. i did see just before you started your report, carrie, but there we go. the metering lights are on, but there is good movement. and we're approaching 6:00, another 4.5 minutes away over here. we're looking at the build though through richmond. pretty typical. the crash cleared south 880 around 29. so that's good news. the speeds should restore. we do have a little slowing right on schedule in san jose 101. no surprises there. there is a crash that showed up in the last ten minutes. south 680 around andrade. that may be a factor, but i haven't seen slowing in. remember, this portion of fremont boulevard is closed for a crash investigation, a major one. so there's closure between peralta and thornton. but the free will be accessed from central or thornton themselves. back to you. thanks, mike.
