you have to ask him. >> reporter: even as he maintains support from key corners of his coalition, like labor unions like the afl-cio. but in another big blow to the president yesterday, hollywood heavyweight george clooney, a w weeks after co-hosting a star-studded fund-raiser for him. writing in "the new york times," the joe biden i was with three weeks ago at the fund-raiser was not the joe biden of 2010. he wasn't even the joe biden of 2020. he was the same man we all witnessed at the debate. adding he loves president biden, but we are not going to win in november with this president. this is the pooin of every senator and congress member and governor who i've spoken with in private irrespective of what he or she president biden's allies are fighting back. a source familiar with the planning for that clooney fund-raiser tells nbc news that the president stayed for over three hours while clooney, they say, took a photo quickly and

left. also this morning, aides here are arguing that despite the president's poor debate performance that believe it or not was exactly two weeks ago, i feels like a lot longer. the fundamentals have not changed. "the washington post" poll shows among registered voters, this remains a dead heat. but other recent polling has shown mr. trump gaining an advantage, savannah, in several key battleground states. >> all right. peter, that sets it up nicely for us. let's turn to senior washington correspondent, hallie jackson. hallie, good morning. i kind of pause before we say something is so make or break or do or die. this is certainly a moment for the president. it's unscripted. he's going to face questions. is he going to face, you know, 15 versions of the same question, or do you this news conference to be substantiative and really, i guess, put him to the test? >> listen, the biden campaign, and my conversations with folks on that side, think that this is a moment for the president to show some substance, for him to

flex his foreign policy muscle and show some of that contrast that he's been trying to draw with former president trump, but it is so clear, savannah, that the focus for a lot of people who will be watching this is less on foreign policy and more on his fitness for office, for the reasons that you describe. this is a high-profile, unscripted, live, lengthy moment for president biden. the last time that he had a high-profile, unscripted live, lengthy moment was that debate performance two weeks ago that has put him in the political crisis he faces now. here's something to watch for, too, over the next 24 hours. it is possible that the floodgates could open after today. look at the way the top democrats have basically temporarily put a little bit more time on the clock, just to let president biden get through this nato summit. you heard flat former house speaker, nancy pelosi, just yesterday, essentially saying, let him finish with world leaders. if you have concerns, democrats, don't put it out there just yet, wait until he gets through this, which makes tomorrow and this

weekend super important. >> it's so interesting to see some of these top democrats who aren't outright calling for them to step down, but then saying, let's wait and see what he decides. he decided. he was not ambiguous about it at all. he said, i'm in it, i'm staying in. and you have some of these democratic elected officials acting like they didn't hear that and they're waiting for a decision. >> and that is why you do a lot of tea leaf reading when you cover politics, savannah. you know this. that is what you're looking at, when you hear something like that from former house speaker pelosi and others. listen, there's a big spectrum between, he should get out of the race and absolutely stay in. there's a lot of gray area between those two ends, and a lot of democrats living in that moment. looking to see moments like this tonight. the biden campaign is trying to stem the tide to the degree that they can. you have a couple of top aides headed to talk to senate democrats later on today, mid-day. i am told by a senior adviser that their argument going to be, listen, here's our path, here our plan, we don't think that the data shows that the president is losing significant

support from voters. they're also trying to make the argument that they're trying to refocus on former president trump ahead of the republican convention next week. but you know as well as i do that folks on capitol hill are worried about those key down-ballot races. those house and senate races with concerns that president biden could be a negative drag on the ticket and hurt democrats in some of those safe blue states now, especially among independents. >> then that obviously gets them quite focused. those elected officials, when it starts affecting their race. let's talk about the polls. peter just showed, for example, another one of these national polls that again shows a neck and neck race. but that's not how we decide our elections in this country. we do it state by state. the battleground states are what are important here. and what are they showing? what are those polls showing? >> our first of many reminders this campaign season, savannah, that it's the battleground states that will matter as it relates to this election. and the latest polling shows that it's former president trump that has the edge, albeit narrowly inside the margin of error in five of seven of those

key battlegrounds. he's outside the margin of error in the key state of pennsylvania there. listen, the biden campaign has argued, they have a lot of grassroots support. they in their internal data suggest that they are not seeing a lot of movement, as the campaign and election actually get closer, people will crystallize their focus. they'll understand this is really joe biden versus donald trump, and make the decision they want to make, but you have to watch what's happening on the fund-raising front as well. nbc news is reporting this morning according to four sources close to the re-election effort, that there has been a major hit on fund-raising, the campaign is pushing back on that, saying that's not accurate. they believe that they have grassroots support. this whole thing gets at the argument that president biden has been making, that it's elites versus the voters. the question is, is that actually accurate? is that correct? and is that where this race is going? >> lots to discuss, hallie, thank you so much. should mention, nbc news will have special coverage of today's news conference. and a programming note. on monday, lester holt scheduled to sit down with president biden for an exclusive interview.

it was installed outside of this elementary school back in february. now it's completely melted. the artist tells us that they always knew that it could melt. it is made of wax, just not this quickly. a shocking example of just how hot it is. >> reporter: this morning across the country, a long-lasting summer heat wave -- >> it's hot. it's a scorcher. >> humidity's killer. i had heat exhaustion a few weeks ago because i was stupid enough to bike to work. >> reporter: the heat has likely contributed to three dozen deaths among six states. among the victims, a probationary police officer in new york city, who was set to graduate from the academy. how dangerous is this heat wave? >> we've been seeing a lot of severe illness from this heat wave. patients can pass away from heatstroke and from excessive heat exposure. >> reporter: and it's combined with a wave of severe weather after hurricane beryl. two destructive tornadoes hitting overnight in upstate new

york. out west, temperature records continue to fall, with las vegas hitting at least 118 degrees on back-to-back days, while in houston, more than a million people are suffering without any ac, after beryl knocked out power earlier this week. and for some, the lights may not be back on anytime soon. >> it's done significant damage to our facilities. we'll have to rebuild it, and that's going to take time. >> reporter: doctors say if you are suffering from symptoms of heat exhaustion, like melted abe over here, they say the key is to act fast. symptoms including muscle aches, headaches, exhaustion. they say, get inside and get cool as quickly as you can. and stay hydrated. >> i cannot believe that statue melted in the heat like that. it's wax. >> you could put a wick in it and make it a candle. just saying. when you have lemons, you make

table. >> hoda, savannah, good morning. good morning to you as well. outrage growing this morning over the death of a minnesota man after he was restrained by security guards at a milwaukee hotel. his family and protesters now stepping up their demands for answers and justice. nbc's emilie ikeda is here in the studio with details on this. >> questions are swirling around what led up to this fatal encounter with devantay mitchell, whose death has prompted comparisons to george floyd. now 11 days later, he will finally be laid to rest, yet without any closure for the family. >> reporter: this morning, the death of a wisconsin man that has drawn outrage now being reviewed by the milwaukee district attorney as a homicide. devonta mitchell died after following an encounter at hyatt regency in milwaukee. this cell phone video recorded by a witness. >> stay down! stop fighting! >> reporter: showing mitchell pleading for help as he's held face down by four people,

identified by police as hotel security. >> to see them beat him repeatedly over and over and over again. they didn't stop. they could have stopped. they could have let him go and he didn't. >> reporter: mitchell's family said they viewed surveillance video that they say showed mitchell running through the lobby on sunday, june 30th, entering a women's restroom. >> i'm sorry! >> reporter: milwaukee police saying that mitchell had fought with security guards who detained him until police arrived. they say officers found mitchell unresponsive and he later died. the 43-year-old husband and father may have been suffering from a mental health episode according to mitchell's family. civil rights attorney ben crump says that one of the men who held him down, a front desk employee, said he told security guards that mitchell couldn't breathe, but was ordered to keep holding him.

>> it's outrageous! it was inhumane. it was unnecessary. >> and overnight, the managing group of the milwaukee hyatt announced that they have terminated several associates, saying that their actions violated policy on june 30th. meanwhile, the d.a.'s office is waiting for the full results of the autopsy, as they way the potential for criminal charges. >> i know you'll keep an eye on it for us. thank you, emilie. let's turn to yet another flight scare at a major u.s. airport. this was caught on camera. an american plane experiencing multiple tire blowouts, just seconds before takeoff in tampa. smoke can be seen pouring out of the bottom of the plane. emergency responders did safely evacuate all 170 passengers and crew onboard. the faa is investigating this. the incident comes just two days after that united flight, leaving l.a.x. lost a wheel during takeoff. and in march, another united flight lost its wheel after leaving from san francisco. all right. let's do sports now. our countdown to paris is on,

here's a look at our top storie, including a family tragedy in the east bay. i'm bob redell here in alameda, where three members of a family are dead after a shooting last night at this home behind me here on the 400 block of kitty hawk road, alameda. police say they have a person of interest in custody and that there is no longer a threat to the public. it was a neighbor who called 911 just before nine last night to report the shooting. alameda police say that multiple members of the family that lives here were shot, including children. it's not clear if they are among the three who died. state regulators will meet in san francisco today to consider pg&e. s latest rate hike request. the utility is seeking another $150 million, which it says would cover the cost for repairs tied to more recent storm damage. if the cpuc approves, it would likely add another $10 per month to the average bill. rates on average this year already higher by more than $35. opponents are planning to protest outside the auditorium where today's hearing

courthouse in santa fe. chloe, good morning. >> hey, there, good morning. we're heading into day three of the trial, and the jury now has a clear picture that the state of new mexico plans to paint alec baldwin as reckless, but his legal team says it wasn't his job to make sure the gun wasn't loaded on that day. >> what they're doing right now, this is a crime scene. >> reporter: the jury in alec baldwin's criminal trial has now seen the frantic aftermath on the set of "rust," where the film's cinematographer halyna hutchins was fatally shot in october of 2021. >> it went through and through on her, through the chest. >> this was an unspeakable tragedy, but alec baldwin committed no crime. he was an actor acting. >> reporter: baldwin, who cases a single count of involuntary manslaughter, listened intently during opening statements on wednesday. his wife, alarya, brother, steven, and sister elizabeth all in the courtroom. and for the first time, even if he meant to fire the gun, he should not be found guilty. >> even if he intentionally pulled the trigger, that doesn't

make him guilty of homicide. he did not know or have any reason to know that gun was loaded with a live bullet. >> reporter: still, they maintain the gun accidentally discharged, and baldwin has repeatedly and publicly denied he pulled the trigger. >> the trigger wasn't pulled. i didn't pull the trigger. >> reporter: the prosecution hoping to convince the jury he was negligent with the firearm during filming. >> cocks the hammer, points it straight at miss hutchins and fires that gun. >> there were people responsible for ensuring the safety of the set and the firearm. those people failed in their duties. >> reporter: his lawyers playing a portion of a 911 call, in which the caller faults the assistant director, dave halls. >> this [ bleep ] ad, he's supposed to check the gun. >> reporter: while one investigator testified multiple

live rounds were onset, the defense has worked to distance baldwin from blame. still, prosecutors insist the veteran actor did not follow industry standards. >> we set safety rules require actors, like the defendant, to treat every firearm as though it's loaded, to never point a firearm at another person. >> reporter: so far, the proceedings have been somewhat testy at times, when the jury is not in the courtroom. baldwin, though, continued to appear engaged, he's taking notes and at times he's turning to look at his wife, brother, sister. at this point, the jury has only heard testimony from first responding officers at the scene, but still a lot more to come in the next week or so. savannah? >> chloe, thank you. let's turn to nbc's senior legal correspondent, laura jarrett, who's with us now. what do you take away from opening statements? any surprises? >> the biggest surprise is now they're saying, even if he did pull the trigger, essentially, opening the door to the fact that they know the prosecution has evidence that he did pull it. they have a witness, day may have video, they might have other evidence.

they're sort of laying the groundwork for that, with the jury -- >> the defense is. >> the defense is. but for more than two and a half years, he's been swearing up and down that he never pulled the trigger. he gave an interview to abc right after saying he never pulled the trigger. i think there's some credibility issues there. that that's what the prosecution wants to get out of it. >> one of the things the prosecutors said was that the actor should treat the gun, every gun, like it's loaded with a live round. i would assume. how is that going to land with the jury? >> i think for some of the jurors, especially ones who have familiarity with guns, the idea that you don't point a gun at someone makes a lot of sense, except, on a movie set where you're an actor, where you have a shooting scene. so you heard the defense say, you've all seen movies all the time with shooting scenes. if he's been told, up and down, by many people, the gun is cold, which means there is no life round, no dummy round, even, you can understand they're trying to invoke sympathy. what else was he supposed to do. but the not pointing a gun at someone is also -- makes a lot of sense.

>> laura, you maintain that this is going to be quite the uphill slog for the prosecution. why is that? and did anything that you heard yesterday change that? >> remember the standard for involuntary manslaughter is not the highest. it doesn't require intent. but the best example i usually think about is something like texting while driving, right? you know that you're not supposed to do that. you know you have a chance that you could possibly kill someone. even if you didn't set out to kill someone that day and hit someone, that makes sense. here's, it's not the same thing. he was not the one who was supposed to check the gun. everyone agrees, that was the armorer's job, and the armorer has been sentenced to prison for that. i continue to think it's an uphill slog. >> and they're not supposed to have live ammunition on the set anywhere. >> and we still do not know how did that live round on set. and certainly no one thinks that baldwin brought the live round to set. >> you can hear a lot more about this case on the "dateline" true crime weekly podcast. the latest episode is out today wherever you get your podcasts. not one, two big surprises

helium leaks, which they believe are minor issues. but the thruster trouble makes nasa nervous and engineers want to fully understand before approving "starliner" to return to earth. so ground teams are trying to replicate the problem, while the crew remains up there. but boeing has struggled with "starliner" engineering setbacks and delays for years. it is still billions of dollars over budget, years behind schedule. it seems it's been snake bit at every turn. are you confidence in the performance of the ship for future missions, as well? >> this is the world of test. this is a tough business that we're in. human space flight is not easy. failure is not an option. that's why we are staying here now. >> reporter: but, wilmore and williams came without their suitcases, because at the last minute, nasa had to lose weight in order to add a critical piece to fix a toilet on the space station. so butch and sunny have been borrowing clothes from other

collapse of baltimore's key bridge. six construction workers who were on it at the time were killed. and this morning, the lone survivor from that crew is sharing his story for the very first time. he spoke to nbc news now's top anchor tom llamas. >> we tell a lot of amazing stories, but how julio cervantes is alive is one you will likely never forget. he was inside of his truck when the frances scott key bridge collapsed. he had no warning, no idea what was going on, until he saw his coworkers start to fall from the bridge. as you're about to hear, a series of incredible events saved his life. >> the whole center span is gone completely. it's in the water. >> reporter: when police first arrived on the scene of the frances scott key bridge collapse, even they were in shock. >> there is no privilege. like, there is no bridge. >> reporter: looking up from the dark waters that night, clinging to a submerged chunk of bridge, julio cervantes juarez couldn't believe he was alive. do you remember what was going

through your head as you were falling into the water? >> si. >> cervantes says when his truck fell from near the center of the bridge, he thought he would never get out. he had been working that night fixing potholes with his crew when the dolly hit the bridge, the men were all in their vehicles on a break. on exact, he says, suddenly, everything started to shake. he saw his coworkers launch into the water. that's when he started to pray. he says he asked god to take care of his wife and kids and asked for forgiveness. his vehicle fell nearly 18 stories to the water below, but luckily, the windows were manual, allowing him to roll one down and escape from his truck, but there was another problem, a big one. >> do you know how to swim? >> no. >> reporter: cervantes says he managed to float out to a piece of the bridge lodged in the river and started to call out for his coworkers, including his brother-in-law and nephew, but

heard nothing. >> alejandro, miguel. >> at that point, do you realize that your friends and family have not made it? >> reporter: he says he knew when they fell in and no one answered, they were gone. >> it was a human tragedy. they each had loved ones who depended upon them. >> reporter: on capitol hill tuesday, maryland senators pressing congress to cover the full $1.7 billion price tag to replace the key bridge. >> a foreign vessel hit an american bridge and killed americans. and they have asked the court to not be held responsible. >> reporter: in may, a preliminary ntsb report said the "dolly" had power issues in the days ahead of the disaster. in the coming weeks, cervantes and the other victims' families are planning to file suit against all of the companies

involved with the ship. >> he ingested all of that bad water, he has torn meniscus, he has other kind of psychological problems that he's going to deal with forever. >> reporter: the sole survivor of an unimaginable tragedy. >> why do you think you survived? >> no se. >> reporter: saying he doesn't know, but believes there is a bigger plan for him. so about those incredible events. he happened to have a car with manual windows, so he got out. he couldn't swim, but was able to grab a chunk of that bridge. and he was able to enter the water with a helmet with a flashlight that would still turn on when the search happened. and he lives with a ton of guilt. when he saw his family in the hospital, he sees his wife, he starts to say sorry, he starts asking for forgiveness, because he asked his nephew to come work with him. so he's carrying that guilt. >> oh, wow. >> tom, beautiful job. thank you. folks, switching gears a bit

all the music, like in a musical, people burst into song when they're feeling extra happy or extra sad and in this, all of good morning. it is 856 on marcus washington. well, a tragic story breaking this morning in the east bay. that's where four people have been shot and killed inside an alameda home. this happened a little before ten last night on kitty hawk road near riddler park. now, all of those victims are said to be a part of the same family. police just confirming with us that two children were shot. one of those children is dead. a man, two women and that child all died after being shot in that home. police say that this was a domestic violence incident. person of interest was arrested and there's no threat to the public happening now. bob redell speaking with investigators. he'll have a live update for o midday newscast.ur
