stunner. republicans fail to impeach homeland security secretary alejandro mayorkas after a handful of gop members voted with democrats. donald trump denied. a federal appeals court rejected the former president's claim of absolute immunity from prosecution. what it means for his election interference trial. and unprecedented verdict. the mother of a michigan school shooter convicted of involuntary manslaughter. what convinced the jury. good morning and good to be with you. i'm anne-marie green. we begin with that major blow to republicans in the house. their effort to impeach secretary of homeland security alejandro mayorkas fell short after a handful of gop members joined democrats to vote against it. it comes as president biden called on republicans to show some spine on border security. cbs news' michael george has the details on how things unfolded. good morning, michael. >> reporter: good morning. look, there's no getting around

this. this was an embarrassing defeat for republicans. but it's more than that. it's also a sign of the disarray in the party just nine months ahead of the election. there was plenty of drama on the house floor including one lawmaker rushing from his hospital bed to make it in time for the votes. >> the resolution is not adopted. >> reporter: the house gop-led vote to impeach homeland security secretary alejandro mayorkas failed yesterday. >> secretary mayorkas has willfully and deliberately refused to uphold the laws of the united states -- >> what you have to offer the american people is this sham impeachment. >> reporter: in the end, four republicans joined the democrats in voting against the resolution with some arguing that impeaching a cabinet official would set a dangerous precedent. texas democrat al green even left his hospital bed post surgery to cast his no vote. he spoke with cbs news after returning to the hospital. >> i went there to help a good

man keep his reputation. >> reporter: several house republicans say efforts to impeach mayorkas are not over. >> we can bring the articles of impeachment back to the floor maybe as early as next week. >> reporter: in statements, the white house and department of homeland security described the vote as baseless and called on congressional republicans to support the senate's bipartisan border security bill. but republican house speaker mike johnson has pronounced it dead on arrival. >> we have no real chance here to make a law. >> it's time for republicans in the congress to show a little courage, to show a little spine. >> reporter: yesterday president biden accused gop lawmakers of caving to the demands of former president donald trump who's come out against the bill. also yesterday the house failed to pass a gop stand-alone bill that would have given over $17 billion in aid to israel. 14 republicans joined democrats in opposing that vote. >> thank you so much.

a federal appeals court rejected former president trump's claim that he is immune from criminal prosecution. the three-judge panel ruled unanimously and said trump can stand trial in connection with the charges he plotted to overturn the results of the 2020 election. election. trump says that he will appeal. jan crawford has more. >> reporter: the ruling by the influential d.c.-based federal appeals court was a stern rebuke of the former president's sweeping classmates about immunity from prosecution. with the court saying the former president must face trial for efforts to subvert the 2020 election. for the purpose of this criminal case, former president trump has become citizen trump with all the defenses of any other criminal defendant. in court and on the campaign trial, donald trump repeatedly says he can't be prosecuted for his actions as president. >> a president has to be given immunity, and this has nothing to do with me. >> reporter: the three-judge panel two of democratic appointees and one republican

was unanimous and emphatic -- any executive immunity that may have protected him while he served as president no longer protects him against this prosecution. the bounds of trump's immunity arguments became clearer last month while he sat in the front row of a packed courtroom, one of the judges presented his lawyer with a dramatic hypothetical. >> i asked you a yes or no question. could a president who ordered s.e.a.l. team 6 to assassinate a political rival who was not impeached, could he be subject to prosecution? >> if he were impeached and convicted first -- >> reporter: since the senate failed to convict trump that would mean special counsel jack smith couldn't either, and the appeals court flatly rejected it, but this is not the final word. trump can always ask the full appeals court to reconsider this decision or skip that step and go straight to the supreme court. but having lost at every turn, it is an uphill battle. i do not see how he gets five

votes from those justices which means a trial could start late spring or sometime this summer. jan crawford, cbs news, washington. breaking overnight, donald trump's remaining challenger for the republican presidential nomination, nikki haley, suffered a defeat in the nevada primary. cbs news projects the option none of these candidates got the most votes. haley was second. trump was not on the primary ballot. he's taking part in nevada's gop caucuses, that's tomorrow. meanwhile, cbs news projects an easy victory for joe biden in the state's democratic primary. and the mother of a teenaged school shooter was found guilty of involuntary manslaughter in a case that examined parental responsibility. jennifer crumbley was convicted yesterday. it was the first time an american parent was held responsible for a child carrying out a mass shooting attack. the jury foreperson said a key detail was jennifer crumbley was the last adult with the gun. the maximum penalty for

involuntary manslaughter is 15 years in prison. her son ethan killed four students at his michigan high school in 2021. prosecutors argue jennifer crumbley and her husband allowed ethan to have a gun despite signs he was in mental distress. this morning, a troubling report from the ntsb reveals bolts appeared to be missing from a boeing 737 max 9 door panel that blew off mid flight. senior transportation correspondent kris van cleave has the latest details on that. >> reporter: harrowing new details when the door panel blew off this alaska airlines flight last month it did so with enough force to slam the captain's head into a display 26 rows away. and now the ntsb says the four bolts that should have held the plan in place were missing prior to the blowout on the new 737 max 9. if the bolts are, there the door doesn't move up, means it doesn't my off. >> it prevents the door from disengaging from the stopped fittings. >> reporter: and flying off the plane. >> at flying off the plane.

>> reporter: the ntsb report reveals a photo from september of the door during final assembly at the boeing factory without the bolts in place. in a statement, boeing's ceo says the company is accountable for what happened and is implementing a comprehensive plan to strengthen quality including changes to the 737 production system. the bolt bombshell came just hours after the new faa administrator was in the hot seat on capitol hill. >> the current system is not working because it's not delivering safe aircraft. we have to make changes to that. >> what are we doing to not only assure safety but to assure that people can feel safe? >> how do you maintain a safety culture or return to that safety culture that we used to have and i think we've lost? >> we have to get back to a culture where safety is first. >> so you'd fly on the 737 9 max? >> yes, i would. >> reporter: boeing has launched an investigation into boeing's manufacturing processes around the 737 max to include quality

control and its safety culture. the agency says it has sent about two dozen additional inspectors to boeing facilities. united and alaska, who both by this the 737 max 9, tell us both airlines have completed their inspection process. most planes, about 94%, are back in service. kris van cleave, cbs news, las vegas. secretary of state antony blinken is in israel today as he continues his trip in the middle east trying to broker a deal for a truce and free the remaining hostages in gaza. blinken saying there is, quote, a lot of work to be done after hamas responded to a cease-fire framework drawn up by the u.s. and its allies. israeli intelligence confirming 31 hostages captured by hamas and its allies have died since the start of the war. officials say there is also unconfirmed information that at least 20 other hostages may have also been killed. coming up, deadly storms. the death toll rises after days of record rains in california. and we're live in las vegas as a popular tourist spot is

"the los angeles times" reports the death toll from days of relentless rain in california has climbed to nine people as destruction mounts in southern california. record rainfall from back-to-back atmospheric rivers has caused flash flooding and mudslides. los angeles officials say crews have responded to nearly 500 mudslides. they've received more than half of its average rainfall has fallen in three days, and forecasters say the threat is not over as more rain is in the forecast today. kevin alstrup was charged with four misdemeanor counts, that's according to court record. he is not accused of violence or vandalism, though. he posted videos from outside on social media and surveillance videos showed him entering the building on january 6th, according to charging documents. the state department said the contractor is no longer working for the department. and "npr" says meta will start labeling ai-generated images on instagram and facebook. meta says users will start seeing the labels on photos in the coming months and eventually on ai-generated audio and video. in making the announcement, the social media company made note of upcoming election that's are taking place around the world. experts and regulators have warned that deep fake digitally manipulated media could be used to mislead and manipulate voters. still to come, actor gina carano sues disney and lucasfilms over her firing from the series "the mandalorian."
