donald trump's historic hush money trial. attorneys on both sides will present their final conclusions to jurors. the larger potential impact in the race for president, and a new funding push to improve one of california's most dangerous train crossings, right here in the bay area. this is today in the bay. and good morning to you on this tuesday. thanks for starting your morning with us. i'm marcus washington and i'm laura garcia. we'll check that commute as folks head back to work today. all right. and let's check the forecast first with carrie. looks like a good one today. it's going to be a great day. and it's a short week. so for a lot of people we're going to have a lot of changes over the next few days. and we're starting out with fog, low visibility coming in from the north bay across the golden gate bridge. it's misting, it's drizzling. but we also know that that's what keeps our temperatures cooler in santa clara. it's going to be cloudy for the next couple of hours. at 9:00. it's starting to clear out

at 10:00. it's completely sunny the rest of the day. we're enjoying sunshine and mild temperatures with our highs in the low 70s. there mountain view 71 degrees, while dublin will see about the same and upper 70s for morgan hill. we're up to 81 today in santa rosa. we'll talk about some hotter temperatures ahead. mike, what's going on now in the tri valley? still tough. tough drive in the tri valley. westbound 580 starting to slow down at right around our camera, which is just about tassajara, just west of east of hopyard. we see this lower drive because we're still down one lane at the dublin interchange. we have almost four miles of backup now from when you start to tap the brakes, we're down one lane. like i said, three vehicles need to be cleared, but we look like speeds might be improving right around the scene. i'm hoping that means they're clearing lane, the lane here. we're tracking that for the tri valley with more build out of the altamont pass. the good news? the bay bridge continues to recover. back to you. all right. thank you very much. we are following some breaking news overnight that happened in the east bay. a person is shot and

killed, and now police are searching for the suspect. today in the bay bob redell joins us live from san leandro this morning. this is where the victim was found dead. sadly, in a car crash. what do we know about this? bob well, we believe that the victim was trying to get away from the place where he was shot. he ended up crashing here along macarthur and durant, just on the border with oakland. we're actually in san leandro, where you can see there was a crash involving a white van in front of the soundtech music karaoke business. the victim's vehicle has since been taken away, but this white van is still here. this all unfolded around 1120 last night, about a mile away from here on macarthur and 98, which again is actually in oakland. that's where police responded to reports of shots being fired. and officer on the scene told our photographer that someone was shot while sitting in a car. you should be able to see the yellow cones in the roadway. those are indications of different shell casings, casings or dozens of shell

casings found at that scene. so after the shooting, the victim either drove or had someone drive them to the location where i'm at. again, about a mile away, their vehicle crashed into a white van, which crashed into this building. the black car carrying the victim wrecked up onto the sidewalk behind me, where the victim was declared dead from their gunshot wounds because it was really loud. and so the guy was sitting in the car. i couldn't vaguely i could see him, but i couldn't get a good look at him. but he wasn't moving at all. so apparently he must have been dead because that car had to be going over 100 and some miles per hour. you know, it was going crazy. so again, the victim's car has been taken away. the white van that the car crashed into is still here. there's still a mess in the sidewalk here again. we're in san leandro and macarthur at durant. we have reached out to oakland police to try to get more information. we have no reports of any arrests so far. reporting live here in san

leandro. bob redell today in the bay. all right. wow what a night there. thank you very much, bob, for the latest. also busy in the south bay developing at this hour. san jose police investigating after a homicide leads to an hours long standoff. this is a live look at the scene as the investigation continues. this happened along north 20th street in julian, not too far from coyote creek. investigators say they received reports of a shooting at a home around 6:00 last night. officers arrived, then engaging with a man who barricaded himself inside the home. he eventually surrendered to police about 2.5 hours later, but sadly, a woman was found dead inside the home today in the bay's ginger conejero saab is on the scene this morning working to gather some new information. she'll join us with a live report ahead in our next half hour. we'll new this morning. spain, norway and ireland are set to formally recognize a palestine as a state. now, spain's prime

minister made that announcement in a televised address today. he said that spain will not recognize any changes to pre 1967 borders unless agreed by both parties. the government of spain will approve the official recognition of palestine as a state with this decision, spain joins the more than 140 countries that already recognize palestine. this is a historic decision that has a single goal to contribute to achieving peace between israelis and palestine's . now, the spanish government is expected to formally approve that recognition later today. well after closing arguments are set to begin today. and former president donald trump's new york's hush money trial. here's a live look for you in manhattan courthouse. this is where the proceedings are set to begin. just shortly after more than a month. this is a pivotal moment in the first criminal trial of the former u.s. president. today, in the bay's brie jackson

live in washington this morning. she's covering all of this for us now. brie has the former president responded to those closing arguments and they're set to get underway just shortly . yeah. that's right. good morning marcus. so closing arguments are expected to begin this morning. and they could last the entire day. former president trump meanwhile, earlier overnight he did air his grievances online complaining that the prosecution gets to make the final argument, saying why can't the defense go last after weeks of back and forth battles in the courtroom, the prosecution will get its final chance to convince jurors that former president trump falsified business records in an effort to silence adult film star stormy daniels. take the jury through how the conspiracy was formed. how we know donald trump himself was not only a part of that conspiracy and a broad sense, but okayed the payment to stormy daniels. the defense is expected to take aim at former trump fixer michael cohen and his

credibility, and try to suggest that michael cohen was acting completely independently to the extent there was a conspiracy here, it was a conspiracy between michael cohen and david pecker and, you know, keith davidson, but not donald trump. trump spent parts of the memorial day weekend at campaign events next night. that's nice. he was booed at the libertarian national convention saturday. then during a nascar race sunday, he ignored shouted questions about this pivotal week for his trial. thank you everybody. thank you very much. how do you feel about tuesday? how do you feel about closing arguments? meanwhile, the biden campaign is ramping up its attacks on the presumptive gop nominee by the president. president trump is unhinged. he's dangerous, and we cannot let him get back to the oval office. trump has denied any wrongdoing, claiming the hush money case against him is a

witch hunt and a verdict, and former president trump's hush money case could come as soon as this week. marcus and we will be following brie jackson in washington this morning. brie. thank you. calls are growing to fund a proposed grade separation of what's considered to be one of california's most dangerous train crossings. over the years, numerous collisions have occurred at the broadway crossing in burlingame. state senator josh becker today will talk about plans to include $100 million in state budgeting for the planned grade separation, which already includes renderings. similar ideas are proposed for two other peninsula train crossings. a news conference is scheduled for 830 this morning, but before that, senator becker will join us live on our streaming newscast at 8 a.m. you can watch the full interview on roku and other streaming platforms. 609 as we take a live look outside, you can see right here in san francisco. not as clear as we liked it to be. you see some there, some little drops there on the camera. meteorologist

kari hall is monitoring that. not a rainy start there, but i guess a few little sprinkles here and there. carrie. yeah, some drizzle to start out. our morning in san francisco. it's going to linger for a while and keep temperatures cooler. and in martinez it's breezy and we're already clear. now we're going to see some areas clearing out a lot more quickly. and that's where our temperatures will be slightly warmer. but you can see the warming trend happens very gradually as we head for the upper 70s here. and then as you make it into the east bay, we're in the low to mid 70s and much of the east bay into the south bay, san jose. today we'll see a high of 7571 in mountain view and 66 in san mateo. in napa today, 77 degrees and san francisco will be in the mid 60s. we do have a significant warm up coming our way. we'll talk about that coming up in a few minutes hopefully. mike, you're seeing lower numbers there for gas prices. there are at least holding right. we worry about that as we have a big driving holiday that we just passed over here. we're looking at cupertino has your best in the south bay. 459 at great gas

nationwide. i know i ama who has a noah so there. oh oh haha pretty cute. that's both on the list. that's multigenerational. yeah. all right, well, we're starting out with some clouds this morning as you get ready to head out. we are going to have a mostly cloudy morning across much of the bay area, but in spots like dublin, it's going to clear out a little bit sooner i think by about 9:00 we're seeing a mostly sunny start. temperatures in the mid 50s and we're headed for the upper 60s for this afternoon. on the cooler side for a lot of spots compared to what we typically see for the end of may, los gatos will see a high of 76 degrees and also in the mid to upper 70s for much of the east bay antioch 79 degrees, while oakland will be in the upper 60s, fremont will see a high of 71, and we're also up to 71. in redwood city, daly city, 59. a lot of clouds, a breezy wind, and that's going to keep those temperatures down. and in san francisco expected to be in the

low 60s and the mission district. but it will only be in the mid 50s for the marina district as the fog just lingers there throughout much of the day. in sonoma, we're looking at 76 degrees, really nice temperatures, but if you've been checking out the 7-day forecast, it's going to be heating up. before we get there, let's check in on our reservoirs across the state. we're doing pretty well here. a lot of them at or above capacity. we've seen those rivers, those lakes, those reservoirs running pretty high. and now that we're getting more of that sierra snowmelt underway, i do think that a lot more of those reservoirs will continue to go up. looking at the storm systems that have been moving across the pacific northwest, this one is going to bring in at least a slight cool down for us for today, but it doesn't last long. quickly we see high pressure building. and then as we approach the weekend, we're going to see another one moving in. that's going to bring down the temperatures for saturday and sunday. so no rain. but we are at least going to see that affect our temperatures

i say, is packing it all up as we go to paris. you know what we are asked? we asked our in-house travel pro chris chmura to give us a peek at some of those unusual cargoes that we're seeing flying overseas. good morning. meet the team that's fueling team usa chefs, sous chefs and dietitians. in total, nine food pros will fly to france to feed team usa three meals a day. we spoke with brian knudsen, who oversees team usa's food and nutrition. he says his

team started planning the menu two and a half years ago. their cooking up 250 recipes using a thousand ingredients. they're going to buy most food locally in france, including 13,000 baguettes. met with the bakery my last time there and my current estimate is around 200 baguettes per day, which he is prepared to make more. he he's like, you're going to be buying more. but team usa isn't going 100% local. it's bringing a couple tons of all american flavor. 34 pallets. you see, there are shipping from the states to france just to bring that that, you know, comfortable piece, that familiarity that our athletes get here, that's why we go. right. you know, last thing you want to do during an olympic year, during the games, is change their diets. these pallets also contain more than 10,000 american made protein shakes. knudsen said he just couldn't find anything in france that matched the athletes expectations for post-workout

get you caught up on that forecast today. meteorologist kari hall has been monitoring what we can expect across the bay area. looking pretty good this morning, carrie. it looks great. and if you didn't watch the news, didn't watch the weather over the weekend and you're heading back to work, it's going to start out with the same weather we've been seeing the past few days. cloudy temperatures in the mid 50s, and it's going to be a really nice day. take a look at our trend in san jose by 8 to 9:00. it's starting to clear out temperatures going from 50s to low 70s for today. really comfortable. we're headed for the mid 70s for this afternoon. and a lot of these numbers are cooler than what we typically see for the end of may. things are soon going to heat up. so we're going to enjoy this while we have it. we're going to talk more about that warm up coming up in a few minutes. marcus and laura sounds good. we'll check back with you. carrie. well, some breaking news overnight. oakland police trying to find a person who shot and killed a man today in the bay. bob redell joins us live from san leandro this morning where the victim tried to get away, but we

understand. later died from his injuries. but correct. and appeared a crashed here along macarthur and durant in front of the soundtech music karaoke shop. that white van is not the vehicle that the victim was in. the victim was in another car, but obviously crashed here. don't know what the relationship to the white van, the other vehicles been taken away. this happened around 1120 last night actually, the shooting taking place about a mile away from us at macarthur and 98th, which is the video you're looking at right now, which is actually in oakland. and according to police, they responded to a report of shots fired you can see on the ground there. they have the yellow cones that indicate all the shell casings. so they're clearly a lot of shots fired there when police arrived, though, the victim was already gone. apparently this victim either had someone drive them or they drove themself to where we're at right now, which again, is about a mile away on macarthur at durant, where the victim crashed their vehicle.

and according to at least one witness, when they arrived, they found the victim dead in the car. so it sounds like the victim was traveling very fast. it was dealing with the injuries. and then passed away and crashed right here. we have reached out to oakland police. so far there are no reports of any arrests. reporting live here in san leandro, bob redell. today in the bay. all right. thanks for the very latest on that investigation, bob. developing this morning, investigators are trying to piece together what went wrong inside a home, leading to an hours long police standoff. now, when it ended, officers made a disturbing discovery inside a dead body sedan. the base ginger conejero saab live for us there at the scene now, ginger. police sharing what they've learned so far. what may have happened here ? well, good morning, marcus san jose police so far only providing a few details of what happened here last night. but this was an hours long standoff.

we're here on the 300 block of north 20th street in san jose. we're not far from san jose high school. you can see part of the block here still, is still taped off. you can see crime scene investigators are here on the scene, continuing to piece together what really happened. police say they originally responded to a possible shooting here a little after 6 p.m. yesterday. and someone barricaded themselves inside a residence. a warning went out to avoid the area, and nearly three hours later, police say the suspect surrendered and was taken into custody. officers then discovered a woman's body inside the home, immediately calling it a homicide. now, the motive and circumstances surrounding the event are unknown, as is the relationship. if there is one between the suspect and the woman found inside, that is the latest that we have from sfpd, we do see the crime scene. investigators are still here. we are expecting the coroner to arrive at some point

this morning. i was told by one of the officers that, the that they are expecting the coroner to come out and just literally seconds ago, i received a response from san jose police here. they say they are still here on the scene. it is still active. so they're at this point is not much that they can pass along, so far here, that is the latest update that we are getting from san jose police. we as soon as we do hear more, we'll make sure to bring that to you guys on air and online at nbcbayarea.com. for now, i'll send it back to you guys. all right. i know you're going to stay on top of that for us, ginger. thank you. and from san jose over to concord, that's where police have kept busy. this is with a barricaded suspect. now, it's still not clear what happened there yesterday, but our crews were there as officers ordered a suspect to the ground and took them into custody. now, this was a three hour standoff. it ended at around 9 p.m. on someone's front yard on rosebrook court.

that incident also triggered a shelter in place. no one was injured. a busy week ahead in court for the man who violently attacked paul pelosi. today, the judge is expected to reopen david depapes federal sentencing hearing, this after the judge never allowed to pop the opportunity to speak when he was sentenced to 30 years. the duration of the sentence is not expected to change. in the meantime, testimony could start as soon as tomorrow in depapes state trial. jurors were sworn in last friday, but his attorneys today are expected to argue the state charges should be dismissed, citing double jeopardy. a massive fire at an east bay lumber yard is still under investigation. this morning, we're hearing from the owner about some of the damage left behind. it happened sunday night at economy lumber on high street in oakland. john bacon is the owner of the well-known east bay lumber yard, which has been in the city for decades. he says the estimated charges from the fire to high end lumber and equipment could be millions of dollars. you've got, you know,

almost a million bucks in forklifts that were in that shed, the charging elements for keeping the units charged up. oakland fire still trying to determine the cause of the fire, but it confirms the fire did originate inside of a building at the lumber yard. as for the next steps, bacon says work at the lumber yard will be put on hold until next week, and any future redesign of the building will include a sprinkler system, which was not in place previously. well, now to decision 2024 and a special election being held today in berkeley. four candidates are vying for a city council seat vacated by kate harrison abruptly resigned back in january. now the election covers berkeley's fourth district solely. alpert currently serves as the berkeley rent stabilization board. ilana auerbach is a community organizer. ruben hernandez story is the chief of staff for fellow council member terry taplin and

igor trubin works in climate policy. harrison's term runs through 2026. voters can vote in person at the morse block building. this is on shattuck avenue. it's 6.38 on your tuesday morning, taking a live look overlooking dublin. lots of folks headed back to work today. if you were lucky enough to enjoy an extended weekend. kerry's got a look at our forecast. nice this week. it is going to be nice this week. a little bit warmer over the next couple of days, but today we're keeping the cooler temperatures. it seems like there's not as many people out as we usually see for this time of morning, but we are also seeing a lot of cloud cover. those clouds will linger in the peninsula from now through at least 10 to 11:00. it's going to be slow to clear, but once it does, we are going to have a beautiful day. but it's going to also be windy, especially in san francisco and near the coastline. we are going to see those winds picking up to

30 40mph for the evening and even for the inland valleys. it's going to be breezy with those winds at about 20 to 25mph as our temperatures head for the low 70s in the tri-valley, we'll see mid 70s in the south bay, north bay, anywhere from 78 in napa to 81 in santa rosa. we'll talk about that warm up coming up in a few minutes. but mike says, now the commute is pretty smooth. pretty smooth. yeah, we had some unexpected slowing in the tri valley, but things have sorted themselves back out. after the crash cleared, three vehicles involved but no major injuries at the dublin interchange. good recovery, so that indicates lighter traffic coming in, even though behind me, more traffic out of the altamont and no more issues as far as southbound 680 at mission boulevard. there was a brief issue for a crash there into the south bay north 101 right on pace, now slowing from capital up in toward the earlier slowdown, which starts right on schedule at 640 through that area, maybe a little stronger. so we'll track that. but so far looks okay. and then looking ahead we have a night game. remember that for the giants at

daring rescue. police say on saturday he made the mistake of walking on an incredible steep terrain under a bridge in mason county, about 100 miles outside of seattle. he then fell 400ft. first responders sprang into action, using a harness to rescue him. amazingly, he only suffered minor injuries. police say similar incidents at the bridge are not uncommon and are usually fatal. well, president biden had a very different memorial day monday than his opponent, donald trump and scott mcgrew today, tuesday, very different as well as well. both days for sure. today, trump's going to be in court for closing

arguments in his first criminal trial. biden's calendar shows no public activity at all. he'll be working at the white house with nothing scheduled in front of cameras today or tomorrow, so that could very well be intentional as we focus on the courts. you mentioned monday was different. boy, was it ever president biden laid a wreath at the tomb of the unknowns alongside the vice president and the secretary of defense. trump issued a statement that started happy memorial day to all, including the human scum, and then he went on to list a set of complaints and for some reason, known only to him, brought up e jean carroll, the woman to whom he has lost two court cases for defamation. the woman, a civil court, found him liable of sexually assaulting. he said in his memorial day message he had never met her, which goes to the core of the previous lawsuits against him, the ones he lost to the tune of $83 million. carroll's lawyers say they are open to filing yet another lawsuit, though. trump's biggest

trouble right now is that new york case, the criminal case closing arguments will start any moment. the case could go to the jury later today, likely tomorrow. his two sons are already in the courtroom right now. one daughter, tiffany. now, just to refresh our memory on this, trump lawyer michael cohen took out a loan on his house to pay stormy daniels to remain silent about an alleged affair with trump. trump then paid cohen back through payments called legal expenses. and all of this is fact. nobody disputes any of this except the affair. trump said he made the payments but didn't have an affair. now, new york law says that fraudulent business records are a misdemeanor unless you're doing it to cover up another crime, then it becomes a felony. the prosecution has these two things on its plate. the defense only has to convince the jury that labeling those payments legal expenses wasn't exactly untruthful. while trump complained about the order of the closing arguments on truth

it is. so you heard some of the excitement. there researchers spotted a north pacific right whale. it is estimated only about 500 still exist, and most of them are off the coast of alaska. this one was spotted by a team of researchers from the applied california current ecosystem studies group. the team had actually gone out to survey wildlife a few miles off the coast of point reyes. the national oceanic and atmospheric administration says. even though north pacific right whales are on the endangered species list, fishing nets and cargo ship collisions have caused their numbers to dwindle. it's a pretty amazing that they saw it out there. that's cool. a pirating sea otter that stole the hearts of people around the world, seemingly back in action again after months outside the public eye. when we talk about it, probably not funny for the people out there. so a local photographer, mark woodard, actually started documenting her interaction with people last year, and it actually took these photos over the holiday weekend.

several people reported seeing her hopping on boards there during the surfing competition along west cliff in santa cruz. you may remember otter 841 went viral last summer. this is after she was seen in videos plundering the surfboards and all of this while avoiding capture from california's fish and wildlife. while most of it so far has been lighthearted fun, experts say they need to remind everyone to give wildlife their space to be wild. there you go. she's a cutie, though. fun to watch. yeah, that name didn't hit the top ten list of baby otter eight for one. yeah exactly. next year, next year, something more creative. they're going to rename an olivia. olivia. yeah. all right, well, we're starting out cloudy this morning. whether you're surfing or just going to work, here's a live look at san rafael. we are going to have a cloudy start for the next couple of hours. we'll see those clouds linger and then clear out temperatures for most of us are in the upper 40s, low

50s. we're at 55 in san jose, 54 in san mateo, and it's 49 in martinez. as we take a look at gilroy and what to expect today, it's going to be cloudy through 8 to 9:00. the rest of the day. sunny temperatures gradually warming up and headed for the low 70s for today. it's going to be nice and we're also going to see those temperatures for the middle of the afternoon in morgan hill. head for 79 degrees 75 in milpitas. if you've been looking at that 7-day forecast up at the bottom of the screen, you know it's going to be heating up over the next few days. so we're enjoying some slightly lower than normal temperatures for many of our microclimates. and compared to what we usually see for the end of may, how about this 75 in danville, 73 in livermore and in oakland, as well as hayward. we're in the upper 60s. we're going to see some mid 60s for san mateo and palo alto, 73 degrees and a high of 62. in downtown san francisco, upper 50s for the outer sunset and our

north bay temperatures in the low 80s for santa rosa. meanwhile, in napa, we'll see a high of 77. and then we've also seen this cooling effect happening as this cold front, this storm system moves into the pacific northwest. after that, it quickly warms up. we're going to see high pressure building. and then that's with us for a couple of days before another cold front dips in. this one brings in rain a lot closer to the bay area we're not going to see any of that rain here, but we are going to at least have the cooler air coming down. and then next week we're going to be heating up again. so take a look at the changes we're going to see temperatures going up and down. so we're going to see the peak of those temperatures on thursday. but it will be a nice weekend ahead with highs in the lower 80s. mike things still moving smoothly. yeah i mean we consider this movement and we consider this smooth. it's standard at the bay bridge toll plaza early issues caused a slowdown in an unusual pattern, but it cleared up nicely there. there is a bill out of richmond to build through richmond, and we're looking at more slowing

welcome back. we're moving you forward with a look at the top stories on today in the bay. and we begin with breaking news. police are trying to find a person who shot and killed a man in the east bay. now here is a live look at macarthur boulevard and durand avenue in san leandro. that's where police say that the victim's car ended up crashing into a white van, sending it into a building. now,

that shooting victim died there at the scene, and investigators say that the violence occurred about a mile away in oakland. now, so far, there are no arrests nor information on what led up to that shooting. san jose police investigating after a homicide leads to an hours long standoff. it happened along north 20th street in julian, near coyote creek. this is a live look at the scene. the investigation continues. detectives say they received reports of a shooting at a home around 6:00 last night. and officers say they engaged with the man who barricaded himself inside that home. he eventually surrendered to police about 2.5 hours later. a woman's body was found inside the home. she had been killed. today in the bay ginger conejero saab is on the scene this morning. she is gathering new information. we'll continue to follow this in our 8 a.m. streaming newscast as well. a busy week ahead in court for the man who violently attacked paul pelosi. well, today a judge is expected to reopen david

depapes federal sentencing hearing. now this after the judge never allowed speak when e was sentenced to for the duration of the sentencing. it's not expected to change. meanwhile testimony could begin as soon as tomorrow into perhaps state trial. jurors were sworn in last friday, but the attorneys today are expected to argue that the state charges should be dismissed, citing double jeopardy. calls are growing to fund a proposed grade separation at what's considered to be one of california's most dangerous train crossings. over the years, numerous collisions have occurred at the broadway crossing in burlingame. state senator josh becker, today we'll talk about plans to include $100 million in state budgeting for the planned grade separation, which includes renderings. similar ideas are proposed for two other peninsula train crossings, a news conference is scheduled for 830 this morning, but before that, senator bker will join us live on our streaming newscast at 8 a.m. you can watch a full interview on
