back for the 51 year old convicted murderer who is fighting to get his conviction overturned. a judge has denied nearly all of the dna testing requests from peterson's defense team. just one item will be retested. this is a case that's not only captivated the bay area for decades, but the nation. so what happens next? well, scott peterson is serving life in prison for the 2002 killing of his wife, laci, and their unborn child. but he wants another trial for a chance at freedom. and his new attorneys say there's big reasons to reconsider his guilt and to be scott peterson appeared virtually in a san mateo county court once again today as his new attorneys with the la innocence project made their case to test new evidence for dna and retest other items, all in hopes of proving he didn't kill his wife and unborn child. more than 20 years ago. his former defense attorney, mark

geragos, has always maintained his client's innocence. my belief is, is unfortunately, you're going to all this does is delay the inevitable, which is give this man a chance to show that he's innocent. he's talking about the judge's ruling today. peterson's lawyers wanted to retest 14 different items for dna, but the judge said they can only test one of them. the duct tape found on laci peterson's body. if you can develop a profile of this duct tape as a result of the kind of, the more robust techniques available in the scientific arena now than there was 20 years ago. and that leads to a profile of somebody else. and that somebody else, is a viable suspect. yes. that's a way to unravel it. in court. peterson's lawyers also brought up the burglary across the street on the day laci disappeared. they claim a phone call between two of the suspects a month after the disappearance will show they knew laci was missing and that she walked up during the burglary. but the

main focus was on what the defense is describing as a bloody mattress inside a burned out orange van. it was found in modesto, near the peterson home the day after laci disappeared. they say its existence, which wasn't discovered until 2015, could show someone else killed laci. laci peterson's dna be found anywhere that would be irrefutable exculpatory evidence supporting mr. peterson's claim of innocence. stanislaus county deputy da david harris says there already was dna testing done on some of the items inside, and that there is no blood on the mattress. he argues laci's family is protected under law from the repeated, piecemeal dna requests for evidence to court or the trial judge has ruled on this particular evidence. so it is law of the case. in this particular case, we don't get to overturn it. we don't get to go back and rehash it because this defense team would do it a different. a jury found peterson guilty after a trove of circumstantial evidence

morning and neighbors were telling each other about it tonight. residents are taking precautions and keeping their pets indoors. images that caught people in two milpitas neighborhoods by surprise. how the heck did he ever come down here? the mountains are that way, so i wouldn't expect any mountain lion to come this way. milpitas police shared this video of a mountain lion. the video was captured by a ring camera at the friendly village mobile home park at about 2 a.m. police told residents to be on alert and aware of their surroundings. as seen in the video, the mountain lion was strolling along a patio. it was right outside high fees home. at one point. the video shows the animal leaping onto his shed. i talked to my mom. them go outside to do something. he always, he always do water the plant like him. others at the friendly village mobile home park are also thinking twice about being outside, especially after dark. i don't think it's a good idea, it just take be a little snack for the kitty.

denise says she's keeping her dog frodo, inside tonight. the little scary because, he he's allowed to go in and out the house, but at night, he's not anymore. about two miles away, in the area of fair meadow way, residents are feeling the same way. milpitas police shared another video of a mountain lion. this video, also captured by a ring camera. but 2.5 hours later, after the first one, the mountain lion leaps over a fence. we're like, oh my god, that's actually definitely our area. so it's kind of scary to think about, especially because our dog was outside last night and he was being a little he was acting different. the california department of fish and wildlife says while these areas are more urban, this does happen occasionally, especially young mountain lions that are trying to figure out their area where they live, what's best for them, entering into places that they shouldn't be. tonight, marissa and her family are keeping their dog inside and are trying to stay indoors after dark. my husband just told our oldest son, like, he's like, yeah, so

you're going to be bringing the garbage cans in before it's dark, just to be safe. if you're out walking and you see a mountain lion, don't run away. stand tall, raise your arms, make noise and walk back slowly and find a place that's safe. maybe your home, maybe a car in milpitas. jocelyn moran, nbc, bay area news. jocelyn. thank you. an attack at a vta station sends a person to the hospital in san jose. it happened around two this afternoon at the station near the children's discovery museum. the sheriff's office says the suspect ran into a nearby home and barricaded himself inside. he was arrested a couple of hours later, still unclear what exactly happened. we have reached out to the sheriff's office and we are waiting to hear back. a major jam in the south bay. take a look. a truck hauling 40,000 strawberries crashed in a busy interchange. the truck overturned on the northbound 101 on ramp to 880. the crash shut down the northbound connection on both freeways for ten hours.

crews spent the day removing strawberries and a fuel leak from the road. the driver was not hurt. former president trump is awaiting his fate and so is the nation. the verdict could come as early as tomorrow morning in his hush money trial, mr. trump is facing 34 felony counts. he's accused of falsifying business records in connection with the hush money payment he made to former star stormy daniels. today, the jurors in new york city spent about 4.5 hours deliberating. they'll be back at it tomorrow morning, 6:30 a.m. our time. the former president has pleaded not guilty to all the charges. they don't know what the crime is. that's what the problem is. it's a disgrace. this thing ought to be ended immediately. and here's the million dollar question will the verdict, guilty or not, have any impact on t election? we asked our political analyst, larry gerston, if he's found guilty about three fourths of the voters say they'll vote the

same way, but about a quarter there you have it. 24% say they're likely to vote against it. now, who are these people? that 24? well close to half, 11% or so are, republicans. excuse me? 10% of republicans, 11% are independents. those folks could move. they say they are likely to move now if convicted. mr. trump faces anywhere from four years in prison to simply a probation, and the presumptive gop nominee can still be elected president. well, the man convicted for the attack on paul pelosi is back in court this week for his state trial, and prosecutors wasted no time getting to the most graphic evidence. today's opening statements included pictures of paul pelosi's injuries and video showing depape hitting him in the head with a hammer. prosecutors are trying to prove he attempted to murder pelosi. depapes public defender did not dispute the evidence, but instead asked jurors to consider

incredible story about incredible human beings that competed under really trying circumstances. steve, today from alameda is the host of a leagues podcast where he's interviewed dozens of family members connected to the stars of the league, which provided the only opportunity for black baseball players to compete professionally during a time of segregation. and he's more than excited to see major league baseball officially integrating league statistics into its record books. and if you look at the top ten hitters right now, i'm looking at a list. five of them are league ballplayers. today's decision by the mlb is giving league stars like josh gibson, who never got a chance to play in the majors. some long overdue recognition. gibson is now the mlb all time leader in both batting average and slugging percentage. this is a great day not only for the gibson family, but all the family members of league

baseball players and even local legends like san francisco giants. great willie mays will get his ten hits from his time in the league. added to his final hit total. bob kendrick is the president of the leagues baseball museum and calls today's news a watershed moment for the league. as commissioner manfred said, i hope that these statistics will be a gateway into wanting to learn more about the leagues. steve agrees, but admits that seeing the stats makes him wonder what could have been if the league stars were given a fair shot to compete in the majors. if the players could have actually squared off and competed against each other? pete serratos, nbc, bay area news an update on the sick and starving pelicans that have been showing up around california. the birds have been pouring into rescue centers over the past several weeks, showing up disoriented in backyards and ponds. even oracle park during a giants game. scientists believe it may be caused by a broken

link in their food chain. food sources are too deep or too far offshore for these pelicans to reach, they say. it's happened on smaller scales in past years and populations did rebound. but with so many of these pelicans sick, rescuers say it's costing them around 1500 bucks per bird to nurse them back to health. a bizarre story on the peninsula elementary school students got violently ill from chemicals used in a nearby training exercise. tonight, there are questions about what exactly they were exposed to the training exercise happened at the san francisco sheriff department's jail property in san bruno. this was on may 22nd. the training involved testing a number of chemicals used in tear gas and pepper spray. some of the fumes apparently drifted half a mile away to portola elementary school. around 20 children reported burning sensations in their nose and throats, and as reports rolled in, the drill was called off. now, the that date back as far as the 1960s,

after words, she continued to have, like, coughing, lung inflammation, nasal inflammation. we took her to her doctor, pediatric doctor, who confirme, the sheriff's department apologized to the school and said all chemical agent training has stopped amid the ongoing investigation. mountain view is the latest city in the bay area to approve license plate readers. council members voted unanimously late last night after a long hearing. they say the license plate readers are going to be used to assist in crimes, including hit and runs, amber alerts and car and package thefts. some people are concerned about the added surveillance, while others believe the time has come. police plan to use 24 cameras across mountain view, which will capture license plate images and compare that information with the national crime database. a

heads up for bart riders this weekend. a portion of the san francisco line will be shut down between the 24th street station and daly city. crews will be replacing aging rail and installing new lighting. the green line service will be canceled, and there will be no red line service from millbrae to daly city. bart says there will be a free bus service between those stations. all right, let's turn things over to our chief meteorologist, jeff ranieri. we are approaching friday adjacent. yeah, we are getting close to that weekend. no doubt everyone's keeping track of that. and today it was warm out there. wanted you to see the official highs where we did tie a record in santa rosa with that 89. last time we got this hot this time of the year was way back in 2002. now we're in for a repeat performance tomorrow. even temperatures a little bit hotter from this area. high pressure bringing the heat. we are tracking some 90s. let me show you more right now on that microclimate forecast. and for tomorrow morning as you get going on that commute. for most of us it will be a sunny

start. we could see a little bit of patchy fog right up here against the coastline for some of our beaches. then through the afternoon we will see some high clouds move in from the east. i'm not seeing any rainfall with this, but do expect some filtered sunshine at times with some of that high cloud cover overall through the morning commute. we're going to start it off with temperatures here down in the 50s, 56 for the south bay, tri-valley 54. and we have lots of those low to mid 50s here for the east bay san francisco and the north bay. so with those temperatures warming up down here across south bay, it's going to be good enough to put us to 89 in los gatos, 87 in san jose, a double eights there in milpitas. best chance of widespread 90s is going to be right here. antioch, livermore, pleasanton, danville up to concord. even warmer though by the bay with 80. in hayward, 78 in oakland. probably some of the best weather right there in oakland at that 78 through the peninsula, 86 in palo alto up to san mateo, 82 stays chilly at the coastline from that ocean breeze in the 60s. but you get to downtown in the mission. we

should be in the low 70s tomorrow and up towards the north bay, 92 in clear lake and 90 back here towards napa. so the way i see it right now, this is just a one day event here for us. by the time we get to friday's forecast, the storm track is going to move a little bit closer and knock some of that hottest air to the south. so here's the trend at least most immediately will cool it off by this upcoming weekend into the low 80s. still warm, but not as hot. and then we'll see it surge back up next tuesday, wednesday and thursday with some low to mid 90s here in napa. and then it drops off for the following weekend. so we get a few pops of heat coming our way right here in san francisco. that will put us back to the 60s this upcoming weekend. and for the inland valleys, not too bad. we get that 90 tomorrow and 82 on saturday, and i don't know about you guys, but that's looking pretty good to me right now. it looks like a nice five day vacation ahead of us. oh wow. who has the five day? i don't know, we're all here, but

police say thieves are hiding cameras in yards to monitor when people leave, so they know when to break in. owners have found cameras and battery packs in front yards and flower beds. another l.a. suburb, glendale, is also seeing this trend. police say arrested four colombian nationals, all part of an apparent burglary tourism ring. investigators say the group of thieves, a usually chilean or colombian nationals visiting on tourist visas their sole purpose for visiting is to case and burglarize homes. new at 11 evidence from a skull has revealed that ancient egyptians, the physicians in ancient egypt, may have tried to treat certain cancers with surgery. that's according to a study published today in the frontiers in medicine journal. it found two ancient egyptian skulls had cut marks around the cancerous growths. it suggests that ancient egyptians had explored ways to treat cancer through operations. ancient egyptians were known for their medical know how, and their texts
