crooked joe to an 18-hole golf match. >> reporter: the biden campaign quickly responding overnight saying in part, quote, donald trump is a liar, a convict and a fraud only out for himself, par for the course. also, new indications of how much the last couple weeks have impacted this new race. look at this. this is new ratings from the highly respected not partisan report. they show former president trump has an edge over president biden in three key swing states that biden won in 2020, arizona, georgia and nevada now all main republican. of course, savannah, that's only a snapshot of this moment, but it does show the challenges that president biden faces. >> thank you, peter. meanwhile, all eyes are on the democrats, especially in the senate and how they're addressing the president's now problem-plagued campaign. ryan nobles joins us from washington with that part of the story. hey, rayen, good morning. >> reporter: good morning. for a day, it seemed like joe biden held off the avalanche of calls to get him to drop out of the race.

he is going to be our nominee, and we all have to support him. >> ryan, the president, of course, has this news conference tomorrow afternoon, high stakes. what are the expectations there? how long is it going to be? do you have any information about that? >> reporter: savannah, i think there is no doubt there is a real sense among democrats that every public presentation that the president makes from this point forward will be under an incredible amount of scrutiny. this press conference the president is scheduled to take part in, a solo press conference as part of the nato summit is something many democrats tell me they're going to point to as giving an indication that he has what it takes to stay in the race. that's why some are willing to give him some time to prove that he has the ability to beat donald trump. but that time is running out. many pointing to the weekend at the point in time in which democrats need to make a final decision whether they're all in or all out. >> ryan nobles, thank you. all right. another major story we're following, extreme weather. tens of millions facing another

day of scorching heat. the brutal temperatures especially hard to handle in parts of texas where crews are racing to restore power in the wake of hurricane beryl, taking aim at the midwest and the northeast. we will get to al's forecast in just a moment. but, first, kathy park joins us from houston. hey, kathy. good morning. >> reporter: that's right. this is a hard hit neighborhood, entering day three with no power. this morning, it is already feeling quite muggy. highs climb into the 90s once again. inside some of these homes, some residents say it feels more like a sauna. as texans clean ups from destructive hurricane beryl, in houston the heat index expected to soar into the triple digits again today. >> open up all the windows, you get the breeze, your house is still hot. >> oh, wow.

>> reporter: dangerously hot for nearly 2 million texans still without power. the storm already blamed for at least nine deaths in the u.s. with power outages entering a third day, some residents are prepared to leave to find relief. >> we have a portable fan that is chargeable battery operated, so that helped last night, but we won't probably stay another night. >> reporter: generators working overnight and gas stations packed to keep up with fuel demands. hue houston isn't the only one dealing with oppressive heat. more than 120 million people baking on both sides of the country. heat records shattered in las vegas where it climbed to 119. new york now on its fifth consecutive day in the 90s. in northern virginia, residents at this apartment complex had to ensure 90 degree temps inside their unit for days after a cooling tower went down. and as beryl makes an exit, a final blow in the midwest, spawning a destructive tornado

in indiana, a summer of extreme weather with powerful storms and sweltering heat. and with the heat advisory in effect until later on this evening, here in houston, the lieutenant governor dan patrick is urging center point energy to restore power as quickly as possible. at this point, it is unclear when everyone will have their power back on. >> kathy, thank you. let's turn to al and see what you have on tap today. >> again, we will start off with this heat. good morning, everybody. 121 million of us, a huge amount of heat out west. it is that dry heat. in the east, we have more severe heat coming in with high humidity. of course, down in texas they've got those problems. look at boston, washington, d.c., macon, georgia close to 100. jackson feels like 96 degrees. heading into the weekend, not much relief. richmond will be in the upper 80s to 90s in charlotte. near 100 in atlanta and montgomery, alabama as well.

weekend, the suspect taken into custody after he was shot by a u.s. marshal assigned to protect the supreme court justice. erin mclaughlin joins us with the latest. >> reporter: good morning, craig. this brazen attack happened hours after 4th of july celebrations in the capitol. carjackings are a persistent problem here in d.c., and law enforcement has been cracking down, but a source close to the investigation tells nbc news they believe this carjacking attempt was random and not related to the supreme court justice. this morning an investigation is underway in washington, d.c. after a u.s. marshal shot a suspected carjacker near the home of supreme court justice sonja sotomayor. the incident happened in the early morning on this block of the nation's capital hours after the fourth of july fireworks. police arrested suspect 18-year-old kentrell flowers. two deputies who were a part of the unit that protects the homes of justices were sitting in an

unmarked government vehicle when, according to a federal complaint, flowers stopped directly next to them in a silver minivan, got out and pointed this firearm to the front driver's side window. according to the complaint, one marshal fired approximately four times at flowers, hitting him in the mouth. the silver van fled the scene as the marshals provided first aid to flowers. the latest incident in a series of carjackings near the capitol, the latest incident an example of high-profile carjackings in the capitol. late last year in georgetown, two teenagers were arrested for allegedly breaking into the car of the secret service agent protecting the president's

granddaughter. carjackings near the capitol are down 46% compared to a spike last year, according to police. this week the u.s. attorney for the district of columbia acknowledging there is still more work to do. >> while we have not reached our destination, we are on the right path. >> reporter: the suspect, who was hospitalized with non-life threatening injuries has yet to enter a plea. nbc news reached out to justice sotomayor and the supreme court for comment. >> erin, thank you. the state of virginia is cracking down on students using cell phones in public schools with a half million dollar initiative, so citing a teen mental health crisis, governor glenn youngkin issued an executive order to establish a cell phone-free education. the plan includes dedicated cell phone pouchs and lockers to restrict access. virginia, by the way, the latest in a string of states to legislate restrictions on phones in classrooms. the others include florida and indiana. good for them, i'd like to say. turning to sports now and

will give an update on the state's ongoing wildfire response. right now, there are six active fires statewide that have burned more than 1000 acres. the largest fire has now burned more than 25,000 acres. that's in santa barbara county. this morning, it's about 15% contained. a separate fire burning near truckee has scorched more than 200 acres since sunday. i'm ginger conejero saab in san francisco, one of the places in the bay area without an excessive heat warning. officials warn of the dangerous risks of the heat. there are 14 confirmed recent deaths from the santa clara county medical examiner's office. they are now looking into whether or not these deaths were heat related. last week, san jose mayor matt mahan posted on fixing an unhoused person died in san jose because of the heat. now, here are some signs and symptoms to watch out for indicating heat exhaustion or heat stroke. thanks, ginger.

since halyna hutchins was fatally shot on the set of "rust," and now after a back and forth on whether baldwin would face charges, the trial is set to begin today. alex baldwin's family is showing their support. >> lawyers are hours away from delivering opening statements in alex baldwin's criminal trial. the actor greeted his wife and youngest child outside the santa fe courthouse. in all, 12 jurors and 4 alternates have been seated. among them 5 men and 11 women most saying they have seen some news coverage of the case. today they will hear a detailed accounting on what happened on the set of "rust" in 2021 when halyna hutchens was shot. baldwin faces a single count of involuntary manslaughter and could serve up to 18 months in prison if found guilty. baldwin's defense says their

client had been told that the firearm was safe and had no reason to believe it was loaded with a live round. the jury will hear testimony from investigators and members of the "rust" crews, likely including the assistant director that admitted he handed baldwin the gun without first making sure it wasn't loaded with live ammunition. >> i was negligent in checking the gun properly. >> reporter: the state plans to call hannah gutierrez reed. she could be forced to testify on key details. >> the question, is something that could impact her if she gets a new trial, then, yes, she could plead the fifth. there is a lot of questions like did you offer him training on a gun? those kinds of things would not impact her trial if she got a new one. >> we find the defendant guilty. >> reporter: in march, hannah gutierrez reed was found guilty.

her conviction, legal experts argue, may complicated the state's argument that baldwin is to blame. the big question is if alex baldwin will testify himself. and it's definitely a legal gamble according to experts. like we just heard, we might hear from joel souza and dave halls, the one that handed baldwin the loaded gun, guys. >> thank you. we want to turn now to nbc's senior legal correspondent laura jarett. do you still look at this as an uphill battle for the prosecution? >> yes. this case has been saddled with challenges from the very beginning, from the prosecution team itself, which changed hands many times to the actual legal theory. remember, they had to convince this jury that an actor somehow had a duty to make sure that the gun didn't have a live round in it, even though nobody has said that that is the standard. he will put on an expert that says that's never been the standard for actors, and he was led to believe there was no live rounds onset, much less in the actual firearm. >> and the judge said they can't

bring in the fact that baldwin was a producer on this. >> i think that ties the hands of the prosecution even more. they were already going in here with a hard job, and that will make it harder because they want to say, look, he wasn't just an actor. he was the producer. he should have had more of a heightened duty to be on charge of safety on the set. it was fast and loose. they have video of him using the gun after they called cut and things like that. i think they have an even harder job. >> the woman who was in charge of safety on the set, she's already serving 18 months, convicted of manslaughter. she may take the stand as well. what could that potentially mean for the case? >> she may not be that help because she's trying to challenge her case on appeal. she might be more careful on what she was saying that concerned her, too. plus, the judge has already limited what they can say about the fact that she's already been convicted. so she might not be that helpful for them. >> laura, thank you very much. coming up on this wednesday

palace. rooms off limit until now. we took a tour through the east wing before it opens its doors to the public for the first time next week. visitors will get a chance to see the opulent yellow drawing room where the late queen elizabeth would sit for portrait. the walk down the corridor lined with paintings of descendants of the royal family. arguably, this is the most intriguing room of all. this is called the center room, where the royal family waits before they step out onto this balcony. so every time we see them out there, they were here first preparing. so we're talking about everything from the king's most recent official birthday celebration where we saw the princess of wales with her children looking out the door well of the room, to royal weddings from charles and diana to william and kate, marriages sealed with a kiss. even the end of world war ii was celebrated on this same balcony by members of the royal family alongside then british prime minister winston churchill. it is a tradition dating back 150 years. footsteps of earlier generations

then look over the next few days into the weekend, the heat continues. humidity levels high as well, so that's going to be a problem as well. out west, we're talking triple digits. these are air temperatures. denver, phoenix, billings, san jose on into palm springs. and the remnants of beryl causing 20 million people to be under flood watches from chicago all the way to bangor. you can see the heavy shower and thunderstorm activity, and airport delays in chicago, back through detroit as well. we're looking at a risk of severe weather for six million people, the possibility of tornadoes in central new york. we will be watching that. and with heavy rain falling, we could be looking at flooding anywhere from six to eight inches of rain upstate new york and into england and parts of michigan as well, guys. >> we'll check back in with you in a bit. meanwhile, the health of this country's economy is center stage.

the fed chair, jerome powell, testifying, making the said lines yesterday saying while the economy is strong, holding interest rates too high for too long could further jeopardize economic growth. so we bring in nbc's business correspondent, brian cheung. brian, good to see you as always. it seems as if the fed chair yesterday may have been foreshadowing a rate cut in the fall. what else did he say? >> yeah. it seems like markets and economists have said, all right, after his remarks yesterday, it sounds like it could happen in september. when we talk about what he said, his overall outlook on the economy is a two-sided risk. we know about inflation, inflation, inflation. americans have been feeling that pinch. the other side is the labor market. the job market has been largely strong post-pandemic. we're starting to see a cooling

down. we're no longer basically blowing out estimates of how many jobs we're earning in a month. it is around what estimates have been, in addition to the unemployment ticking up to about 4.1% now. not necessarily caution there, but something worth watching, which is why they're saying maybe we should look at the rates. >> he is just threading the needle. >> tight rope. >> it is a tight rope. if the interest rate cuts happen, who will feel it first and most? >> we're talking about mortgage rates, credit card rates, and auto loan rates, which in many cases are at an all-time high, 25%. now when it comes to the housing market as well. those 30-year fixed interest rates, that could bleed through to all the rates i just talked about. it will only be a quarter percentage rate when they do cut rates later this year. that doesn't mean that mortgage rates will fall to 3% or 4%, but it could mean a little relief in terms of the 7% rate coming down a bit. >> thank you. meanwhile, things got heated
