alec baldwin. two jurors were dismissed who admitted they couldn't be impartial. how long will it take? one day that's all the judge's alotting for this, it's likely we'll get a jury seated, no complications or any thoughts that maybe this could go into tomorrow, it could be a long drawn-out process because there are a lot of questions being asked to these potential jurors. we'll likely have a jury seated by today zopening statements are expected to start tomorrow and this trial is expected to last eight days. >> dana, do we know who some of the potential witnesses might be? during the trial and whether alec baldwin himself plans to testify. >> no indication that alec baldwin will take the stand in his defense. we likely won't know until the

very last minute. we heard from legal experts it wouldn't help his case because it opens him up to be questioned about statements he made publicly. so that's something that a defense team is not going to want him to readdress. we'll see some of the same faces that we saw during the armorer's trial earlier this year. you'll hear from hannah gutierrez reed herself, she's expected to be called to the stand, she plans to plea the fifth and director joel souza, he gave an emotional testimony during his testimony earlier this year, likely also hear from the first assistant director,

at a very low point and they're attributing that to the new asylum restrictions that biden administration put in place in june. >> julia ainsley, thanks so much. we're following another mechanical issue in the sky, the united airlines flight departing from los angeles international airport on monday lost a tire during takeoff, nbc news senior tom costello, he joins me now from washington, hi, tom. >> reporter: the second time in foths this has happened with a united plane, no injuries, at least one passenger we spoke to tells us the united crew informed and prepared passengers well for a safe landing in denver, and now both united and the faa are looking into how that tire fell off the plane's landing gear. it happened in the air

monday morning. >> we were just told a tire came off your aircraft. >> reporter: a flight losing a tire during take-off. >> tire came off. we saw it rolling down the runway. >> reporter: the boeing 757 with 181 passengers and crew onboard continued to denver, its destination, landing safely. one of the passengers allen stubblefield commending the united crew for preparing them for the landing. >> brace, brace, brace. brace, brace, brace. >> there was one bump, but it was a normal bump. and you didn't hear any brakes. you didn't hear any unusual screeches or noises. >> reporter: in a statement, united tells nbc news in part, the wheel has been recovered in los angeles, and we are investigating what caused this event. it all comes just a few months after the faa increased oversight and scrutiny of united's maintenance operations following a string of incidents on its jets, including a united flight headed to san francisco from sydney, forced to turn

around midflight after fluid was seen spewing out from the right landing gear. another united jet sliding off a wet runway in houston as it tried turning on to a taxiway. >> see the trucks en route. >> reporter: and there was also this march incident in san francisco. >> the last departure lost a wheel on departure, so we will have to shut the runway down. >> reporter: a united 777 headed to japan lost one of its six tires from its main gear assembly as it took off. the tire landed in a parking lot, damaging several parked cars and a fence. fortunately, though passengers were often inconvenienced, all of the flights including monday's landed safely. >> you know, machinery breaks. even though you do your best to try to keep things up, i still consider flying in the u.s. to be a very safe thing. >> tom, these incidents all involve boeing planes but this is not a boeing issue, right. >> reporter: you know, that's such a good point because boeing

us district court in oakland. now, the subpoena warns that the disclosure of any of these documents could, quote, seriously impede or thwart this important investigation, unquote. the east bay times reports that the city attorney, parker, issued a memo to employees to preserve the documents in connection with this investigation. you might recall, last month, fbi agents carried boxes out of the home of oakland mayor sheng thao, who ae jones. agents also searched two homes owned by members of the politically influential delong family that owns the recycling company cal waste solutions. the mayor has not been charged with a crime and denies any wrongdoing. here is a list of some of the documents requested in the subpoena. quote documents and communications related to andre jones. all calendar entries or records of the existence of planned or scheduled meetings for sheng thao andre jones between june 20th june 1st of 2022, to

present documents and communications relating to the 2022 city of oakland mayoral election. the fbi did get back to me this morning. they refused to comment. the us attorney's office said they can't even confirm the existence of any such subpoena. and as always, under these circumstances, they must decline to comment the on the existence or nonexistence of any such investigation. the city attorney would not comment, but they did send us a copy of the subpoena and said they did issue a privileged, confidential attorney client communication between the oakland city attorney and other city of oakland staff members. the mayor's office did not respond to a request for comment. bob redell nbc, bay area news. thank you, bob. we have new details into our newsroom about a bomb scare in north san jose. we've learned police arrested this man, felice ana. it happened last wednesday on ritter park drive, an area with several shops. police say annette called in the bomb threat himself, and when officers arrived, they found the makings of an

explosive device behind a business. nearby. shops were evacuated as authorities searched the area. officers eventually found arnez in his car several miles away and arrested him. he now faces several charges. no word on a motive. bart has hit a roadblock in its extension project in san jose. leaders are asking the white house for help. construction on the six mile underground tunnel is already underway. the extension is meant to run through berryessa transit center through downtown and then ending in santa clara. but vta says another $6 billion is needed to cover the costs to extend bart from berryessa station to diridon station, then on to santa clara. a final decision on that funding is supposed to be made by the end of the year. we're actually listening to a news conference and we'll have an update in our evening newscasts. we are getting a break from those high temperatures today, but it's not going to last for long. here's meteorologist kari hall with the details as we take a look at our high temperatures for today. this is our break from the high heat that's ahead. it's mostly

in the 70s and 80s with a few low 90s, but it will be as hot as 96 in the south county and up to 104 in ukiah today. but then as we look at our wednesday forecast, we see the return of the moderate to major heat risk as our temperatures top 100 degrees in the south bay, as well as much of the inland east bay into the north bay. but unfortunately, that's not the peak of the heat. it gets even hotter on thursday, with a high up to 111 degrees in ukiah. a lot of 90s in the north bay, and we're seeing a cool down for the weekend. so we'll take a look at that coming up in a few minutes. meantime, firefighters can continue to battle the state's largest wildfire. the lake fire, sparked last friday in santa barbara county. it's near lake. it's near los olivos by highway 101. just yesterday, cal fire issued new evacuation orders. the fire has burned over 26,000 acres of land and one structure, and it continues to threaten michael jackson's former neverland ranch. cal fire says

years, the zoo says the duo are still getting used to their new home. they should be out for the public to see in just a few weeks. let's talk about the race for the white house now. since the first presidential debate, 12 days ago. >> 118 days until election day, anything changing either president biden's or former president trump's position in the polling? let's talk about that with our nbc news national political correspondent steve kornacki. a number of polls have come out since the debate. what are we seeing in general. >> some movement. democrats, a bit of dilemma how they'll interpret it, all the polls that have come out and been conducted entirely after the debate, donald trump leads in seven of them the eighth one

is a tie. what you're seeing here the same polls last time before the debate. looking for movement here, you see pretty consistently, but trump doing, you know, a couple points better, two points better from the before debate to after debate polling, the trend here trump leads now in almost every poll. the question for democrats, when they look at numbers like this, look, biden's supporters are going to say, you know, it's not like the bottom fell out from him. they're saying that this is something they can overcome, it's only a few points, it's not as much damage as the cover might suggest. but the opponents looking for a new candidate would say, the bottom line is, biden loses in all these polls the bottom line biden has been trailing donald trump most of the year in an

election we think is going to be close these democrats would say even losing a point or two points extra could be all the difference. >> steve, amid the pushback against biden you mentioned the most likely replacement would be vice president kamala harris, any numbers on how she might win or poll against president trump? >> we have numbers. there have been three polls since the debate that have measured both biden against trump and harris against trump. in one harris does better than biden. in another one biden does better. a group of middle schoolers made fake tiktok accounts impersonating their teachers. tim furlong from our nbc station

in philadelphia with more. >> our students still think this is appropriate behavior. so disheartening. >> reporter: the head of the school district upset students created over 20 fake tiktok accounts impersonating their teachers, making it look like they're making crude, racist comments. imagine being the teachers back in february when you first saw these posts of yours and how hard it would be to keep teaching these kids. >> i want to ensure our staff we have your back. >> reporter: the district has done cybercitizen ship sessions with the school and while it's possible teachers can investigate defamation-type legal action the district said holding kids accountable in a

public school is tricky in a case like this. they block tiktok from the school's wi-fi system. when kids are at home t not muc punishing school districts can do in those cases. >> speechless. >> reporter: that's the reaction of the local school union. . >> in my classroom, i promote integrity, leadership, and confidence, so when no one is looking you should be doing the right thing. our social media networks need to do a better job. they have a stake in this just as much. environmentalists push for more solar energy across the

country, california lawmakers are trying to reduce it, why, well, the state is apparently making too much solar energy which means a lot of it is going to waste. liz kreutz explains. >> reporter: across california, it's common sight, road of suburban homes topped with solar panels. a counterintuitive problem has emerged, california at times is generating too much solar. since solar power relies on the sun, on days when it's not too hot, run into this issue of having too much solar, people aren't home and the system can generate more than the state can use. this imbalance has been dubbed the duck curve, production exceeds demand. inside california's independent grid operator showed us how they

managed the state's electricity in realtime. there's solar energy right now that's essentially being thrown away. >> you know, the bottom line is there are times when we don't have the demand for electricity for the full solar fleet. >> when you say curtail you're saying throwing it away. >> dispatch instructions to those fleets to reduce. >> reporter: the amount of renewal energy curtailed most of its solar has skyrocketed both from oversupply and so-called congestion, more electricity than the transmission lines in some areas can handle. so far this year the state has already lost out on nearly enough to power all the households in san francisco for a year. to solve the problem the

governor's administration has been asked to add more batteries. cutting financial incentives for homeowners looking to install solar. ed murray, in sacramento, says the impact has been devastating for his business, he's laid off ten employees over the last year. since the changes there's been a 66% drop in residential solar installations and estimated 17,000 green jobs lost statewide. to make it cost effective homeowners now need to install batteries in addition to solar panels. that can cost an additional $20,000. the governor defended the state's policy.

for some members of sam's club, the days of free shipping are numbered. starting august 19th, sam's club plus membership, a subscription that runs over $100 a year will only qualify for free shipping on orders of $50 or more. the wholesaler facing backlash from customers online. one user writing, these changes will make it harder for me to keep my membership. while others say they may take their business to a competitor. sam's club tells nbc news that these recent changes are designed to simplify the experience for same day shipping and provide access to items our members buy the most. >> it really changes the game in a consumer's mind whether they will continue with sam's club or not. it would not surprise me if they lost some members over this. >> reporter: sam's club is just the latest retailer to increase free shipping minimums in recent years as companies are squeezed by high operating costs. in 2023, amazon increased their free shipping threshold by $10 for nonmembers. and they're not alone. 19% of retailers increased the average free shipping last year ranging from 5 to $200. >> want to save money?

in san jose wrote us about an lg dryer that wasn't fully drying. well. the randhawa's had bought a lowes extended warranty, so they paid lg 361 bucks to fix the dryer and expected lowe's to reimburse them. but lowes said no. the randhawa's were supposed to let lowe's hire the tech, the randhawa said that's not what they expected from their warranty, so they contacted us. our team contacted lowe's. it took action and gave them their 361 bucks back. here's what a lowe's rep said. our care team has been in contact and the issue has been resolved to the customer's satisfaction. again,
