indication of what we have on the way for today. thank you so much for starting your weekend with us this memorial day holiday weekend. i'm kira klapper cinthia pimentel has a quick look at our microclimate forecast. oh gosh. and then look behind you. i know as people hope to take off from sfo it is gloomy. we have that drizzle out there as well, probably responsible for making the camera look like this towards dublin. we finally got our camera back! yay! but it's also a gloomy start. there kind of hard to wake up and get the day going. san jose those low clouds hovering over downtown and as we go throughout the morning, it's going to be stubborn to mix out of here. so that will put a damper on our mood. but then by the middle of the afternoon, we should get some more clearing skies. temperatures, however, will struggle to warm up only low 70s through santa rosa. most of us stay in the 60s, but the good news is there is warmer weather ahead for tomorrow and memorial day. monday i'll have more on that coming up in about 15 minutes. kyra. oh thank

goodness. all right cynthia thanks. new this morning. one person was hit and killed in a hit. and run in the east bay. it happened just before 130 this morning on san pablo avenue. and shamrock drive in san pablo. police say two cars were involved. one driver did stay at the scene where one victim died. police were able to track down the truck that left the scene about two miles south in san pablo. our cameras saw one person in the back of a patrol car. we are awaiting confirmation on any arrests. the chp is now handling the investigation and there is developing news on the peninsula where overnight police swarm a typically quiet neighborhood in belmont. this all unfolding last night near o'donnell park, which is right off of ralston avenue near the highway 101 on ramp. belmont police only confirming to us that they are conducting a criminal investigation. they tell us there is no threat to the public. turning now to graduation ceremonies,

continuing this weekend across the bay area. but in oakland, there will be heightened security at those graduation events. this after a shooting at a high school graduation. it happened in the parking lot of skyline high. three people were hurt. one person is under arrest . and as today in the bay's gia vang reports, police are offering a reward for any information leading to more arrests. nithya raman. so much excitement over chu for cornell. buckner's family celebrating her nephew, a graduate of oakland unified school district's castlemont high school. i'm just proud of him overall. you know, he's overcome a lot of obstacles, living in oakland, you know, it's hard and trying to beat statistic numbers and, you know, it's a lot. ceremony looks slightly different than years past, according to vincent burton. he has worked next door to the school for 18 years. i think this will be my first year seeing police cars out here

directly. i can imagine from what happened yesterday at skyline high school, what happened? gunfire erupted just after skyline high school's graduation, swarming the area with red and blue lights. opd says as people were leaving the ceremony, two groups got into a fight in the school's parking lot. shots rang out and police say three people were hit. they'll be okay and officers did arrest an adults but are still looking for more opd is offering $15,000 for information leading to an arrest, the oakland unified superintendent said in a statement. our hearts are with the victims of this incident, their loved ones and every graduate and their extended community who attended the ceremony to celebrate this once in a lifetime achievement i now would like to invite. as for the seven ceremonies following that incident, it wasn't just added patrols but tighter security. yeah, we got checked, you got we needed tickets and then you needed your, you needed the pass the metal detectors to and bags. they were a no go at graduations today. it was apparently a last minute shift from the school district. i overheard educators saying it was because of what

happened at skyline. i had to literally, like, put my baby stuff just down at the bottom. did you know that that was going to happen? no, i wasn't aware until, my nephew's dad called, the mayor's office said in a statement the city will continue to support ousd to reduce the number of violent incidents on their school campuses. this says the celebrations went off without a hitch. the attention on the hard work of these graduates gia vang today in the bay a lot of people are hitting the roads this memorial day holiday weekend, and so too is the california highway patrol. a live look outside on 101 in san jose looks like a lot of people are either already out of town or not awake yet. the statewide maximum enforcement period went into effect yesterday and it goes until late monday night. so what that means is you can expect to see extra officers on patrol. last memorial day weekend, the chp made more than 1100 dui arrests. that's an arrest roughly every four

minutes. and the holiday weekend got off to a deadly start in the south bay. the chp is asking witnesses to come forward if they saw this crash. it happened between a honda sedan and a big rig truck around friday. around 11 friday morning in. investigators say the driver of the sedan was going the wrong way north on southbound 101 near blossom hill road. he then hit the big rig head on. the driver of that sedan, 22 year old san jose man, died at the scene. the big rig driver from los banos was not hurt sticking in san jose. this man is now under arrest, suspected of killing his mother, 34 year old roger ley was detained thursday. san jose police tell us they were investigating a suspicious circumstance at a home and found the body of ley's mother again. this happened thursday around 11 a.m. the home where police were investigating is on shadow dance

drive off of almaden road, not far from state route 87. as you see there. after further investigation, homicide unit officers arrested ley and booked him into jail on charges of murder. a motive has not yet been released. this marks san jose's 14th homicide of the year . calling for action city politicians and community groups are angered over san jose regional medical center's plan to close its trauma unit. they're now taking their complaints to the state attorney general, rob bonta. the issue is whether the hospital is putting profits over people, today in the bay jocelyn moran reports. san jose regional medical center is located in east san jose. in february, we learned of its plans to shut down its trauma center services in august, prompting concern from residents, political leaders and community groups. this closure is based on one goal more profits for their shareholders, and it's a direct attack on our

communities. they're asking attorney general rob bonta to investigate hca healthcare, who runs the hospital. it operates on a for profit basis and has said it will close certain hospital services because, in its view, not enough people use them. the closest hospitals with trauma centers, then, would be at santa clara valley medical center, about eight miles away, or stanford hospital, more than 20 miles away. well, what we found is that if you were experiencing a closure, a trauma center closure, and you had to drive more than 15 minutes away from your original, trauma center, that your mortality increased by 21. doctor renee shaw, with ucsf has extensively studied the effects of trauma centers, closing. she's also looked into why they close. she says there's evidence showing hospitals tend to close emergency services like trauma centers, more often in areas with low income or poorly insured residents. hospitals choose to provide certain services in more affluent areas, and trauma services can be very

revenue generating if it's located in an area where there's, quote, good patient payer mix, meaning that that patient population has commercial insurance. in a response to nbc bay area's request for comment, hca pointed out that regional medical serves about 225 patients a day and that emergency services need to be prioritized, including adding $10 million that will boost emergency beds from 43 to 63. we asked doctor shaw about the differences between a trauma center and an emergency department. trauma centers have the ability to take a patient to the operating room when they need to go in the middle of the night. there's certain capability that a trauma center has that regular emergency departments do not have. the south bay labor council says it talked with bonta's office, adding that the attorney general has offered his support in san jose. jocelyn moran, nbc, bay area news. the push to recall oakland mayor shane tao has hit a milestone. the group behind the recall now says it has enough signatures to put it on the ballot. the group oakland

unified to recall shang tao or oust, says it's collected more than 30,000 signatures for its petition. they only needed 25,000 to get it on the november ballot. those supporting the recall say mayor tao's policy are to blame for many of oakland's problems. those include rampant crime, business closures and the loss of the oakland a's. she's been dismissive. she said that the leaders of the recall were losers. well look what we losers have done. we have energized and motivated oaklanders as the county registrar of voters needs to verify all those signatures before this becomes a ballot vote. we've reached out to mayor shang tao's office for comment. we have not yet heard back. one of the biggest party weekends of the year kicked off last night, bottle rock. many people look forward to this event all spring long. food wine and music especially all in one place. big

is a forum communications hill. looks like the sun is coming up, although that cloud cover is here for some time. cinthia pimentel will be along with your full memorial day holiday weekend forecast in just a few minutes. but first, new problems for the aquarium of the bay in san francisco. it has lost its accreditation because it wasn't meeting standards in a, quote, number of key areas. the association of zoos and aquariums, or aza, announced that it unanimously voted to rescind the aquarium's license. the organization says the aquarium was not meeting standards in financial stability, staffing capabilities, employee morale and turnover. this after that man you see there, head of the

aquarium ceo george jacob resigned on wednesday. staffers at the charity that runs the pier 39 aquarium raised concerns about jacob's spending lavishly on travel and events, including a concert that he hosted in dubai. meanwhile, california leaders want to help residents prepare for emergencies that tend to hit in the summer as temperatures rise and the state's vegetation dries out. governor gavin newsom yesterday unveiled the new website pico boulevard dot gov during his visit to the california office of emergency services, or cal os. newsom described the website as a quote, one stop shop for californians to prepare for extreme weather and other emergencies. the website is all part of a larger effort called least dose california. it's a state effort to connect communities with resources before, during, and after emergencies. well, san francisco's union square has

been a centerpiece of the city for decades. but since the pandemic, it's lost a lot of its major retailers. and now one of the world's biggest video game makers, nintendo co, is moving in. here's today in the bay sergio quintana with how this could be a lifeline for union square. news that a nintendo store is coming to san francisco's union square prompted fond memories for people we talked with about the announcement. i think nintendo is very cool. it brings back memories of childhood and happy memories of growing up. it's a fun thing. do you still have your nintendo? yes, for my kids, yeah. yes did you ever play them? no. not really. when we're when they were little, yes, i did the nintendo store announcement is a big deal for union square over the last couple of years, the premier shopping district has seen retailer after retailer close its doors. we talked to tim walsh, who lives in menlo park and is touring around a couple friends who are visiting from germany. it's a ghost town near the financial district. it's a

little unsettling if you haven't been here in a while. yeah, but it's great if you're looking for a parking spot. according to data compiled by a research firm called coresight, 40 retailers have closed in union square since 2020. the city has been trying to attract other companies to replace them, and a few new high end retailers and restaurants have opened in the union square area. nintendo has not announced exactly where in union square it will be, but according to the city's office of economic and workforce development, it's a welcomed part of union square's transformation. this is the kind of activity where you are not just looking at things and purchasing things, you are engaging, it really is the forefront of retail and we're really excited to see more of that happening in union square, because this is exactly the kind of activity that we've been working to court and stimulate nintendo operates three standalone stores in japan and one in new york city. nintendo opened its new york city store in 2005. so 20 years later, 2025 is when nintendo's san francisco store is expected to open.

sergio quintana today in the bay now to the weekend festival. so many people have been waiting for. carnaval returns to san francisco today and tomorrow. the two day festival is considered the largest multicultural celebration in all of california, kicks off today in the mission's latino cultural district. the celebrations include music, dancing, those beautiful costumes and, of course, good food. but the main attraction, you could argue, is the parade. that's tomorrow. so here's a look at those closures to look out for during the parade and the festival. it includes mission between 15th and 24th, along with harrison and bryant streets and part of 24th itself. so how will the forecast be for people going to carnaval? bob rock, let's check in with cinthia pimentel for our microclimate forecast. everything today will be much gloomier than tomorrow. so that's good news for the grand parade. there on sunday. we're starting off with that may great

throughout the bay san jose, san mateo, danville and sausalito all socked in with that cloud cover and temperatures starting off in the 50s. when does the sunshine come? i know lots of us want to get out there and do all of these long holiday weekend plans. well, by the mid morning hours into the 10:00 hour, we're still looking at that cloud cover, some drizzle at times that could dampen your car wash that you got earlier on in the week. lose that shine. by the time that we get into one 2:00, the north bay starts to get some clearing as far as eastern cocoa county and alameda county, but it doesn't really get sunny until we go on into two three. this afternoon and continuing into these this evening and tomorrow as well. it's going to be another day where you have to bundle up because of that wind that's coming in from the ocean, that's cooling these temperatures down. by the time that we get into the afternoon hours, around 20 to 25 mile an hour wind gusts, of course, gusts here in our typical spots out towards the bay area, beaches for carnival this

afternoon we are going to be looking at that cloud cover hanging around san francisco. that's pretty typical. and notice that our temperatures only in the upper 50s. as we get into that afternoon clearing. so bring a couple of layers. but in all the dancing and celebration, you might just push them aside. lucky you. if you're going to bottle rock, our outlook for today and tomorrow. much cooler today. bring a jacket out there for tomorrow. you're going to need all those beautiful sun hats as our temperatures rise just a little bit more into those low 70s. as far as everyone else for today, 57 in half moon bay, low to mid 60s for our east bay shoreline and inland and as far as san jose and morgan hill. we're going to keep it in those upper 60s and some low 70s. when does the more sunshine come for our memorial day weekend? mostly as we go on into tomorrow and monday. if you want to honor our service members outside, that will be a nice way to warm up and get into that holiday spirit as we go on into half moon bay, the coastline. it's going to be breezy out there, cooler out in half moon bay, but the good news

is that aside from this tumbling weekend with the temperatures, we should be into a little bit of a warming trend as we go on into the final days of may. of course, san francisco will stay mild in the 60s, but by friday we could be looking at some 70s in our inland valleys. well, aside from the breezy and cool start to today, we should be warming up into the 70s and then 80s by late week. looks good cynthia. thanks. we have much more ahead on today in the bay coming up, one local woman helping her fellow students as she works to earn her own degree. we think her story will make you bay area

most expensive region in the u.s. but even with all that wealth, there are still always people without enough food to eat here. and one local college student is doing what she can to help feed those in need. today in the bay's garvin thomas has her story in this morning's bay area proud one of the traditions of graduation weekend is students showing their family the places that have influenced and inspired them over the past few years. usf is proud of the graduate for graduate maria bochenski, though that was going to mean taking her parents off the university of san francisco campus to just outside the 16th and mission bart station. thanks, dad. you're getting into it. it's here. for the past three years, malia has been

coming every thursday evening to share food. there you go. with those who could use some. we'd love to have it with everyone. the meals malia normally serves on these evenings are made up of excess food gathered from usf dining halls and the san francisco food market. it is part of malia's effort to bridge the gap between those who have too much food, with those who don't have enough. this is what i'm passionate about. this is what i'm interested in. if i see a problem and i know, like, awesome, this is this lines up with everything i stand for. like i will 100% go for it. and then you go down these stairs. but it's not just out in the community that malia has made her mark. it's right on campus, too. when malia started with the food recovery network at usf, its food pantry for students was not the easiest to find. it was housed in the basement of the school library. it was right in this room was the in a closet original food pantry. it definitely was something. it felt like we wanted to keep it

hidden. we maybe didn't want to talk about bread. sometimes these days, though, it has found a much more spacious home. the food recovery network's weekly food giveaways now in the library's main lobby and featuring much fresher food, will regularly draw in 100 students. malia helped make it the less stigma there was among students about using it, which is just what she wanted to happen. yeah, it's awesome. and it's grown into something that's people will come and hand out cookies or make coffee. it's a very like it's something that students are super excited to get involved with. to come to usf as the end of a college career is typically a time when students look forward to all the change they're going to make in the world, malia estudillo avenue of course, there will always be those who don't want to wait until graduation to get started. garvin thomas with another beautiful story for us. thanks, garvin. 727 we have much more ahead for you on today in the bay. coming up, a new warning about an aggressive

police say the victim had been shot several times. there were two separate scenes related to the shooting that one on frazier and foothill. police found over 30 shell casings. the second scene at 106th and foothill. they found a silver sedan after it had crashed into a fence. no word on any arrests. turning now to heightened security at graduation ceremonies across the oakland unified school district after a shooting this week, three people were hurt after someone opened fire in the parking lot of skyline high school as the graduation ceremony ended, one person was arrested. but now police are offering up a reward for information leading to more arrests outside of castlemont high school's graduation last night, oakland police squad vehicles you can see there this, of course, as we just mentioned, coming after gunfire erupted after skyline high school's

halt any offensive attacks against hamas in rafah, nbc's ralph sanchez reports. this israeli air strike hitting rafah. our team in gaza following fire crews trying to put out the flames. what the palestinian need is immediately stop war. the strike coming just as the un's highest court ordered israel to stop its military operations in the city to protect civilians, israel must immediately halt its military offensive. the ruling is binding, but the world court has no means of enforcing it. and israel giving no sign it will comply, saying it launched a just war to eliminate hamas following the october 7th terror attack and that it's acting to reduce as much harm as possible to civilians. but nearly a million palestinians have been displaced since the start of the rafah operation. the court's actions adding more pressure on israel after war crimes. prosecutors earlier called for the arrest of both israeli prime

minister benjamin netanyahu and hamas leaders. the white house called that move against israel outrageous. we don't think there's an equivalence between what israel did and what hamas did, the court also calling it deeply troubling that hamas still refuses to immediately release its hostages. israel's military says it recovered the bodies of three more hostages. and after a call with president biden, the leader of egypt, tonight, agreeing to allow more aid into gaza through israel, that was ralph sanchez reporting for us back here in the u.s. to texas, the city of uvalde held a vigil for the two year anniversary of that tragic shooting at robb elementary school. a large crowd you see there gathered yesterday for a candlelight vigil to remember the 19 children and two teachers who lost their lives on that day. other events of remembrance included a bell ringing and a butterfly release. in the two years since the shooting, 21 bills to reduce gun violence and bring justice to the affected

families have been brought to texas legislature, but none have been heard in the state senate. despite the family's pleas. back here in the bay area, the jurors in the david depape state trial have been sworn in. depape is facing numerous state charges, including attempted murder and burglary, for breaking into the home of former house speaker nancy pelosi and attacking her husband earlier this month. as we've been reporting, depape was convicted on similar charges, but that was in federal court. in federal court, he was sentenced to 30 years in prison. opening statements for the state trial are expected to start wednesday in a san francisco courtroom. the trial is expected to last three weeks. a new warning for people who live in santa clara county. an invasive mosquito that can cause disease. the mosquito has been detected in east san jose since early april. the county says it's found 12 of the mosquitos near

machado lane. they are known to be aggressive and carry viruses, including zika. the concern now having detected the aedes aegypti mosquito here in santa clara county, makes us concerned that in the future we might start seeing something similar here where people don't have to travel to get those diseases. but just being here, they're at risk. santa clara county has been applying larvicide in the area, but come wednesday, it plans to start a new treatment. the county is asking homeowners to allow crews onto their properties to spray. for those mosquitoes sticking in santa clara. now, the stadium authority and the san francisco 40 niners apparently have reached an agreement that they say resolves long standing disputes over public safety expenses and food costs for legacy seat license holders at levi's stadium. the agreement, announced this week, reduces the amount the stadium authority owes to the 40 niners by $22.3

quarter billion dollars next week. but the thing is, some of that money could be yours. consumer investigator chris kramer is here to explain how to get yours before lawmakers do. hey, chris. kira. good morning. the next couple minutes could put a couple hundred bucks back in your pocket. record prices at the gas pump. sudden inflation, unleaded gas for over $7 a gallon. hit family finances hard in 2022. not just for gas, but for everything else. it's really hard. state lawmakers and the governor responded with an emergency relief program. it's

called the middle class tax refund. and it's our way of getting money back into your pockets to help with everyday expenses. as sacramento sent millions of people a debit card or deposited money directly into their bank accounts, it was for $700. carlos solis, who's a san jose state student, welcomed the relief money, which i thought, you know, this will help me. i mean, tremendously to pay tuition. a year and a half later, part of the relief program is beginning to wind down, but state financial records we reviewed show hundreds of millions of dollars left unspent. and now at risk of not benefiting any families at all. in fact, next week, the franchise tax board is set to trigger a huge transfer on june 1st, it will move more than $360 million out of the better for families fund and into the general fund, where lawmakers can spend it however they want.

before we dig into how and why so much emergency money from 2022 is still sitting unclaimed in 2024, we're going to put a qr code up on the screen, snap it to contact the state to see if you're due any money. if the government makes a promise to help the people, they should remember carlos and his $700 will. turns out part of his relief money was stuck. he couldn't transfer it all from his car to his bank. so i kept calling and calling for the period. about six seven months. and it was the same deal every every day, every time. it was just, oh, sorry to hear that. or let me transfer you to the right department. and i got disconnected. ultimately, he asked for our team's help to get his full 700 bucks without our intervention, the state might have labeled his account dormant and might have sent his money back to lawmakers. that's not acceptable. other people complained to us, too. this is our tax money and state lawmakers. we got calls, you know, by the hundreds from

people who literally could never get through on the customer assistance lines. and that frustration ultimately led, i think, for people to just give up. a recent state audit of the refund program found lax oversight at the franchise tax board, allowing its private card contractor to ignore 36% of calls for live help with the tax rebate cards. the vendor, called money network, told us. calls were not answered for various reasons. like some callers hanging up quickly, it said the middle class tax refund program was unprecedented in speed and scale. the big failure was on the folks who were not able to get through in the system, and the folks now who still have these benefits coming to them, who haven't access to them yet. if you never got a payment or aren't sure, speak up before june 1st. scan that qr code. now if you've got a debit card but haven't spent it all, your balance is safe. for now, the state is holding that money in a different bucket that lawmakers
