and to a new month. i'm frances rivera, just hours from now, the supreme court could shield donald trump in one of his legal battles. the court will release their remaining opinions for this term, including ruling on the question of presidential immunity. nbc's brie jackson joins us now from d.c. hi, brie. good morning. what is on the line today for the former president? good morning. frances. this ruling could mean mr. trump cannot be prosecuted for his role in the january 6th attack. the former president is facing federal election interference charges, but he's arguing that he cannot face prosecution for actions taken while he was in office. this landmark decision could set a new standard for presidential power. it is possible the court chooses not to give absolute immunity, which, while still charging or excuse me while still carving out protections against criminal charges. now this ruling is coming on the

same day that a former trump aide is heading to prison. steve bannon is due to start serving his four month prison sentence today for contempt charges after defying a congressional subpoena related to the capitol attack. the supreme court denied his request to stay out of prison while he appeals. bannon spoke to nbc's vaughn hillyard. why refuse to comply with the congressional subpoena? because. because first off, my lawyer told me when i got the letter of exerting executive privilege from the from the president, the j6 committee was not legitimately structured. so therefore, their subpoenas don't mean anything. so far, no court has agreed with those objections . bannon says he has no regrets and that he won't stay silent while he's in behind bars. his release date is just days before the november election. francis brie jackson for us. brie. thank you. president biden continues to face fallout after a poor debate performance. the

president spent the weekend huddled with some of his closest family members during a pre-planned trip to camp david, two sources familiar with the discussions tell nbc news that the president's immediate family, including the first lady and hunter biden, are urging him to stay in this race. many of the president's allies are saying he is still the best choice to take on donald trump. in november, joe biden has confronted and had to come back from tragedy, from trials, from tribulations throughout his entire life. so the moment that we're in right now is a comeback moment. members of the biden campaign have been working to reassure their top donors, insisting that the president has no intention of stepping aside. election results in france this morning show the far right national rally party in the lead, with an estimated third of the vote. this is the first of two rounds of legislative elections. it does not impact sitting president emmanuel macron's term, but it is still a sobering rebuke of macron, who

called the snap election just three weeks ago. the result puts france on course for its first far right government since the occupation of world war two. for the latest, let's go to claudia lavanga. good morning. claudio. how does this gamble backfire for macron? good morning. frances. what? it looks like macron's gamble backfired spectacularly. now back in june, the french president decided to dissolve parliament after his party was crushed by the national rally at the european elections. and analysts say that he's called for snap elections, even if he didn't have to. for two things, 1 to 1 to outmaneuver the far right party by scaring voters off, and the other is to allow the far right party to get into power now, in the hope that they will be disappointing ahead of the 2027 presidential elections. well, it had the opposite results, to be honest, because the national rally did better than expected

by winning more than 33% of the votes. now, of course, this was only the first round. now the voters are called to go to back to the polls on sunday for the second round of voting. but and president macron has called for all the democratic and republican political forces to come together to at least limit the damage. but now the damage is done. now france and french politics are in turmoil. and as you mentioned, by this time next week, france may have the first far right party in government for the first time since the second world war. back to you, frances. claudio thank you. new this morning. north korea test fired two ballistic missiles this morning. that's according to the south korean military. it came a day after north korea threatened an overwhelming response to recent military drills between the south japan and the u.s. south korean media, citing military sources, say one of the missiles failed and landed inside north korea. the other landed in the sea of japan

. just five days ago, the north tested a multi-warhead rocket designed to penetrate missile defenses. the utica police department has released body cam video showing the deadly shooting of a 13 year old asian boy by a white police officer, and a warning this video is disturbing. you can see nimoy running away from officers who are questioning him as they investigated an armed robbery that happened in the same area the previous day. the police department has edited the footage, highlighting what officers said appeared to be a handgun in the child's hands. police wrestled him to the ground and one of them shoots him. the gun turned out to be a glock replica pellet gun. a police press conference attended by the victim's mother and other korean community members erupted in protests and had to be postponed. local officer patrick husney and two other officers are on administrative leave pending an investigation by the new york state attorney general. california is cracking down on drink spiking starting today, bars across the state are

required to offer drug testing kits that can detect substances often referred to as roofies. it also requires bars to display signage that raises awareness about drink tampering. the regulations will stay in effect for at least three years, but could be extended. severe thunderstorms spawned flash flooding in parts of new mexico over the weekend in albuquerque, floodwaters submerged a bus and suv that needed to be towed. residents in multiple areas were forced to evacuate, including in the village of ruidoso, which was recently ravaged by wildfires. meanwhile, the city of las vegas, new mexico, is still recovering from last week's deluge. officials are still providing bottled water to residents amid an ongoing shortage of clean water. let's bring in now nbc meteorologist michelle grossman, who's also tracking a hurricane brewing off the coast of barbados. good morning michelle. good morning francis. and it's a major hurricane. tropics is looking more like september on this monday. we're looking at a category three storm was a category four storm. we do

expect it to restrengthen to a category four later on today. but we're looking at winds at 120mph. it is 110 miles south southeast of barbados. so we will see life threatening storm surge, life threatening winds to the windward islands in just a few hours. really heavy rainfall anywhere from 3 to 6in, even up to ten inches in some spots. we could see some landslides, some mudslides, also some flash flooding. this will move. a burro will move off to the west as we go throughout the next couple of days, and we're going to see that category three storm become a category four storm. we're looking at tropical alerts, tropical storm watches, tropical storm warnings, hurricane watches, also hurricane warnings across the windward islands. it's going to move south of haiti, south of cuba, south of hispaniola. over the next couple of days. and again, we're going to see it strengthened to a category four storm later on today. then weakened to a category three storm, but still a major hurricane, a category two storm by 7 p.m. and then by thursday, we're looking at a category two storm. it will make its way over the yucatan peninsula and weaken

to a tropical storm before it enters the eastern coast of mexico. back on land, we're looking at some travel troubles today. not a whole lot because we're looking pretty good in chicago, saint louis, san francisco, also, los angeles could see some strong to severe storms in parts of the plains. also the northern rockies that could slow us down in denver and looking at showers and storms in miami as well. that's a look at the big weather story of the day. here's a closer look at your day ahead, at least for now. things are comfortable with some areas of low clouds, some patchy drizzle out along the coast, but as we move forward from lunchtime into the afternoon, mid to upper 90s in reach for the inland valleys. even hotter coming up on tuesday. all the details coming up on today in the bay all right. that's your monday forecast okay. thank you michelle. now to the desperate race against time to rescue a massive pod that was stranded in shallow waters off of cape cod in massachusetts. nbc's laura jarrett has the story. here are just a few of the 125 dolphins that got stuck friday after the tide dropped, struggling in shallow water. with time running

out, a massive response. volunteers armed with life jackets, diving in to help surrounding each dolphin, herding them out to deeper water, others using boats to bring them out, and some doing triage, dousing the dolphins with buckets filled with water, and even using wet bedsheets to keep them cool. more than 100 dolphins were saved. the international fund for animal welfare is leading the rescue effort. this event of this size is actually fairly unusual. so this is our largest stranding event on record in our organization's history of 26 years. what a rescue. our thanks to laura for that report. coming up, the new legal turbulence for boeing and marty mcfly is still got it. michael j. fox steals the show with the huge guitar solo at a coldplay concert. you make me feel like dancing. i want to dance. feel the power of

boeing. us prosecutors plan to seek a guilty plea from the company over a charge tied to a pair of fatal 737 max plane crashes. cnbc's karen cho joins us now with those details. good morning, karen. francis, good morning to you. yes attorneys for victims have blasted what they call a so-called sweetheart deal for boeing. us prosecutors want boeing to accept or plead guilty over a charge around the fatal crashes of 737 max planes with an additional fine of $247 million. an outside monitoring of the company. now, attorneys call this a slap on the wrist for the company and are fuming over the potential for the company to avoid a trial after a string of safety issues, the department of justice is reviewing whether boeing violated a 2021 settlement that protected the company from federal charges linked to the 2018 and 2019 fatal crashes that killed 346 people. boeing has until the end of the week to decide on whether to accept the

plea deal. separately, boeing has agreed to buy spirit aerosystems for more than $4 billion after months of negotiations around the supplier to address safety concerns and supply issues. boeing will pay $37.25 per share, an all stock deal for the company. the deal will also result in the breakup of spirit, which would see some assets go to the french plane rival airbus. frances, back to you. okay, karen, thanks so much for the update. a strike hitting canada's second largest airline is over this morning. westjet just announcing that union mechanics will report back to work immediately. the mechanics walked off the job friday, forcing westjet to cancel more than 800 flights over the canadian long weekend. more than 100,000 passengers were affected by the cancellations. yet another delay for the return of boeing's starliner space capsule. the two astronaut crew could now be at the international space station for months after what was meant to be a ten day mission, nasa insists they are not stranded,
