"early today" starts right now. we begin this morning in italy where president biden is attending a high-stakes international summit on the ukraine war. the g-7 meeting in the southern part of the country will also focus on the war in gaza. climate change, and the threat of a.i. and development in africa. for the latest, let's go to italy, and claudio lavanga reporting live. what's expected to come out of this summit? >> reporter: good morning, frances. on his way to italy on air force one, jake sullivan, the national security advisor told reporters that while they're both at the g-7, president biden and the ukrainian president, volodymyr zelenskyy, are expected to sign a new bilateral security agreement that he says will send a message to vladimir putin. now he told reporters, and i quote, if vladimir putin thinks he can outlast the coalition supporting ukraine, he's wrong. he just cannot wait us out, and this agreement will show our resolve and continued

commitment. now, while he's at the g-7, president biden is expected to rally support behind his proposal to issue a new $50 billion fund to ukraine that will be repaid in the future with the billions of dollars in profit generated by frozen russian assets in western countries, especially in europe. now, while this agreement or this proposal has received widespread support among g-7 countries, some may be concerned about the threat of retaliation from russia and others, maybe concerned about using frozen assets under international law. other subjects that will be discussed, as you mentioned, the ongoing war in gaza, climate change, migration and artificial intelligence. the session will be attended by pope frances on friday, the first pope to ever attend the g-7 summit in person. he's expected to ask leaders around the world and the g-7 to respect ethics while developing a.i., frances?

>> claudio, thank you. senate democrats plan to force a vote today to protect ivf treatments. one of the senators leading this fight is senator tammy duckworth. she used in-vitro fertilization to have her two children. the right to ivf act would make the procedure more affordable and ban states from imposing restrictions. republicans are expected to block the legislation, saying it is unnecessary and politically motivated. this vote comes one day after the southern baptist convention came out against ivf at its annual meeting. this is the largest and most politically-powerful protestant denomination in the united states. the aclu has filed its first major legal challenge to president biden's recent executive action on the border. and we have new reporting that migrants crossing illegally are still being released into the u.s., despite the drastic restrictions mr. biden promised. here's julia ainsley. >> reporter: new evidence migrants who cross the border

illegally are still being released into the u.s. by border agents, one week after president biden signed an executive action suspending their entry. >> they choose to come without permission, and against the law. they'll be restricted from receiving asylum and staying in the united states. >> reporter: but nbc news has learned border patrol is still releasing many migrants into the u.s. who crossed illegally to pursue asylum claims. a senior official tells nbc news those releases have dropped by more than half but are still happening because agents don't have enough space to detain the large numbers of arriving migrants. an internal memo to border patrol agents in san diego directs agents there to release migrants into the united states unless they are from these eight countries. overall, illegal border crossings under the new policy are still high but have dropped from 4,000 to 3,000 per day, dhs sources tell us. president biden signed the executive action after fierce criticism of his handling of the border, with a record nearly 10

million migrants entering the u.s. since he took office. but the border patrol union says the president's new action is not tough enough. >> the status quo, things have not changed. the executive order has not made any significant impact as it relates to illegal border crossings. >> reporter: we suffer a lot just to get here, says this guatemalan woman. and immigration advocates suing saying it goes too far. >> this ban is patently illegal. the trump administration enacted a nearly identical asylum ban. we sued over that, we won, we hope to win again. >> reporter: a senior dhs official says it's too soon to judge the policy's effectiveness. they say they need more help from congress to do more deportation flights. >> our thanks to julia for that report. the house has voted to hold attorney general merrick garland in contempt of congress. all but one republican voting to hold garland in contempt for defying a subpoena to turn over audio of president biden

speaking with special counsel robert hur. the president was questioned about his handling of classified documents. the white house invoked executive privilege over the audio, but the lawmakers were already given the transcript. the doj is not expected to act on this referral from the house. a devastating blow to the last living survivors of the 1921 tulsa race massacre. the oklahoma supreme court dismissed their lawsuit seeking reparations for the horrific attack, saying the suit didn't fall within the scope of the state's public nuisance statute . tulsa's "black wall street" was attacked by a mob in 1921. as many as 300 were killed in one of the worst attacks against black people in u.s. history. two filed suit in 2020 over lack of compensation for victims' losses. johnson & johnson has reached a settlement with states

over allegations the company misled customers over the dangers of its talc-based baby powder. kate snow has the story. >> reporter: the makers of that iconic white bottle. >> johnson's baby powder, a feeling you never outgrow. >> reporter: now paying out $700 million to 42 states and washington, d.c. the attorneys general accused the company of deceiving customers about the safety of baby powder containing talc. >> we began our investigation five years ago, but we worked together as a team, arm in arm on a bipartisan basis, and we did a good job making sure johnson & johnson stepped up. >> reporter: the company faces tens of thousands of other hauts from individuals, who say j&j baby powder caused cancer and mess thiel yoema. they did find a link between talc and cancer, which they've

disputed. i sat down with a lawyer representing the company at the time. >> the notion that johnson a& johnson would sell that product knowing that it causes cancer in women is just outrageous. >> reporter: in the settlement with states, johnson & johnson admits no wrongdoing, but just last year it stopped selling all talc-based baby powder worldwide. and the agreement with the states says j&j will never sell talc-based products in the u.s. again. the company in a statement says it is pursuing several paths. does today's news sound like some form of vindication? >> yes, definitely. i think it definitely is a step in the right direction. >> reporter: she used baby powder since she was a teen and diagnosed with ovarian cancel at 49. >> i thought i was going to die. so my husband and i, we began to think about casket versus cremation. >> reporter: she was the first person to file a lawsuit against johnson & johnson. she refused a settlement.

then won in court but received no payout. do you think if you hadn't gone forward with your case none of this might have happened? >> definitely yes. i do feel that way. >> reporter: burg has been cancer free for 17 years and hopes no other women will go through what she did. kate snow, nbc news. now to storms spawned by a tropical disturbance that continue to soak southern florida. more than a foot of rain falling in some areas, leading to dangerous flash flooding, submerging roadways and cars. florida governor ron disaesanti declaring a state of emergency. the storm also canceling flights, delaying travelers, including the nhl's florida panthers. they were three hours late departing ft. lauderdale for their flight to edmonton for games three and four of the stanley cup final. and the deluge is expected to continue again today. nbc meteorologist angie lassman is tracking that system. this is something else, the

record rainfall they've gotten. >> it definitely is incredible rainfall. we saw over a foot of rain in some spots across south florida yesterday. unfortunately, we do have the potential to do that all again. any additional rain is going to be problematic. hence the reason for the flood watches for 7 million people. most of the heavy rain is sitting south into the parts of the florida straits right now. the keys seeing additional rainfall and a little rain working through parts of the west coast of south florida. through the day today where he' go we're going to see another push of that tropical moisture. we see things slow down a little bit, but still locally-heavy downpours will be a threat. any additional rainfall will be problematic. we'll see maybe another 5 to 10 inches in some of these spots. we'll be watching that. a couple of things to watch as far as the tropics are concerned. one area we're going to watch,

erin mclaughlin has the story. >> reporter: on the bottom of lake champlain, the answer to a 50-year-old mystery likely solved. this wreckage believed to be the remnants of a private jet that vanished in january of 1971, discovered by underwater investigator gary kozak, who says he succeeded where 17 searches had failed. the ntsb has yet to confirmed findings. >> we brought in a remote operated vehicle, and we captured the underwater images confirming that it's 99% the right maplane. >> reporter: the ten-seat plane carrying these men. vanished on a snowy vermont night shortly after take offer with no distress signal sent. >> i started getting more interested in the problem and the challenge of why has nobody found this plane? >> reporter: kozak, a seasoned underwater rescuer joined the effort in 2014. his first attempt to find the

jet in 2022 turned out to be a false alarm. >>we got all excited. we found it. closer inspection, it stencilling that looked more military in nature, not something you would see on a commercial private jet. >> reporter: last month, kozak and his partners say they finally cracked the case with decades-old sonar data. >> it was in the location that the radar lost tracking of it when it crashed. it is painted the same custom paint scheme, black, red, black, that was on the side of this jet. so there's little very little doubt in my mind this is the right plane. >> reporter: finally appearing to put one of lake champlain's biggest mysteries to rest and giving five families a sense of bittersweet closure. frank wilder's father was on the plane that night. >> i'm feeling a lot of sense of relief, because spending 53 years not knowing if the plane was in the lake or maybe on a mountain side or around there
