we begin this hour, though, with major developments in donald trump's hush money trial. >> witness testimony is now complete and america's first-ever criminal trial of a former president. because of the upcoming memorial day holiday the judge has decided to wait until may 28th to call the jury back when closing arguments will begin. >> trump's legal team called only two witnesses, trump faces 34 felony counts of falsifying business records. he's pleaded not guilty to all counts. the case is about to be in the hands of the jury, they heard 16 days' worth of testimony from 22 different witnesses. >> leading us off this hour vaughn hillyard outside the courthouse in lower manhattan. vaughn, walk us through what happened in court today and what happens next? >> reporter: right, guys the defense rested their case and

after those 16 days of testimony, it's now going to be up to the jurors to make their determination of whether donald trump is guilty of the 34 felony counts or not. as we speak, the two parties, the defense, attorneys for trump's as well as the prosecutors are working through jury instructions with judge merchan. the jury is not in the room for this. they've been dismissed. right now, the jury instructions are being formulated. this is what the jurors are going to be tasked with, the two sides on different opinion on exact wording and how the law should be interpreted by the jurors when they go behind closed doors. it's up to the judge ultimately to deliver the jury instructions. >> what do you make of the case that the defense made over the

last two day and they called two witnesses, one was a paralegal who substantive e-mail and call logs. costello, was very combative at one point the judge excused the jury to actually admonish him, i don't think the defense's case went really well, what it did it fed into the prosecutor's narrative these are the individuals that donald trump surrounds him with. a defendant doesn't need to put any type of case, they're presumed innocence and trump will still be presumed innocence. but i think this fed into the narrative of the prosecution. >> vaughn, you covered the trump campaign and we need to ask you about something that happened outside the courtroom, the former president posted a video on his truth social, if trump was to win the election, not real headlines, one of them reads industrial strength significantly increased driven

by the creation of a unified reich, of course the term used by the nazis, that video has since been taken down from his trump's account. how is the campaign explaining that? >> reporter: they're not explaining too much beyond placing it on an unnamed staffer for posting the video. that mock headline was in that video at the same time i think it's worth noting that it was first alerted to the campaign when ap posted a story about it at 9:00 p.m. eastern it wasn't removed by donald trump off of his social media account until nearly 12 hours later, if you're looking at the statement from the biden campaign they're a little bit more explicit with their pushback. america stop scrolling and pay attention. donald trump is not playing games -- rule as a dictator with

reich -- so, donald trump here making the case through his campaign that the video was posted by a staffer while he was inside of the courtroom and that video has since now been deleted. >> thank you both. an international airlines said a passenger died mid-flight after the plane experienced what they're calling severe turbulence. the. >> the singapore airlines flight was heading from london to singapore but had to be diverted to bangkok. let's bring in josh lederman. josh, what more are we learning about this incident and the person who ultimately died? >> reporter: this flight was about ten hours into its flight to singapore. this was drop of some 16,000 feet in the course of about

three minutes. now we know that dozens have been brought to the hospital according to airport authorities seven of them were in critical condition, many more dealing with less substantial injuries and as far as the person that died, 73-year-old british citizen and according the the airport's general manager they believe he may have had a heart attack and how directly that was connected to the turbulence and exactly what took place was pending, but clearly a very terrifying incident for everyone onboard. >> it's really incredible for that to happen. josh, how are british and singaporean authorities responding? >> reporter: yeah the british foreign ministry say they have provided help, they're in contact with local authorities and in singapore the transport minister said all of the various singaporean authorities are providing assistance not only to the people who were onboard and their families but to crew

members as well, kate. >> josh, thank you. israeli prime minister netanyahu is lashing out at the international criminal court. >> its prosecution said he's seeking arrest warrants on israeli authorities and hamas leaders. nbc news international correspondent matt bradley joins us now. matt, where does this process of icc arrest warrants stand right now. >> reporter: it's not done deal, right, we don't know if it's going to go through, this is the chief prosecutor said he's going to be seeking these warrants and then it goes to a panel of several judges, they take two months to actually issue those warrants. again, not a done deal. it could still be happening. benjamin netanyahu and hamas as well, senior officials included

docu-series about child actors in the late '90s. bell told me more about the abuse he suffered as a teen and his reaction to what that abuser did after he left prison. >> i came here today to tell my story. >> reporter: in the docu-series "quiet on set," drake bell described being repeatedly sexually assaulted as a teenager by dialogue coach brian peck, who worked with him at nickelodeon. he said the best word to describe it was gruesome. >> i can't tell you what he did to me and this be aired on national television. >> it's too graphic? >> it's far, far too graphic. >> reporter: bell said some abuse happened in a room where a signed painting of john wayne gacy hung in the wall. >> how far is this really going to go. am i going to make it out of

scene tape is, that's where the road narrows and people are going too fast. in his opinion, the crash happened around 1230 this morning. no other vehicles are involved. two men were in the car and as you can see in the video, as i mentioned, the car caught fire. the passenger was rescued, but sadly the driver did not survive. the pet store surveillance camera captured the collision. the general manager who watched it tells us that it does show the car speeding, at least according to his estimation. he can see it hit a lamppost and crash into the tree. he says that within about 10s, a fremont police officer happened upon the scene. the officer immediately grabbed his fire extinguisher from the back of his vehicle, and ran over to the vehicle, putting out the flames that were underneath the car at the moment, trying to subside them, managed to get them low enough, so that way he and the 4 or 5 people who came out of the apartment complex were able to get the remaining survivor out of the car, and then they all just backed away

from the vehicle because i think it was probably a at risk of catching on fire. again, a wrecker has removed the car from the scene, still waiting for the driver off. this is while the father of the driver or a young man, the man who died watched on earlier this morning. the father is still out here. he told me that this was his son and in spanish he said, quote, they could have taken him out, they could have taken him out. but they let him burn. now, there's no indication that first responders did not try their best to save the driver. the passenger was taken to the hospital again. his condition unknown, and police again do not know if the driver was speeding or what might have contributed to this crash. fremont boulevard between thornton and peralta has been shut down. police estimate it should reopen early this afternoon here in fremont, bob redell. nbc bay area news. thank you. bob. here's some other stories you need to know about san jose leaders cracking down on homeless encampments near school. a federal investigation

now launched after a deadly crash in the east bay. but first, san francisco leaders working to condemn a series of racist threats in the last month , terry williams says he received two packages at his doorstep. they contained a doll in a noose and a message with racial slurs telling him to leave. ever since, neighbors have been rallying around williams, and today, sf supervisors will adopt a resolution to condemn the intimidation and threats toward his family. it also urges police to prioritize this investigation . a deadly crash in the east bay being investigated now by the ntsb. and it happened last month in pleasanton. police say an electric vehicle crashed into a large tree, burst into flames. it killed tarun george, his wife and their two children, nine and 13. the owner of the car actually belonged to tarun, george's coworker, and before the crash, he had actually filed a complaint about the car. a vinfast vf eight complaining about steering issues. it's not clear yet if that was a factor in this crash. san jose leaders will hold a final vote today to ban rvs, tents and other

ebrahim raisi. images released by state media shows thousands of mourners gathering for a funeral po procession today. tomorrow has been declared a holiday in iran. it's scheduled to take place in tehran. in southern italy hundreds of homes were evacuated. more than 160 earthquakes have struck near a super volcano in the last 48 hours, the strongest quake registered at 4.4. the most powerful we've seen in 40 years, no injuries have been reported but plans are in place to evacuate 500,000 people if things get worse. elvis presley's famous graceland home is in danger of foreclosure, a public notice posting earlier this month that elvis' late daughter used the

old racetrack in charleston to commemorate 260-odd union soldiers who died in the infield in an open-air prison, that's by any count the first full-scale grassroots practice of what we have come to call memorial day. >> as a historian how do you suggest that we commemorate and mark this day, beyond the barbecues. >> beyond the barbecues and bike races and so on, well, it's always going to have a sacred quality, it's commemorating the dead, it's a local, personal matter. it's also a national matter and it's generally been the scale of wars that have brought us out in political ways. when memorial day becomes politicized it's a problematic
