5:31 pm
i'm katie porter and i approve this message. home of super bowl lviii between the 49ers and the chiefs, this is kpix cbs news bay area. right now at 5:30, a live look from allegiant stadium in las vegas where super bowl lviii kicks off in less than three days. >> can't wait. >> and the 49er faithful are flocking to las vegas to get a taste of all the excitement, but most of them don't have tickets to the big game. >> the lucky fans who did get a ticket are spending big bucks to watch in person. ticketmaster is the nfl's official ticket platform. this afternoon the cheapest ticket
5:32 pm
you could find was more than $6,300. >> wow. >> the most expensive ones, they're going for up to 50 grand. >> all for one ticket to one game. that's amazing. one big reason prices are so high, so-called ticket hackers who use automated programs to scoop up tickets before fans ever have a chance. >> juliette joins us live from las vegas once again with the push for a solution. juliette, we know you have one of the best seats in the house. >> reporter: yeah. you know what? i would have to say so because this definitely gives me a view of everything that's happening now in las vegas, home to super bowl lviii, but yeah, when you talk about these big ticket events, it is a problem. taylor swift fans, leave it to them, they are coming to the rescue in their own right. they're trying to crack down on these illegal bots. here's the story.
5:33 pm
>> reporter: in a packed arena it's not just excitement taylor swift fans feel, it's empowerment . in the nation's capital these swifties are lobbying for change. >> i brought you the swiftie friendship bracelets. >> reporter: one friendship bracelet at a time. >> this is my new best friend. can i give you a hug? >> reporter: i appreciate it. they want lawmakers to overhaul the ticket industry. >> the ultimate goal is for the consumer to have a fair experience in live entertainment. >> reporter: single mom jennifer kinder couldn't get a ticket to the eras tour. so the personal injury lawyer turned her anger into action, representing more than 350 swifties in separate lawsuits against ticketmaster, fans like julie barfuss. >> i made 41 attempts to buy tickets, documented because i
5:34 pm
got charged 41 times. >> reporter: did you anticipate how much of a challenge? >> no. i don't think there was any way to anticipate quite what a disaster it was, honestly. >> ticketmaster is accused of botching the presale of tickets for taylor swift's upcoming eras tour. >> reporter: the day taylor swift's tickets went live, according to ticketmaster, 3.5 billion requests crashed the system forcing the company to suspend sales. >> live nation blames bots for the issue. >> reporter: a year ago senators grilled ticketmaster about the eras tour chaos. >> payments processers, they get bot attacks every single day by the thousands and they have figured it out, but you guys haven't? >> reporter: ticketmaster rarely gives interviews, but they agreed to talk with us. do you have a mechanism in place right now to track bot
5:35 pm
activity? >> many. when it comes to bot defenses, ticketmaster invests more than the rest of the industry combined perform. >> reporter: a bot is software designed to perform automated tasks faster than people, in this case buying up concert tickets forcing consumers to buy on resale platforms. some eras tour tickets sold for 70 times face value. it's literally like having 100,000 people trying to buy tickets. >> exactly. >> reporter: you're doing it as one person. >> exactly. >> reporter: data scientist mitch davis used to write bot software for a living, not for tickets, but to buy up sneaker inventory to resell at five times the price. >> the goal with that was to take as much stock as possible and that's where you could drive up of the price. >> reporter: you were skewing the supply and demand. >> absolutely. >> reporter: how quickly can bots wipe out inventory? >> oh, seconds, seconds. >> reporter: congress tried to stop these attacks in 2016 with the bots act which outlawed reselling tickets purchased with automated software. the federal trade commission is
5:36 pm
responsible for enforcing the bots act, but in the eight years since it was passed the agency has only applied the law one time. senator marsha blackburn from tennessee says the ftc has left the bots run wild and without enforcement bot operators are acting with impunity. the ftc would not go on camera, but sent us an email saying it remains the economied to enforcing the bots act. did ticketmaster report the bot attacks during the eras tour to the ftc? >> we've shared a lot of information on that particular sale with many branches of government. >> reporter: what has the response been? >> lots of conversations. i can't really get into the behind-closed-doors conversation on that. >> reporter: other countries like australia tried a different solution, capping the profit ticket resalers can make at 10%. is that something ticketmaster would support? >> we operate in many countries that have similar laws and we are all for universal industry
5:37 pm
solutions. a key one would be giving artists more control over how their tickets are resold. >> reporter: ticketmaster would support a federal law that puts a cap on how much you could resell a ticket for. >> we would support federal legislation that evens the playing field on resale. >> reporter: does there need to be a cap how much you can upcharge or what percentage over face value? >> yeah. i think that's something we could look at for the future. i'm very open to that idea. >> reporter: with taylor swift's new album on the way, these fans want change before the next ticket sales. >> we're not giving up. i haven't given up. >> i'm not giving up either. >> reporter: australia's 10% retail cap is showing results. the government of new south wales launched 14 investigations last year and issued tens of thousands of dollars in fines, but here in the u.s. more than a dozen states have passed or are considering laws that ban any limit on ticket resale profits. >> reporter: fans who got a ticket to the game are in for a real treat with some a-list

musical performances at halftime and also opening up the super bowl lviii. post malone will sing "america the beautiful." aundra day will perform "lift every voice and sing" and reba mcentire singing the national anthem and the halftime performance headlined by r and b star, usher. the eighth-time grammy winner says this is decades in the making. >> i don't have this moment by myself. all of my fans that i bring with me, each and every person that had anything to do with the music, the creativity, everybody is a part of this celebratory moment. >> reporter: i love the fact that in his interviews he's saying he is so excited to be part of this halftime show and we also learned that his kids are actually giving him -- his son is giving him advice on which songs to sing, which
5:39 pm
songs not to sing. i totally get it because my kids would do the same thing, mom, don't do this, do that. they're usually spot on. you got to listen to them. >> his kids don't realize their father is usher. >> reporter: to a kid it's just dad. . >> dad. don't sing that song. they want to dance. >> you can watch the halftime show right here on cbs news bay area also streaming on paramount+. up next, new details emerging in the helicopter crash in southern california with five marines on board, what investigators are revealing about what went wrong. it's not just fans having trouble finding tickets to the super bowl, how

growing up, my parents wanted me to become a doctor or an engineer. those are good careers! but i chose a different path. first, as mayor and then in the legislature. i enshrined abortion rights in our california constitution. in the face of trump, i strengthened hate crime laws and lowered the costs for the middle class. now i'm running to bring the fight to congress. you were always stubborn. and on that note, i'm evan low, and i approve this message.

five marines confirmed dead after a helicopter crash outside san diego. they were on a training flight when their cargo helicopter disappeared on tuesday night. this happened during a storm, but a retired marine colonel and former helicopter pilot said he does not think weather caused the crash. the cause of that crash is still under investigation. >> i immediately began to think something mechanical happened, a 53 echo, big stable platform to simply go missing is very rare. >> as we mentioned, that cause of the crash is still under investigation. still ahead here at 5:30, divided loyalties. >> it's a true conflict, you know. it's a true conflict, for sure. >> why a north bay chef and long time chiefs fan now say he's rooting for the 9ers to
5:43 pm
win the super bowl. straight ahead in sports from las vegas, i will tell you why we are here, what's behind the curtain. we're just three days away from the 49ers taking on the chiefs in super bowl lviii, the 9ers practicing hard to get ready for this game and they had a bit of a rude awakening this morning. we'll explain.
5:44 pm
two leading candidates for senate. two very different visions for california. steve garvey, the leading republican, is too conservative for california. he voted for trump twice and supported republicans for years, including far right conservatives. adam schiff, the leading democrat, defended democracy against trump and the insurrectionists. he helped build affordable housing, lower drug costs, and bring good jobs back home. the choice is clear. i'm adam schiff, and i approve this message. this ad? typical. politicians... 5:46 pm
we've been enjoying this nice dry stretch, except sometimes you get a little pocket of rain every once in a blue moon. >> we had mostly dry weather today. the actual dry weather takes over beginning tomorrow. i know they're thankful for a dry stretch in las vegas. we'll start with their forecast over the next seven days. if you are heading out of town tomorrow for super bowl weekend, it will be chilly with highs only in the low to mid-50s. if you're staying after the super bowl, first, good for you, second, temperatures warming back to the low 60s wednesday and thursday next week. super bowl sunday itself, the outside temperature will be in the mid-50s in las vegas. the inside temperature, they'll have it set in the 60s when people file into the stadium. all those thousands of people will gradually warm the temperature up to around 72 degrees by kickoff. let's look at our weather patterns. high pressure building in the upper
5:47 pm
levels of the atmosphere just means more atmosphere taking over our heads. that's going to suppress development of any rain showers for a while. dry weather prevails to finish the workweek tomorrow as we head into the weekend and the first half of next week. we still have to get leftover showers to quiet down, still a couple out there, one running down the peninsula from san francisco into the higher terrain of san mateo county and another one along the spine of the east bay hills. once these quiet down we are done with the rain showers through the rest of tonight. looking said on now for the mark hopkins hotel, you can see the cloud cover and a little daylight. it's nice to see some light still as we approach 6:00 p.m. temperatures topped out in the mid- to upper 50s today, very similar temperatures across the board tomorrow. we'll warm up a little more through the weekend into early next week. some locally dense fog will try to develop by early tomorrow morning, but it's going to be localized. we'll see most of it developing through the central valley and spill through the delta into the inland valleys of the east bay,
5:48 pm
shouldn't take too long for that to dissipate, should hold on till about 9:00 or 10:00 and a mix of clouds and sunshine the rest of the day. tonight mid- to upper 30s inland, 40s around the bay, these temperatures only 3 to 6 degrees below average. we'll warm back up to about where we were today, 59 degrees in san jose the warm spot. even on the warm end of things we'll fall a little short of 60. we'll start to sprinkle in a few more 60s here and there heading into the weekend, both saturday and again sunday with the warmest days taking shape after the weekend, the first half of next week. temperatures in the mid- to upper 50s like tonight's low temperatures only 3 to 6 degrees below average. more importantly, dry weather tomorrow, dry weather over the weekend and dry weather continues the first half of next week. let's look at the week long rain chances. we'll start with super bowl sunday,
5:49 pm
still dry, but you see increasing rain chances once we hit the latter half of the week, a lot of uncertainty in this time frame. the forecast models are sorting out what's going to happen. it looks like we'll have a more active weather pattern heading towards presidents' day weekend. this is the part of our rain forecasting timeline when we aren't even in a trend forecast. we're just starting to get a grasp on the overall pattern and how that eventually impacts our big picture rain chances. it's possible a few showers make their way in for the last day of the seven-day forecast. that's going to be next thursday, but otherwise we're talking about partly cloudy skies through most of the seven-day outlook with a gradual warm-up. i think our temperatures take a minor step back sunday. these temperatures will go for the entire bay area, not much variation as we've seen the past several weeks, everybody within about 5 degrees of each other, low to mid-60s by wednesday and
5:50 pm
thursday next week before the potentially more active weather pattern shapes up heading towards presidents' day weekend. time for a check of what's ahead at 6:00, we switch over to juliette goodrich live in las vegas. >> reporter: hey, ryan, the lights are on, all speed ahead. we've got a full show at 6:00. have you ever wondered why the 9ers chose santa clara as their home for levi's stadium? it all comes down to one major sales pitch. it's really a once-in-a-lifetime story about this sales pitch and it happened on a great america ride. we'll explain. plus 9ers fans are arriving to vegas and, boy, do they have the greeters there, the welcoming committee, a team of volunteers there to welcome them as they touch down. i like that wonder, touch down. let's go to our very own vern glenn and talk more touchdowns and all that in his winning report. hi, vern. >> reporter: hey there, jules. i'm going to confuse or prompter operator a second because i have to explain
5:51 pm
what's going on. we were on the red carpet. we're off the red carpet and we're in this awards tent. let me show you something. behind this curtain in there is the hall of fame awards tent. that hall of fame class will be announced tonight. we're hoping patrick willis is one of the recipients. if he's selected, he'll be in that tent along with many, many awards winners tonight from mvp to offensive player of the year. it's going to be all that. now back to the script as we're just three days away from the 49ers kicking off against the chiefs in super bowl lviii. the 49ers are hard at work today. they certainly were back at practice on that field as they get ready for this game coming up sunday about 3:30 right here on cbs, kpix. in the morning, most of the players were woken up early
5:52 pm
from a false fire alarm at the team hotel, oh, my gosh. hopefully nothing nefarious from a chiefs fan, but it didn't impact head coach kyle shanahan who was already awake getting ready for the game. >> we were already up. we're in the basement. we didn't actually hear it. by the time i saw the players at 7:00 and asked how their night was, they all were complaining about the fire alarm and all having to go outside and everything. so i didn't realize how big of deal it was till i met them and they showed me the video. i think it was a pain for them. no one wants to get up at 6:00 and have to go outside when we don't have meetings till 8:00, but it is what it is. >> reporter: let's get into left tackle trent williams ready to play in his first super bowl and the future hall of famer is keeping at least one of his opponents up at night. that is chiefs defensive tackle chris jones. he's considered one of the best in the nfl in his position, but he
5:53 pm
has nothing but respect for the 49ers left tackle. >> he's scary. he's vicious. he's one of the best players i can face. i'm a little nervous, man, a little nervous. i'm going to pray about it a little more and continue to prepare. i mean we got a great deal of respect between each other. he's a heck of a player. obviously he's being a little sarcastic. he definitely don't have any fear. >> reporter: the only thing scarier than trent williams on the football field, in-law drama, but it's all good now after mccaffery secured the seats for sunday's christian mccaffery's mom lisa who joked they couldn't afford seats unless their son or fiancee floated the bill, olivia. despite her attempt to purchase box seats, christian ended up
5:54 pm
taking the check. >> yes, my family's sitting today. olivia tried so hard, but i would not let her because i'm not letting anyone pay to come watch me play, even as she tried so hard, wanted to do a favor, but my family has to pay to catch me play the super bowl, something's wrong. so i stepped in. >> smart guy. >> good son. >> reporter: on a more personal scale, i know if there's a meal or maybe a drink or something like that, i know juliette goodrich would fit that bill as well out here in las vegas. that is for sure. >> she's not here to defend herself. we'll say yes, she would. still ahead at 5:00, a bay area
5:55 pm
two leading candidates for senate. two very different visions for california. steve garvey, the leading republican, is too conservative for california. he voted for trump twice and supported republicans for years, including far right conservatives. adam schiff, the leading democrat, defended democracy against trump and the insurrectionists. he helped build affordable housing, lower drug costs, and bring good jobs back home. the choice is clear. i'm adam schiff, and i approve this message. you want to see who we are as americans? i'm peter dixon and in kenya... we built a hospital that provides maternal care. as a marine... we fought against the taliban and their crimes against women.
5:56 pm
and in hillary clinton's state department... we took on gender-based violence in the congo. now extremists are banning abortion and contraception right here at home. so, i'm running for congress to help stop them. for your family... and mine. i approved this message because this is who we are. this ad? typical. politicians... "he's bad. i'm good." blah, blah. let's shake things up. with katie porter. porter refuses corporate pac money.

5:58 pm
to be a chef. while some kids are hooked on video games, cooking in the kitchen was his passion. getting grounded for darrell meant he couldn't cook for his family of six. >> the family just saying like all right, we see that you enjoy this so much to the point where if you're going to get in trouble, we're going to take this away from you. >> reporter: while cooking is his first love, he did play some linebacker growing up and there's only one team he rooted for. >> it's been 30 years. i've been a die hard chiefs fan all the way. >> reporter: but for the first time in his life, family ties turned him into somewhat of a 49er fan. >> it's a true conflict, you know. it's a true conflict, for sure. >> reporter: his cousin ronnie bell is a rookie wide receiver for the 49ers. >> i want the chiefs to do great and do what they do, but
5:59 pm
blood is blood. so you got to root for ronnie. >> reporter: darrell hopes his cousin does well on sunday, but his heart is hoping for another super bowl win for kc. off the field the chef knows all about having to be on top of his game after working in france and under chef thomas keller. darrell is opening his first permanent restaurant in napa. he's making history by becoming the first to open a black-owned restaurant in the city. >> my goal with this is to make this something to the point where i can look up two, three years from now and say okay, there's another black-owned restaurant here. there's another one over here on, you know, and we're not the only one. that's it for the news at 5:00. cbs news bay area with juliette goodrich starts right now. >> reporter: thanks so much. good evening to you live from las vegas. here we are home to
6:00 pm
super bowl lviii where it's starting to look more and more like the bay area. fans all decked out in 9er gear are touching down in sin city and they have brought their confidence. >> 2019, we thought that was our year. so we're back and this is it. >> reporter: we go along with the team of volunteers there to greet fans at the airport. >> welcome to las vegas. have a great time! >> reporter: ever wonder why the 9ers chose santa clara as the home of levi's stadium? it turns out a towering amusement park ride had a lot to do with it. >> it's not a thrill ride, but that day it was. >> reporter: the story of the high stakes sales pitch that ended up closing the deal. plus a city struggling with crime and the state is taking note, the extra legal help coming to oakland to help prosecute crime. home of super bowl lviii between the 49ers and the chiefs
