they said would be humane, but witnesses say it was anything but. >> i stood there and cried. i saw someone get suffocated to death. >> the killer's final message. first, ready for takeoff. the boeing jets grounded after that terrifying mid-flight blowout will soon be back in the air. good morning, and good to be with you. i'm anne-marie green. today alaska airlines is expected to resume flights on the boeing 737 max 9 jets. it comes just weeks after the federal government grounded the plane after a side panel blew out shortly after takeoff. cbs' jarred hill is joining us now from here in new york with the latest on this investigation. good morning. >> reporter: good morning. the bolts from that particular door panel still have not been found, but officials say the panels on all the other max 9s have been thoroughly inspected as the planes prepare to fly again today.

cbs news has learned that in just a few hours, alaska airlines plans to send its first 737 max 9 planes back into the air now three weeks after a door plug blew out minutes after takeoff. the terrifying ordeal over portland prompted the faa to temporarily ground the model nationwide for safety inspections. alaska airlines' ceo ben mimicucci on cnbc about the future of the fleet -- >> we expect within about a week our entire 65 airplanes or close to that should be up back in full service. >> reporter: the ntsb continues to probe the incident. investigators will return to the boeing plant in renton, washington, today, while other officials are still examining the retrieved door panel at a lab in d.c. yesterday boeing halted production of the 737 max for safety stand down at the renton factory with more planned at other production facilities in the coming weeks. >> we at the boeing company are under a tremendous amount of

scrutiny, and what i will say is rightly so. >> we're going to talk about transparency and responsibility. >> reporter: this comes as boeing's ceo was back on capitol hill yesterday to meet with senators. >> he has a real ongoing multiyear problem at boeing of quality-control issues. he said he's fixing it. >> nothing is more important than ensuring that the flying public is safe. >> reporter: united airlines is also expected to resume flights on the boeing 737 max 9 this weekend. and united and alaska say that passengers who don't want to fly on a max 9 can change their flight no extra cost. meanwhile, the faa is investigating whether boeing and its suppliers followed proper procedures during manufacturing and won't let boeing expand its production of that plane until it's satisfied. >> all right. jarred hill in new york. thank you. alabama carried out the nation's first execution using nitrogen gas. kenneth eugene smith was put to death after the supreme court denied a last-minute appeal.

smith's attorneys argued the state was making him the test edge is for an experimental execution method. smith was convicted in the 1988 murder-for-hire of a pastor's wife. the victim's son said his mother got justice. >> kind of a bittersweet day. we're not going to be jumping around hooting and hollering hooray and all that, that's not us. we're glad this day is over. >> the execution took about 22 minutes. media witnesses said smith appeared to remain conscious for several minutes, shake his head, twist and turn, and breathe deeply. >> tonight i watched my husband jerk and convulse and gasp for air for at least ten minutes.

>> there is no doubt that even the most hopeful of persons could not look at what we saw tonight and see any sort of humaneness. >> in a final statement, smith said alabama causes humanity to take a step backwards, i'm leaving with love, peace, and light. he made the "i love you" sign with hands toward his family members. breaking overnight, a moscow court denied an appeal and extended the pretrial detention of "wall street journal" reporter evan gershkovich until the end of march. that's according to russian state news agencies. gershkovich was arrested last march on espionage charges. he and the "journal" deny the allegations, and the u.s. government said that he is being wrongfully detained. former president donald trump is expected back in a manhattan courtroom today for closing arguments in the civil defamation trial of writer e. jean carroll. he briefly took the witness stand yesterday in his own defense. and cbs' erroll barnett was

there. >> reporter: two days after a joyful win in new hampshire, former president donald trump was stone-faced testifying in his own defense on the witness stand in new york. judge lewis kaplan presided over the previous civil trial in which trump was final liable for sexual abuse and defamation of writer e. jean carroll. for this trial he emphasized no testimony could contradict the previous verdict which left trump's lawyers with few questions. >> she's not my type. >> reporter: including whether he stood by the deposition in which he declared his innocence. trump said yes. at one point, trump said of carroll, quote, she said something i considered a false accusation. the judge ordered the comments stricken from the record. and when trump said, quote, i wanted to defend myself, my family, and, frankly, the presidency, another objection, and instruction to the jury to disregard. trump's entire testimony lasted only four minutes. and when he said before taking

the stand "i don't know who the woman is," the judge reprimanded him for interrupting. exiting the courtroom, trump was overheard saying, quote, this is not america. now jurors return friday morning for closing arguments and could begin deliberations over this potential eight-figure defamation sum by lunchtime friday. donald trump, who was not required to testify and is not required to be inside the courtroom, says he will be here friday for the proceedings, as well. erroll barnett, cbs news, new york. negotiations on a bipartisan senate deal to overhaul u.s. immigration policy and provide more military aid to ukraine is in danger of collapsing this morning. it comes after donald trump called the deal meaningless. senate minority leader mitch mcconnell is warning that trump might want to make immigration a campaign issue, threatening gop support. >> the idea that someone running for president would say please hurt the country so i can blame

my opponent and help my politics is a -- a shocking development. >> donald trump have the ability to kill this immigration deal? >> well, i think there's not a deal to be killed yet. >> the u.s. says it's run out of money to supply ukraine with additional weapons and ammunition for its war with russia. a dramatic day in court in a landmark case. testing the limits of who's responsible for a mass shooting. jennifer crumbley is the first parent to be charged and go on trial for a school shooting carried out by her son in oxford, michigan, two years ago. cbs' elaine quijano has more. >> reporter: jennifer crumbley sat at the history-making trial. >> she is responsible for those deaths. >> reporter: her son was 15 when he shot and killed four students at oxford high school in michigan. ethan crumbley pleaded guilty and was sentenced last month. >> the defendant shall serve the rest of his life without the possibility of parole.

>> reporter: the four students who died ranged in age from 14 to 17. seven others were wounded including teacher molly darnell. >> i realized he's raising a gun to me. >> reporter: she showed jurors her bullet wound as she described what happened. >> i texted my husband "i love you, active shooter," and then i started feeling blood dripping down my arm. >> reporter: prosecutors say jennifer crumbley and her husband james ignored warning signs of mental health issues including drawings of a gun with the words "the thoughts won't stop. help me." they bought him a gun as a gift. the defense revealed crumbley herself will testify. >> she did not have it on her radar in any way that there was any mental disturbance that her son would ever take a gun into a school, that her son would ever shoot people. >> reporter: in convicted, the crumbleys could face 15 years in prison. not for what they did, say prosecutors, but what they failed to do.

the mayor says that there was no prior indication anything was wrong with the building. the stone building dates back to around 1850. a dancer's death is being blamed on mislabeled cookies, and a new development in the hunt for a teen fugitive. those are some of the headlines on the "morning newsstand." "the philadelphia inquirer" reports the alleged on, accomplice of a teenage murder suspect who escaped is in custody. 17-year-old shane pryor escaped from juvenile jail staff wednesday during a visit to a hospital. video released by u.s. marshals shows pryor talking to a front desk employee after getting away. investigators believe he later called an accomplice who picked him up. the getaway driver was taken into custody and questioned while the search for pryor continues. "the new york post" says a 25-year-old professional dancer died after eating mislabeled cookies containing peanuts from a stew leonard's grocery store

in connecticut. orla baxendale died earlier this month after going into anaphylactic shock. authorities say the vanilla florentine cookies contained peanuts that were not listed on the ingredients. stew leonard's recalled hundreds of packages of the cookies. the store and the bakery that supplied the cookies are braming each other. and cbs los angeles says beverly hills residents are outraged after squatters turned a multimillion dollar mansion into a problematic party house. neighbors say they've been dealing with the unruly squatters for months. the listing broker for the house says the squatters changed all the locks including the gate code. he says the uncertain ownership status of the home makes it difficult to take legal action. the previous owner allegedly fled to lebanon after being accused of killing a woman. still to come, a stunner down under. tennis star novak djokovic gets derailed by a newcomer at the australian open.

the dow gained 242 points. the nasdaq jumped 28, and be the s&p 500 was up 25 points. new economic data shows the nation's economy grew at a surprisingly strong 3.3% pace last quarter. this despite high interest rates and inflationary prices. analysts say that's a strong sign of economic resilience. the latest numbers also reveal america's gdp rose at an annual pace of 2% or more for the sixth straight quarter. meta says it's trying to make instagram and facebook safer for teens. the tech giant is rolling out new messenger settings on the apps that would block messages from strangers to users under 16 and require parental approval to change. it follows growing criticism from lawmakers and parents who are concerned the social media platforms leave teens vulnerable. meta's ceo, mark zuckerberg, and other social media executives will testify before the senate
