scott peterson is now 51 years old, serving life in prison, but he wants a new trial. his attorneys want to test evidence for dna that they claim was never tested or admitted. in his initial trial, peterson was convicted of the 2002 killing of his wife and unborn child. nbc's ian cull joins us from the san mateo county courthouse with what the judge decided today. the defense was dealt a major blow by the judge late today. they had wanted to retest 14 different pieces of evidence, but in the end, the judge will only allow them to test one of them. scott peterson appeared virtually in a san mateo county court once again today as his attorneys made their case to test new evidence for dna and retest other items, all in hopes of proving he did not kill his wife and unborn child. more than 20 years ago. among the items they want tested clothes and duct tape found near lacey's body. but the major focus today was on what the defense is describing as a bloody mattress

inside a burned out orange van. it was found in modesto, near the peterson home the day after laci peterson disappeared. they say its existence, which wasn't discovered until 2015, could show someone else killed her. in all of my years, i have never had to litigate a dna motion to this extent because dna is just a no brainer. it's very concerning that they are so vehemently opposing dna testing in this case. bottom line according to peterson's team, there's big reasons to reconsider his guilt. we have demonstrated, i believe, in our papers and through our dna expert that the methods used now would and the methods and the technology would provide more probative results. meanwhile, the stanislaus county deputy, da david harris, tried to poke holes in those arguments, saying peterson filed his first motion for dna testing in 2013. this is now the third time he's asked for it, and that's why they say they're objecting to it, arguing

lacey's family, the rocas, shouldn't have to be retraumatized the pomp and final determination of marsy's law. that particular provision protects the roca family from these repeated, piecemeal dna requests from coming up over and over again. the deputy d.a. also addressing that orange van, saying there already was dna testing done on some of the items inside of it and that there was no blood found on the mattress. he added scott peterson lied multiple times on the record and noted that there was overwhelming evidence to convict him during the trial in court, where the trial judge has ruled on this particular evidence. so it is law of the case. in this particular case, we don't get to overturn it. we don't get to go back and rehash it because this defense team would do it different. the one item the judge will allow further dna testing to be done on is the piece of duct tape found on laci peterson's pants.

when asked if this is the end of the fight, peterson's attorneys said, quote, no, we have a whole lot more at the san mateo county courthouse, ian cull nbc, bay area news. a major headache in the south bay, or in this case, a major jam. a truck hauling a truck hauling strawberries crashed at a busy interchange. that truck, carrying 40,000 pounds of strawberries, overturned on the northbound 101 onramp to 880. the crash shut down the northbound connection on both freeways 101 and 880, for ten hours. they didn't reopen until about 1 p.m. crews spent the day just removing all those strawberries and a fuel leak. the driver, thankfully, was not hurt. a heads up now for drivers in san francisco. a busy road in the sunset district will partially shut down beginning tomorrow. northbound 19th avenue, a big artery of the city , will be shut down between sloat and taraval for construction. actually, it started today. crews are working

to fix potholes and repave the road. the northbound lanes will be closed starting at nine tomorrow morning and will reopen around 3 p.m. the same closure will be in effect on friday, 9 a.m. to 3 p.m. crews are also expected to start restriping next week, which could bring more lane closures. there's a warning tonight for people in the south bay neighborhood after a mountain lion was caught on camera roaming a neighborhood, nbc bay area's marianne favro is in milpitas with a look at what police are trying to do to try to find that big cat. a wild scene overnight in the south bay around two this morning, a mountain lion was caught on camera strolling along a patio in milpitas. high fee says his security camera caught the cat hanging out right next to his home. in fact, at one point, video shows the animal leaping onto his shed right in front of the camera. fee says now he's worried about his mom's safety. yes i talked to my mom. don't go

outside to do something. he always. he always do what? the plan. neighbors at friendly village mobile home park on dixon landing road say they can't believe a mountain lion was roaming the area while they slept. i'm shocked. yeah, because you might see coyote, right? but not mountain lion. steve gonzalez with the california department of fish and wildlife says mountain lion sightings are more a sign of the times than a trend, saying this is likely more about cameras rather than more cats or a yard that a mountain lion maybe have 25 years ago crossed in the middle of the night. nobody would ever know, today we'll capture it on video. milpitas police responded and tried using a heat seeking drone to find the cat. then came a second sighting two hours later. just a few miles away, the security camera video caught the cat scaling a fence at a home. we had a mountain lion sighting this

morning over in the meadow fair area. apparently he's in someone's backyard, probably looking for some food jumping around today we're over here in hidden lakes flying our mavic two. our drone looking for that. that big cat. as police continue their search, fish and wildlife say if you encounter a mountain lion, don't run. put your hands up to make yourself look bigger and make lots of noise in milpitas, marianne favro nbc bay area news. we have an update on those sick and starving pelicans that have been showing up around california. the birds have been pouring into rescue centers over the past several weeks, showing up in disoriented, showing up, disoriented in backyards, ponds, and even oracle park. scientists believe it may be caused by a broken link in their food chain. food sources are too deep or too far offshore for the pelicans to reach, they say. it's happened on smaller scales in the past, and populations did rebound. but with so many birds sick this time around, rescuers say it's

costing them around 1500 bucks per bird to nurse back to health. prosecutors in kentucky have dismissed charges against scottie scheffler, the world's top golfer. so scheffler was arrested two weeks ago when he arrived at valhalla golf club for the second round of the pga championship. a deadly crash snarled traffic when he got there, and that is when he had an interaction with an officer who claimed that scheffler dragged him to the ground with his car. he was charged with assaulting an officer and other charges. today, the jefferson county district attorney's office said based on the evidence, they can't move forward with that case. a menlo park startup is slashing its workforce. we're talking about the luxury electric car company lucid motors. lucid is laying off 400 employees. the ceo, who previously worked at tesla, said the cuts include leadership and mid-level management. he said the company has costly projects in the works and need to cut spending. the new suv model

hasn't gone into production yet, so it isn't even generating any revenue. but the ceo is optimistic about that project. he expects the gravity suv program to start production by the end of this year. staying up late could impact your mental health. that's according to a new study by stanford medicine. researchers looked at the sleeping habits of nearly 75,000 people, and they found people who stay up late have higher rates of mental and behavioral disorders. researchers are still trying to figure out why sleep impacts mental health, but they suggest that everyone should go to sleep before 1 a.m. all right. the first presidential debate is just weeks away, and the race is on to collect donors during the summer campaign season, the voters, president biden and vice president harris tried swaying today, i'm chief meteorologist jeff ranieri. as those temperatures heat up, we're also seeing a spike in the pollen, olive and grasses in the

debate is june 27th, about a month from right now. today, the president and vice president made an appearance, a joint appearance in philadelphia, to launch a new campaign aimed at winning back the black vote. here's nbc's alice barr. president biden and vice president harris in philadelphia today, working to shore up support with a critical constituency. black voters. you invested more in black americans than any previous administration in history. as we open more doors for economic opportunity. black voters were essential to president biden's 2020 victory, but recent polling shows much lower interest at this stage, heading into the next election. and former president trump is making some gains among voters of color. trump today is going to be is the man that can save

this country. drawing a diverse crowd at a rally in the bronx last week. it's too much crime. it's everything is going downhill. the economy is going bad. the food is expensive. the president and vice president unveiling a new effort. black voters for biden-harris, aiming to team up with grassroots organizations and trusted surrogates to directly engage with black communities that sustained organizing work stands in stark contrast to the outreach efforts, or lack thereof, that we see from the trump campaign at morgan state and historically black university in baltimore. some students are planning to mobilize against former president trump. i do not trust him, and i think if he ends up winning the presidency, america will turn into something unrecognizable. while a key message stands out, black voters are not a monolith. it's important to allow us to form our own thoughts and opinions, because we haven't been afforded the option to do that previously . voters looking for authenticity and results as

thing. if you are going to be heading out over the next few hours, no need for a jacket at all. you can just do the shorts. the t shirts, maybe even flip flops, right? just keep it casual. we've got some 70s here dipping in six, seven and 8:00 tonight, so somewhat mild night for us and some 60s later on this evening. now we'll take you out to concord, 87 degrees right now, certainly the hottest across inland contra costa. alameda county's 83 here at 7 p.m, 78 and 9:00. and then we'll also have those 60s rolling in by ten. and also 11. san francisco not nearly as hot. we still have a slight ocean breeze, but it was a beautiful day for you. we had some low to mid 70s in downtown right now. 71 a breeze though, kicking out of the west northwest at 28. that's going to drop us pretty fast here. 66 at 7 p.m. now tomorrow's forecast. i still see this area of high pressure keeping the coldest air away, allowing more of that warm weather to stay with us. and lots of sunshine. so we'll start it off tomorrow morning under mostly sunny skies. it got you

down to 56 here through the south bay, we're also coming in with 55 here for the east bay and low 50s san francisco to the north bay. now as you move through the day tomorrow, temperatures warming up a few more degrees, not quite widespread. 90s down here in the south bay. but we're going to be very, very close. we're up to 89 in morgan hill, 88 in gilroy, 88, milpitas 87. right there in san jose. best chance of 90 will be inland. contra costa, alameda county's going up to 91. in antioch. it's going to be one of my hottest some summer sizzle moving on in. even though it's not officially summer, summer like temperatures 90 here in pleasanton, 87 in martinez and 78 in oakland. over to the peninsula, 82 in san mateo down to palo alto, 86 san francisco, some low 70s downtown in the mission and the north bay. have you at 87 here in novato, 89 in sonoma. so it's a one day event here for us by the time we get to friday. i mean, this is the

the third down wide receiver specialist known as third and jawan, signed a one year contract extension with more than $10 million guaranteed last year. he only had 19 receptions during the regular season, but he had a breakout playoff run with ten catches. he also caught a touchdown and threw a touchdown pass in the super bowl. teammates say they know his value. for a guy that does it all. he runs the routes, he does the run game, he shows up every day. you know, loving the game with a great attitude every single day. and then you get the game day and he makes all those plays. it's something it's that's someone that you want to be in your building and someone that you want to pay. that's someone you want to reward because he's just going to keep bringing that every single day, and he's just going to raise the standard of everybody around him. so when you have a guy like that, that does everything, it's great for us. what's not so great for the niners? their top receiver, brandon aiyuk, is still a no show at otas, despite

being under contract for this season. he reportedly wants a new deal that would double his $14 million annual salary. running back christian mccaffrey has also missed both of the niners organized team activities. although these workouts are voluntary, there might be a reason for concern if cmc misses next week's mandatory minicamp. as for the overall team, there are a lot of new faces on the roster, but they still have a strong core of veterans and the same belief that this team is a championship contender got a really good roster, great coaches, great players ready to win. i'd say that's the state of the franchise. need to win now at levi's stadium. anthony flores, nbc bay area all right, the takeaway they need to get aiyuk and mccaffrey back into camp. baseball now a fiery afternoon at china basin. the red hot giants look to sweep the phillies. but they ran into some bad blood. take a look here. this was an interesting game. philly superstar bryce harper is leggie. he struck out in the first inning, then went to the dugout and did this a little

a major fire that killed dozens of palestinians. the white house says israel has not passed the biden administration's red line. us officials say the us is keeping an eye on israel's operations in southern gaza. they do not believe the country has launched a major ground operation that would trigger a change in us policy and stop weapon payments. a volcano has started erupting in iceland. take a look. video shows lava just spitting out of that volcano while large clouds of smoke rise from it. volcano is located in the southwestern part of the country. this is the

fifth time it's erupted since december. almost 400,000 people live near that volcano. they've actually built barriers to steer the lava away from infrastructure, including a geothermal power plant, a new kind of public transportation is coming to japan. a self-driving bus. two companies in japan teamed up to launch this project . the hope is that it's the answer to some transportation issues in japan, including a shortage of bus drivers. no hands on the steering wheel. you can see it there, but there's still a driver on board in case of an emergency. there's also a control center where employees monitor those busses remotely. they are testing this out? pandas headed back to the national zoo, china and the smithsonian national zoo in washington, dc announced that a new panda cooperation agreement today. the country will send two young giant pandas later this year. back in november, zoo returned three of the bears amid heightened tensions between the two global superpowers. just last month, you'll remember san

francisco mayor london breed announced that the city will also receive giant pandas from china. china's ambassador to the us says that the agreements are a very good sign for u.s. china relations. we can just look at these pandas all day, all day. they're so cute. like moving teddy bears. gia vang joins us now with what's coming up next. well, we've got a lot to cover right now at six, a training exercise gone wrong on the peninsula, and it put a group of students in danger. how tear gas ended up wafting into an elementary school, making students sick. also, a cowboy in the east bay, now part of a potential civil rights lawsuit, the heated confrontation with police officers at the center of his claim, and a state law that would have banned gender based care for trans youth shot down by lawmakers today that as protesters on both sides of the issue face off outside a bay area elementary school. the news at six starts right now. good evening and thanks for being

with us on this wednesday. i'm raj mathai and i'm gia vang. it was a law enforcement training exercise that went very badly tonight we're learning more about the chemicals involved. last week, 20 students at a san bruno elementary school got violently ill after chemical fumes from that training at the san bruno jail wafted onto their campus. nbc bay area's robert honda has the details. the jail facility here in san bruno is tucked away in the hills, but less than half a mile from portola elementary school. plenty of room for students and staff to avoid people and vehicles from here, but not chemical fumes. the tactical training classes at the san bruno jail facility took place on tuesday, may 22nd, and involved testing and handling of numerous chemicals used in, among other things, tear gas and pepper spray. but the fumes apparently drifted onto portola elementary school, sickening at least 20 students and an adult. the sheriff says the drill was called off and emergency crews

went to the school to check on the students. some parents, who asked not to be shown, told me their children got violently ill over the next two days. around 24 hours later, woke up in the middle of the night and vomited. and unfortunately, you know, was basically violently vomiting and couldn't hold down liquids for around 12 hours. another parent said the cause was clear afterwards, she continued to have like coughing, lung inflammation, nasal inflammation. we took her to her doctor, pediatric doctor, who confirmed that these are symptoms of tear gas exposure. now the san francisco chronicle cites sources who claim those chemicals may have included expired chemical agents that date as far back as the 1960s. the sheriff's office has not commented on the claim, but san mateo county supervisor david canepa says investigations need to be conducted on what are often vague safety procedures. but this incident really, has
