homer insuperable debate between the 49ers and the chiefs, this is kpix, cbs news bay area. trees down, roads flooded and another powell for -- powerful storm heading our way. police can use it to solve crimes but facial recognition technology has its flaws. we sit down with the bay area lawmaker who is now pushing for limits. the 49ers get back to business to prepare for super bowl lviii, airing right here on kpix. how it will be a full circle moment for property. thank you for joining us this afternoon. we are in the middle of a series of bay area storms and today is another first alert weather day as we monitor the next an atmospheric river. let's get right out to chief meteorologist paul heggen in the virtual view studio. >> we are tracking rain across the bay area. let's add up the

rain. scattered showers and sunshine between. the santa cruz mountains picking up 5 inches of rain and the exact same amount in the higher elevations in marin county. pacifica, 2 inches of rain. oakland hills, 2 inches of rain. about 1 inch of total rainfall from yesterday evening. we are going to be in this unsettled pattern as we head into the first half of the weekend and that next storm system will move in. this will send another atmospheric river toward the coast but exactly where is the factor that we are going to be pinning down over the next 72 hours. let's talk about the lingering showers on first alert doppler. we have a heavier downpour just to the south of downtown santa rosa. more showers making their way from marin county to napa county. a little bit of a dry

break in the moment. more rain moving out of the santa clara valley into the higher elevations east of san jose. we have seen a few cloud-to-ground lightning strikes. this is the pattern we can expect for the next few days. a couple of thunderstorms here and there. it is going to be hard to get anything done because as soon as the sun breaks through, another batch of showers will be moving through. we will see that to evolve into early saturday morning. be flexible because saturday looks like the dryer half of the weekend. we see the two longer-range forecasts side by side. there could be some significant differences be clean -- between the models. the driest day we will see for a while is shattered a -- is saturday. the

european forecast model really focusing the bulk of the rain just down the coast. the american forecast model breaks a lot of rain and a lot of wind in the bay area. look at all of that snow. they will get hit either way. the question is, how will this impact us? we have a lot of rain and wind. it will be the worst of it just missing us. lingering showers likely on monday and lingering showers in the forecast on tuesday. if we will get heavy rain and gustier winds, it will likely be in the forecast through the day on sunday into sunday night. in the short-term, in terms of our temperatures for tomorrow, it looks like we will top out just below average for this time of year. mid to upper 50s across the entire bay area. take a look at the 7-day forecast which does include wet weather across the entire region, at least that is the way we are leaving the forecast we are going to be seeing the rain

more widespread into the weekend on sunday and then we get into the off and on shower pattern with rain lingering on monday. the question is how intense it will be . one of the forecasts could go either way. stay tuned for updates. we are always evaluating new information as it comes in. it happens on an almost continuous basis. we have lingering showers through the forecast on thursday. temperatures will not change a whole lot. they will have our full attention through the weekend. what is not in question is the rain, the wind making a mess across the bay area today. let's check in with anne makovec for a look at those news headlines. >> this slight letup in the rain is giving people a chance to clean up and try to prepare

for the next several rounds. the storm drop down trees across several bay area cities including this big tree in los altos. it pulled downed power lines on its way down. firefighters and pg&e crews were out working to clear it and get the power out. nobody was hurt and no homes were damaged. another tree toppled in daly city last night. not far from the sierra madre mall. luckily, no one was injured. elsewhere, flooding has been a big concern. this was the scene in mendocino county where high waters took over a road. wineries in that area also taking a hit. the water is coming from the russian river which surged above flood stage overnight. and sonoma county, crews spotted rope rescue a driver was trapped in a car. this was in the city of windsor. we look at this store all of its website us streaming on the three cbs news app.

a new bill in california aims to restrict law enforcement's use of racial recognition technology with the goal of preventing mistaken arrests. police say facial recognition could be a helpful tool in solving cases but it has had its flaws in the past. the federal trade commission found that it often misidentifies blacks, asians, latinos and women. last year, the ftc banned rite aid from using the technology after shoppers were wrongfully accused of stealing. joining me today is assembly member bill team. thank you for having me. >> why is it important to put these regulations on? >> what we have seen is, when i did a bill in number of years ago, it started a three-year moratorium on facial recognition and body cameras. the mismatched many of the faces on the legislators with a crime book. what we saw was, if you build safeguards around it, you could misidentify people.

>> the aclu wants facial recognition technology banned altogether. >> what do you say to them? >> i am open to a ban on facial recognition technology but, right now, in the legislature, that is not what we need to get done. at this point, with the moratorium expiring, law enforcement can do whatever they want. they are working closely with law enforcement last year and this year to see what would make sense, how to have certain guidelines for them all around the state. >> san francisco was the first major city to ban the technology altogether. do you think this bill would change their mind? >> this is fine and it works. what we are looking at, and this is what my bill does, make sure that before law enforcement searches or arrests , actually presents an affidavit of someone, that they use more than just facial recognition software to identify that individual. >> what about big events like

the super bowl where this technology was identified to develop -- identify security risks? would it eliminate the need for this type of technology? >> if they are concerned about a threat and they have other information, other evidence and they identify someone with that facial recognition along with that other information, it is fine. what i was working with law enforcement on last year was, we wanted to make sure people felt like they could exercise their civil rights, they could protest in the streets, they could make free speech and they would not be worried that by making a speech in public or joining a rally, that they would get misidentified or just that peaceful protest. >> apologies for the cough. thank you so much. >> thank you for having me. still ahead, we are your home for super bowl lviii and our niners are back on the practice field. they are trying to pace themselves ahead of the big game. vegas getting ready to play host. we will show you how the strip is shaping up to host thousands of super bowl fans.
