marianne williamson announced she has ended her long shot bid for the democratic nomination. that leaves just minnesota congressman dean phillips challenging president biden, who comfortably won the nevada primary on tuesday. and keegan-michael key will host the nfl honors tonight from las vegas. it airs on cbs and streams on paramount plus at 9:00, 8:00 central. for it's thursday, february 8th, 2024. this is "cbs news mornings." missing marines. a desperate search is under way for five marines after their helicopter goes down in a remote area of california. america retaliates. a u.s. drone strike kills a leader of an irani-b militia linked to attacks on american service members in the middle east.

but first, history in the making. the u.s. supreme court wades into uncharted territory. what it could mean for donald trump's attempt to return to the white house. good morning, and good to be with you. i'm anne-marie green. the presidential race is taking a bit of a detour today through the nation's highest court, and hanging in the balance donald trump's bid for a second term. at issue is the former president ineligible to run because of his conduct during the january 6th attack on the capitol? cbs' michael george is joining us with details on really a high-stakes case. >> high stakes is right. there may be no stakes hire than -- higher than whether or not former president trump is disqualified from the presidency. and that's essentially what the supreme court is being asked to decide. it's a case that could impacts the ballot in all 50 states. the line began forming yesterday into the night outside of the u.s. supreme court where the nine justices will hear oral arguments today on whether

former president trump is eligible to stay on the 2024 ballot. >> this is a landmark decision, and i want to be in the room where it happens, to quote "hamilton." >> reporter: the legal battle was sparked after colorado's supreme court ruled in favor of a group of voters who challenged trump's candidacy based on his actions on january 6th. they argued those actions violated section 3 of the 14th amendment which disqualifies officers of the united states who have engaged in insurrection or rebellion from holding office. >> once the state has said that trump is disqualified, the supreme court had to weigh in. it's going to have to resolve difficult legal and factual questions. >> reporter: trump's legal team argues he is not an officer of the united states as a former president and that he did not engage in an insurrection. the justices will also be asked to consider whether state courts have the power to enforce section 3. >> they're deciding something for which there's not a lot of modern precedent, where political tensions are high. >> reporter: the supreme court's ruling will reverberate throughout the country with

challenges to trump's candidacy pending in over 30 states including maine. and we can't forget that three of the nine supreme court justices were appointed by former president trump himself. you'll remember the last time that the supreme court was caught in the middle of a presidential election like this was bush v. gore in 2000. >> yes. but a much different political environment back then. thank you so much, michael. >> thanks. all right, so rescue crews are searching for five missing marines after their helicopter went down in a mountainous area outside of san diego. officials say the marines' ch 53e helicopter took off from creech air force base near las vegas tuesday night heading home to marine corps air force station miramar in california. the chopper vanished, though, during a powerful storm. it was located yesterday morning, but snowy conditions are hampering the search for the missing troops. now to that drone strike in iraq that the pentagon says killed a high-ranking commander of an iranian-backed militia.

the u.s. says the commander was responsible for planning and participating in the attacks against american forces in the middle east. cbs' david martin reports from the pentagon. >> reporter: the drone strike in downtown baghdad engulfed a vehicle in flames killing a senior commander of the largest iranian-backed militia in iraq and syria. known as kataib hezbollah. u.s. officials said the nighttime strike was part of the retaliation ordered by president biden after the drone attack which killed three american soldiers in jordan. the target of tonight's strike was in charge of kataib hezbollah operations in syria. just across the border from jordan. and pentagon officials had fingered kataib hezbollah as the most likely suspect. >> as the footprints of katib hezbollah but not making a final assessment on that. >> reporter: retaliation for the jordan attack began last friday with air strikes against half a dozen locations in iraq and syria, including ammunition dumps which set off spectacular secondary explosions.

more than 85 targets in all. >> we assess that we had good effects and the strikes destroyed or damaged more than 80 targets at the seven facilities. >> reporter: the effect that matters is whether these retaliatory strikes put an end to attacks against american troops. since that friday night strike, there have been two confirmed attacks, both in syria, but no injuries to americans. david martin, cbs news, the pentagon. secretary of state antony blinken wraps up his fifth trip to the middle east today after meeting with the families of hostages still being held by hamas. this after israel rejected hamas' latest offer to includes a 135-day cease-fire, the release of all of the hostages in exchange for hundreds of imprisoned palestinians, including senior militants, and an end to the war. prime minister benjamin netanyahu called hamas' demands delusional saying that it will invite another massacre.

he warned that while victory was close, it would still take months. blinken had a more positive tone. >> while there are some clear non-starters in hamas' response, we do think it creates space for agreement to be reached. >> meanwhile, israel's -- israel released new video of an extensive tunnel network under the southern gaza city of khan younis that it says housed senior hamas leaders and included cells to hold at least 12 hostages. back in washington, a landmark $118 billion bipartisan plan to tighten the southern border and pay for the war in ukraine has collapsed, and there's little hope congress will find a new way to respond to either crisis. scott macfarlane has the fallout of a frantic 72 hours of dysfunction on capitol hill. >> reporter: as migrants continue to cross, congress is frozen in place. >> it shows how broken washington, d.c., is. >> reporter: a u.s. senate plan

to stiffen border security, tighten requirements for asylum, and nearly shutser the crossings had the support of senate leaders and a national border patrol union. >> my republican colleagues changed their minds. turns out they want all talk and no action. >> the motion is not agreed to -- >> reporter: it collapsed in a vote in part because former president trump opposed it. >> americans are ticked off that this is not resolved. >> reporter: the impasse is a blow also to cities like chicago where alderman byron sigcho-lopez is helping the city respond to thousands of migrants bussed from the border. >> the federal government has exacerbated and worsened the issue at the border. >> reporter: the senate then shifted to a new plan with tens of billions to help ukraine and israel but no border changes. it will face stiff resistance in the house. >> i mean, this place is just -- it's just chaos, right? >> reporter: the failures happened a day after house republicans came up one vote short in trying to impeach homeland security secretary

alejandro mayorkas. was it a surprise how it played out? >> i don't think it was a surprise, more of a disappointment. >> reporter: texas democrat al green hospitalized near the capitol after surgery made a surprise appearance on the floor, casting the deciding vote. you had to sign a waiver to get out of the hospital to vote? >> it was an acknowledgment that i understood that there could be some consequences that could be not in my best interest to do this. >> reporter: the house could vote as early as next week on a second attempt to impeach secretary mayorkas further inflaming an already fiery and gridlocked congress. scott macfarlane, cbs news, the capitol. coming up, pennsylvania investigation. officers are shot before a fire engulfs a house. and later, super bowl sneak peek. we're going live in las vegas for an inside look at the big game. big game. breaking overnight, another volcanic eruption in iceland. the country's meteorological office says the volcano started spewing lava into the air after seismic activity. the volcano in the southwestern part of the country has now erupted three times in the last two months. ohio abandons a plan involving transgender health care for adults, and officers were shot in pennsylvania. those are some of the headlines on the "cbs news mornings" newsstand. "the philadelphia enquirer" reports two police officers were shot and wounded at a suburban philadelphia home where multiple people including children are still unaccounted for after the home was set on fire. authorities say the officers responded to a report of a child being shot when they came under fire. one officer was hit in the arm. the other in the leg. officials say that at least six people may have been inside the house when it caught fire, but they won't be able to search until later today. "the columbus dispatch" says ohio governor mike dewine scrapped a plan that would have restricted gender-affirming treatment for transgender

adults. the rules would have required doctors and medical ethicists to have roles in creating gender-affirming care plans for clinics and hospitals. officials said they revised the rules after thousands of people weighed in. the plan would still require patients under 18 to receive at least six months of mental health counseling before they can receive gender-affirming health care. and "the san francisco chronicle" says the cdc is investigating after more than 150 passengers and crew on a luxury cruise ship reported stomach illnesses. the "queen victoria" departed san francisco yesterday after a two-day stop while on its way to hawaii. the 55-day cruise originated in germany last month. the ship is carrying close to 3,000 people. cunard isolated sick passengers and crew and increased cleaning and disinfection on the ship. still to come, royal remarks. hear what prince william had to

today's cbs "money watch." >> reporter: stocks rose again wednesday as investors assessed another round of quarterly earnings signaling a strong economy. the dow gained 156 points. the nasdaq was up by 147, and the s&p 500 gained 40 points. disney is banking on some big names to boost profits. in its earnings report released wednesday, the company announced it will exclusively stream the "taylor swift: the eras tour" and plans to release a "moana" sequel this november. it also announced a new strategic partnership with epic games, the company behind the video game "fortnite." fast food chains like taco bell, kfc, and pizza hut that quietly increased prices last year are seeing a dip in profits. yum brands operates all three of those chains and reported weak sales growth in the last quarter of 2023.
