. now at 11:00. a kick boxing tech worker becomes an unlikely hero. >> sent him flying. >> how he teamed up with a perfect stranger at the perfect time to save an elderly plan from a knife-wielding attacker. a history-making move to remove trump from colorado ballot. could california be next. we have a storm coming in just in time for the morning commute. from kpix this is the late news with sara donchey on cbs news bay area.
11:01 pm
hello, i'm sara donchey alongside paul heggen. we hope you did not like the break from the rain too much. that was it, paul t is about to start ramping up again just in time for a lot of us to hit the road and head back into work. >> right. >> if you have the option to work from home tomorrow i would exercise that option. >> yes. since the ground is wet, there is a close call in sonoma county. 230 foot tree uprooted and grazed a house. it took downpour lines and smashed into a fire hydrant, luckily the house only had a little damage. the tree was supposed to be removed next month. during a break in the rain we saw people filling up sandbags in livermore to hold back all of the flooding when the heavier stuff rolls in. paul is talking about staying home for that early morning commute because it sounds like a lot of the leaf rain will be around that time? >> right, the morning commute will be a mess. always a mess to begin with but more so when there is a rain and even more so when there is heavy rain. in
11:02 pm
the process of moving closer to us as we speak right now. we look at the doppler, talking about approach number two. it is making its way closer and closer to the coast. hitting the coast of the north bay as we speak. zooming in for a closer look at the first plume of heavier rainfall followed up by more of that heading through the rest of tonight into tomorrow morning, coming down at a good clip. towards clover dale and hitting the coast of marin county and sonoma county as well. for the rest of us, talking lighter, light to moderate rain showers continuing through the next several hours, more rain showers happening in the santa cruz mountains as well. we zoom out we see a band of heavier rain steadily inching its way closer and closer to the coast. the problem is, the heavier downpours moving south to north. the line, it is slow she nudged closer to it. we can track it with future cast, a little earlier than what we
11:03 pm
anticipated for the heaviest rain to hit the majority of the coastline for the bay area. likely most of us are sleeping at 3:00, 4:00 in the morning, the rain continuing with drive time for moderate to occasional rainfall making its way up to the morning. continuing through the afternoon. it looks like a mess on the roads generally throughout the day on wednesday. adding up more rain on top of what we accumulated. here are the latest numbers for how much we added up since the rain started on sunday. talking about almost just short of an inch of rain in san jose. that is the lowest number on the map. between an inch and an inch and a half. just an inch total for redwood city. more than that along the coast and half moon bay. approaching 2 inches highest in north bay, up in elevation and farther to the north and closer to the coast. three inches of rain so far around santa rosa. of course, all of the rain helped to help erode our rainfall deficit. we
11:04 pm
are at 20-40% of average rainfall heading into the system. now we are up to 50-75% of average rainfall and will continue to erode that deficit as we head through the next 24 hours. taking a longer look at future cast and tracking the end of this rainy weather pattern this round of it coming up. >> we will pay attention, paul, thank you. >> what happens when a tech worker teams up with an off duty cop, an australian and a couple other good samaritans, they stop crime in san francisco. he told us he heard a cry for help and it turned into a chase and a take down of the guy who attacked an elderly man with a knife. as he told betty yu he was in the right place in the right time with the right people. >> all began here just outside of marin amidel school after 5:00 p.m. a good samaritan witnessed a struggle between the victim and a would be car theft armed with a knife.
11:05 pm
>> starting to figure it out. going to tackle the guy? no, i am just going to knock him down. like a crow hop, just like a kick. >> reporter: san francisco native, jesse hunt, who works at zoom, was walking home with a friend in the marina when he jumped into action. >> i hear somebody yelling out, i need help. i am being robbed, i have been stabbed. the guy is trying to take my car. i looked at my friend madison and there is a guy in a scuffle with another guy. >> the victim, 74-year-old man seen in this photo. jesse yelled at the suspect to drop the knife that prompted the attacker to take off on chestnut street so he chased him. >> as i was running up to him he jumped off and pulled a knife out at me. i backed off and then he started zig-zagging at the street and went towards people at the bus stop. i was kind of like this is my one chance to take him down. knife
11:06 pm
in the left hand, keys to the car was in the right. i sized it up and put my foot there. >> reporter: jesse has been taking kick boxing for about a year. it disarmed the suspect who then pulled out a second knife. jesse was able to grab the stolen car keys after another chase through part of the san francisco public library, more help arrived. including from the victim himself who caught up with the group an off duty federal officer seen in a hat and two other witnesses. together, they held down the suspect until the police arrived at bay and webster streets. >> one thing that i would love people to takeaway from this is stuff is going to happen in the city. it is always going to happen in any city. you can not take it upon yourself to jump in and take action when you see something going down. >> the attacker has been identified as 35-year-old man, he was booked into jail on an active warrant out of san
11:07 pm
francisco. along with other charges. >> it is a snap decision that worked out. you know, i do recognize that he could have a gun. he could of had tear gas on him. i got lucky. a lot of people would have done something. >> wow. that was not the only story of people taking matters into their own hands to stop crime. a store manager in place anthill was so fed up with people breaking in he tried it all. hiring security guard, installing 50 cameras and then came the big test. a group of six masked robbers forced their way inside of the estates consignment store. security video shows they rushed the security case with sledge hammers in their hands, then, things took a turn. >> i let them know i have a gun. you know, be careful. and then, they dropped the sledge hammer, they got scared and they run out. >> robbers took off in two get away cars just as the cops showed up. the police followed them out of the lot. we asked

if they ever arrested anyone they can not comment because it is an ongoing investigation. >> there have been a lot of first when it comes to former president trump. this time, target of the first of its kind ruling with the colorado supreme court deciding to kick him off of ballot in 2024. the reasoning? the constitution so-called insurrection clause. >> he is by far the most popular candidate for president in the gop. you will not see his name on the ballot in colorado. >> we are just 27 days away from iowa's first in the nation. we are going to win the iowa caucuses and then we are going to crush crooked joe biden next november. >> reporter: former president trump took to the stage in iowa soon after the supreme court barred him from the state's 2024 ballot. the court made up entirely of democratic appointees said trump is not eligible for the job under the constitution insurrection clause. in a move surprising to no one, the campaign promised to appeal to the u.s. supreme
11:09 pm
court. a case that santa clara university professor is preparing to weigh in on himself. >> while i am going to argue to the supreme court is this is not a political question it is a legal question and you the supreme court should really be the ones to decide whether or not donald trump is eligible to be president under the 14th amendment. >> gop voices are already calling on them to reverse the colorado decision like ron decant whois described it as an abuse of judicial power -- desantis described it as abuse of judicial power. >> i believe in voters having the right to decide but in a constitutional democracy. they can not pick someone born outside of the united states or under 35 years old. 14th amendment that says you can not pick someone who aided in insurrection that is part of the constitution.
11:10 pm
>> reporter: trump is only off of the ballot in colorado for now, other states could follow suit. but california probably won't any time soon. >> likely implication for california is california sits back and waits to see what the u.s. supreme court says. >> here is what we have seen in other states. michigan judge just ruled congress should decide if trump should stay on ballot and they refused to bar anyone else from the ballot. what better way to wait out the apocalypse than in paradise. mark zuckerberg and a top secret project in the middle of an island. >> i am not going to be a fan boy but i am being real. we know steph cure sethe greatest shooter ever. is it time to bring him into the crowded room discussion for greatest player ever. he just cooled down the hottest team of the game. all right, the next one has

this next round is a little more to contend with, right? >> more on the way and the timing could be better. it has to lineup with the heaviest downpours from the morning commute adding up more rain on top of what has family en. tomorrow is a first alert day pause of the impact on the morning commute. the afternoon commute could be effected as well. adding up a lot of rain. over 5 inches and approaching 3 inches in richmond and almost that level in pacifica. even, coopertino you are in the rain shadows. picking up an inch and a quarter of rainfall. there is more rain rolling our way courtesy of this storm system. round 2 and heavier rain is on its way. in this system, everything depends how close it attracts and the closer it is to us the more the heavy rain will go farther and farther inland. let's look at the loop over the last couple of hours. you see the rain surging up to the north. seeing off and on
