ruling on the question of presidential immunity. nbc's brie jackson joins us now from d.c. hi, brie. what's on the line today for the former president? good morning. frances. so this ruling could mean mr. trump cannot be prosecuted for his role in the january sixth attack. the former president is facing federal election interference charges, but he's arguing that he cannot face prosecution for actions taken while he was in office. this landmark decision could set a new standard for presidential power. it is possible the court chooses not to give absolute immunity while still carving out some protections against criminal charges. this ruling is coming on the same day a former trump aide is heading to prison. steve bannon is due to start serving his four month prison sentence today for contempt charges after defying a congressional subpoena related to the capitol attack. the supreme court denied his request to stay out of prison while he appeals. bannon spoke to nbc's vaughn hillyard. why refuse to

comply with the congressional subpoena? because. because, first off, my lawyer told me when i got the letter of exerting executive privilege from the from the president, the j. six committee was not legitimately structured. so therefore their subpoenas don't mean anything. and so far no court has agreed with those objections. bannon says that he has no regrets and that he won't stay silent while he's behind bars. his release date is just days before the november election. francis brie jackson, boris brie. thank you. president biden continues to face fallout after a poor debate performance. the president spent the weekend huddled with some of his closest family members during a pre-planned trip to camp david, two sources familiar with the with the discussions tell nbc news that the president's immediate family, including the first lady and hunter biden, are urging him to stay in the race. many of the president's allies are saying he is still the best choice to take on donald trump.

that the political gamble by the president of france, emmanuel macron, backfired spectacularly. now, back in june, when the french president dissolved parliament after the crushing defeat of his party against the national rally. well, he also analysts say, called for snap elections, even if didn't have to, to do two things well. one was to outmaneuver the far right by scaring voting voters away. at least that's what he hoped. or to allow the far right to actually get into the government now in the hope that it will disappoint ahead of the 2027 presidential elections. well, that had the opposite effect, because the national rally had an amazing results in a much better than expected more than 33. of course, this is still just the first round of voting. voters are called to go back on sunday for to the polls for the second and last round. and president macron has called for all the democratic and

republican, political forces to come together to at least limit the damage. but now the damage is done because because of that gamble, now france and french politics are in turmoil. and by next time and by this time next week, well, we may, as you mentioned, have the first far right government in france to lead the government in france since the second world war. france frances, what a change in direction for the country. all right, claudio, thank you. the utica police department has released body cam video showing the deadly shooting of a 13 year old asian boy by a white police officer and a warning the video is disturbing. you can see nimoy running away from officers who are questioning him as they investigated an armed robbery that happened in the same area the previous day. the police department has edited the footage highlighting what officers said appeared to be a handgun in the child's hands. police wrestle him to the ground and one of them shoots him. the

gun turned out to be a glock replica pellet gun. a police press conference attended by the victim's mother and other korean community members erupted in protest and had to be postponed. local officer patrick haney and two other officers are on administrative leave pending an investigation by the new york state attorney general. a new york man is now facing drunk driving charges in a crash that killed four people, including an off duty officer. police say 64 year old steven schwall was seen speeding through a parking lot when his suv plowed into a nail salon in the suburbs of new york city. four people were killed at the scene, including nypd officer amelia rennhack, nine others were hospitalized. swalwell was also hospitalized and charged with driving while intoxicated. he will be arraigned at a later date. another delay for the crew of boeing's starliner to return to earth. the space capsule, now set to remain docked at the international space station for the foreseeable future, with a return date possibly months

away. but nasa insists their astronauts are not stranded. melissa parra has more. high above earth's atmosphere, two astronauts are waiting to find out when they can return home. let's go forward into starliner. at the time, nasa astronaut suni williams and butch wilmore gave this tour of boeing's starliner docked. since june 6th at the international space station. they thought they'd only be there for days. just super happy to be here on the international space station. but now, after a series of delays, a planned ten day mission has become a weeks long stay, with a return date unknown. nasa fighting back on suggestions that the astronauts are stuck. i want to make it very clear that butch and sunny are not stranded in space. our plan is to continue to return them on starliner and return them home when at the right time. it was just under a month ago when boeing's starliner launched into the skies for its historic test flight. but helium leaks and thruster issues since

are delaying its return. nasa boeing saying that to leave the es now would mean the evidence would burn in the atmosphere upon reentry. so they need time to study the root cause and they insist time is on their side. how much time do they realistically have? so there's plenty of food. there's plenty of resources up there. there's plenty of clothing. they will be absolutely fine for an extended period of time. nasa and boeing are looking at extending the mission window to 90 days, but say the astronauts are in no danger, and starliner has been cleared to return in the case of emergency. but with pressure mounting to find the cause of the thruster issues, they'll start ground testing the thrusters in new mexico as soon as tuesday. but that could take weeks and how quickly they move through those tests will likely determine when these astronauts. oh, i'll go first. and you follow me. get the green light to come back. earthside. marissa parra nbc news here. now, a severe thunderstorm spawning flash flooding in parts of new mexico over the weekend. in albuquerque, floodwaters submerged a bus and suv that

needed to be towed. residents in multiple areas were forced to evacuate, including in the village of ruidoso, which was recently ravaged by wildfires. meanwhile, the city of las vegas, new mexico, is still recovering from last week's deluge. officials are still providing bottled water to residents amid an ongoing shortage of clean water. let's bring in now nbc meteorologist michelle grossman, who's tracking, among other things, now, the hurricane brewing off the coast of barbados. so much to watch as we start off the week. michelle there is. hi there. francis. yeah another really busy week. first day of july and the tropics looks more like september. we have a major hurricane in the atlantic moving into the caribbean. it will impact the windward islands in just a few hours with life threatening winds, life threatening storm surge. really heavy rainfall that's going to lead to flash flooding, mudslides, landslides. so something to watch over the next 24 hours. right now, a category three storm with winds at 120mph. the location is 110 miles south southeast of barbados. it's moving quickly right now, west at 20mph. we do expect it to continue on that

westward track. we tropical alerts extending across the windward islands, also through hispaniola, because we expect it to move south of puerto rico, cuba and also hispaniola. so as we go throughout time here, we expect it to restrengthen to a category four storm. yesterday, it was a category four storm winds at 140mph. that would be later on today. then still a major hurricane as it passes south of haiti. category two by wednesday at 7 p.m. and then we'll see it weaken as it moves over the yucatan peninsula, eventually into a tropical storm as it moves into mexico. that is the tropics. back on land here we are looking at a travel forecast. big week for july 4th. this is today looking pretty good in san francisco, los angeles. the spots where we could see some delays denver, northern rockies into the plains. that's because we're expecting some showers. some storms, could see some hail in any of those storms. and also really gusty winds could see some slowdowns too. also in miami with some showers there. that's a look at the big weather story of the day. here's a closer look at your day ahead. at least for now. things are
