how they're making this christmas unforgettable. from kpix, this is the late news with sara donchey on cbs news bay area. had hello, i'm sara donchey. a san francisco jury handed down a verdict today in a case that fired national debate about safety in san francisco. a homeless man caught on camera beating a former fire commissioner with a pipe in his own neighborhood was just acquitted of assault. the public defender's office says it was a clear case of self-defense. the man who was beaten talked exclusively to our betty yu back in april, allegedly before he ever gave police a statement. >> when you have animals on the street saying they're going to rape your daughter and kill your mother, and you have nothing to do or help. and when you call for help, 911, and

that's your savior, and they don't show up? >> tonight betty has more on the big twist in the case, and a neighbor is reacting to you words not guilty. >> reporter: part of the attack against don carmenani happened at this gas station in the marina. it fueled the debate about crime and homelessness in san francisco. friday's not guilty verdict came as a surprise to many in the community. first, there were several videos of a brutal attack that left don with a broken jaw, dozens of stitches, and a traumatic brain injury in april. witnesses is ed the attacker, a homeless man was a known and menacing presence in the marina. >> when i was running away, the impact in the back of my head went through my skull. >> reporter: i sat down with the former fire commissioner and long time resident in an exclusive interview after he was released from the hospital.

>> i didn't go out there to fight anyone. i was just trying to get him down the road. it's three on one. i know odds. i'm 52 years old, i have two hip replacements, i'm an old guy. and i could have been a dead guy. >> reporter: then came a twist. defense attorneys released video showing a man they believe to be don using bear spray on a homeless person. >> they show me a person of interest, and that wasn't me. >> reporter: the public defender argued that the homeless man, who was seen picking up a weapon from the trash can was acting in self-defense after don first targeted him. on friday, a san francisco jury found him not guilty of assault and battery for beating don. the da's office released a statement that read, i would like to thank the jury for their service and respect their decision. >> people are basically saying

that this was attempted murder. i would at least at minimum say he has to go to anger management. >> reporter: patricia has lived in the marina for 40 years and president of the merchants group and has followed the case from the start. >> i think people are going to be very disappointed. this is what the people who pay taxes, are raising their children, and families are hearing. that they can get away with anyone. >> reporter: she says on the day of the attack she called the police number because she saw the homeless man and two palling outside don's parents' home. don and his mother said they called 911 multiple time, but the group remained outside, used drugs, harassed neighbors, and refused to leave. defense attorneys argued that don threatened to stab and kill the man if he didn't move his belongings. don said the only thing he had on him was pepper

spray, which he accidentally used on himself that day. >> they had completely blocked the the sidewalk, so i had reported them for breaking americans with disabilities act. and they simply were not removed. this may not have happened if they were not removed. >> reporter: during our interview, we saw nathaniel roy walk by with drug paraphernalia in his hands. he confirmed he was sitting outside don's home the day of the attack. what was your reaction to them finding him not guilty? >> good for him. >> reporter: police say the man in the video and doughty's case were possible related. >> i think it's a sad state for our country for somebody to be almost killed and the

perpetrator voted not guilty by innuendo. the owner of local donuts says they're beyond fed up because they've been robbed three times in six months. we covered when the store was robbed in june. flash forward to this week, and thieves targeted the store twice over the past few days. one robbery was at gun point. customers rallied around the store today where the owner told our da lin he thinks the city is just not doing enough to help him and businesses like his. >> reporter: friday 4:20 in the morning as a worker was mopping the floor at colonial donuts, two men were hoods and masks walked in. they hopped over the counter and went for the cash register. the robber threw the register to the floor repeatedly to try and break it open. >> the kicker is they leave with the cash register and take a donut. how am i supposed to feel as a business owner here

in oakland? it's infuriating. >> reporter: the owner declined to show her face for safety reasons. on sunday, at 7:00 p.m., a man with a mask walked in. he said he had a gun and demanded cash from a worker. the worker complied. the owner says the robber grabbed at least $200 in cash and ran off. and there was another robbery back in june. >> the violation, it just makes you so angry. my family has been here 40 plus years, and this is the worst they've seen. >> reporter: supporters rallied in front of the shop on friday morning. the general manager of noah's new york bagels says he too was robbed twice this week. >> three guys with just black on came up to me, knocked me down, took my bag. i had my ipad, by wallet, my credit cards. and nobody came. i tried calling the police, couldn't get ahold of them! >> reporter: the day before on monday morning, three gunman robbed him in front of wells fargo across the street from

his shop. he had walked over to deposit cash. >> i have bruises all over. this is from tuesday. >> the main priority now is stopping the crimes from occurring in the first place. >> reporter: oakland police announced on thursday they've stepped up patrols in the overnight hours to prevent commercial burglaries and robbery, but critics want the city to declare a state of emergency. >> if we declare a state of emergency, there's a large neon sign for people to not come here. >> reporter: councilwoman carol fife says they're already getting help from the chp and sheriff's department. but many businesses like colonial donuts say it's not enough. >> us as business owners in oakland are constantly pivoting and adjusting, and when is the city going to adjust for us? >> the shop is open 24/7, but now they're closing the door at night and serving customers from the window instead. a lot of people traveling, driving, flying with kids which

is challenging. i can tell you from personal experience regardless of the weather and delays. but paul, we need to check and see what things look like all over the country because so many people are just heading out now. >> yeah, it's going tuberculosis a busy weekend. and the -- to be a busy weekend. and the good news is, things are improving in southern california. the storm system that brought flooding rains, more than a foot of rain in parts of the mountainous areas above santa barbara, that's moving towards the phoenix area. the weather is improving around los angeles and san diego. if you'll be traveling around the state, the weather looking pretty good tomorrow. maybe some morning fog in los angeles and san diego. some left over moisture. otherwise a mix of clouds and sunshine. we'll see plenty of sun over the bay area. everybody's temperatures pretty close to normal for christmas eve eve. as we look at the national travel forecast, a few potential trouble spots to highlight. some early showers in chicago and in phoenix. that system in phoenix will be moving through the mountains spreading first rain, and then changing over to snow in denver tomorrow night. there could be

time capsules are meant to be dug up by future generations. but for one family, they never intended their wallet to become one. the owner of a historic atlanta theater was renovating a space when they found a hidden area behind a bathroom wall. they went inside and found a wallet from 1958 loaded with pictures, credit cards, personal items, all vintage. someone had lost the wallet in the theater 65 years ago. the owner thinks it

was stored in the manager's office at one point, but never claimed. so the theater's owner decided to try and track down who it belonged to. and he found someone. the owner's daughter. >> i mean, this is a treasure trove of 1958. >> it's meant more than i realized it would. truly. >> turns out the woman who owned it died ten years ago, but her daughter lives less than 20 minutes from the theater. back here in the bay area, there are a lot of toy give aways during the holidays. and they are all important ways to put a smile on a child's face. but this one, by the the santa clara sheriff's canine unit was extra special. they honored a brave little girl who just survived the fight of her life. ruby battled cancer, and while she was in the hospital, officers came to cheer her up. tonight the same department gifted her a tv and nintendo switch. she was also dubbed an honorary deputy by the sheriff's office. >> ruby's going to arrest

everyone! >> and ruby strong! watch out santa clara county! future officer, right ruby? >> smiling and ready to arrest everyone. her family has a lot to celebrate, though, this holiday. they say ruby's last scan was cancer-free. and during the holidays, ginger bread houses are built all over the world. but in tonight's project earth story, some very special homes were built to help us reconsider the world as our planet warms. elizabeth cook takes a bite. >> reporter: this holiday season, a very special ginger bread creation is on display. it's an entire city, and the concept is very timely good the theme for this exhibition is climate change. >> reporter: as greenhouse gases blanket the earth, global warming and climate change are in turn altering our world. punishing heat, intense and more frequent weather events, and devastating wildfires. this exhibit looks to inspire the public to think about ways to

deal with the impacts of climate change. the project was initiated by a uk-based charity dedicated to promoting sustainable design ideas. >> it's 50 plus architecture, landscape, architecture and design offices have participated in this exhibition. they've come together to creatively design an entire city, which is edible. a kind of miniature metropolis. >> reporter: one piece is entitled rain drop art knew semi. art museum. it features water blue gel. >> what we have here is kind of a little stream and river, and you see that the actual water, this blue gel, is running into the river and addressing the multiple changing water level that we see in the future unless we address climate change as soon as possible. >> reporter: designers used ginger bread, frosting, and candy to create house, train

stations, bridges, museums, and parks. they were asked to think about how to design and build cities vulnerable to sea level rise, drought, and flooding. >> i was thrilled to be invited to show our work because i really like the premise of the exhibition. it's about educating the general public. >> reporter: cooking up some sweet ideas to whet our appetites to a changing world. we've made it through the week that is always kind of hard to work through, when you know you have a holiday on the other side. >> yep. >> one of us is feeling very festive. >> wore the red chuck taylors. >> and dressed in the holiday spirit. and the other is going to a funeral. >> chose a different tactic. >> that was not on purpose. it was just what was clean at the time. >> everyone is festive in their own way. you do you. do you have like a black and white santa hat you can use to top off the look? >> no, but i'm now interested in finding one. >> you can find them in

literally every color combination. >> thank you so much for honoring my spirit. >> just putting that thought in your head. browsing for santa hats online while i do the weather. let's look at what's happening weather-wise through christmas weekend. it's a calm weather pattern that's settled in, and it's going to continue the next several days. the storm system that brought all the nasty weather to southern california, that brought us several consecutive days of rain, that's moving out. as it loses influence over the weather, we'll settle into dry conditions through the day after christmas. but without rain in the forecast in the foreseeable future, we are going to be collecting a little bit of well, stuff in the lowest levels of the atmosphere. air quality is going to be deteriorating as we head through the weekend. into the moderate category pretty much across the board by christmas day. could even get into the orange category, unhealthy for sensitive groups. that's when we'd get a spare the air alert. nice look towards downtown right now from treasure island. temperatures

mostly still in the low 50s, but down to the mid-40s in santa rosa and upper 40s in oakland. those numbers aren't going to fall too much farther throughout the rest of the night, but most of us in the 40s by early tomorrow morning. low to mid-40s with a few upper 30s in the north bay valleys. most of the numbers normal for this time of year. we'll warm back up, just not as much as today. today's temperatures were five to ten degrees above average. closer to normal tomorrow. temperatures in san francisco warm up to the upper 50s. close to 60 degrees. but while that's cooler than today, it's normal for this time of year. get out and enjoy it. should see similar temperatures with passing clouds throughout the rest of the holiday weekend. thanks to everyone for sharing their holiday dogs with us the past few weeks. temperatures reach the low 60s in the santa clara valley. temperatures within a degree or two of 60 degrees across the entire bay area, which is very close to normal, and still technically about one to three degrees above average. upper 50s for half moon bay and san

francisco. also upper 50s in oakland with temperatures in the north bay right around 60 degrees. and again, we'll continue this theme through christmas eve on sunday, and christmas day on monday as the dry weather will continue. eventually, though, our rain chances are going to increase. so let's take a look at the forecast models side by side and see where they agree. and what they do agree on is the dry weather pattern ends by wednesday. the models largely agree we mostly dry out thursday. this is where some divergence comes into play. we're having a hard time zeroing in on the system that comes in next. the american model keeps it offshore while the european model brings heavy rain in friday. the american model brings it in new year's weekend while the european model has plenty of rain sticking around for the next

holiday weekend. but we're talking about day seven and eight of the forecast, and right now we're really just evaluating the big picture pattern. the approach of the rain is day five in the forecast. that's still in the trend forecast category. we're still looking at is the rain becoming more likely or less likely. it's more likely at this point. but as we advance through the weekend, that's when we'll start to get more of a sense of some of the rough details and be able to narrow those down into next week. we'll keep you updated. let's look at the seven-day forecast. we really don't have to narrow things down by microclimates because everyone has a very similar forecast. doesn't matter if you're around the bay, along the coast, or farther inland. temperatures close to 60 degrees tomorrow. maybe a degree or two cooler for christmas eve and christmas day, but close to normal. then the rain chances move in. increasing clouds tuesday. rain arrives wednesday. showers in the forecast thursday. and we bring a chance of rain in on friday, even if it looks like it could go either way. but it does look dry for the niners game on christmas day evening.

you know, christmas time and the holidays are a good time in the bay area for sports. >> yeah, and the warriors certainly have something on their wish list. it's not too difficult for santa to give them this one. they ask for a return to their winning ways, which they did friday night. two games ago, steph curry had the streak of 268 straight games with a drained three snapped. but tonight he scored 30, and 23 came in the second and third quarters. the warriors' youth also on full

display. curry couldn't believe this dunk. another impressive performance for jackson. throws down the chris paul ally oop. his second straight double double. golden state won 129-118. they have four straight wins and even the record at 14 and s. but the story line coming into the game was the return of jordan poole. he looked to get emotional in a pre-game video tribute, received a standing ovation. he struggled shooting, just 7 of 21, but still led washington with 25 points. the wizards fell 5 and 23 with the loss. 49ers and ravens match up is a christmas gift for all football fans. both teams are 11 and 3, the first time in 30 years the two best teams in the league play each other this late in the season. brock purdy is the current favorite for nfl

here in san francisco. all month we've been celebrating a lot of history and memories. so here is a quick look back at 75 years of kpix. >> 1948, kpix went on the air. >> there's another aftershock. >> reporter: the mark hopkins hotel here on nob hill is known for its beautiful 360-degree views of the city. but it also plays a significant part in kpix history. this is where it all began exactly 75 years ago. it was december 22nd, 1948 at

6:45 p.m. kpix signed on the air as the first tv station in northern california. it all happened right above the top of the mark bar. so why the mark hopkins hotel? well, at the time it was the highest point in san francisco. and we have some archive footage on the roof of the hotel, engineers installing the first bay area tv broadcast antenna, and the first master control room complete with skilled technicians was in the attic of the hotel. and fun fact, the first thing viewers saw was a test pattern for 15 minutes that gave new tv owners a chance to adjust their sets. it was talled t-day because television was finally coming to the bay area. we'll continue to celebrate our 75th anniversary, and after digging through the archives, we have no shortage of retro kpix reports. you can watch all of
