this case has been vetted up and down the courts already. right now, at five, guess who's back in court today? lawyers for disgraced theranos founder elizabeth holmes will give a federal judge in san francisco the reasons they believe she didn't get a fair trial. also, growing calls for a cease fire. a live report from washington on the newly us backed resolution for gaza. this, as we get a look at new video of an israeli military raid that rescued four

hostages. plus, we are heating up. we'll show you when and where the heat will peak across the bay area so that you can plan your day. this is today in the bay. a very good morning to you, and thanks so much for starting your day with us. 5:00 right now i'm laura garcia and i'm kris sanchez. i'm in for marcus washington. we want to start right off the bat with that forecast, because we were talking about it being hot even before we started the day. yeah. and i know the weekend was a nice relief. but today we are expected to see a boost into the 90s upper 90s in some spots. and you probably notice even overnight we didn't get much in the way of relief. i mean, if you look at the current temperatures right now, look at san jose. it's about 59 degrees. we have some areas in the 60s, and we are expecting to see a day in the 90s. san jose live look right now in downtown, i want to show you how quickly we're going to warm up. so even though we're at about 59 right
5:02 am
now, if you notice right around your lunch hour, we're talking, you know, 11, 12:00 will already bump up quickly into the 80s. now we're going to be enjoying those clear skies. but remember, whenever we're talking about a warm up, and especially because we're dealing with some high pressure, we're also talking about drying conditions. that lowers that humidity. in addition to that, we're going to get a little boost of onshore winds as well into the afternoon. that mix right there is going to bring elevated fire danger, but also a heat risk index if you notice, especially for areas in the north bay. but of course into the interior where we're going to see some of the warmer spots, we are going to be seeing a heat risk index between anywhere from minor to moderate. now, not as bad as those triple digits that we saw just a week ago. but even so, you definitely want to take your time. i will make sure to talk about that elevated fire danger and the heat advisory coming up in just a few minutes. first, let's check in with mike. all right. hey, we have a car fire to talk about. 580, but it's back here before they join. so this is back over just in. just

at or just outside the tracey border there as we're looking at westbound, i think they just cleared this from the roadway. so we should see some improvement that will blend with the folks off the 205. that means more traffic coming into the altamont pass, but everything is looking pretty standard as far as the distribution of traffic flow. no major issues as we look from the south bay to the city. and over here, we do have a new crash that may be causing an issue. actually, it's not a new crash. i see a new little bit of slowing westbound highway four toward that 680 interchange. i'll get more details on that crash coming up. back to you, chris. all right. thanks, mike. so in just a few hours, the case that captivated silicon valley returns to the spotlight, this time in san francisco. lawyers for disgraced theranos founder elizabeth holmes will face a judge there to request an appeal. today in the bay's ginger conejero saab joins us live. and ginger, legal analyst you talked with says this is a long shot. good morning chris. i am told that this type of appeal is typically not successful, but this can also be the last.

seeking a new trial. and we will be closely monitoring how this all unfolds at the federal courthouse in san francisco later this morning. that is where lawyers for the theranos founder will make the case and seek a new trial, arguing that the judge in the original case erred in several decisions during the 2022 proceedings. holmes is serving her 11 year prison sentence in texas and is not expected in court today. her lawyer will appeal the conviction, the sentence and restitution orders. legal analyst steven clark believes theranos co-founder and holmes, former partner sunny balwani, who was convicted on all counts against him, may have more to work with as far as an appeal goes, i think the balwani team actually has more to work with, particularly when it comes to the conspiracy counts, mr. balwani was found guilty of conspiring with miss holmes, yet she was found not guilty of conspiring with mr. balwani. and
5:05 am
that is an inconsistent verdict. and may be grounds for an appeal . now, balwani is also not expected in court today, but his appeal will also be heard now regardless of what the courts decide on either appeal, clark says the impact of these convictions remains and we will be there to bring you updates both on air and online at nbcbayarea.com .com. chris. hey, thank you so much, ginger. a lot of us will be watching. well, now to new video of a chaotic scene in ucla. that is where multiple people were arrested after police denounced an unlawful assembly on campus. this all following an hours long roving pro-palestinian demonstration. protesters on campus were reciting the names of thousands of people who died in gaza. it remained mostly peaceful, but the situation turned when lapd and private security guards formed a line

san jose city council members will call for greater transparency when it comes to hundreds of millions of dollars in recent homelessness funding, a new state audit finds. san jose has not adequately accounted for the spending of $300 million over the past several years. members ben john and arjun batra are calling for a comprehensive audit to ensure the money goes to the proper places. the audit will also call for a new accountability hetty in the city's response to homelessness and exploring options to improve it. it will be proposed at today's council meeting this afternoon. all right, let's take a live look outside our window over san jose and look at that lavender sky matches your dress. well, i asked it mother nature. well, laura, once laura gets and if laura wants heat, laura is going to get heat. vinnie. and that's. we're going to see especially in inland areas. i mean even around the coast, if you look at san francisco right now, we've got a live look. we don't really have that marine layer that we have really enjoyed as far as the cooling effect of it. now, we

the reason why we're going to see warm up. but it's going to be for one day that ridging is going to really crank up the temperatures back up into the 90s, nearing the triple digits. and we do have a heat advisory for all of the areas highlighted in orange. you can see here stretching from napa down through vallejo and through livermore, fremont, san jose and morgan hill. those temperatures are going to near the 100, but we're also monitoring that humidity. this is going to be in effect from 11 a.m. to 8 p.m. remember the peak of the heat typically happens between 2 and 4:00. so drink lots of water and remember your pets if it's way too hot for your feet or your palms, it's way too hot for their paws. now we are going to be seeing as well. not only that, but we're going to be seeing a boost in those daytime highs. so let's take a look at your daytime highs for today. these are your max highs. we've got 96 degrees in morgan hill. and here are some of our warmer spots into the tri valley. now let's get a check of traffic with mike vanna. just so you know i do put my hand. i actually put my hand on the pavement before i put my dog down so the neighbors think i'm

saturday, there was a 44 acre wildfire that burned in this field behind me just north of 580 here at the altamont in livermore, which prompted a quick response from firefighters. this is not far from where the 14 000 acre corral fire burned a week and a half ago, and tracee yesterday, another fire broke out in the east san jose foothills and burned through a garage with a number of cars inside. one person was taken to the hospital and unfortunately, these fire conditions are going to be worse today. the national weather service is vienna is going to talk about has issued a heat advisory for between 11 a.m. this morning and 8 p.m. tonight, with temps expected to hit in the upper 90s here in livermore and other inland areas in the north, south and east bay. right now, cal fire is bringing its staffing up to peak levels and putting more ground and air equipment on standby to be ready for the next wildfire. it's based on whatever incidents that we're having. we've seen quite an increase in fire activity recently, but it's also based on
5:33 am
weather forecast and what what we're looking at going forward. if you live in a so-called wildland interface, cal fire reminds you to make sure you create 100ft of defensible space around your property and time your yard work for the morning. cal fire recommends you use your mowers and weed eaters before 10 a.m. so if those machines were to throw off sparks, it wouldn't be happening during the hottest and driest parts of the day. reporting live here in livermore, bob redell. today in the bay. some good advice there already. so dry out there. our coverage continues today with today in the bay vianey arana. she's actually tracking those hotter temperatures that we're going to expect today. are we going to feel it even in the morning? yeah. i mean we're not really seeing much relief overnight. that takes it over into the early morning hours. we had some 60s. and i want to talk about when we're dealing with fire risks, what we look for so hot weather paired with dry winds versus the timing accelerate the drying time which
5:34 am
then boosts that fire danger. so notice we've got weather topography and the fuels. now the trends show that we've had an earlier start to the fire season, but also sometimes even later into the season. today's regional fire risks. this is what we're looking at when it comes to the fuel moisture content. paired with the warmer temperatures. we look at things like grasses that's going to be higher, probably one of the biggest concerns heading into the afternoon hours is going to be how low the humidity gets. then we're seeing that brush that's elevated trees moderate, larger trees moderate. the regional risk is about average right now a lot higher for areas like the north bay. and here we go with the temperatures. so when we see those temperatures warm up we get that humidity that dries down. when you look at the humidity we're talking about the moisture content levels not only in the air but also in the vegetation. so you might be thinking, oh, but we had such a fantastic water year. you know, just last year we got great amounts of rain. well, here's the thing. now with all of that rain, what we saw is we
5:35 am
got a lot of new greenery, a lot of new plants. with all that rain. it boosted the growth of new plants. and now as we see those begin to dry out, if you're not properly maintaining any of those areas with the higher vegetation, that then creates a possibility for some fuel. so if you look at the forecast highs, we're going to be in the upper 70s, even around the peninsula. we're going to be in the 80s. if you're going to be heading to the city, we're going to be in the 70s and then the north bay. i'm concerned for the north bay because the humidity can fall anywhere from 20% to below 15. and when we're talking humidity, mike, we want to keep it above 30% ideally. so we're going to definitely be monitoring that very closely today. how are the roads doing. it's getting busy already. we are getting more busy on the roadways more traffic flow. and sometimes those sparks or something thrown from the vehicle. so the reminder don't throw anything out of your car. especially not cigaret butts. i know that's old fashioned, but still it happens on the roadways. we're looking at 580 westbound with the volume picking up a bit. not a major concern. so out of the altamont, a smooth flow of traffic just
