[ cheering ] today, wednesday, august 14, 2024. from nbc news, this is "today" with savannah guthrie and hoda kotb. from studio 1a in rockefeller plaza. good morning. good to see you. happy you're with us on this wednesday morning. savannah is enjoying the day off. i didn't want to say pumpkin spice latte too loud. it does trigger roker. >> triggers al. we'll trigger him later. >> we have a busy morn ahead. we will begin with tropical storm ernesto, it is cherning across the atlantic. >> right now the storm packing winds of 70 miles per hour and puerto rico bracing for impact with some areas expecting nearly a foot of rain and we could see dangerous surf and rip currents all along the east coast later this week and into the weekend. >> of course, al is watching it all closely. mr. roker, tell us the latest here.

>> all right, guys. we are still waiting for the latest update from the national hurricane center which should come in in about an hour, but right now ernesto just below hurricane strength, it's moving northwest at 16. as you can see inundating puerto rico right now. we do have tropical storm warnings for puerto rico, tropical storm hurricane watches for parts of the virgin islands. we are expecting anywhere from six to ten inches of rain in all when all is said and done for puerto rico. flood watches and warnings, worried about mudslide, as well. so we'll be watching for that very closely. so it will start to rapidly intensify during the day today into tomorrow, approaching bermuda as a category 2 storm and right now it goes right over bermuda. we'll have to watch and see what happens there. as far as the continental u.s. from miami into new england, large swells, dangerous surf and strong rip currents and then heat. we are talking about 45 million people from kansas city down to

israel as the u.s. works behind the scenes to avoid a wider crisis in that region. there are alarming developments in russia's war against ukraine. we have two reports. richard, good morning. >> good morning, hoda. all hope now is on negotiations originally set for tomorrow in the region, but they are not looking promising with israel and hamas blaming each other. >> iran is rejecting calls from the u.s. and europe not to retaliate against israel over the assassination of a hamas leader in tehran two weeks ago. iran's president saying the country has a right to respond. a white house senior u.s. official says iran is still deciding how and when. president biden said he hopes a wider crisis can still be averted if israel and hamas agree to a ceasefire and hostage deal. >> you have the understanding

that iran could stop doing action if the ceasefire deal is possible? >> that's my expectation, but we'll see. >> there is very little hope this morning for the talks. hamas says it already agreed to a u.s. proposal a month ago and won't attend a new round of negotiations set for this week, accusing israeli prime minister netanyahu of stalling to keep the war going, an accusation he denies. israel says it's hamas that's stalling and continuing to hold hostages in gaza. romi gonen was taken hostage from the music festival. her mother and sister know she is alive, but injured, shot in the arm. she turns 24 on sunday. >> we celebrated with her here. we understand we're not here

surprise push into russian territory during the week-long operation that's been shrouded in secrecy. it led to the capture of russian forces who could be used in a prisoner exchange. nbc's kelly cobiella with more on this. kelly, good morning. >> reporter: good morning to you, craig. it's day 903 of this conflict, that's how long since russia launched its all-out invasion of ukraine, but we haven't seen ukraine break through the russian border like this before and this morning it's launching a wave of drones and missiles after its troops attacked russia eight days ago. ukraine says it doesn't want to take land, only protect its own citizens. this morning ukraine on the offensive continuing to fight inside russia. the ukrainian military releasing video they say shows russian soldiers surrendering earlier this month and this showing russian prisoners blindfolded in the back of of a pickup. nbc news has not been able to independently verify these

images. it's the first time there's been a foreign incursion of russia since world war ii. the offensive in russia's kursk region on the country's southern border. ukraine now controls 74 settlements across 386 square miles. ukraine's top military commanders telling president zelenskyy tuesday the fighting is ongoing along the entire front line. the two discussing the possibility of a prisoner exchange between captured russian forces and ukrainian prisoners of war. president biden weighing in. >> i have spoken with my staff a regular basis, probably every 4 or 5 hours in the last 6 or 8 days, and it's -- it's creating a real dilemma for putin. >> reporter: russia says more than 100,000 residents have now been forced to evacuate or are fleeing on their own. this group of russians recording a video message asking president putin for help after losin ...

[ opening bell ringing ] annual inflation of 2.9%, that is the coolest in three years and when you have volatile food and energy, the coolest in three years. this is good news. about half of the food categories fell from june to july and half went up a little bit, but overall you're seeing the price pain of a couple of years ago have certainly had it and that could allow the federal reserve to go ahead and start cutting interest rates later this fall. that would be a real sea change for american family finances and those lower interest rates could mean lower borrowing costs for a mortgage, for a new home and credit card debt and we are entering a new period of the inflation fight after three years of price pain. you're starting to see some relief here and 2.9% and when

good morning. >> hey, craig. hey, guys. good morning to all of you. yeah, bryan kohberger's team has long been building the argument to move it to boise. they argue that cobergy's constitutional right to a fair trial would be to a fair trial would be violated by holding the trial where they say the jury pool is biassed against him. now the prosecution is firing back. >> this is the state versus bryan kohberger. >> reporter: the state of idaho fighting to keep bryan kohberger's trial in the country where he is accused of committing four murders. >> the people of the county the attempt to seat a jury here first. in a newly filed motion, prosecutors objecting to the defense's argument to move the trial 300 miles away to boise, writing that the court should decline to relocate itself, the state and scores of witnesses hundreds of miles only to face another jury pool with similarly high media exposure. cob

coberger is cobergy is expected to stand trial for madison mogen, xana kernodle, kaylee goncalves and ethan chapin, four university idaho students. are found fatally stabbed in november 2022. the defense arguing that the jury pool is already prejudiced against kohberger, in part because of overwhelming media attention. >> i'm saying there is pervasive media coverage in this case. it's prejudicial media coverage. we conducted a survey in the county. that survey is going to show bias and that you shouldn't have a trial in this county. >> reporter: that survey commissioned by the defense saying 98% of the people in the county recognize the kohberger case with 70% of the people in the county saying they have already formed a guilty opinion of kohberger. >> these are deeply held opinions in this community, within this jury pool. >> reporter: but prosecutors arguing that the survey actually

showed a higher prejudgment rate in residents of ada county in boise than latah. moving the trial hundreds of miles away would impose a massive inconvenience and expense for the family wos have been anxiously awaiting justice. >> this is a community where the healing needs to happen. as part of healing, there needs to be justice and a conclusion to this case. >> as you point out there, this has gone on for almost two years now. what's next, liz, as the judge weighs all of this? >> reporter: the next hearing on a venue change is august 29th. both teams will make their cases inside the courtroom. if the court were to change venue, prosecutors are arguing the trial should be moved to one of the neighboring counties and not as far away as boise. some of the families live closer to latah county than boise, craig. >> thank you. still ahead, they will need a bigger paddle. the inside story behind this

what are you, some kind of real estate agent? >> he's a realtor. there is a difference somehow. >> somehow. >> we're back with a clip from "modern family," setting us up for "today's consumer". >> that never gets old. >> never. >> there are some new rules about to kick in, rules that will change the real estate landscape for both buyers and sellers, and they could potentially mean thousands of dollars in savings. >> nbc's business chess chess brian cheung is here with everything we need to know. so all of this is happening, this big change is coming, and it has to do with commissions. and somehow we're going to save money? >> yes. this follows a big settlement from the national association of realtors earlier this spring. the bottom line is it will give home sellers a lot more transparency and negotiating power into the fees that they pay when they sell their home. if you sold your home with 5% or 6% commission and you pay for that.

usually the way that works the agent for the seller will split that 5% to 6% bounty with the agent of the buyer that ultimately buys the home. now they will have to be more upfront about how those fees are negotiated. if you are a seller, you may say, i don't want to work with this agent unless i can get a 4% or 5% commission. which is one reason agents are telling us this could, in some cases, lower the fees that sellers will pay and this takes effect beginning on saturday. >> so if you are a home seller, how much potentially could you save? and if you are a home buyer, how much potentially could you save? >> this could be thousands of dollars. if you do the math, and i am the data correspondent, after all. if you sell a home that's $300,000 and pay a 6% commission on that, that would be $18,000. if you are able to negotiate, let's say, for example, a 3% fee, that would go down to $9,000. that would be a $9,000 savings if you are able to negotiate again, if you're able to negotiate that. that could be some great things for those trying to sell.

>> what does that mean for the housing market overall? >> yeah. when you talk about the housing market, first off, buyers have to be aware of this change as well. in some cases maybe the seller says, i want the buyer to be on the hook. they will see some paperwork in some cases from their agent just to see a house that's upfront about saying, here is how much you could be on the hook for, if any, when it comes to these fees. in this market, it is pretty much a cold market. high mortgage rates have been the good story, but the good news is mortgage rates have come down. it was 7.8% just as recently as october and now in august 2024, 6.5%. it's not 3% and that's a substantial decline combined with lower commission fees. it might be a good time to sell a house. >> i'm sure real estate agents aren't happy about this. >> when it comes to the fallout from this, it seems on the buyer's agent said, it will be rough because they will have to sign all the paperwork to see a house you'll have to sign all of this paperwork, but on the seller's agent's side, they're

up, and there should be some mud slides. the path brings it as a category two over bermuda sometimes late saturday morning into sunday morning. but we're going to be watching that closely. the coastal u.s. will feel strong surges, dangerous surf, large swells and rip currents from nantucket down to miami, and we've got heat advisories and heat warnings for 46 million people. kansas city, all of the way down to texas and on into florida. look at these heat indexes. 110 to 115 degrees from dallas, corpus christi. little rock, panama city, miami will fell like 108 tomorrow. more of the same with triple digit heat indexes and air temperature for fort worth, jason and also tallahassee down to sanibel island and all cooler and lower humidity. guys? >> al, we'll come back to you in a moment. meanwhile, new developments this morning in the alex murdaugh case.

the supreme court will hear an appeal from the convicted murders and decide whether murdaugh should be given a new trial after claims of jury tampering. murdaugh is serving two consecutive life sentences for the murder of his wife maggy and son paul. no date has been set for the appeal. two kayakers have quite the story to tell after an unnerving close encounter with a great white shark on the coast of california. it was all caught on camera. nbc's morgan chesky is in los angeles with the details. morgan, good morning. >> reporter: sheinelle, talk about a close call here. it is the one thing you don't want to see when you are kayaking, especially a mile away from shore. a shark fin just feet away from you. fortunately, it didn't have any interest in taking a bite out of them, but others this summer haven't made it out as safely. >> there it is. >> this is the moment two kayakers in half-moon bay noticed they were being followed by a great white shark. >> you all right? >> yeah.

treatment in the hospital, though she is battling pain and phantom limb symptoms. earlier this summer, 49-year-old pro surfer was killed in hawaii. florida saw four bites in one week this last july. and a rash of attacks off the coast of texas, too. aerial video capturing the shark that attacked several beach goers on south padre island. still, experts say sharks a tagging humans is exceedingly rare. this summer's attacks are no higher than average. >> many times in shark sightings, we see increasingly more because many more people have drones. and, so, people are much more aware of animals in the water. doesn't mean there are more animals in the water. >> so some context here. here are the stats. florida leads the world in shark attacks. the state had 16 unprovoked attacks this year, that is more than california, hawaii and all of australia. one possible explanation,

happy hump day! we have a very special guest with us on this wednesday morning. ladies and gentlemen, the olympic medal winner and break-out star of the paris games. there he is, stephen nedoroscik! >> yeah! [ cheering ] >> you know what, he's got a lot of cool nicknames. he's dubbed the clark kent of the pommel horse. stephen sat on the sidelines for three hours waiting patiently for his turn during the finals, and then you know what he did? he whipped those glasses off. he put them right there next to the pommel horse, and he nailed that routine. that gave team usa its first medal in the team event in 16 years. he is here with that bronze and the second one that he earned in the pommel horse finals. it is so good to see you. i remember you saying as you were kind of meditating, waiting for your turn, you knew that when everyone nailed it, momentum was on your side and you guys were going to do well.

tell us about that. >> yeah. momentum is a big thing in gymnastics. my teammates did all the work for me. they hit every single routine. i knew all i needed to do was do my job. have fun with it, and as i was meditating i heard them say we trust you, steve. we got your back, steve! as i was standing up, i looked so serious. then i heard them saying that, and i gave out a little smile. that's what you need to hear in those moments. i could hear them the whole time and nailed the set. it was just one of those memories that will live in my head forever. >> i'm looking at that video there. what was going through your mind there? >> oh, my gosh. yeah. in that moment, everyone jumping up and down, picking me up and celebrating. i didn't know for sure yet that we had done it. but when it started, i was like, we did it. we freaking did it. >> of course, you have been dubbed clark kent. it's been a whirlwind for you. i saw you on jimmy fallon, and i just saw your lois lane in the corner wearing that beautiful olympics sweater. what do they think about this

>> well, i just think the -- when you are standing there on the podium and hear the national anthem -- it is something i was talking about with the guys afterwards. it is something about when the national anthem is played and you are humming and singing along to the tune. it is really emotional. if you go to sports games and the national anthem is layed and it's a cool experience. you have your hand over your heart, and i was just really proud in that moment. yeah, i was very emotional. like i said, at the gymnastics earlier in the week as well, watching the girls on the podium, you know, beaming with pride and hearing the national anthem, it really is something that's very emotional and, you know, i'm proud to be an american and i'm proud to be there standing listening to the national anthem. >> dan, you are sitting next to the guy that finished in the comcast business tour top 10. for those that don't follow the sport as closely as they should, that means he's in the poll

right. the new school year under way for a lot of folks including for students in tennessee, but for the first time in public schools, a new law allows teachers and staff to be armed in the classroom. >> nbc news daily anchor kate snow traveled to tennessee to see how it's playing out. >> good morning, guys. in the last five years, there have been more than 750 shootings on school campuses. this law was passed in the spring in the wake of a devastating shooting at the covenant school in nashville last year where you remember six people, including three children, were killed. the new law sets up a lot of rules and training before a teacher or staff member could show up to school armed. while some teachers say they would feel safer carrying a gun, that doesn't seem to be happening just yet. as kids and teachers head back to school in tennessee, a new

law allows teachers and staff to possess and carry a firearm on school grounds. >> there is an option in that piece of legislation. it is a tool that districts can use if they choose to. it, therefore, will be decided at the local level. >> each school district and principal would need to approve. and so far, the tennessee education association says it is unaware of any school boards that have modified their firearm policies to accommodate the new law. josh arwood teaches sixth great history in rural eastern county, tennessee. he wishes his district would allow him to carry his gun into the classroom. >> if they were to allow it, i would be fine with doing it. >> you would sign up to carry? >> uh-huh. >> and what would that look like for you? >> it would be concealed at all times. >> he says he would be ready to confront a shooter to save his students. >> what if somebody came into my classroom? what if someone came into my school meaning harm to them? i want to feel like i did everything i could to protect them. >> we sat down with josh,

alongside jennifer who teaches fifth grade science and social studies in nashville. >> do you think teachers should be armed? >> no, i don't. i'm just afraid the likelihood of someone being hurt accidentally is greater than the likelihood that any teacher is going to be able to prevent a school shooting. people are not walking into schools with handguns. people are walking into schools with ar-15s. and a handgun against an ar-15 is useless. >> and to you, josh, do you worry if that weapon is larger than what you have got, do you worry you will be able to do any good. >> i mean, i wouldn't be able to do any good if i didn't have a weapon. at least having something gives me some chance. >> i just don't think that an environment that is full of children needs to be full of more guns. just in general. >> under the new law, teachers would need to pass background checks, undergo 40 hours of training and would be personally liable if something went wrong. anyone armed must conceal their weapon, and no one would know which staff members were armed,

not even parents. and tennessee is not unique. about half the states have laws allowing school employees to be armed according to the giffords law center. >> i can't imagine sending my child to school knowing there is a gun in the room. within feet of her learning how to be a fifth grader. >> mary joyce's daughter monroe was 9 when she was injured at the shooting at the covenant school. she describes herself as conservative, a supporter of the second amendment. last summer she fought for gun reforms, like a red flag law that never passed. this spring she was part of heated protests against the legislation to arm teachers. >> why do you think this law passed? the legislators said they were doing this for covenant, in the wake of school shooting at your kids' school. >> they weren't listening at all. it felt like we were screaming

underwater. >> do you think this is the law now for political reasons? do you think it was political? >> i think partly it was political. >> josh, who is also a republican county commissioner, and jennifer, a registered democrat, agree on this. >> it is at least a good step to see where it goes. but i think it was so some of them could give themselves a pat on the back and be able to throw red meat at their constituents. >> i think they're trying to say, well, we tried to do something to make the kids safer. >> representative ryan williams, the tennessee lawmaker who sponsored this legislation said in a statement, in part, there is nothing political about ensuring districts have the ability to determine how best to protect their schools from dangerous individuals. josh has been a teacher for 18 years, jennifer for 11, and guys, they both say their jobs have gotten harder. jennifer said to me, when i walk into a new classroom, the first thing i do is think about where would i put the kids in the event of a shooting. and by the way, jennifer keeps a
