news with sara donchey on cbs news bay area. >> hello, i'm sara donchey. we are starting the new year on a very rainy and windy note. the bay area is expecting everything from rain to thunderstorms and once again, high surf. heavy showers have been moving across the bay. here is how it looks in hayward tonight. sheets of rain coming down. it is really windy out there, too. but, tomorrow, all eyes will be on the coast where the storm surge can throw up more dangerous waves. a surf advisory is in effect for most of the day tomorrow. our meteorologist paul haggen has been busy on this day back from vacation tracking all of this, true to form, when you come back there is use a lot of work to do.. >> that seems to be the case. just because the timing is inconvenience with the heaviest rain coming through the bay area right around the peak of rush hour. the first batch, pushing off to the east.

lingering rain activity. still in santa clara county. things are drying out for the moment in san jose. another line of showers making its way onshore in marin county. moving into san francisco. locally heavy downpours, a narrower band of rain compared to what came through earlier. that is the trend. still, possibility of additional showers, locally heavy rain that will not last all that long. showers to start the day, the morning commute could bring in a few flashes here and there. and then drying out as we head towards midday. how much rain? the amounts of variable. a few 10th of an inch of rain. to half an inch. short of the half-inch of rain so far in san jose. the numbers are largely in line with what we have expected. the exception is san francisco, 3/10th of an inch so far. i am suspect of that number because the downtown sensor is looking weird over the past few weeks. farther to the north. just short of one inch of total

rainfall so far in santa rosa. more rain heading through tonight and tomorrow. there is more on the way later this week. track all of that. >> new details in the murder of oakland officer, half a dozen arrests have been made. early this morning his fellow officers got word of this one. >> i want to advise everybody, that the killer of our officer is in custody. >> all of the officers have been working all night, dispatchers, thank you, everybody. >> that was a radio dispatch that went out to everyone. so far oakland police are not naming the suspected gunman but law enforcement sources confirm to cbs news bay area it is this man, 27-year-old mark sanders. santa rita jail records show he was arrested just after midnight. around the same time the radio dispatch went out. held without bail tonight on

first-degree murder and other charges. community leaders tell us that the officer bridged the gap that needed a voice. >> reporter: with several people behind the bars after the killing of an officer, a sense of relief for many in oakland. >> that man is no longer on the street hurting, robbing people, robbing businesses or killing folks. >> reporter: the president of the oakland chinatown foundation. >> he did so much in our community. >> reporter: he was part of the oakland community off duty and onduty. his cultural knowledge breaked down barriers, especially in little saigon neighborhood. >> they felt like someone was looking out for them. >> reporter: the president of the vietnamese chamber of commerce echoed that. >> he would give his card, this is my cell phone, call me

wherever you want. and, and, for a community that does not feel represented to receive that, i mean, it is on a sad note to share but, they don't, they did not stop calling him. >> reporter: he was working undercover and responded to a burglary in progress of a suspected illegal marijuana grow house. he was shot and killed when the suspects tried to get away. the police sources tell cbs news bay area that at least 7 people have been arrested and more arrests are imminent. after the shooting, alameda county district attorney pamela price issued a statement saying her office is ready to prosecute whoever is responsible. >> i talked to so many people. they are concern about when the case went to the da. >> he says the community wants justice for the officer, his family, for the people of oakland that he served and to ensure the people responsible don't harm again. >> we will be there for the family. making sure that

justice will be served. >> so the oakland chinatown plans to have a vigil later this week. >> obviously, max, when this happens law enforcement from across the country reactedded to it and they take things radioic this seriously. i know a lot of agencies cooperated right when this happened. >> all hands on deck deal. sfpd for example em, law enforcement says one of the suspects was arrested after a high-speed chase. two squad cars smashed together. other agencies included livermore pd, alameda sheriff, the chp, the california attorney general's office, even more here, federal agencies, atf, the fbi and the marshals. a massive amount. >> thank you for keeping us posted. appreciate it >> yep. exactly a month after a woman vanished her former rock star boyfriend is in custody accused of her murder. he was

arrested this morning in santa cruz county. he became a person of interest when his car was found near his home. he was a founding member of the '80s group mr. bungel. he was not cooperative touring the investigation that led them to human remains in berkeley. they are waiting on dna testing to confirm they are her remains. the alameda county sheriff's office says a pair of violent car thefts could be connected. twice in the last two days suspects fired shots while trying to steal cars outside of people's homes. the first time was where someone shot the house, the second was near hayward where the suspect shot at the victim who caught them trying to steal his car, thankfully, nobody got hurt. still to come, a work of art or a deadly trap. the bay area sculpture caught in the middle of a bizarre battle over birds. >> just how rough is the california surf right now?

people were killed in this powerful 7.6 earthquake. that is the aftermath. rescuers are racing the clock to find more survivors who might be trapped in all of these ruins the quake flattened homes, businesses and other buildings after it struck yesterday. they are dealing with aftershocks and while they are looking for anyone to be alive. 64,000 people forced out of their homes and looked after in temporary shelters. dozens of dead birds are being found in the light rail station. animal rescue group is pointing a finger at a peace of art, strangely. this piece of art. it is an afternoon way created by a bay area sculpture. it was meant to be enjoyed by the public. one an man rescue says it turned into a death trap for birds. our reporter shows us

why.. >> reporter: this is blamed for killing birds. >> it is pretty much going to die. >> sacramento wildlife care association says gaps in the hollow metal arch allow birds to get inside and then they get trapped. >> they fall in or dive in and there is no way to get back up. the sculpture sits at the regional transit light rail station along franklin boulevard. the 20 foot tall arch, created by petaluma-based sculpture. >> this structure has been at the station since 2015. an owl was found struggling inside and firecrews were called in to help save it. it later had to be euthanized due to extensive injuries the rescue group says 30 dead birds have been found and safety changes need to be made. >> it would be easy to modify it. all it needs is something over the top so birds can't get in or a hole at the bottom where they can get out. preferably both. >> reporter: why are they not

making it safer for birds? >> because it is public art we are not allowed to touch it or make adjustments in any way. we need the artist to make the changes. we are working on a contract to be able to get him back out to franklin station and make adjustments. >> reporter: the artist's intent was to build a temple-like sculpture invoking sacred and safe place. now it is becoming a tomb for wildlife >> it is killing animals. something should be done. >> if it does not get fixed we will have more and more birds get in there >> there were more dead birds in there. the artist is set to make changes come next month. >> the same storm that has been pouring all over the bay area is dumping snow in the sierra. i-80 is shutdown in both directions right now at donner summit. bad news for drivers, obviously, good news for the snowpack. just at a quarter of average for the first official measurement of the season that happened earlier today. and,

wherever the high surf brings to the coast tomorrow it will not be as interesting as this. a bomb washed up in santa cruz county on new year's eve the bomb team was out there covered from head to toe with a protective suit. they deemed it was safe but they still remove today from the beach. all right, paul has been tracking all of the rain. obviously the question is, we know it messed up the evening commute. tell clear out in time for the morn something. >> it will be clearer but there will be a few showers here and there for the morning commute. i don't think there will be a huge impact on traffic. considering what the surf is like last week. not nearly that kind of event. high surf warning that we usually see this time of the year. rain, lingering showers heading through tonight. coming through, early in the evening, the peak of rush hour, showers tomorrow morning are quiets down. a dry break tomorrow

afternoon. continues through thursday and more rain chances farther down-the-line on friday and saturday. details on those fuzzy. we have to get this system out of the way first before we can focus on the next couple. the rain is pushing to the east. more widespread rain. coming into san francisco. the bands of rain, quite a bit narrower. not lasting long. there are more of them out over the pacific. it will be an unsettled night. showing the showers on the map early tomorrow morning, fewer and farther between. lighter. that is why we expect not too much of an impact. light showers will be gone heading towards midday. a mix of clouds and sunshined with afternoon. the temperatures returning close to normal for this time of the year. the next rainmaker, taking shape. moisture showing up to the northwest by thursday afternoon. that is going to try to dive down late thursday night. likely after midnight. but, again, the details on the next system still fuzzy. something we are going to continue to monitor heading

through the rest of this week. talking about the snow, add be up 2-3 inches an hour. we are talking about anywhere from a few inches, several inches of snow to a foot and a half accumulation for this system. the next round of potential rain heading friday into saturday. it is bigger for the snow maker in the sierra. great news for the snowpack, not great news for travel. a lot of folks want to head up there the first week in january, a busy sky time. it will be a headache if not treacherous on friday and saturday. something else that we will keep you updated on heading through the rest of the week. a lot of clouds out there. the rain just about to move pack into downtown san francisco. the temperatures are a mix of upper 40s, 50s. we will end up in the 40s across the board early tomorrow morning, slightly above average, inland, seeing a lot

of 30s in early january, the impact of the blanket of clouds holding warmth near the ground level. temperatures are not holding up tomorrow. we will be back near average. climbing to the 60s in most locations today before the rain moved in. tomorrow, back to the middle to upper 50s that is where we are supposed to be. not much differences in temperature. half-moon bay and livermore and the warmest spots at 59 degrees, san jose, that is all of the variation that we will see. just an even playing field for everybody's temperatures tomorrow afternoon with a mix of clouds and sunshine taking over. this is the trend that is going to carry us through. not just the rest of the week but all of the way through the entire seven-day forecast. once again, we don't have to worry about focusing on individual microclimates, everybody has the same forecast. everyone's temperatures will be a few degrees within each other. all of the way through the seven-day forecast. we bring the next chance of showers into
