the first since his assassination attempt and trump, now the official gop nominee, taking center stage next to his vp pick, ohio senator jd vance. our washington insider breaking it down from inside the rnc. plus, another day in court for scott peterson's legal team. a live report on the request the la innocence project is making on behalf of the convicted killer. the decision, which could come today. this is today in the bay thanks so much for joining us on this tuesday morning, i'm kris sanchez. laura garcia is off and i'm marcus washington. first we want to start with some big news for you a big rig causing the backup and contra costa county. mike, i know you're here, and you've got more on that for us. it's actually got all of northbound 680 closed. let me show you where this is, folks. now, it's too early for most of the

commute. oh, here's that video that we talked about. it just came into the newsroom and that big rig, you see, the one that is marked. if you can see the markings, the jb big rig is the one that's going across the freeway. there is another big rig there in the background, but the one that's crossing all lanes right now is that jb big rig crews are on scene, but they need two heavy duty tow trucks to clear these two big rigs from northbound 680. so as we get out to the maps, i'll show you the closure. starting over here. as you're traveling north on 680, basically at livorno road. that's where everybody is being diverted off of the freeway. don't go to the east. go to the west like you see the slowing now because folks are making their way up danville boulevard. traffic is very light right now. watch that surface street traffic. they'll jump on it rutger road. but in the future, as the commute builds and it's already showing the backup, there will feed more traffic through the area. you can go over to during lavender over there on the east of the freeway that also jumps up to red geer road and gets you up past the scene, but that will again mean a lot more surface street route. so use caution and allow that extra time because you have to go slower. now that's also what

we call counter commute. when there is a commute, which typically will come down out of contra costa county, the rest of the bay is looking pretty smooth. but again, avoid northbound 680 as you're passing in the area through alamo and walnut creek because of the blocked freeway northbound right now, just north of livorna kerry. all right. we're starting out nice and quiet. this morning as we take a live look outside in san jose. a few clouds to start out, but also it's going to be a cooler day. here's a look at our current temperatures around the bay area, with some upper 40s low 50s for much of the north bay. nice and cool. there while in the south bay it is 63. in san jose, but mostly upper 50s. and this is a look at where we're headed for this afternoon. martinez will reach a high of 81 today. upper 70s for fremont, 80, in san jose. it probably doesn't get any better than this for the middle of july, but we'll talk about some warmer temperatures. will be coming our way as we head toward the end of the week. that's coming up in our full microclimate forecast. marcus first, we want to get to a

little earthquake that just happened. 503 now it was a 3.2 earthquake. you might have felt if you were in the area of gilroy. it happened near san felipe lake right off. 152 so far we have no reports of any damage or injuries. well turning now to decision 2024. all eyes on milwaukee as the republican national convention enters day two. former president donald trump making a surprise appearance following this weekend's assassination attempt in pennsylvania and the other big headline we now know who will run with trump in november. the now official gop nominee selecting ohio senator jd vance as his running mate today in the bay's brie jackson. following that announcement, jd ohio senator jd vance receiving a warm welcome at the republican national convention after being named former president trump's 2024 running mate. the 39 year

old says he brings loyalty to the ticket. the president can't be everywhere, even donald trump can't be everywhere. so you've got to be a person, he can trust, he can rely on to actually advance the agenda. the first term senator was a trump critic in 2016, but since then he's changed his position and has been by the former president's side for court cases and campaign events. vance's addition to the republican ticket comes just two days after a gunman fired at trump, injuring his ear. my first reaction was just to pray for him, you know, i was terrified at former president trump surprising the crowds at the convention and making his first public appearance since the assassination attempt. on the same day, trump officially secured the gop nomination, president biden sat down with nbc's lester holt, calling it a mistake to have used the term bull's eye when discussing his political opponent. i mean, focus on him, focus on what he's

doing, focus on, on on his policies. president biden also weighing in on trump's vp pick a clone of trump on the issue. so i don't see any difference. there's got to go. protesters outside the republican national convention are speaking out against the gop's agenda. americans remain divided over issues like abortion and the country's future. with vance's name added to the gop ticket, voters now have a clearer picture of their choices this november in milwaukee, brie jackson, nbc news and coverage of the rnc continues on the today show. savannah guthrie live in milwaukee as former president trump prepares to accept his party's nomination this week. she is also following the latest on the investigation into trump's assassination attempt. that's all ahead for you at 7:00, right after us here on today in the bay, and president biden is planning to tackle rising housing costs. this is according to a fact

sheet obtained by nbc news. biden will call on congress to pass a law that would require landlords to cap rent increases at 5, or they would lose on a federal tax break. now, the law would apply to landlords that own more than 50 units. the administration also wants to sell extra federal land to be used for affordable housing. well, just a few hours. attorneys for convicted murderer scott peterson will be back inside that redwood city courtroom in san mateo county as they continue to fight for a new trial today in the bay's bob redell joins us now from the superior court there. and bob, there's still an important issue that has not been resolved. well, actually, no, it has been been resolved. the judge yesterday did decide on a lab to perform a dna test on a piece of evidence. as you're aware, scott peterson was convicted of murdering his pregnant wife, laci, and their unborn son, connor, back in 2004. his defense team is pushing for a

new trial, asking a judge to test evidence from the original trial. the judge only gave the green light to test a piece of duct tape found in laci's pants. the la innocence project, which is defending scott peterson and the stanislaus county prosecutors. they couldn't agree on a lab to handle that testing. so yesterday, again, a judge picked a third party lab, a pure gold forensic labs based in redlands. a victim statement by laci mom sharon rocha was also read aloud in court that read in part, quote, we endure the pain of reliving laci's murder, ripping the scabs from the wound with each attempt he makes for freedom. why is he allowed to pursue having the conviction overturned? time and time with evidence? other courts have already denied? this is not justice for laci and conner. he is guilty of murdering them. when will this end? peterson's lawyers also filed motions concerning discovery and what's known as a 1050 4.9 motion, saying peterson is entitled to more than 600 items of evidence, some of it not used during his

original trial. the defense believes a burglary at the home of peterson's neighbor on christmas eve, the same day laci disappeared, is connected to her murder. hearing continues behind me in superior court in redwood city at 9:00 this morning. the judge is expected to issue a written ruling on these motions within 90 days, reporting live here in redwood city. bob redell today in the bay. all right. we know we'll hear back from you later this morning. thank you. bob. well, today, san francisco supervisors will consider a resolution that would put an opioid fighting tool in every pharmacy. the measure calls for drug stores to carry the drug, called buprenorphine. it's a prescription drug showing particular promise for fentanyl addicts by reducing their cravings and easing their withdrawals. the federal government recently eased the restriction on that drug. now, if supervisors pass the measure, pharmacies would be penalized for not carrying sufficient amounts. clean up getting underway this is after a severe weather wreaked havoc on the

windy city. this is one of several places seeing an impact due to the strong line of thunderstorms. now you're looking at dash cam video. this is of that rain. seeing those windshield wipers into overdrive. multiple tornadoes were reported in the chicagoland area last night. now that storm, which you don't see in this video, toppled trees and power lines in that area, leaving thousands of people in the dark. large limbs ripped from trees fell onto multiple cars, several homes and a meteorologist, kari hall of course, been tracking these lines of storms. and kari, where is that storm system heading now? we're seeing it pushing off towards the east, and we're also seeing another batch of some severe weather going through the ohio valley this morning. and this is possibly causing a lot more hail and heavy rain as well as some flooding in those areas. as we continue to watch that severe weather threat push off towards the south and east. here at home, we're enjoying a very beautiful start to our tuesday morning live look outside in san francisco where it's all clear and there temperatures will reach into the upper 60s. across

the bay, oakland will see a high of 7381. in dublin, 80 in san jose and upper 70s for much of the north bay. into the day tomorrow, it's going to be very much like today, but slightly warmer, and the warming trend continues as we go toward the end of the week. so we're enjoying this break from the high heat until it returns for the end of the week. so we'll talk more about that in a few minutes. mike's been looking around for lower gas prices. yeah, kerry and i do have a traffic alert, but i got to shout out these prices because traffic is pretty light right now. we do want to shout out santa clara today. san jose does dominate the best prices for the south bay, but we'll take 369 at platinum gas and washington street. i check, in fact, maybe i'll go looking for it today. tri valley 399 at sunol super stop in sunol is on andrade road and san rafael still has the best in marin county. the only thing under four bucks that we see on the reports. 399 at mobil on ritter street. the reports i'm talking about are on gasbuddy.com now on the roadways. everything's relatively smooth, except for this one section where 680 is

olympics, you could look now to see if it's better to take an uber from the airport or the train. the wall street journal says elon musk plans to donate $45 million a month to a superpac to support donald trum. musk endorsed trump on saturday. the america pac takes lessons from democrats on get out, the vote efforts, including mail in voting business world, trying to figure out what a jd vance vice presidency might mean. vance is a venture capitalist, but he's very, very different from the traditional market and business friendly republican platform we saw in the likes of reagan or two bushes. vance, for instance, supports many of the antitrust efforts made recently by the ftc. he has in the past called for upping the federal minimum wage and higher taxes on business. he's generally been very pro-union. of course, vice presidents can disagree with their president on all kinds of policies, including economics,

again. oh, yes. yes, it looks great going into the next couple of days. thursday and friday is going to be warming up. so we'll talk more about that. let's get a look at where we're starting this morning. it is chilly this morning in san rafael 49 degrees. as you're stepping out the door. it's 57 in dublin and 63 in san jose. you can see the clouds overhead, but it is clear right now in san francisco. let's get a look at our high temperatures in the south bay los gatos. you'll see a high of 86 degrees 80. in san jose and 89 in morgan hill for the east bay. it's very mild for this time of year. we're only up to 84 in concord and antioch. we'll see danville's high temperature of 83 degrees and 73 in oakland today, and some 70s for much of the peninsula down to palo alto, 76 degrees and low 60s in daly city, upper 60s for the mission district today and the marina district that 64 degrees and in

sonoma 8077. in santa rosa it is still warm for ukiah and clear lake, with highs up to 90. but we're going to see some more intense heat coming in as we go into the next few days. as high pressure quickly moves in and then starts to retreat back to the east. so even if we just get a couple of days of some hotter temperatures, we are going to be bracing for that as we make plans to wrap up our workweek. here's a look at our high temperatures for the inland valleys going from mid 80s today to 90 tomorrow. then 93 on thursday. it is going to be hot on friday, but looking a little bit better for the weekend with low 90s. while san francisco will see temperatures in the 60s and 70s throughout the forecast. mike still 680 blocked. yeah. because of this, the rigs are still there. just like this video from earlier this morning. you see one of the rigs completely across basically perpendicular to the northbound lanes. there is another big rig there. now let's take a look at the map so i can explain what's

donald trump's pick for vice president and take a closer look at his bay area ties and what went wrong. answering the many questions and concerns surrounding that assassination attempt on the former president. we'll speak live with one law enforcement expert about the security breakdown. this is today in the bay. thanks so much for joining us on this tuesday morning. i'm kris sanchez. i'm in for laura garcia, and i'm marcus washington. we want to check in with our mike inouye. he's been tracking the sig alert for us over in the east bay. mike, how are things looking now? well, pretty much the same as this video taken from earlier this morning. not too long ago. you see this big rig? it's actually perpendicular to the lanes of traffic on northbound 680. and so they can't move. actually, two big rigs until they get a heavy duty tow truck out there. two of them. let's look at the maps as we're talking about the jam traffic folks are reportedly forced off at livorna. now, between this exit and that big rig, there are some folks that are stuck on the freeway as well. so that's no joy for them. everyone else

seems to be getting off livorna and taking danville boulevard. now, if we widen out this map, you do see that there's some slowing on the approach as you're approaching stone valley road that may be related, or folks are trying to use the alternate there, you can again get over to danville boulevard. more surface street traffic, also over toward red gear via lavender. if you're getting on to west onto eastbound livorno road. so there are options because kerry right now the commute is relatively light, but northbound 680 is still closed at livorna. yeah, it looks light here in oakland as people are getting up and out and about on this tuesday morning. we have some cool temperatures and it's going to be a nice day. take a look at our trend here. going from low 60s this morning only into the upper 60s for the afternoon and just briefly touching the low 70s in san jose. it will be 80 degrees. and for much of the north bay, we're in the upper 70s for this afternoon. san francisco looking at a high of 68 degrees. and we're in the mid 80s for the tri valley up toward concord and upper 80s for morgan hill and san martin. tomorrow. we're also

looking at a slight warm up in a few spots in the inland areas, but overall, a comfortable day before it heats up by the end of the week. so we'll take a look at all of our temperatures and our microclimates coming up in a few minutes. well, former president trump returning to the public eye for the first time last night. this is just days after he was grazed by an assassin's bullet. scott mcgrew. he made that appearance at the republican national convention, but it kind of went beyond politics there. it really did. i mean, how do you even really describe what we all saw? americans certainly glad to see another american is alive and well, his children greeting him in the crowd, trump's face inscrutable. he was neither victorious nor defeated, energetic nor exhausted. probably pretty surreal for him to take a look. if you missed i, please welcome the next president of the united states, donald j. trump.

mr. trump did not make a speech, but he was officially nominated by his party as candidate for president for the third time. the convention continues tonight. tonight's theme is make america wealthy again. trump, accompanied by his vice presidential pick, freshman ohio senator jd vance. vance at 39, exactly half trump's age, our ginger conejero saab will be up in just a moment to take a closer look at vance and his san francisco venture capitalist roots. president biden sat down with our lester holt for an interview last night, scheduled long before the attempt on trump's life and the selection of jd vance. so those subjects were kind of the new focus. here's the president's reaction to trump's choice of a running mate. well, it's not unusual. he's going to surround himself with people who grieve completely with him, have a voting record. i support him, even though if you go back and

listen to the things j.d. vance said about trump. all right, so what the president's referring to, what's pretty well known by now is j.d. vance. not only didn't like trump to begin with, he actively spoke against him, saying trump was a danger to the united states, that he was reprehensible, that he made people vance cared about afraid. vance even wrote op eds about trump comparing trump to heroin in a piece he wrote for the atlantic in 2016 called opioid of the masses. donald trump feels good, he said, but the comedown will be harsh. president biden, back on the campaign trail. he's in nevada right now. one of the key states he needs to win, that he did win last time. he'll participate in an economic summit and sit down with an interview with bet black. support has been very important for biden's campaign. president biden also ordered the us secret service to provide protection to third party presidential candidate robert kennedy jr, following the attempt on donald trump's life. generally, third party

candidates don't qualify for protection if they haven't reached 10% of the expected vote. the kennedy's you know, it has had such a tragic past, including that man's own father and there are other exceptions. senator barack obama received secret service protection long before he was nominated as the democratic candidate for president. president because marcus of threats against him. yes. remember those times. all right, scott, thank you. well, donald trump backers here in silicon valley praising his decision on the running mate. that's because it's a place j.d. vance has some deep connections today in the bay's ginger conejero saab is in san francisco. ginger vance once lived and in san francisco. and where kamala harris also started her political career. that's right. good morning. chris and marcus will be interesting to see if that is a topic that can be referenced in a future debate. both of them, how they will use their experience and

ties to san francisco and silicon valley to strengthen themselves as vice presidential candidates or vice president kamala harris's vp herself, and as well as now, senator vance taking that vp, vp nomination. now, the biden campaign saying vice president harris is ready to meet j.d. vance on the debate stage. both of them have bay area ties. now, we are aware of vice president harris's history in san francisco, but we are learning about the many bay area connections to mr. trump's vice presidential pick. vance and his wife lived here for two years, beginning in 2015. vance signals a lot of republican support in silicon valley. now his 2016 new york times best selling autobiography, hillbilly elegy a memoir of a family and culture in crisis, tells the story of vance's background, how he was raised by his grandparents, how he served in the marines and graduated from yale law school, and how he moved on to silicon

valley as a tech investor. now that is where he associated himself with venture capitalist david sachs. and he also worked with paypal founder peter thiel, both of them making appearances at the gop convention. somebody who lived the american dream of coming up from a really hardscrabble past, and, working his way up to success. he was a vc in the silicon valley, so he understands a lot of our issues there now. his wife and the mother of his three children, usha chilukuri, worked for years and was with a law firm headquartered in san francisco until she left the firm yesterday. the firm calling usha, who clerked for chief justice john roberts, an excellent lawyer and colleague. now that autobiography that we mentioned earlier became a movi, marcus and chris will continue to watch to see how the reviews

for, senator vance as the new presidential pick come in, guys, back to you. all right. silicon valley just about everywhere. thank you very much, ginger. the scotts touched on this just moments ago. the secret service facing questions and criticism for what some in law enforcement are calling a security failure. so tommy tonneson, former police chief at arvin police department and current criminal justice professor at bakersfield college, joins us now live this morning. thank you, sir, for being up so early. can you tell us first what you think went wrong on saturday and how difficult it can be to provide security for these times? this type of really big campaign event, this tragic event to our nation and the response by secret service as they responded to him was very well put together. what was not very well put together was the advanced planning. advanced planning or reconnaissance before the united states secret service goes to an

event is where they look at a perimeter, an outer, and an inner perimeter. for some reaso, this particular shed that he was on top of, they consider it to be an outer perimeter issue and not a threat. and that was where the planning kind of went awry and should have gone a lot better than it did. so is this just a lack of communication? because we heard the sheriff from butte county say this wasn't in our purview, you know, the secret service saying this was not in our purview. so how does that fall through the cracks whenever there's a presidential protectee, it is the secret service's responsibility and again, they often play. and i've been a part of this planning before. and local sheriff pd and the secret service generally work this out months ahead of time and have that advance reconnaissance planning completed. for some

reason, it just did not occur the way it should have occurred in this particular incident. and so when it comes to in terms of that investigation into what went wrong here, what does that look like and how do you think that is going to change? moving forward? what they will do, they will go back to how far away the shooter was, what they possibilities were, why the perimeter was not extended further out, and why the coordination should have been a little bit more tighter between local law enforcement and the us secret service. and this happens a lot. they're very good at planning. they're very good at responding. but for some reason the internal partnership coordination didn't complete itself the way it should have been completed for this particular event, 150ft is much too close to a presidential candidate or the president. and i know that they're looking at

this right now, and they're going to discuss this, that in the future they will extend perimeters and outside venues more than they did in this case. now, you talk about all of the extensive planning. and we've heard, like, you know, we planned this 18 months in advance. well, this isn't like the rnc. this is like a small, you know, a campaign rally. and those things kind of change as as the candidates see where they need to caught the votes. so how do you prepare for a situation where you say, oh, shoot, now we need to go to bakersfield to rally the base there. when we weren't planning on it, you know, a month ago, what you do is you look at the strategic location. what is the highest ground if you took bakersfield, for instance, and they decided to come to bakersfield college, we have buildings all on campus. we've had dignitaries come to our campus, the local police department, a lot of times will coordinate with secret service because of the shortage of personnel, the secret service, and they'll go to the high ground. they'll go with their their counter sniper teams and

go to the very top of buildings. in this case, that was a top of a building that was near where a principal is going to be, and it should have been planned out a little bit better than it was, so that this person doesn't have access, because, again, it's much too close. but when you go there and you, you would map out, there would actually be a map put together of all the potential threats perimeter, inner perimeter or outer perimeter. and that does not appear to have occurred. all right, tommy tonneson, thank you so much for joining us this morning. it is 542 for you right now. let's take a live look out in san francisco. meteorologist kari hall has been monitoring, i think, a very nice week when it comes to the weather. i mean, coming off of last week and the week before that, this is nice. it is nice. and even looking at the forecast, expecting a warm up, it's not going to be as strong as extreme as the heat that we had last week or even a

couple of weeks ago. so we're starting out nice and cool this morning. take a look at san rafael. we're only at 49 degrees. it's 63 in san jose, and we're starting out with the clouds now starting to roll in, but will eventually clear out late morning into the day. we're going to see temperatures in the upper 70s and mountain view a high of 77 as well in hayward and in napa, 85 in fairfield, while morgan hill will be in the upper 80s in fremont today, expect a high of 79 degrees. mike, you've been tracking that crash all morning. what's the update? it's still there. we still don't have an expected time opening northbound 680. so it's still fully closed about livorna road. some folks are stuck between the crash to jackknifed or jackknifed big rig and another rig in a crash here and livorna road. so there's a backup that can't leave the freeway there. everybody else coming into the area gets off the freeway at livorna and takes danville boulevard. i pulled out these speed sensors to show you it's about 20mph. there's only one lane traveling northbound,

one lane in each direction. beautiful tree line. danville boulevard is not ready to take the capacity of northbound 680. some folks are getting off at stone valley road. and then there's a crash now at stone valley road. i don't know the details, but that's why we saw that weird slowdown developing here. so that's going to push more traffic over to danville boulevard to the east of the freeway. there are other alternates, but you have to go win back and forth and zig zag through the area, and it's just not advisable. so do take this freeway traveling north again if you need to, or if you're around the dublin interchange, you can go 580 over and through castro valley and then take 580 up here. continue off to highway 13 and get about your business. if it was in orinda, lafayette, walnut creek, that is possibly worth the time. an easier, more pleasant route or the bart system is talking about no delays. again, that's northbound 680 with the big problem between alamo and walnut creek heading toward the benicia bridge. over here, the bay bridge light traffic still continues back to you. thank you. mike 545 now and a first of the kind a law now on

bar school districts from notifying parents if their child asks to change their gender identification. now, the law requires school staff to withhold the information unless the child gives permission. it comes after some districts started requiring schools to notify parents about gender identification changes. supporters believe that that new law will help students living in households which do not welcome the idea. opponents say that it hinders transparency between schools and parents. coming up on 550 now and covid levels continue their summer surge. that is according to the latest cdc wastewater data, including covid rates that are up in all but six states. just last week, california was one of seven states with very high covid levels. positive results are already nearing last summer's peak at more than 13. the new flirt subvariant is said to be behind the surge, which is considered 20% more transmissible than the variant infecting people. last winter, parts of california are also experiencing a surge in

emergency room visits. well, oakland leaders are showing their support for renters, tenants rights groups argue. when it comes to making it in the bay or anywhere in california. one of the biggest hurdles is the inability to create rent control laws. proposition 33 on the fall ballot seeks to change that. it's called the justice for renters act, and supporters say that it would upend three decades of laws preventing communities from placing rent control on single family homes. today, council members will vote on a resolution supporting that measure. oakland leaders will also vote on a data sharing agreement between police and the chp. this is involving 300 new license plate readers. those cameras have been installed on streets across oakland, including on ramps and off ramps. governor newsom first announced that plan last spring. nearly 200 more devices have been deployed in areas surrounding oakland. we are more

than a week away from the 2024 summer olympic games in paris. in the bay area has many athletes setting their sights on gold and one of them is 23 year old jenny guy from fremont, who will be competing in mixed doubles badminton with her partner vincent chu. she first started playing when she was just eight years old. guy said that her father introduced her to the sport as he took up badminton at a local rec center, getting all the way to paris. it is not cheap. guy started a go fund me account to help fund the constant tournaments she had to participate in in order to get into the games. there are so many competitions we were often like on the road for 5 to 6 weeks, 4 to 5 tournaments in a row, and each tournament costs quite a lot. i'd say average, maybe 1.5 k guy says that she and chu are not only physically getting ready for paris, but mentally as well. part of that training is working with a
