"early today" starts right now. good morning. i'm frances rivera. with the help of the supreme court, former president trump is trying to get his hush money conviction tossed out. attorneys for mr. trump think the sentencing should be postponed and the guilty verdict set aside. they believe the supreme court's new landmark ruling on presidential immunity applies here, because the justices put limits on what evidence can be used at trial. and, in the hush money case, there were some personal documents that were signed after mr. trump took office. for more on this historic decision on presidential power, here's nbc's laura jarret. >> reporter: a monumental win at the supreme court for former president trump. the conservative majority finding the presumptive gop nominee must receive sweeping immunity for any official acts taken during his presidency. the 6-3 ruling a defeat for

special counsel jack smith, with the court bull doeding through t doze the charges against mr. trump. >> today's decision almost certainly means that there are virtually no limits on what a president can do. >> reporter: chief justice john roberts laying out a new sliding scale of what can be prosecuted. saying a president may not be prosecuted for exercising his core constitutional powers. that he has immunity from prosecution for all his official acts. but that a president has no immunity for private, unofficial acts, while cautioning, the president is not above the law. a federal grand jury indicted the former president for orchestrating a conspiracy to retake the white house. prosecutors alleging he leaned on his doj, vp and state officials to help him reverse the election results. mobilizing meetings of fake electors. it all culminating in the violent attack on the capitol on

january 6. mr. trump has pleaded not guilty to all charges and argued without immunity, every president could be prosecuted by political opponents. >> if you don't have immunity, you're not going to do anything. you're going to become a ceremonial president. you're not going to take any of the risks. >> reporter: the majority agreeing the commander in chief must be able to carry out his constitutional duties without risk of political prosecution. writing, without immunity, such types of prosecutions of ex-presidents could quickly become routine. and that would weaken the presidency. which is exactly what the framers intended to avoid. the special counsel had pushed to get the case to trial before november. >> my office will seek a speedy trial. >> reporter: the ruling now dramatically chipping away at parts of smith's case. the justices finding mr. trump's urging of the then-attorney general to investigate voter fraud now absolutely immune from prosecution. what remains in the indictment, including his pressure on his former vp. >> mike pence is going to have

to come through for us. >> reporter: are now entitled to a presumption of immunity. the liberal justices with a blistering push back. justice sotomayor writing when a president uses his powers in any way under the reasoning he will be inch latsulated from crimina prosecution. takes a bribe in, change for a ba pardon, immune. as for what comes next here, judge chutkan, the trial court judge, will have to bring everyone in for a hearing, possibly even hear witnesses and take testimony on this issue of what's immune and not immune. none of this will be fast. all of it will take months, if not longer. back to you. >> laura, thank you. there has been a dramatic drop in crossings at our southern border. a department of homeland security official tells nbc news that just over 84,000 migrants were apprehended in june, a 30%

drop from may and the lowest monthly total since president biden took office. some officials tell nbc news that the lower numbers are in part due to the hot weather. and also because mexico is stopping more migrants before they reach our border. israel has released more than 50 palestinian prisoners back into gaza. all have been held without charge. many of them in a camp in the negev desert. in may, cnn quoted three israeli whistle-blowers it said had been stationed there who described inhuman inhumane treatment, including hand c handcuffs so tight that hands had to be amputated. there was a high-profile name among those released. >> reporter: that's correct. one of them is no other than the director of the al shifa hospital in gaza. now al shifa was one of the largest hospitals in gaza, still is. but it has also been a focal point of the humanitarian crisis there over the past several

months. he has been in israeli captivity as well during that time. he appeared at a press conference, his appearance, of course, frail after so long in detention. and he claimed that he had been released alongside some 50 other palestinian prisoners. he said today he'd been subject to extreme torture. the doctor himself claiming that his fingerwas broken and that he had been bashed over the head on multiple occasions. during his time in captivity, he said he had also been brought before three or four legal proceedings but that no charges were ever brought against him during these proceedings. israel's prison service, which operates the pris be won and whe and the others were held, have released a statement saying that all the prisoners were treated in accordance with the law. meanwhile, there are now concerns that a renewed idf assault on the city of khan yunis may be imminent. an order was issued to civilians in the city to begin a massive evacuation, suggesting that khan yunis will be an upcoming target

in a series of ongoing israeli raids, all of them focussing on parts of gaza that the idf had previously abandoned. they're claiming hamas is regrouping in these areas and that they must be dealt with. now to a major development in one of jeffrey epstein's high-profile cases. a judge in florida has released the transcripts of a 2006 grand jury investigation into the convicted sex offender, it was made possible by a special law signed by ron desantis. the records show that prosecutors knew epstein had raped two teenagers before they cut him a lenient plea deal. in 2018, federal authorities brought new sex trafficking charges against epstein, who died in custody in 2019 from strangulation from hanging. his death was ruled a suicide. now to a murder trial out of boston that was filled with twists. a jury failed to reach a verdict in the case of karen reed,

of exhibits and allegations of a police coverup, captivating watchers on social media and outside the court. prosecutors allege following relationship issues and a night of heavy drinking, reed backed her suv into o'keefe, leaving him to die in the snow outside the home of a fellow police officer. arguing the constellation of the facts point to reed, including pieces of a broken taillight recovered in the snow. >> i hit him. i hit im. him, i hit him. those were the words of the defendant. >> reporter: they pointed to a botched investigation, arguing reed was being framed for murder by police. prosecutors say the gallegation untrue and are vowing to re-try the case. turning now to the southeastern caribbean where hurricane beryl is pummeling the region. it's now strengthening to a category 5 storm after making landfall i grenada ales care

major hurricane strength as it continues west ward, impacting folks for the yucatan peninsula late this week and early next week. we'll watch for heavy rain and the storm surge and strong winds. the hurricane-force winds for jamaica. now beyond that, we've got 7 million at risk for strong st storms today, kansas city involved in that. we likely will see hail, wind gusts and isolated tornados. it's a big week for travel. looking ahead to your wednesday travel. chicago, st. louis are a couple spots you will have to watch for because of strong storms and potentia o shreveport. san angelo headed to 105.
