where 101 meets 880, and the breakdown of the workaround as the innocence project has alleged, a threshold belief that scott peterson could still be innocent. and i think that is the key to the case here. back in court, scott peterson's attorneys now making a new bid to clear his name, the potential evidence his defense team is focusing on and the big challenges our legal expert sees in getting his conviction overturned. good morning. thanks for joining us for our midday newscast. i'm marcus washington. well, hours later and it is still a big mess for road crews in the south bay. a big rig overturned on a critical connector ramp and the impact for drivers stretching for hours at this point. our team coverage on the traffic situation begins right now. we want to kick things off with nbc bay area's bob redell. he's there live at the scene. and bob, we know this has to be a well coordinated

cleanup there. so how are things looking? well, chp had tweeted out that they would be reopening this connector from 101 to 880 right now at 11 a.m, but i just spoke with caltrans and they're coordinating this cleanup of all these strawberries that were on the big rig. and then the damage to the road, the supervisor is telling me it could be another 60 to 90 minutes. so the area we're talking about is northbound 101 connector to northbound 880. and then the northbound 880 connector to northbound 101. those are the areas that are shut down right now. the actual 101, i don't want to say the 101, because we're not socal 101. highway 101 is not impacted. the traffic is still moving on that northbound. but you can see right here caltrans has got people out here to do cleanup. and then you can see the big rig that was recently taken away within the past few moments. this is video earlier when they were uprighting, it. one reason why it took so long is it was loaded with roughly 40,000 pounds of

strawberries, shortly after it overturned overnight, they tried to upright it with the strawberries on board. it was just too heavy. they were afraid they were going to tear the trailer park apart. and we've seen that happen before and it just becomes a bigger mess. so it took time for them to offload those strawberries. and unfortunately, all those strawberries have most of them just gone to waste because they were tipped over and they're going to be disposed of, as you can see, right here behind me. so again, the issue is the big rig is gone, left within the past few moments, caltrans needs to just do some repairs to the road, you can see in the foreground we got the strawberries in the background. we've got those orange barrels that are normally filled with sand. but when this big rig overturned overnight, it knocked those barrels down. by the way, this happened around 3:00 this morning. it was a solo vehicle accident. the driver is fine, but according to chp, they believe that he was probably just going too fast when his load overturned. for more, i'm going to send it back to you guys. marcus. all right. good thing that driver is okay. well, let's take things over to mike

inouye because he has been looking at those workarounds. mike, i know a lot of folks traveling in that area. how is it looking? they actually pretty good right now. bob shows you the closure of the ramp. one of them goes this way north off north 101. the other one comes this way. and so they're complementary, sort of in the cloverleaf there. that's why both of the directions are blocked. you see the slow traffic on old bayshore highway. and that really has borne the brunt of the slowdown and the redirection for folks in the area. 10th, we have, we have, old oakland road as well as gish. they've taken a lot of traffic as well. things are light right now for the next couple of hours. should be lighter. so that should be good news. hopefully they'll open this before the evening commute. but we do have a lot of slowing as folks are passing by 101 and heading to 87 to get past the incident back to you. all right, mike, thanks. now, our team has been sending out updates about this story from the moment it broke. now, if you haven't already done so, make sure you download our free nbc bay area app. that way you're going to get those updates as they come in. well happening now convicted

murderer scott peterson back in court for an ongoing bid to clear his name. today's focus dna testing peterson's attorney say, was not part of the original murder investigation. nbc bay area's ginger conejero saab live for us outside of the courthouse in redwood city. and ginger peterson's attorneys there arguing that the dna testing really could have changed that outcome 20 years ago. that's right, marcus, that's the picture that scott peterson's attorneys are painting in court this morning. how much a difference that dna testing could have made in the original murder trial and its conviction. now, scott peterson was back in court virtually this morning. you're seeing some file video of him in his past court appearances. he has been in the past as joining virtually from mule creek state prison, where he's currently serving his life sentence for the murder of his wife, laci, and their unborn son, connor. now, peterson did not say much in court this morning, his attorneys instead arguing on his behalf that dna testing is critical in this case

, which has either not been examined before or not with the level of technology that exists now, defense attorney paula mitchell from la's innocence project arguing the need to test evidence on a mattress found inside a burned out van that was found near peterson's modesto home, as well as other pieces of evidence that washed up along san francisco bay. legal expert stephen clark, however, believes this is just one hurdle of many that the defense will need to overcome. i think it's going to be an uphill battle for the peterson defense team, even if they get a new trial, but what they're trying to say is, is that if they can establish that laci peterson was still alive in modesto when scott peterson went fishing, that is a completely alternative theory of the case and could point to scott peterson's innocence. the dna expert for the defense is in court this morning, as is a sister in law of scott peterson.

janie. now, as we speak, i just received an update that prosecutors are making their case at this point. they're saying peterson has filed for a motion for dna testing several times before. the first time back in 2013, there was also a second motion this time. this is the third time around. and that is why the da's office says they are opposing it. are ian cull is still in the courtroom. he will have updates later on in our newscast, so watch out for that. but for now, i'll send it back to you. marcus. all right. ginger conejero saab in redwood city. ginger. thank you. well, happening now, a protest underway outside of the chevron headquarters. that protest is happening simultaneous with the shareholder meeting. the group oil and gas action network calling for chevron to divest from operations in palestine as well as israel amid the ongoing war. that group sent us this video of the rally. now to a live look outside of the manhattan federal courthouse. this is where you're seeing

heavy police presence as jurors are considering the guilt or innocence of former president donald trump. now, trump is accused of falsifying business records in order to cover up hush payments to an adult film star. scott mcgrew says those jurors have a lot to consider. marcus. those 12 jurors have more than 30 different counts to consider to help guide them. the judge in the case gives them jury instructions. our nbc reporter, laura jarrett, tells us to say those instructions are complicated is a massive understatement. now, a weird quirk of new york law says they can't take those instructions in with them to the room where they deliberate, but they can send as many questions out to the judge as they want. pictures of mr. trump taken before today's hearing got underway. after the star cameras not allowed, mr. trump was described as a bit restless as he listened to the judge this morning. he's once again joined by some family members in the courthouse. now,

remember in new york, falsifying a business record is a misdemeanor unless you do it to cover up another crime. the jury is to decide whether he falsified records. and while the prosecution pointed out various crimes he was covering up, the judge instructed the jury they don't have to agree on what crime it was to find him guilty of the original charge. our legal analysts say that's an advantage for the prosecution. so now we wait. a small number of trump supporters, curious new yorkers outside the courthouse. and as you pointed out, marcus, there's a heavier police presence than normal as we wait for a verdict in the very first criminal case of a former president in the history of the united states, though not the last trump is facing three other criminal cases, two involving the election and the accusation he took and later hid classified documents in its mar-a-lago home. thanks, scott. well

happening now. opening statements begin in the state trial for david depape. he's the man who attacked paul pelosi with a hammer. now depapes attorneys yesterday arguing that the state charges should be dropped due to double jeopardy. the judge deferred the ruling, saying that the trial should proceed. depape did get a chance to speak yesterday as part of his federal sentencing. the judge also resentenced him to 30 years in prison. new at 11, people in milpitas are on alert. this is after a mountain lion sighting earlier this morning. so this happened around 2 a.m. near dixon landing road and friendly village mobile home park. this was near the bart tracks. police are telling people in that area to remain cautious. now let's take a live look out. a beautiful day here in the bay area. really? pretty much in every direction. this is in walnut creek. meteorologist kari hall has been talking about just how nice it's going to be, and warmer it's going to be today. i was just out a few minutes ago and i was like, oh,

it's already warmer than it was yesterday. at this time. and it's going to get even warmer as we get into the day tomorrow. but take a look at this beautiful shot. looks like a painting there. looking from our sutro tower camera down at the golden gate bridge. and we are starting that warming trend today with a peek of the temperatures tomorrow and friday. and then as we look ahead, we are going to see a spike in temperatures as we get into early june. and then looking at where we are right now, we're in the mid 70s in the north bay. it's in the low 70s, so it's still pretty comfortable out there. but when you do compare it to yesterday at this time, it is now 11 degrees warmer in santa rosa. and we're going to see those highs there up to 8577 in hayward and 79 in san jose. not too bad. but we'll talk about some hotter temperatures in our microclimate forecast. it's coming up in a few minutes. marcus all right gary thank you. well new at 11 for you boarding and traveling on muni. and san francisco is getting a big boost to make that commute easier. that announcement coming from the white house this morning, eight states are getting more than

$343 million to retrofit light rail systems and make them more accessible for people with disabilities. muni is getting nearly $5 million now that money funds improvement sat stops on the j church line and three other stops on m to oceanview line. that includes tightening the gaps between the train and platforms, plus building new platforms and wheelchair ramps. also today, a head up for drivers moving through san francisco's sunset district because northbound 19th avenue is now closed. now that normally busy street is closed between sloth and taraval. now, this all started at about 9:00 this morning. that closure ends at 3 p.m, but the same closure will be in effect tomorrow and friday. crews are working on potholes and repaving that stretch of roadway. they will actually start restriping next week, which will likely bring more closures for all new developments. following the arrest of pro golfer scottie scheffler. next here on nbc bay

halted that project over environmental concerns. a new study concludes that the process does not pose any measurable risk high risk, that is, to residents or wildlife. the vote on continuing that project takes place next week. well, speaking of the skies, beautiful skies this day in san francisco. we've seen it pretty much all across the bay area today. yeah, it's nice and sunny. you know, our temperatures are a little bit warmer. and i know it's been kind of cool for this time of year. usually at the end of may, we're thinking, shouldn't it be warmer at this point? but we are going to have a few more days of some warmer temperatures, and we're right now in the mid 60s for oakland, low 70s for much of the rest of the bay area. as you make your way inland. and we've got some comfortable weather for the giants game at first pitch. it's going to be in the upper 60s and then sunshine throughout the game, and it's still going to be breezy there. not as windy as it was yesterday, but we're still talking 20 to 25 mile per

hour wind gusts. and our temperatures the farther inland you go, will be much warmer into the upper 70s for dublin, up to 88 degrees in fairfield. and we're going to see highs in the low 80s from napa to novato and santa rosa, reaching a high of 85 degrees. tomorrow is when we reach the peak of the temperatures and then along the coast. you're not going to feel much of a difference, but when you get to the tri-valley parts of the east bay, the delta, fairfield, 93 degrees and much of napa and sonoma counties are also going to have some warmer temperatures, with santa rosa in the upper 80s and upper 80s for the south county as well. and then going into friday, we're going to see temperatures still in the 60s for san francisco, but then away from the bay, we're seeing temperatures in the upper 80s and even up to 90 degrees. so we will have a couple of days of warmer valley temperatures. and then we have a nice little cooldown coming our way this weekend, all thanks to more active storm systems moving into the pacific northwest. and

look at how close that rain gets on monday. it's possible that the north bay may see some spotty sprinkles, but expecting much of that rain to evaporate before making it into the bay area. and then right after that high pressure builds and ramps up our temperatures. so the middle of next week is looking pretty hot, and the climate prediction center is putting out the outlook with our temperatures and what we're expecting here. this area is expected to be well above average. the bay area is expecting some above average temperatures, so let's get a look at our 7-day forecast. it shows our temperatures in the inland areas in the upper 80s, low 90s, and then a nice little cool down for the weekend with breezy winds, a few more clouds, but then heating up again for next tuesday, possibly next wednesday. our temperature range for san francisco is not that significant, but it will be slightly cooler for the weekend. marcus all right. thanks, gary. well, outside lands, get ready
