"early today" starts right now. glad you're with me this morning. i'm frances rivera. at the stroke of midnight, much of our southern border was shut down. president biden signed an

executive order, side-stepping congress and taking drastic action to try to stop a surge in illegal border crossings. alice barr joins us now. what does this new directive mean for the border? >> reporter: frances, the new restrictions are triggered when unlawful migrant border crossings top 2500 a day. lawful points of entry are still open, but migrants who cross illegally outside of those points will not receive asylum. the directive stays in place until crossings drop below 1500 a day. the last time border encounters dropped below that level was in july of 2020. there are exceptions to these restrictions, including for unaccompanied children. president biden says this move was necessary after republicans blocked a bipartisan border security bill. >> we must face the simple truth to protect america as a land that welcomes immigrants. we must first secure the border and secure it now.

>> reporter: a trump campaign spokesperson responded to the order, saying the exception for unaccompanied children gives a green light to child traffickers. and republican lawmakers are calling this an election year stunt. >> why did you wait until now if you were serious about doing it? the simple answer is, he's not serious about securing the border. >> mr. president, joe biden, this is too little. this is too late. and the american public knows it's too late. this stunt is not going to save your political life. >> reporter: some immigration advocacy groups are threatening to sue the biden administration. they say this takes away a legal right to claim asylum. frances? >> alice barr for us, thank you. the senate today is set to vote on a bill to protect access to contraception. chuck schumer saying that the vote is vital for presenotectin

reproductive freedoms. house democrats are expected to force a vote on an identical item in the chamber. but both face uphill battles, it's part of a push to put republicans on the record on reproductive rights going into the november election. it was big primary night in new jersey. current house representative, andy kim has won the democratic primary for senate. speaking to lawrence o'donnell last night, he described the stakes ahead of the general election. >> i'm running against both an indicted sitting senator as well as someone whose first action in politics is to endorse a convicted felon. and i think that's the dynamics of this race here in new jersey that i'm facing for the general election in november. >> kim was referring to his republican opponent curtis bashaw and incumbent bob menendez under federal indictment and will run as an

independent. menendez' son rob won for the eighth district. attorney general merrick garland mounting a fiery defense of the justice system at a combative house hearing. he fought back against republican attacks, including the false accusation that the justice department was behind the manhattan prosecution of donald trump. hallie jackson has the fireworks on capitol hill. >> reporter: a message both blunt and sharp from the attorney general. >> i will not be intimidated. and the justice department will not be intimidated. >> reporter: a full-throated defense from the typically-soft-spoken a.g. slamming suggestions the doj had a hand in former president trump's state felony conviction last week as mr. trump falsfalsely claimed. >> that is an attack on the judicial process itself. >> reporter: but many insist the biden doj is playing politics.

>> many believe there is a double standard because there is. >> reporter: the house gop looking to hold merrick garland in contempt of congress for defying a subpoena for the audio between president biden and robert hur who ultimately declined to prosecute the president over his handling of classified documents, suggesting the jury would be unlikely to convict a well-meaning elderly man with a poor memory. republicans want more. >> we haven't heard the tapes. we don't know if they match up. if you have audio or video, that is better than a transcript. >> substantively, the transcript may be accurate, but, you know what? the audio would tell us so much more. >> reporter: but the white house exerted executive privilege at the request of garland who says he would be concerned about a chilling effect. >> it would affect witnesses answers if they thought their answers would be broadcast to congress and the public. >> reporter: and with the house speaker rolling out a new

>> reporter: something a prosecutor called the stuff that happens in mob movies, as a minneapolis jury heads into deliberations without two jurors after someone tried to bribe one ba and a second was asked about it by her family. a bag decorated with butterflies and $120,000 in cash on the inside. a woman showed up at the doorstep of juror 52 on sunday night with the bag, handing it to the juror's relative, saying it was a present for the juror, referencing her first name. she was told to say not guilty tomorrow and there would be more of that present. juror 52 immediately called 911 to report the incident. police finding 100, 50 and 20 dollar bills. >> when we have someone interfering with the jury process, that is supposed to be sacrosanct, something that is not touched throughout the
