torrential rains in the northeast. mystery revealed. defense secretary lloyd austin is battling prostate cancer. the reason for his hospitalization. why did he keep it a fight? -- keep it a secret? the fight over presidential immunity. a federal panel hears donald trump's claims, but the judges sound skeptical. good morning. it is good to be with you. i'm anne-marie green. we are starting with the deadly storms impacting all 50 states. hundreds of thousands of people are waking up without power this morning, and at least four deaths are being blamed on the weather down south where multiple tornadoes were reported. in new york city, drenching rains and howling winds forced the evacuation of nearly 2,000 migrants from a tent complex. cbs' jarred hill joins us now from here in new york. good morning. >> reporter: good morning. it's basically pick your poison with the severe weather across the country. here in the new york area the heavy rain, the strong winds are largely done. but with those swollen rivers,

there's still a risk of flooding. elsewhere, there are dozens from some of the other storms left without a home. this morning the cleanup continues after winter weather wreaked havoc across the country. suspected tornadoes tore a path of destruction through the south. from this mobile home park in north carolina where at least one person died to south carolina, alabama, and florida, where this house in panama city was uprooted. >> it of the a freight train hitting a brick wall. that's how loud it was. >> reporter: a person in graceville, florida, described the frantic scramble for shelter as the storm ripped through the roof. >> i have a bathroom in the middle of the house. as i was trying to get there, the back of the house was ripping off. >> reporter: in louisiana, a tornado blew the roof off this thrift store. >> we are the people who help everyone, and we feel like we can't help no one because we're in this predicament. >> reporter: the storm brought gusts and winds that uprooted trees and downpours that led to flooding throughout the mid-atlantic and parts of new england.

>> it would be more fun if it was snow. >> reporter: the snow did blanket parts of the midwest making driving dangerous in nebraska and iowa. >> speed is the biggest thing. if you have to be out, slow down your car. >> reporter: now parts of the northeast including new york on down to the south are bracing for more rain and storms today, while to the west another bout of blizzard conditions and heavy snow. so the national weather service is saying that parts of central u.s. should be expecting a really significant cooldown over the next couple of days. we're talking about temperatures so cold that there's a risk of hypothermia as well as frostbite if people don't bundle up or stay inside. >> give us a break, mother nature. thank you so much. so we are finally learning why the defense secretary has been in the hospital for more than a week after keeping the public and the president in the dark for days. lloyd austin is being treated for prostate cancer. now the white house has issued an order to all cabinet members

to make sure the failure to disclose doesn't happen again. here's the story from cbs' david martin. >> reporter: secretary austin had surgery for prostate cancer more than two weeks ago but hid the diagnosis from his commander in chief. >> the president didn't know about the diagnosis until this morning. >> reporter: austin underwent surgery on december 22nd. cbs news chief medical correspondent dr. jon lapook describes the operation which the pentagon called an elective medical procedure. >> when you take out the entire prostate, it is a major operation. >> reporter: on new year's day, austin began to suffer complications. >> including nausea with severe abdominal hip and leg pain. initial evaluation revealed a urinary tract infection. >> reporter: this is an unusual complication. usually these operations are big but people recover generally well without a complication. admitted to the icu with a tube

down his nose to drain his stomach, he turned over his powers of secretary of defense as his deputy but waited three full days before telling the white house he was in the hospital. >> it is not optimal for a situation like this to go as long as it did without the commander in chief knowing about it. that's not the way this is supposed to happen. >> reporter: the white house ordered all cabinet secretaries to immediately report whenever they are not able to perform their duties. in the pentagon, they began a review of what took so long. austin's spokesman provided one answer. >> despite the frequency of prostate cancer, discussions about screening, treatment, and support are often deeply personal and private ones. >> a sensitive part of the body. but it's important for men to know what their risk factors are for prostate cancer to get screened appropriately. >> reporter: because they caught austin's cancer early, his doctors say prospects for a full recovery are excellent. he will also have to recover from an examination of whether

his desire for privacy led him to violate laws governing the transfer of power. david martin, cbs news, the pentagon. boeing is acknowledging that last week's incident when a door panel blew off an alaska airlines flight was the company's mistake. investigators are trying to determine if four bolts used to secure the panel on the 737 max 9 jet were missing before the plane took off from portland, oregon. both alaska and united airlines reported finding loose bolts and other parts on some of their now-grounded max jets. now to donald trump's legal battle over whether he should be immune from prosecution for allegedly trying to overturn the results of the 2020 election. the former president was in court for the arguments, but the three-judge panel appeared to have their doubts. scott macfarlane was inside the courtroom. >> reporter: after arriving in a motorcade through the rain, donald trump sat in the front

row as his attorney argued the 2020 election conspiracy criminal case against the former president must be dismissed. >> to authorize the prosecution of a president for his official acts would open a pandora's box from which this nation may never recover. >> reporter: a trial judge rejected his claim of presidential immunity last year saying a former president doesn't enjoy a get out of jail free card which the prosecutor echoed. >> the president has a unique constitutional role but is not above the law. >> reporter: the appeals court appeared skeptical, too, with one judge calling it paradoxical for a president to swear an oath to uphold the law but be allowed to violate the law. judge florence pan posed a pointed hypothetical to trump's attorney -- >> could a president who ordered s.e.a.l. team six to assassinate a political rival who was not impeached, could he be subject to prosecution?

>> reporter: they said the former president could have been charged if he had been convicted by the senate at his 2021 impeachment. >> if donald trump could have been impeached and convicted and therefore could be prosecuted, then how can they argue immunity at the same time? it's a contradiction. >> reporter: though he claimed he was forced from the campaign trail by the case, trump appeared in court voluntarily and addressed cameras at his former d.c. after. -- former d.c. hotel after. >> i feel as a president you have to have immunity. very simple. >> reporter: no timetable for when the three-judge panel -- two nominated by president biden -- will rule. the losing side will likely appeal, and the special counsel has tried and failed to get the supreme court to fast track this case which means trump's scheduled march 4th trial date here in washington is very much in jeopardy of delay. scott macfarlane, cbs news, washington. the mother of former first lady melania trump has died. former president trump's wife announced the death of her

synagogue tunnel in new york city and a suspect in the killing of tupac shakur may soon be free. those are some of the headlines on the "morning newsstand." "the las vegas review journal" reports a judge granted bail for the man accused of orchestrating the 1996 drive-by shooting that killed rapper tupac shakur. yesterday the judge set a bail of $750,000 for former gang leader duane "keffe d" davis. the 60-year-old pleaded not guilty to first-degree murder after being arrested in september. the judge said davis can serve house arrest with electronic monitoring ahead of his trial. "the new york times" says a secret tunnel in a new york city synagogue led to a clash between jewish worshippers and police. video from monday shows officers confronting hassidic men in the world headquarters of habad lubavich movement. the organization says a group of extremist students built the tunnel.
