live nation is a monopoly that needs to be broken up. the reason the doj says this has nothing to do with getting tickets to shows also how the company is responding. good morning. thanks for joining us for our midday newscast. i'm marcus washington and i'm laura garcia, live nation, the parent
11:01 am
company of ticketmaster, is feeling the full weight of the u.s. government and 30 states as it faces a massive new lawsuit accusing it of ripping off customers. the department of justice and state's attorneys general say live nation acts as a monopoly, and scott mcgrew is here with us now. and scott, they actually say that they have emails to prove it. yes they do. good morning. the doj pointed us to emails between live nation and another ticket promoter called oak view group, where the two companies discussed not allowing artists and agents to play the two companies against each other. just one of the many allegations in the lawsuit. but strong evidence of what the government would say is illegal collaboration between competitors. just about every ticket buyers familiar with the frustration of trying to get a ticket. how they're snapped up quickly, the astronomical prices scalpers set. well, today's lawsuit does not solve those problems. it focuses rather, on the way live nation works with stadiums and other ticket companies. for instance, punishing a stadium for working
11:02 am
with some other promoter by withholding future live nation concerts. we are not here today because live nation ticketmaster's conduct is inconvenient or frustrating. we are here because, as we allege, that conduct is anti-competitive and illegal. now, in a statement, live nation responded to this, saying, quote, this lawsuit distracts from the real solutions that would decrease prices and protect fans, like letting artists cap resale prices. that statement goes on to say the doj is wrong to portray live nation as the source of fan frustration, because live nation says it ignores everything actually responsible for the high cost of tickets, like scalping and the production costs of putting together a rock concert. now not far away from there in washington at the capitol, the house education committee held more hearings on what it says is
11:03 am
anti-semitism on college campuses, specifically the pro-palestine protests. the committee asked to hear from three university leaders who had negotiated settlements with protesters to end the protests. the witness with the white hair there is chancellor block from ucla, but it was the president of northwestern university who defended the three schools decision to show restraint. we made the decision to talk to our students, to model the behavior that we want to be engaged in that dialog rather than force. and we had a de-escalation. the tents came down right after the agreement was struck. the entire protest is now in conformity with the university rules. now, an update a small number of protesters have since returned to ucla this morning, startling shortly after that testimony, live pictures from the air in los angeles. they're back with
11:04 am
some tents and a few barricades. but again, a very small number. president schill, who you saw there in the purple tie, was questioned by the panel about investing, fighting anti-semitism. he himself is jewish, and he's talked in the past about his religions, dedicated to tolerance. even if the people that you're tolerating saying you don't like very much. right. interesting and this isn't the first time that university presidents have been in the hot seat, and it's been a hot seat. we've seen some contentious hearings before, and congress is free to invite any university president. they want. and the witness always thanks the committee for the invitation. but i don't think they really want to be there. no one wants. well, because both the president of penn and harvard had to step down. yeah that's right, their appearances. that's right. so okay. interesting to follow. thank you scott. well one person is dead. another hurt after a mobile home caught fire in the east bay. nbc bay area's bob redell is in pleasanton with the overnight race against time for firefighters that they ultimately lost. i did speak
11:05 am
with a battalion chief with the livermore pleasanton fire department who tells us they did try to save the elderly man who lived in this home here with his wife. but the fire flashed over and the captain was crawling inside this double wide trailer home, trying to reach the man. he had to get out of the structure for his own safety. the fire started just before midnight. this is a home here in the hacienda mobile home park on vineyard avenue and pleasanton. when firefighters arrived, they say the home was already fully involved and the wife? she was able to get out on her own. she was obviously very upset about the fact that her husband was still inside the bbc tells us. they actually had to stop her from trying to go back in to try to save him. we spoke with the next door neighbor, who was briefly evacuated by the fire department. i was just praying my heart out because they were fighting this humongous fire. it was a very hot, fast fire. so they've been they've worked all night. did you know your neighbors? oh, very much, very
11:06 am
well. your thoughts on the man who passed away? oh i'm so sad. and i'm praying for my their family, praying for kathy and richard was a dear man. the wife was taken to the hospital for what the fire department says were minor injuries. the livermore pleasanton fire department has been on the scene this morning. they've been waiting for the sun to come up. one to have the coroner come out to remove the man and chu to get their investigator inside this home, so they can try to figure out what caused this deadly fire here in pleasanton, bob redell, nbc, bay area news. thank you bob. well, students and parents alike in shock on a south bay campus after a violent confrontation ended in a stabbing and an arrest, nbc bay area's kris sanchez was on campus as students and parents returned to class this morning. there are counselors on campus today to help any student or staff member who needs help processing, but we can tell you that the student who was stabbed
11:07 am
is going to survive, had non-life threatening injuries. and i talked with gilroy police this morning. they say there's no indication that this was related to any sort of gang activity. it happened yesterday afternoon, just about 24 hours ago. and according to gilroy police and gilroy unified, ■the two boys were in a fight in a school locker room when one of them pulled a knife and stabbed the other. a on campus, and thee was almost was there almost immediately and called lockdown, which lasted about an hour. while gilroy police investigated. this was clearly traumatizing for the students who witnessed it. and you just hear a big commotion and i just see a kid laying on the floor and bleeding out and then everyone's just circling around and then they they haul them off. although the end of the school year is here for many students around the bay area, here at christopher high school, there are still two weeks left in the school year, so still activities and finals and graduation, which is coming up on june sixth in gilroy. kris

sanchez nbc, bay area news. all right. thanks for the latest there, chris. well, as you know, we're heading into a three day holiday weekend. and yet another sign that summer travel season is taking off. according to triple a, memorial day travel is expected to be the busiest it's been in nearly 20 years. and this midday we have team coverage for your planned trip. meteorologist kari hall is tracking that forecast our mike inouye monitoring any impacts to your drive. but first, let's head over to nbc bay area's ginger conejero saab. she is tracking the busy travel day. it's still an early start to the memorial day weekend. here at sfo, but according to triple a's projections, today will be the busiest day for travel heading into the weekend. take a look at those security lines behind us. they've fluctuated throughout the morning, but they've definitely been manageable. those wait times have been manageable, ranging anywhere under ten minutes to get through whether you have priority clearance or not. that might all change later in the day, especially with triple a's forecast for this unofficial kickoff to the summer season.
11:09 am
they say this year's numbers are inching closer to a 2005 record of 44 million travelers. the forecast for this year is just shy of that number, with 43.8 million travelers over 38 million people are traveling by car. that is the most road trips triple a says it has ever seen. 3.5 million people are traveling by air, both of those numbers up by 4% since last year. now, according to a triple a spokesperson, there's a surprising new category of travel that's quite popular these days. cruises have been gangbusters, as she put it, since the pandemic. that was the industry last to come back, and it has just exploded. here's triple a's spokesperson giving her thoughts on why travel is still growing. two things there one. prices are not much higher than last year, so we're not paying much more for flights, hotels and car rentals. in fact, it really obviously depends where you're going for flights. but if you're willing to fly basic economy and maybe have a
11:10 am
layover, you might be able to score a pretty cheap flight, especially if you book a for a flight that leaves tuesday or wednesday. those are the cheaper days. i just chose to go this weekend not because it's memorial day and yeah, it's a little expensive, but heck, i'm going with my 30 year old son for five days. it's not the end of the world. that busy travel will involve some delays, especially if you're planning on traveling to tahoe this weekend. caltrans warning bay area travelers to be wary of delays on interstate 80 because of emergency construction starting in colfax and extending to the nevada state line. caltrans plans to pause some of that construction starting tomorrow afternoon, running through monday. but if you are planning on getting a head start today, those projects may add 30 to 40 minutes to your drive times and back here at sfo, you don't want to experience what one man we spoke to did this morning. he arrived at the airport 50 minutes before his flight. he says he missed it and now his flight to mexico has been
11:11 am
purchased. and until 11:00 tonight, something that we can all be reminded of on a busy travel day. like today, a lot enough time to get through the lines here at the airport at sfo. ginger conejero saab nbc, bay area news. only 12 more hours to go for him to learn a lesson. yeah, you don't want to delay your vacation again. that's right. and you've been tracking some of those flight delays? yeah, it's been mainly on the east coast, but that can cause a ripple effect for those other flights that are going elsewhere. and now we're still seeing some 97 minute average delays for those flights from the new york area. and we're also seeing about 30 minute average flights for boston. it looks like it's improved for newark, but elsewhere we are looking pretty good here with those travel plans and flights arriving on time, it's all clear across the west, so we're not seeing any delays here. but if you're here, you're going to enjoy the weekend and also some events going on. we have bottlerock happening in napa and
11:12 am
we really couldn't have more perfect weather. highs near 70 with sunshine. mike, you've been keeping an eye out for any unusual traffic flows and so far, well, the better usual traffic flow has been lighter flow this morning just a bit, but it's a shorter lived. so look the south bay completely. well almost completely at speed. the note of course, like yesterday and like tomorrow around san jose state, watch their repeated ceremonies over at the event center. and that means more traffic as folks get to the graduation ceremonies, then clear in time for the next one to come in. that's going to affect the off ramps near 280 and 87 into downtown. oh, over here we do see some early slowing getting out to the altamont pass. so that is getaway traffic. some folks head over to i-5 getting over toward the sierra. same thing if you're going through the north bay, but no slowing here. so at least things are holding off for a bit today. expect the traffic to build though, as we get through the afternoon and into the evening. back to you. thank you so much, mike. well, breaking their silence, sean diddy combs ex-girlfriend, speaking out after the video of a violent

assault against her goes public. ahead this midday, the message she's sending amid the domestic violence scandal at the hands of the mogul. plus, a live look in oakland mayor shengtao outlining her challenges as the city faces a $117 million budget shortfall. what she says is not on the table when it comes to addressing financial challenges

scottie scheffler. louisville police say the detective who arrested him violated policy when he failed to activate his body camera. new video from that day was released by the police department this morning. you may recall last friday, scheffler was arriving at valhalla country club for the pga championship, but a deadly accident caused traffic problems as he tried to enter the club. the golfer was stopped by the detective, who
11:16 am
was directing traffic. the detective said scheffler demanded to be let in and then continued. the officer claimed he was knocked down. scheffler attorney says the new information changes nothing for his client. nothing has changed since my comment last friday. he didn't do anything wrong. we will go to trial or the case will be dismissed. we are. we have no interest in settling the case. there's no discussions regarding that. we're prepared to litigate it as deeply. louisville's police chief says the detective faces disciplinary action. scheffler is due to appear before a judge on june 3rd. well, the ex-girlfriend of rap mogul sean diddy combs is breaking her silence this comes after video surfaced showing him beating her in 2016. now we want to warn you this video is disturbing. a video captured in a los angeles hotel, it matched the description of a violent beating, the victim, cassie ventura, detailed in her now
11:17 am
settled lawsuit. and that lawsuit ventura claimed combs raped and physically abused her over the course of their relationship. in a statement posted to instagram, ventura is thanking her family, friends and strangers for their support, saying in part, quote, my only ask is that everyone open your heart to believing victims the first time. it takes a lot of heart to tell the truth out of a situation. you are powerless in now. diddy over the weekend released an apology video calling his behavior, quote, an inexcusable. the l.a. district attorney's office says it is aware of that video, but would be unable to charge anyone in connection to it because it happened outside the statue of limitations for assault. well, now to a live look for us this midday, laura. that's right. we're talking about oakland this midday, where mayor shengtao was outlining her plan to fill the city's $117 million budget deficit. and she says the city can do it without cutting staff or defunding police and fire
11:18 am
departments. mayor tao says the deficit will be closed partially through personnel moves and freezing more than 100 jobs in the city. she says the city's 911 dispatch system remains fully staffed in the budget, so there will be no cuts there. that's thanks to recent investments that help fully staff the 911 dispatch program, improving response times another factor bringing in more money into the city is the sale of the city's stake in the coliseum. the city sold its half of the land to private developer african american sports and entertainment group for a minimum of $105 million. this transaction should have happened a long time ago, so that we can develop ndp oakland to allow for those families to prosper from that investment and so with that being said, we're just thankful that, you know, that the stars kind of aligned. however, at the end of the day, we'll still be working towards making sure that we address the structural deficit as we want to be really
11:19 am
responsible when it comes to our finances. the city is also proposing a rebate program to promote film production in oakland. the incentive will offer film projects a 10% rebate on the costs in hopes of boosting jobs and revitalizing arts in oakland. new at 11 the environmental protection agency in concord is looking at its efforts made by cal state east bay's the climate resilience initiative. now, the epa awarded the school a $915,000 grant to support the 6000 square foot garden, which lies at the foot of mount diablo. that area part of the concord center. the land was home to native tribes, including the oholone. the climate resilience initiative's mission is to educate the public on sustainability and climate resilience. there's a rich history to the bay area that isn't just from the san joaquin valley. there's more food and more, indigenous usage and native usages, things that a story that we have always are often lost. i'd say. i grew up in the bay area for the most
11:20 am
part, and some of this is all really new to me. so when you ask is, what's the story here? what are these plants used for? i don't know, and that's what we're hoping to gain from our community members. now, cal state east bay says that it's really hoping to teach more people about accessibility by showcasing how sustainability works, as well as growing native foods and plants. let's check the forecast now on this thursday morning, kind of a mild week that we've had here. we're going to see a dip in the temperatures. yes, it's going to get cooler these next few days. we've been talking a lot about it because it's really unusual for memorial day weekend. we're talking about chilly weather. usually it's really starting to heat up, but here's a look at what we are seeing now. taking a look at this beautiful view from our sutro tower camera over the golden gate bridge. we will be slightly cooler with a breezy wind picking up for the afternoon and tomorrow is when the temperatures really start to drop and the winds will pick up. and for the memorial day weekend, we're going to see our typical may gray. that's that coastal fog and even a chance of
11:21 am
drizzle at some of our beaches and along the coastline. but it will be windy today and we're looking at our our hour by hour wind forecast that shows the winds at about 40mph for the evening. so it's going to be gusty out there in san francisco, but we're not really going to feel much of that for some of our inland valleys. in san jose. we're going to see a high of 77 degrees and the warmest in fairfield at 82, most of us in the upper 70s and low 80s. and then for tomorrow, it's once again going to be slightly cooler. only 66 in hayward for a high temperature. so that's like long sleeve, a light sweater weather for us here as we're going toward the end of may, you definitely want to wear the layers. if you're going to the bay fc game tomorrow late in the evening, those temperatures will drop down to the upper 50s with a gusty wind. and we're also going to see windy conditions at the cow palace for foodie land tomorrow evening. there's so much going on and ways to enjoy
11:22 am
our holiday weekend, but once again, you'll want to make sure that you're dressed appropriately for those gusty winds. and then on saturday with the family, you might want to head out to the rail yard at ardenwood farm. we're going to see temperatures there in fremont in the upper 60s throughout the weekend at carnival and san francisco, both saturday and sunday. here are temperatures will stay in the 50s, but we will see a little bit of sunshine. if you're going to monterey, it's going to be cloudy, misty, drizzly. i know there's the reggae festival happening there. it is going to be very cool and even for our inland areas, we're going to see temperatures in the upper 60s. as we go closer to memorial day. we're going to see highs in the upper 70s. and that's very much like what we'll see throughout next week. san francisco only in the 50s this weekend. so if you are out and about and you see people not wearing the sweaters or buying the hoodies from the gift shop, you know that they didn't know that we were going to have such chilly weather there in the city for the
11:23 am
weekend. and now, as we turn to our climate in crisis, you know, noaa just came out with their atlantic season outlook for what to expect. and we are going to most likely see an 85% chance of an above normal hurricane season for the atlantic. they're expecting about 17 to 25 named storms. many of them will be hurricanes 8 to 13, and about 4 to 7 will be major hurricanes. here's a look at the list of names. and they're expecting it to be a busy season, due in part to the reemergence of la nina, as well as warmer than normal water temperatures. just that heads up if you have travel plans there for the east coast for this summer. back to you, laura marcus. all right. thanks, gary. well happening now. boeing's cfo is forecasting the company will have negative free cash flow this year as manufacturing troubles persist. this comes as the company slowed production. since that door plug blew out of the nearly new 737
