on the republican side, former president trump wins two new caucuses while fighting to stay on the ballot in colorado. the historic case and how the supreme court justices seem to be leaning. and are you ready for some football? the chiefs and the 49ers and now the fans are descending on las vegas with the super bowl just two days away. good morning, and good to be with you. i'm anne-marie green. we start with blockbuster news about the two men expected to face off again this year in this year's presidential election. first president biden going on the defensive after a special counsel's report in the documents case depicted his memory as poor and claimed he could not remember key life events. cbs' michael george now with reaction. good morning. >> good morning. at first glance you'd think the white house would be happy about this report. it found no criminal charges are warranted over the mishandling of classified documents.

but it also describes the president as someone with a poor memory, especially when it comes to remembering dates. now president biden is firing back. after a year-long investigation, special counsel robert hur decided not to bring charges against president biden over his handling of classified materials which were found at his delaware home and at his former d.c. office. in his scathing 345-page report, he wrote that the president's actions posed, quote, serious risks to national security. he also added that if charged, mr. biden would likely present himself to the jury as a sympathetic, well meaning, elderly man with a poor memory. >> the matter is now closed. >> reporter: biden fired back from the white house last night. >> my memory is fine. >> reporter: the special counsel claimed that during the president's five-hour interview, he, quote, did not remember when he was vice president or when his son, beau, died. >> how in the hell dare he raise that? i don't need anyone to remind me when he passed away.

>> reporter: former president trump who faces federal charges relating to his handling of classified documents slammed the decision not to charge biden as, quote, a two-tiered system of justice and selective prosecution. yesterday president biden took questions on the israel-hamas conflict. >> the response in gaza -- in the gaza strip has been over the top. >> reporter: at one point he referred to the leader of egypt as the president of mexico, while leveling sharp criticism at israel. as to why former president trump is facing charges in his classified documents case, the new report appears to address that, pointing out that while president biden cooperated with the investigation and returned the documents when asked, former president trump refused. >> uh-huh. all right. thank you so much. i'm sure the white house will continue to be reacting to that report. on to former president

donald trump now. he won two more republican caucuses last night -- nevada and the u.s. virgin islands. in nevada he was the only major candidate to compete after republican rival nikki haley ran in the state's primary on tuesday finishing behind the none of these candidates option. while the primary plays out, the u.s. supreme court now has to decide a landmark case, whether a state can remove trump's name from the ballot because of his role in the january 6th attack on the capitol. cbs' chief legal correspondent jan crawford takes us inside the nation's highest court for the historic arguments. >> reporter: in a case that could determine the presidency, the justices seemed to find rare common ground, appearing poised to rule perhaps unanimously that states can't use an obscure constitutional provision to kick donald trump off the ballot. that would be up to congress. liberal justice elena kagan got right to the point. >> i think that the question that you have to confront is why a single state should decide who gets to be president of the united states. >> reporter: conservative amy

coney barrett agreed. >> it just doesn't seem like a state call. >> reporter: the colorado supreme court said trump should be removed from the state's ballots, narrowly ruling he committed insurrection on january 6th, and was disqualified under section 3 of the 14th amendment. it says no person shall be a senator or representative in congress or elector of president and vice president or hold any office who took an oath and then engaged in insurrection. justice ketanji brown jackson focused on the amendment's specific words as another reason trump could prevail, suggesting the provision passed after the civil war didn't clearly apply to presidents. >> they were listing people that were barred, and president is not there. so if there's an ambiguity, why would we construe it against democracy? >> reporter: the justices also were troubled by the potential impact of the colorado decision and how it could be weaponized by both sides. >> i would expect that a goodly

number of states will say whoever the democratic candidate is, you're off the ballot, and others for the republican candidate, you're off the ballot. it will come down to just a handful of states that are going to decide the presidential election. that's a pretty daunting consequence. >> reporter: people camped out overnight for up to two days to get a seat inside, but trump did not attend. >> i'm a believer in our country, and i'm a believer in the supreme court. i listened today, and i thought our arguments were very strong. >> reporter: now normally with a case this momentous we wouldn't expect a decision before the end of june, but the court has fast tracked this case. super tuesday is less than a month away, so we could get a decision sometime in the next few weeks. jan crawford, cbs news, washington. excitement is building in las vegas with super bowl lviii now less than 100 hours away. fans are pouring into sin city from every corner of the country as the kansas city chiefs and

"cbs new york" reports police released body camera video of the attack on two officers in times square. >> let's go. let's go. let's go! >> authorities say the officers were telling a group of migrants to stop blocking the sidewalk last month in front of a shelter. prosecutors say one officer pushed one of the men up against a wall when he refused to comply. that led to a group of men attacking the two cops. seven suspects have been indicted in the attack. police are searching for at least five others. "the philadelphia enquirer" says the suspected shooter who wounded two police officers at a suburban philadelphia home is presumed dead along with five

relatives. that's according to law enforcement sources. officials say the officers responded to a report of a child shot wednesday when someone inside the home began shooting. minutes later the house was engulfed in flames. investigators found human remains in the debris. they believe three children are among the victims. and "usa today" reports two kentucky women say they were drugged and raped by employees at a bahamas resort. they say they went to a beach after their carnival cruise docked sunday. they say resort employees gave them drinks spiked with drugs. one of the women said she woke up while being assaulted. >> i ran, screaming for dongayla, and i seen her stumbling down the beach. and i was like, we've got to get help. >> two men have been arrested. the women say they were aware of the state department's travel advisory for the bahamas because of recent crimes. and still to come, get ready to pay more for that valentine's day chocolate. why companies are warning about
