them. in fact, they say it's hurting their bottom line. nbc bay area's damian trujillo joins us along that route. some of the merchants here along alum rock avenue say they've been taking it on the chin. and when the event happens, a couple of them say they'll have to close the door. it's always a party. at mariscos costa alegre on alum rock avenue. but on june 9th, when the city closes down his street to host the next viva festival, the owner says the city's celebration is a nightmare for business. sunday is the day that we make profit. you know, saturday, sunday. marco hernandez says winter sales were bad and with the struggling economy, he can't afford to lose his biggest sales day of the week. we heard similar stories at several stores along alum rock avenue. we're a small businesses one day affects, especially on the weekdays. it gets really slow and the weekends is when we do the sales. if they're closed on the streets, we have no access

for my customers to come in. what can i do? i need to pay bills. i need pay the people, help me out. dia maria de la torre says her bakery is going to have to close that day. viva draws thousands of people to the outdoors and perhaps bike ride or walk through parts of the city they've never been. but the merchants wonder if that discovery comes at too high a cost. it's my job to elevate their concerns and work with the city to make sure that as we do these events, that the community appreciates that we don't leave behind our immigrant merchants. councilman peter ortiz says the city needs to find ways to make the small businesses a bigger part of the festivities. the owner of the western store says he's seen no promotional benefit each time the city closes his street, no residual sales. they can go to alum rock park to walk. they can go to a park. i mean, they don't have to shut down the streets, honestly. i mean, it's really upsetting. damian trujillo, nbc bay area news the jurors in david depape

state trial were sworn in today. depape is facing numerous state charges, including attempted murder and burglary, for breaking into the home of former house speaker nancy pelosi and attacking her husband. now, earlier this month, he was convicted on similar federal charges, sentenced to 30 years in federal prison. opening statements in the state trial start wednesday in a san francisco courtroom that trial is expected to last three weeks. there is growing concern in oakland this evening. tonight, more than half a dozen graduation ceremonies will get underway across the city and they come less than 24 hours after gunfire erupted at a graduation at skyline high, leaving three people wounded. as nbc bay area's tom jensen explains, one person has been arrested, but police are still looking for other suspects. this was the scene outside skyline high school after several shots were fired as the 2024 graduation ceremony ended, injuring three people. like about six shots was fired in between a few seconds in his 21

years living across the street from skyline, zaidi yucel says he's heard gunfire before but never at a graduation. he says he talked to police about two men in a truck spinning and smoking their tires in the street. seconds before the gunshots rang out right before the shooting and i had some concern whether those two had anything because they wanted they were trying to rush out of here. opd is not confirming whether those vehicles may be involved. they say it wasn't a random shooting, though, that two groups were fighting and it escalated into gunfire, leading to one arrest and a search for at least one more shooter. we do know there were, multiple suspects, but we're trying to identify exactly how many. all three victims are recovering and expected to survive. but a family we talked to and zaidi yucel wonder why police weren't already present at the graduation before the incident ceremonies like this. it is a good thing. oakland unified school district superintendent sent a statement regarding the shooting. in part, it reads what

happened after skyline high school's graduation on thursday evening was heartbreaking and absolutely unacceptable. our hearts are with the victims of this incident, their loved ones and every graduate and their extended community who attended the ceremony to celebrate this once in a lifetime achievement. the district did not address our questions about a lack of police presence at skyline, or whether there would be patrols at more than a half dozen other graduation ceremonies. today neither did opd, but the people who experienced the gun violence say they hope they catch everyone involved soon. they ruined it. i've seen many, many graduations, beautiful families comes and it just good to interact with them. and they rubbed it. you know, i just graduated, you know, i got my diploma. you know everything. yeah. it just ended up weird. you know, it just ended up bad. and a district education board member says they're taking no chances of another shooting at eight different ceremonies across the city today. and there

will be a heightened security check at the gates identifying students, parents, people entering and leaving the school sites. oakland pd is asking anyone with pictures or video of the incident to please reach out to the department and help them identify all of the suspects. tom jensen, nbc, bay area news okay, thank you. tom. the number of people smoking is dropping, and while that may be good for the health of the community, one nonprofit in santa clara county says it's causing them to lose money. catholic charities says it's losing funding due to a decline in tobacco tax revenue. the charity is supported by first five santa clara county, which uses tax money collected from tobacco purchases with less people buying tobacco products. catholic charities says it's not receiving the money it needs to run its family resource centers. many families will be, you know, left without a center, left without a person to go and ask

for support. so the families will be, i'm pretty sure, devastated. and they won't have a place to go. catholic charities says six of its family resource centers will be forced to close if a solution isn't found. stop the assault on rafah. that is the order from the united nations top court to israel. rafah is the southernmost city in gaza, and the war there has created more than a million refugees. the court is accusing israel of ignoring the refugee crisis in its hunt for hamas terrorists. nbc's alice barr is tracking it all from washington, d.c. in another major blow to israel, the international court of justice today ordering the country's military to halt its assault on rafah. the united nations court, citing an immediate risk to the more than 1 million palestinian civilians who had sought refuge in the southern gaza city. israel must immediately halt its military offensive. the ruling is binding, but the court has no power to enforce it and israel

has indicated it will not comply. it comes the same week the international criminal court said it would seek arrest warrants for israel's prime minister and defense minister, along with top hamas officials on war crimes charges that prime minister netanyahu furiously rejects. what a travesty of justice! what a disgrace! amid israel's mounting international isolation, house speaker mike johnson announcing netanyahu will soon address a joint session of congress, a very strong show of support to the israeli government and their time of greatest need. some leading democrats accusing the speaker of exploiting divisions over israel, a close u.s. ally. why is the prime minister, who presumably should be focused on freeing the hostages and prosecuting this war, hopefully in a more humanitarian fashion? why is he going to take two days to come serve the speakers naked? political interest. it comes as the israeli military recovered the bodies of three more hostages in gaza. they were killed in the october seventh

hamas terror attack. cia director william burns traveling to europe seeking once again to revive badly stalled negotiations to free the hostages and pause the fighting. president biden spoke today with the president of egypt. the two leaders agreed it will take a stepped up international effort to finally reach a ceasefire deal. they also discussed getting more desperately needed humanitarian aid from egypt into gaza. in washington, alice barr, nbc news thank you, alice china staged mock missile strikes and dispatched fighter jets and bombers off its coast today. those fighter jets were carrying live missiles. analysts say china is making it clear it does not like taiwan's new president. lai ching tae was sworn in three days ago in taiwan's 16th president during his inauguration, he affirmed taiwan's sovereignty and urged beijing to stop the threats. the show of force by china is not as extreme as some military drills in recent years. however it was

expensive enough to send a message and act as a rehearsal for any potential blockade of the island. taiwan has scrambled its military and put all units on alert. the defense secretary of the united states says america is facing new challenges from the south china sea to the red sea. defense secretary lloyd austin made those comments today at the naval academy's graduation ceremony. he says the freedom of navigation rides on byways of u.s. navy ships, and told the graduating class that america is defending the them to secure all the world's sea lanes . the united states has the most capable navy and the marine corps in the world. and make no mistake, we're going to keep it that way. and you are going to keep it that way. the red sea is key trade route for global shipping and energy supplies. now the navy has stationed multiple ships there since the start of the israel-hamas war to recent naval academy graduates have helped shoot down rockets fired by houthi rebels. all

right, let's talk about the hunter biden pretrial hearing in delaware today. a judge set rules for what evidence can and cannot be entered in his upcoming trial on gun charges. president son was indicted last september on three counts tied to possessing a gun while using drugs. he's accused of lying on a form about his drug use when he bought a revolver back in 2018 under biden was pleaded has pled not guilty. his lawyers say the case is politically motivated. that trial is expected to begin june 3rd. okay. still ahead, some of music's biggest names in the bay area for the bottlerock festival in napa. we're going to take you there, see what you can expect this holiday weekend. and yes, we continue our celebration of asian hp community. one man's love of being in the middle of a party is helping transform san francisco's chinatown. i'm chief meteorologist jeff ranieri as we head into memorial day weekend, we are seeing some delays. if you're headed to the airports running 30 minutes behind in

flew over the festival this afternoon. first night of the three day event at the napa valley expo, and it's a foodie dream site. more than 75 bands, though, are also performing, including stevie nicks. this evening, ed sheeran and pearl jam. you got everything there, including food and wine. you've got chef. demonstrations are happening at the williams-sonoma culinary stage, and you've got celebrities making appearances too, including bradley cooper, cameron diaz and, of course, steph curry. festival wraps up sunday night. we're also celebrating asian american, native hawaiian and pacific islander heritage here at nbc bay area as we showcase some of the people who make our area unique. nbc bay area's joe rosado has a story of a businessman working to bring the party spirit back to san francisco's chinatown. all right, let's go. i'm walking. there's probably no one back

scratchers who likes a party as much as stephen lee. i had a party last saturday, even back when he was studying broadcasting at san francisco state in the 70s. you might say he minored in party planning. i joined this social club and we threw parties and dances. unlike most other party people, lee turned his love of a party into a career. so i opened my first nightclub in 2000. i've been doing nightlife for four decades. that festive spirit was a departure from lee's childhood, which was spent far from the action. i'm originally from vacaville, california. cows, onions, he worked in his father's grocery store with occasional trips to visit grandma and his uncles in san francisco's chinatown. i didn't feel myself as being really chinese at the time because all my friends were caucasian. his perspective changed once he landed in college. well, going to sf state, you have to take asian study courses that really hooked me up. on friday. i'm

going to party there. through his experience of owning nightclubs and organizing parties, lee joined san francisco's entertainment commission, where he spent a decade. he also connected with his heritage in a deeper way. when the 150th anniversary of the transcontinental railroad came around, lee realized one group was left out of the honors. well, i was complaining. how come there's nothing visual to say? hey these are the chinese railroad workers. there's no statue and nobody can answer me the question. so lee answered the question himself. he organized a fundraiser and commissioned a memorial to honor the chinese workers who toiled on the railroad. and, you know, wow, this is the real thing. you know, lee saw another chance to take up the cultural call when legendary chinatown restaurant sam wo announced it was closing. when it was announced in the chronicle that was shut down, there was lines around the block from ten in the morning till 3 a.m. the passionate response persuaded lee to organize a

group of investors and save the restaurant in a new location. basically, this place means a lot to the community, so that's why i put my time to rebuild it. but when the pandemic hit, all of chinatown's businesses felt the pain. all these were all boarded up. lee's suggestion the area needed to revive its once legendary nightlife. lee opened a new nightclub called the lion's den, the first live music club to open in the neighborhood in decades. this is where the performers of the 50s used to perform to with bob hope, john wayne, you got ronald reagan here in uniform. the lounge is part of a wave of new businesses bringing new spirit to chinatown. a lot of people are coming into chinatown, which they haven't been in chinatown for years. and really, he's the one that really had a vision for chinatown to bring back its legacy of nightlife. i think chinatown is always going to be a special place. it's amazing

what you can do here. lee's latest project, an all in one art gallery and wine shop on grant that showcases asian owned wineries made in napa valley. it seems through his many endeavors, lee found his way into his own heritage in a neighborhood that just needed someone to what's up to get the party going. joe rosado jr. we do this because we love chinatown. nbc bay area news. and who wouldn't want a party in chinatown? i know it's so great. wonderful. you got all the connections right? it's perfect. all right. boy, what a change. in 24 hours. i mean, i'm wearing a coat on the way to work today. it was that kind of weather here for parts of the bay area. clouds also rolling through. we're going to see that. hang on here, at least for the first part of your memorial day weekend. then we're going to get some much better weather in here. let's get a look at those temperatures. and we all noticed it today. but looking at it on this board and it really puts it into perspective for you right now we're down nine degrees colder compared to this time

yesterday in santa rosa. look at you out here in concord and livermore down 19 degrees colder air we had this week. temperatures in the upper 80s out here towards inland contra costa, alameda counties right now just 58 in livermore. now we're getting all of these changes from this cold front that's sweeping across. it's going to stay with us tonight also through early tomorrow morning. so we're going to keep some on and off wind 15 to about 30mph. the chilly temperatures also some drizzle for the morning. we'll take more looks at the weekend bringing you all the way through that here in a second. but i do want to bring it outside right now. if you're doing anything tonight. jacket weather all around right now 59 in san francisco. we're at a colder 55 at 8 p.m. with that cloud cover continuing to increase right near the bay 59 here as well. and you got double fives here at 9:00 in inland valleys, which are usually on the warm side, we are only averaging right now 62 degrees. we have that sunshine which is making it nice out here. and then we're in the 50s as soon as

the famous cross atop of that church happened earlier this morning. crews lifted it with a crane and placed it onto a frame. the cross survived that devastating fire that destroyed the roof of the cathedral five years ago. it was designed by a french architect in the 19th century, and has been a top of the structure ever since. the reinstallation marked another significant step toward the expected reopening of the cathedral in december. don't forget, you can watch our newscast 24/7 on roku and other streaming platforms. janelle and raj join us now with what's coming up at 530. there's a lot happening. jessica, a busy friday evening as we head into this memorial day weekend. we do have good news for revitalizing san francisco. the major company
